That’s 154 editions, which represents a lot of man hours spent sitting at the computer, but there’s one important advantage to that – it’s certainly flattened my ‘derriere’!

Our popular A5 pocket-sized magazine has the highest distribution figures in Axarquia – 7,000 copies each and every month and that’s just in Axarquia alone. This once quiet little town is now becoming ‘the place’ to be in the Axarquia region, because of all the great events it has to offer throughout the year. You can find details of all the events in July by turning to page 101 and I have worked out that there are only 11 days free from some kind of fiesta or event so these days can be spent relaxing on the beach!

Perky on Prozac A “depressed” pet parrot is back on top form after being prescribed Prozac. Roxxi, an African Grey, used to be full of fun and enjoyed nothing more than sliding down the banister at home on Merseyside but then she began to suffer from anxiety and her life went into a slide. After medical treatment, Roxxi is said to be enjoying life again with 12 other parrots looked after by Marjy Newton, a volunteer with the bird charity Problem Parrots. Drunken antics Two Geordies have been fined after they sparked a major alert at an airport when they climbed onto a baggage chute into a restricted area. Stephen Lennox and Jordan Bainbridge crawled along a black conveyor belt at Newcastle International Airport. They were spotted peering over the check-in desk by staff before they climbed onto the belt. They managed to get to the departure area before being arrested. Prosecutor Justin Gibson said they weren’t due to go on holiday and told police that they were ‘just having a laugh’. He added: ‘The airport was functioning at the time of the incident when they went into the restricted zone. ‘Their own personal safety was part of the concern as well as the airport infrastructure.’ Stuck for homes A vet is facing the daunting task of finding new homes for a family of over 200 stick insects, after they were abandoned on his doorstep. Resident vet Michael Morrice found the insects outside his practice in North Cheam, southwest London, along with a note from their former owner. The note read: ‘I’m so sorry, but I’ve tried to rehome the stick insects without success. ‘Please could you find a new home for them as there are just too many and it’s not fair to them.’ Practice manager Maureen Geraghty described them as ‘fascinating creatures’ and said the vets are only giving them away to those who are genuinely interested in looking after them. She said: ‘We have got rid of several but we still have plenty left.’

Paragliding - Make Your Dream Come True! My first flight

I was spending a day with my family on the beach at Velilla when suddenly, I saw two paragliders approaching – a tandem and a single. They landed close to me and I went to the guide and asked him if I could fly with him too.

Then we descended slightly and the sea came closer. I saw the beaches and the black rocks and the flight got calmer again. I saw the beautiful tower of Velilla and quickly we passed it and flew over the crystal blue water. Much too quickly, Antonio steered the paraglide back to the beach and then everything went so quickly. "Keep standing, we're landing," he said… but too late. The next thing I knew, I was sitting in the sand and I heard my family laughing in the tapas bar. I had to laugh too –but happily. "Antonio, when will we fly again?" was all I could think of!

We made an appointment for the next day. Antonio sent me some information and at noon he picked me up at the landing site. He explained everything to me and spread out the paraglide. A few minutes later, we were already in the air. The take-off moment was beyond description. I felt so light and gasped in amazement with the sight of the blue sea in front of me, mountains on both sides and many more mountains behind. Quietly we hovered and I didn't know where to look first. It was simply gorgeous. Without losing altitude we came closer to the coast. I saw that we were really high above the ground now and the wind got up. The paraglide swayed and I heard the noise of the nylon in the wind. I got a bit nervous. "Antonio, is it normal that it's so windy up here?" I asked. "Yes it is, but don't worry, I've been doing this for 30 years,” he replied. “Sit yourself down comfort-

