Strengthening Wisconsin’s Response to

ELDER ABUSE BY ATTORNEY GENERAL BRAD SCHIMEL

Over the next two decades, Wisconsin’s population of adults 65+ will increase by more than 72 percent. This changing population trend is common among other states across the country, and many experts have dubbed it the “Silver Tsunami.” As Wisconsin’s attorney general, I want to be ready for this coming JULY–DECEMBER 2018 JOURNEY OF AGING

tsunami, and we need to prepare key partners, such as law enforcement, prosecutors, judges, victim service providers, financial institutions, senior living facilities, advocacy organizations, and many others, for the increased challenges that lie ahead for seniors. For this reason, I’ve assembled a multidisciplinary Task Force on Elder Abuse. In addition to studying the

impact of elder abuse in Wisconsin and assessing ways to improve outcomes for this growing population of citizens, the task force will develop strategies to address barriers in investigation and prosecutions of elder abuse, strengthen consumer protection for seniors, and create recommendations for improved cross-system communications.

AGING & CAREGIVER RESOURCES | 13 There are many different forms of abuse, including physical, emotional, sexual, and financial, and studies have shown that one in nine seniors report experiencing some form of abuse or neglect in the past 12 months. The trends in data from adult protective service workers across Wisconsin have shown a steady increase in elder abuse in the last decade, and there’s no sign of it slowing as this population grows. Sadly, instances of financial abuse, one of the most common forms of elder abuse, are increasing each year. Criminals prey on older adults because they know how vulnerable they are to these types of attacks, and the types of exploitation tactics criminals are using are increasingly becoming more sophisticated and brazen. I saw it firsthand earlier this year when an elderly friend was contacted by an individual posing as the government, claiming that my friend owed back taxes. The “government official” threatened to arrest my friend if he did not comply with certain demands. My friend grew up in a generation where he didn’t have debt and feared getting into trouble. The criminals even spoofed the phone number calling him to pretend to be the local law enforcement agency. My friend and his wife were afraid and embarrassed, and paid the criminals thousands of dollars only to realize later it was a scam. While these victims are my friends, I know this happens every day to older adults across Wisconsin, and I am making this a top priority. Elder abuse doesn’t just impact seniors, it impacts our economy and all taxpayers. Financial abuse has been reported to cost older Americans more than $2.6 billion

annually. That figure gets worse because 1 in 10 financial abuse victims turns to Medicaid as a direct result of their savings being stolen. The cost to Medicaid for financial abuse alone costs more than $2.6 billion annually.

I Was His Wife AGAIN THE JOURNEY OF DEMENTIA BY GINA LARSEN Betty King recalls the day she helped move her husband, Gene, to Valley VNA in 2014. “When we finished the move, I felt a powerful sense of physical and emotional relief. After just a couple of days, Gene was seeing me as his wife again, not his caregiver.”

Gene King started to recognize changes in his cognition 20 years earlier while working at Kimberly Clark. After having watched his mother experience relatively early onset Alzheimer’s, he and Betty talked about how and when he would retire. More importantly, they

Gene and Betty eventually retired to North Carolina, where they embraced a life of golf, canasta, travel, and volunteer work for 14 years. Gene’s cognitive decline continued, albeit inconsistently. The couple returned to Wisconsin in 2012 to be near two of their children

Those early talks and plans helped Gene and Betty make necessary transitions without a lot of upset. Gene remained polite, cheerful, and helpful—always the perfect gentleman. “He stopped driving on his own, without argument,” Betty says.

ALZHEIMER’S & DEMENTIA | 19 While still living together in their apartment, Betty taped a sign to the door to prevent his wandering off. “Stay Home,” it read, and one day when their daughter Kelley came to take her dad out to lunch, he refused to leave until he got clearance from Betty over the phone. “He relied on Mom to guide him and help him make choices. He trusted her to be in charge of what happened, and that was very calming for him,” says Kelley. “But he did these things to keep us happy too. That was part of the plan he and Mom had.” Gene would eventually move into assisted living at Valley VNA for 18 months and then move into the memory care unit for another 18 months. Gene King passed away in September 2017 at age 81, and Betty and Kelley remain eager to help other families who face similar challenges with aging parents and partners. Betty is very active in helping her peers discover ways to care for themselves and their aging spouses. She says, “It’s much more helpful to ask about you, the caregiver, than to only ask about how the spouse is doing. When you care for the caregiver, the rest tends to take care of itself.”