De Cotta Law Plus valía – claims for the return of Town Hall tax Anyone who sold a property in Spain at a loss may be able to recover tax paid to the Town Hall known as the plus valía tax. The highest court in Spain, the Constitutional Court, has made a landmark decision which supports previous regional court decisions. This dictates that certain articles in the law on local taxes are contrary to the Spanish constitution. A principle of the constitution is that taxation must take account of the economic capacity to pay, and for this reason a tax cannot be charged where a person has sold a property for less than the price they paid to purchase. In some cases this local Town Hall tax has been tens of thousands. The decision will affect many of those who sold their property after the property crash of 2008 and before prices began to recover. Since the beginning of the crisis many people have sold at a loss, so a tax referring to “an increase in value” is inherently unjustifiable and has now been held to be contrary to the Constitution. Unlike mortgage floor clause claims – see article at – http://decottalaw.com/compensationmortgage-payments-floor-clauses/ - many of the plus valía claims may have to be pursued in the courts if the Town Hall refuses to return the monies paid. As a necessary first step, and before going to court, a formal claim needs to be made. This must be done within the fouryear period after the tax was paid. For a small fee this step can be taken to prevent your claim becoming time barred. Each claim needs to be reviewed by an experienced lawyer – abogado – to see if it is cost

effective to pursue. It is important to stop prescription running by sending the initial claim to the Town Hall. Interest will also be payable on the amount to be repaid by the Town Hall. If you have paid this tax on a sale at a loss, you may be able to make a claim in the courts for the return of monies paid. You will need copies of the deeds and evidence the tax has been paid. Guardia Civil App Guardia Civil Visit The Phoenix Club in Torre Del Mar. A couple of months back, The Phoenix Club in Torre Del Mar welcomed Periana based Officer Juan Tejada from The Guardia Civil to the club who gave a large audience a very informative talk on the history of The Guardia Civil, Crime Prevention, Animal Cruelty, Traffic matters and a question and answer session in which members were able to raise concerns. One of his major topics was the new App which is available through the Apple app store or Google play called Alertcops. This multi-language app allows you to report incidents and crimes direct to the Police. The added advantage of the app is it locates your GPS position so the control room can direct a mobile unit directly to your location or home. This is particularly useful if the person is new to the area and does not know their location, or if you were reporting a theft or burglary from your home which may be in the campo area. The following is a Government description on this new tool which is available through your mobile telephone. What Is Alertcops? AlertCops is a citizen security alert system of the State Law Enforcement Authorities (FFCCSE in Spanish) The goal is to create a universal access to every public citizen security service, so any person, regardless of their language, origin or auditory or vocal disability, can send to the State Law Enforcement Authorities (Police and Civil Guard) an alert about a crime or security incident whether they are victims or witnesses of such. Once the registration process is completed and the access validated by a code that will be sent via SMS to the mobile phone number provided, the application will show a home screen with the following options, which may be selected by clicking the corresponding icon: This service allows a citi-

zen to send an alert from a mobile device 'smartphone' straight to the police bodies in a simple manner, so they can be assisted quickly and efficiently. What Are The Benefits? To offer a new communication channel between citizens and the FFCCSE, in addition to that already existing. To provide foreigners, visiting or living in our country, with a channel in their own language. to access to the security emergency services To improve the citizen response times and the information process. A Day In The Life Of... Busy doing nothing I decide to water my garden. As I turn on the hose in the driveway, I look over at my car and decide it needs washing. As I start towards the garage, I notice post on the porch table that I brought up from the post box earlier. I decide to go through the post before I wash the car. I lay my car keys on the table, put the junk mail in the recycling bin under the table and notice that the bin is full. So, I decide to put the bills back on the table and empty the recycling first. But then I think, since I'm going to be near the post box when I take out the recycling anyway, I may as well pay the bills first. I take my cheque book off the table and see that there is only one cheque left. My extra cheques are in my desk in the study, so I go inside the house to my desk where I find the can of Pepsi I'd been drinking earlier. I'm going to look for my cheques but first I need to move the Pepsi aside so I don't accidentally knock it over. The Pepsi is getting warm so I decide to put it in the fridge to keep it cold. As I head towards the kitchen with the Pepsi, a vase of flowers on the counter catches my eye - they need water. I put the Pepsi on the counter and discover my reading glasses that I've been searching for all morning. I decide I'd better put them back on my desk, but first I'm going to water the flowers. I put the glasses back down on the counter, fill a container with water and suddenly spot the TV remote. Someone left it on the kitchen table. I realise that tonight when we go to watch TV, I'll be looking for the remote but won't remember it's in the kitchen, so I decide to put it back in the front room where it belongs, but first I'll water the flowers. I pour some water into the vase but quite a bit spills on the floor. So I put the remote back on the table, get a cloth and wipe up the spillage. Then I head down the hall trying to remember

what I was planning to do. At the end of the day..... The car isn't washed, the bills aren't paid, there is a warm can of Pepsi sitting on the counter, the flowers don't have enough water, there is still only one cheque in my book, I can't find the remote, I can't find my glasses and I don't remember what I did with the car keys. Then, when I try to figure out why nothing got done today, I'm really baffled because I know I was busy all day and I'm really tired. I realise this is a serious problem and I'll try and get some help... but first I'll just check my emails... :)

Record Funds Raised For Hungry & Homeless Twice a year, local therapists and beauticians give their expertise at a charity spa day to help raise money for Los Angeles de la Noche food kitchen in Malaga. This spring was a record event, with €800 raised. It was held on Saturday 13th May at las Orquideas hotel in Los Romanes. Some of the therapists are based at Tracey Webb’s new alternative & holistic health centre where she practices reconnective healing. The Centro Dharma in El Trapiche is now open for bookings.

Knee fractures are most commonly caused by abnormal force, such as a falling on the knee, a severe twisting motion, severe force that bends the knee, or when the knee forcefully hits an object. Overuse (chronic) injuries

Overuse injuries occur with repetitive activities or repeated or prolonged pressure on the knee. Activities such as stair climbing, bicycle riding, jogging, or jumping stress joints and other tissues and can lead to irritation and inflammation. Overuse injuries include: •Inflammation of the small sacs of fluid that cushion and lubricate the knee (bursitis). •Inflammation of the tendons (tendinitis) or small tears in the tendons (tendinosis). •Thickening or folding of the knee ligaments •Pain in the front of the knee from overuse, injury, excess weight, or problems in the kneecap (patellofemoral pain syndrome). •Irritation and inflammation of the band of fibrous tissue that runs down the outside of the thigh (iliotibial band syndrome). Gimnasia Ritmica - Club Miralmar In Malaga During the month of May in Moguer (Huelva), the Andalusian championships of Rhythmic Gymnastics took place. (This is the equivalent of the 1st division in football). The Gymnasts of the Miralmar club did a fantastic job, obtaining excellent results and leaving Malaga very high up. Our team Alevin formed by Karina Havryshchuk and Laia Tous were CHAMPIONS of Andalusia. Karina also got the gold with the rope. Our Junior team formed by Marta Bailón and Camila Becerra were Subchampions of Andalusia. Marta, at the same time got bronze with the ball and came 4th with the ribbon, while Camila got bronze with the clubs. Both teams have won a pass to the Nationals which will be held in Logroño. The children's team, formed by Sandra López and Jennifer Martin did not have the same luck this time although they defended their exercises, and Jennifer got the bronze medal with the ribbon, they did not get a place in the Nationals. Our senior María González did a beautiful exercise practically without a flaw. Claudia Morales, our infant, performed a hoop exercise with minor failures overcoming a hard season due to an injury caused by a broken right leg. Our Junior Miriam Alamilla managed to close the season with better ball management, dominating the nerves and surpassing herself!!

Our children's cup team formed by Charli Knight and Carla Ledesma was proclaimed CAMPEON of Andalusia. In addition Charli got the gold with the hoop and Carla the bronze with the rope. Our team Alevín Copa formed by Itiziar Ortiz and Samira Pizorno obtained the bronze in the team classification, in addition Itziar got the silver with the hoop. In the category Precopa our gymnast Alevin Camila Nicoly Ferreira got the bronze with her ball exercise. It is worth mentioning the magnificent level of all the gymnasts of the club, who were very high in the classification, especially the performances of Ana Cuenca, Lucia Serrano, Celia Plaza and our children's team cup formed by Mar Cabrera and Ana Cuenca who ended up in fourth position, very close to getting on the podium. Our gymnasts Beatriz Becerra and Evelyn Diaz ended up in the 11th and 20th positions in the Benjamín Precopa category (of 35 participants), also Adriana Benitez, Carla Campos, Daniela Cabrera and Patricia Alvarez ended up in the 6, 13,16 and 21 position in the Category Alevín Precopa (out of 61 participants) We are very proud of all our Gymnasts, who without a doubt have demonstrated it through all their hardwork during the year !!