Words of Wisdom Here are a few nuggets of wisdom Betty and Kelley learned while accompanying Gene through Alzheimer’s: • It’s much more rewarding to engage in a three-way conversation with a person who has Alzheimer’s instead of oneon-one. The affected person can join or recede from conversation without a lot of pressure to keep up with the discussion or

formulate responses on the spot. Don’t ask a lot of direct questions because it can cause anxiety. • Condition yourself to accept change because it will happen whether you want it or not. Keep a sense of humor and laugh with one another about the quirky things. • Live in the moment. Go where your person goes, whether it’s down memory lane or a strange story about what happened at lunch today. Correcting or arguing only causes both of you to get upset, and you simply will not win. • Find one or two good friends who want to listen to how you’re doing as a caregiver without judgment or uninvited advice. Good listeners will help you parse what is happening in your life and how to best face your next steps. • Moving into Valley VNA offered Gene more social interaction and programs that challenged him to remain engaged. He made new friends and enjoyed his time living there. • While still living at home, Gene and his daughter Kelley had regular weekly dates at Lyrics and Laughter, a music enrichment program at Valley VNA for people with dementia and Alzheimer’s disease and their caregivers. “It was the highlight of my week to spend that time with Dad,” she says. Later, Betty attended the program with Gene for nearly the entire time he lived at Valley VNA. “It is important to find activities you both enjoy. Also, it is good to spend time

with others at similar points in their lives.” • After Gene moved to Valley VNA, Betty reclaimed her role as his beloved because she no longer had to be constantly vigilant about his daily personal care and safety. Gene’s eyes lit up whenever he heard her voice, he looked forward to sharing affection every day, and he authentically expressed his love for her. Kelley noticed. “Here we are, in this horrible situation where we all know we are losing him to Alzheimer’s, and yet here is this gift, this second chance at their love.” Photograph provided by Valley VNA Senior Care.

Myths and Misconceptions ABOUT FUNERAL EXPENSES BY JASEN BENTON

There are a lot of myths about how funerals are getting paid for, and how to leave loved ones with funds and instructions to make sure your wishes are done and the kids are not left with the bill. For the most part, paying for a funeral is not a huge problem for a married couple when the first spouse passes. The remaining spouse can usually access joint accounts and pay for the funeral. The real problem comes when the last spouse passes away. Who pays? Who has access to the accounts in a timely matter to pay the funeral cost? Here are some of the answers we hear as we go over this with our clients. JULY–DECEMBER 2018 JOURNEY OF AGING

• “I have a joint account

with one or several of my children.”

The problem here is that even though an account may be titled with yourself and another child, upon death, the account is usually frozen until a death certificate is produced. If it’s JTWROS (joint tenants with rights of survivorship), the surviving account owners, upon receipt of death certificate, become the owners. • “My son or daughter

are our durable power of attorneys and can write out checks on our behalf.”

Power of attorney ceases to exist at the time of death; therefore, the POA loses their ability to act on your behalf.

• “We have a trust

set up and have appointed a trustee to take care of our final expenses.”

The trustee will need to be appointed by the trust as the trustee, which requires a death certificate. • “We have instructions

in our will, and our executor has the power to take care of it.”

Again, in order for the executor to be appointed you need a death certificate.

• “We have life insurance

to cover that.”

Unless it’s life insurance for final expense, life insurance policies require a claim form to be filled out, and the beneficiaries are sent the proceeds. Usually this process takes 60 to 90 days to process. A death certificate is required as well as beneficiary signatures. In order to sign over the proceeds to a funeral home, this needs to be done in advance of death and is not considered a good idea.

The biggest problem is that most accounts that people have require a death certificate to process, and

then the funds are transferred when the proper paperwork is done. Death certificates, depending on the state and county you live in and cause of death (whether an autopsy is required), can take weeks or even months to get. The solution is as simple as putting the funds you earmarked for funeral expenses in the right financial vehicle. One of the only solutions to this problem is solved by life insurance policies that do not require a death certificate and pay the funeral home directly. These can be purchased only through licensed life insurance agents.

Freeing Ourselves From STUFF BY MARY KAY MINNIS

If you are 55+ with adult children, you are most likely facing the same painful dilemma as the rest of us. Our children, quite simply, don’t want our stuff. They don’t want the set of china, the silver plate serving dishes, the Hummel collection, the antique books, or the formal dining room furniture. They don’t want our Frank Sinatra albums, wooden treasures from Hawaii, collection of Mother’s Day plates, National Geographic magazines, or even their own soccer trophies. And we need to downsize. Now what? Over the past six years, as we’ve assisted seniors and their families JULY–DECEMBER 2018 JOURNEY OF AGING

through the downsizing process and liquidated many homes after a loved one has passed on, I’ve had plenty of time to reflect on this issue. There are many resources to help us deal with our excess belongings, such as estate sales, online auctions, rummage sales, charitable contributions, recycling, and disposal. Physically, getting rid of things is fairly uncomplicated. But emotionally? Not so easy. Why does giving up our beloved treasures feel as though we are losing a piece of our heart? It’s the memories we’ve connected to our things. How can we simply let go of the chair we used to rock

our babies to sleep? The tinsel and glitter creations they so proudly brought home from kindergarten? To be honest, I admire the younger generation and their freedom from stuff. Several of our grown children, considered milennials now live in tiny apartments in Minneapolis. A few dishes and books, their clothes, some nice rugs on the hardwood floors, a couple of plants. They have only what they need, and can move to a new apartment with two days of preparation. And they are happy. We should all strive for that kind of freedom! I can’t imagine burdening these free spirits with

my copper music box collection, my Willow Tree angels, or my favorite childhood books. But to have that freedom, we have to learn to let many of our belongings go. I am learning, slowly, to separate the memories from the stuff. I don’t need the actual chair to remember the joy of rocking my babies. I don’t need the wrinkled paper plate ornament with the glitter falling off to remember the joy of receiving a gift from my five-year-old. While our homes can easily become overcrowded with things we really don’t need, our hearts can hold a limitless abundance of joyful memories that we never need to downsize.

But change in seasons also brings thoughts of yard work: shoveling, cleaning, gardening, and keeping up a house that may seem bigger JULYâ&#x20AC;&#x201C;DECEMBER 2018 JOURNEY OF AGING

and more overwhelming each year. Many seniors find themselves torn between keeping their home, with all the fond memories, and the practical need for downsizingâ&#x20AC;&#x201D;and the thought of change is scary. For seniors who are still independent but may need a

helping hand here and there, a move to assisted living may be just the thing. Assisted living can be a lifestyle that offers social opportunities and a sense of community, with meals, activities, and even transportation offered daily. Assisted living residents find privacy within their apartment

When seniors and families think about assisted living, they may picture a single room or small space, but that’s not always the case. While some assisted living apartments come furnished, many are empty and ready to be filled with the

resident’s furniture, decorations, and their own touches to make the new apartment feel like home. Even after the decision has been made to make a move to assisted living, mixed emotions, doubt, and even second thoughts may linger. Is this really the right time? What about the happy memories in the house? There are still sounds of laughter and familiar voices from times gone by. This is a natural reaction, and by embracing it rather than avoiding the conversation, families can find joy in the process of preparing to make another important, exciting life change. Reminisce and remember the many good times in the home. Take time to pull out the old photos and go through the carefully packed boxes tucked in the attic for safekeeping. No doubt there will be laughter and tears. Seniors, friends, and families alike realize the memories will always be with them—in their hearts and in their thoughts. For most seniors who make assisted living their home, there is one piece of advice that is shared over and over: I wish I had made the move sooner.

A LESSON FROM THE SILENT GENERATION:

Senior is a STATE OF MIND BY SHAWN DUNNING We can see society dismiss the senior population as they endure the incredible social, personal, and financial tolls of aging. However, I then find myself turning to the silent generation for their opinions, as their wisdom is scarce on Google. They are children born before 1942, expected to be seen and not heard. I gain wisdom talking with these seniors, and their lessons and teachings are inspiring. Patricia Ann, 82, survived breast cancer, a stroke, and is the owner of a colostomy bag. She raised five children while helping her husband grow their family business. For JULY–DECEMBER 2018 JOURNEY OF AGING

years, her mobility was confined to a walker. We talked a year ago, and she said that she felt like she was disappearing. Since she is no longer able to attend social functions, see friends, and her children are out of the house, her days are filled with reading, TV, box food, and doctor appointments. Yesterday, I saw her walking around without her walker. I was shocked and asked her what had changed? “My mind,” she said. I asked how she did it, and she said she “willed herself to walking.” She began counting her steps, as her grandkids do, but without the technology. She

uses soup cans for weights as she did as a girl. Her motto: aging is not for sissies. Though habits are often hard to change, it can be done, one step at a time. Patricia’s comment about feeling like she was disappearing had haunted me, so I asked other seniors if they felt the same. Many had to come to terms with a new way of life after retirement, while others never found purpose and let aging take their souls. Those that discovered newfound liberty grew their social circles with volunteering, spiritual communities, and learning experiences.

SAFE & HEALTHY AT HOME | 55 Terry, 80, volunteers 12 hours a week at the hospital and at his church. Jack, 92, believes climbing on his tractor is a great daily goal. Bev, 75, says her purpose is to “see her family every week without being a burden.” She drives every day to keep her skills sharp. Isolation and lack of purpose will age a person faster than time. Medical technology is changing rapidly, and it’s important to stay up-to-date on modern medicine. Jeff, over 60, has had back problems since he was 15, mainly muscle spasms. The symptoms started getting worse, and he developed leg cramps. He would often wake from the pain late at night. Jeff went to get an MRI and was diagnosed with spinal stenosis. He found a clinic and had a minimally invasive device implanted into his spine. As a result, he’s back doing the things he loves: playing music, working, and taking care of his farm. People who are their own health advocates can have a better quality of life. Seize the privilege of growing older and finally put yourself in the center of your life.