People Who Come And Go When is a good time to move on…? Recently, I have had at least three cases of couples who have sold their houses and moved out, after many, many long and happy years in the Spanish countryside. Everyone gets to the point, eventually, where they think it is finally the right time to move one – but the big question is WHEN should they make that big, life changing move? In recent cases that are in my mind and thoughts every day at the moment, are couples who, having sold, suffered unexpectedly from the wrench of moving from what has been their home for a good long time, with many happy memories. They moved from their lovely, comfortable and spacious homes into rental accommodation on the coast, or elsewhere, into dramatically smaller spaces, with a busy, noisy environment around them, with other people’s furniture (most rental flats are furnished here), and not knowing anyone around them.

What they had in common was ill health, and perhaps, after years of retirement living, a major move at that time of life is no longer as easy as in earlier years. These recent experiences have made me think about how vulnerable we all are to change, as time goes on and how much it can affect us – something we may not realise until it happens. I have always admired the adventurous souls who uplift their lives and move to Spain in their retirement years to enjoy the good weather, outdoor, active life, friends and even collecting olives and almonds on their own plots. But it is equally courageous for those people to consider, in advance of any health problems, about making their next move, so that any downsizing or change of environment or even a change of country, is something that will still be a positive and stress-free experience. www.cslawyers.es Three percent Capital Gains Tax retention on property sales by non-residents When a non-resident sells property in Spain, the buyer is obliged to retain 3% of the price and pay it to the tax authorities to cover the vendor’s Capital Gains Tax (CGT) liabilities. If the 3% retained exceeds the taxes due, the vendor can expect a refund once all taxes have been paid. The 3% retention is meant to cover CGT liabilities. The 3% retention does not cover the vendor’s ‘plusvalia’ tax liability, which is paid to the town hall at the time of sale. After the sale, the buyer has one month from the date of sale to pay the 3% retention to the local tax office using the form (modelo 211). A copy of the submitted form should then be given to the vendor or his lawyer, so a refund can be claimed. Capital Gains Tax Reclaim If the vendor believes he is owed a refund (that the tax liability is less than the 3% retention), he has 3 months to present the form requesting a refund. This step is done at the local tax office.

If a refund is due, how long does it take? It depends upon the tax office; some are quicker than others. In theory it shouldn’t take more than a few months. This issue only applies to vendors who are considered non-resident by the Spanish tax authorities, i.e: fiscal non-residents. To be considered a fiscal resident you have to get a certificate from the tax office (hacienda) certifying that you are a fiscal resident. You will get this if you have been doing tax returns (declaración de la renta) for several years. Do not make the mistake of thinking you are fiscally resident just because you have an NIE number, or once had a residency card (tarjeta de la residencia). La Vaqueria Last month, if you remember, La Vaqueria changed hands and I am delighted to report this month that things have just got better and better. Dani and Josie are young and full of enthusiasm and have some great new ideas which means that June has seen a lot of changes here in Benamargosa's old dairy. Most notably are the Friday theme nights which are really taking off after the yoga class has finished. Every week a different theme from pie nights to pancakes, pizza evenings, wok Fridays or burger extravaganzas... check out the Facebook page for all of the latest events to be sure not to miss out!! Also the Sunday lunch buffets now have live music every week, the first and third Sundays of the month are jam sessions so be sure to bring your instrument and/or your voice if you would like to join in! The garden is looking fabulous with lots more recycled art dotted around and is child friendly as well as dog friendly... with the very popular laden buffet table it is definitely advisable to book for these events if you

would like a table. Every month on the first Saturday I shall be continuing to hold a mosaic workshop... a fun afternoon with lovely people learning all you need to know to get you started in this lovely and versatile medium. The afternoon provides a meal of home made food as well as your mosaic materials included in the price.
