Lawyer jailed for RAF fraud NIELEN DE KLERK @nielendk
A
former lawyer from Bellville has been sentenced to 12 years in prison after defrauding the Road Accident Fund (RAF) of R14.8 million. The lawyer, Brian Albertus Baumann (53), was sentenced in the Bellville Commercial Crimes Court last week after he helped himself to RAF payouts due to his clients. According to Eric Ntabazalila, spokesperson of the National Prosecuting Authority (NPA), Baumann used most of the funds for his gambling addiction. He is a divorced father of three and admitted to receiving psychotherapy for his addiction. As part of a plea agreement, Baumann confessed to 16

counts of fraud. “The court ordered that an investigation be conducted to determine whether any money or assets can be confiscated from the benefits of the 53-year-old Bellville attorney,” he said in a statement. “The court has also ordered the state and the defence to submit heads of argument on 27 September 2021 and that a confiscation hearing be heard on 15 October 2021.” He was arrested on 13 February this year following an investigation by the Hawks, after committing the crimes between January 2018 and December 2019. He admitted to the court that he was obliged to open and hold a trust account for his practice. “He confessed that he received more than R24.4m on behalf of his clients from the RAF but he only paid his clients R6.7m and un-
lawfully pocketed R14.8m for himself.” The prosecutor, Advocate Siphokazi Makanda, told the court that Baumann failed to pay the money from his trust account to his clients or paid them less than was due. “The accused’s actions have undermined the image and integrity of the legal profession and he has shown the worst form of disregard for the rule of law. He mercilessly defrauded his clients who had suffered severe bodily injuries and were handsomely compensated by the RAF to enable them to apply the necessary measures to improve their quality of life post the road accidents they were subjected to,” she said. “He continued with his criminal actions against his clients even after charges were laid against him, proving total lack of re-
morse for his actions,” she argued. Ntabazalila said the State, in consultation with the Asset Forfeiture Unit, “applied for the confiscation order of the accused assets and probe”. Baumann was ordered to submit a statement that will help assist the court in making a decision. “On 20 August 2021, the applicant must dispute the correctness of the statement made by the accused. The applicant and the accused must notify any person or persons who may have interests in the identified assets or properties that are likely to be confiscated to make representations to the court within seven days of them being notified.” The hearing will be on 15 October 2021. Zinzi Hani, spokesperson for the Hawks, confirmed the events.
FROM PAGE 1 “We all have a role to play through our own actions. Our behaviour will be influenced once we acknowledge and accept that the virus is not gone, but will be with us over the holidays and beyond,” she says. The department pointed out the following precautions: . Wearing a mask properly is of lifesaving importance. You must always wear your mask when outside of your home. There can be no exceptions. . You must avoid crowded and confined spaces at all costs. This is where super-spreader events take place. . You must urgently reconsider hosting all non-essential gatherings of people this year, especially indoor gatherings with poor ventilation. . You must ensure there is always good ventilation whenever you’re in public. The virus droplets spread by air in confined spaces, and so fresher is better. . You must wash your hands regularly with soap and water or use sanitiser. . If you feel sick, you should not leave your home unless it is to get healthcare treatment. You must first call our hotline on 080 928 4102 for guidance. . You should also not visit someone who is sick, and find other ways to provide support, like delivering a meal to a
neighbour’s doorstep. “Should you be experiencing any mild symptoms, we encourage you to visit your nearest facility for testing from Monday to Friday during the week. All 24 hour facilities have now extended their testing times,” Watlington says. The Dunoon Community Health Centre and Vanguard Community Health Centre can be accessed during the following times for testing: . Weekends and public holidays from 10:00 – 12:00. . After hours, Monday to Friday from 16:00 – 18:00. Health Minister dr Zweli Mkhize raised his concerns about the climbing figures of positive Covid-19 cases in the country on Sunday, especially with regards to matric rage gatherings which have been identified as superspreader events. “We confirm that we have now identified a number of Covid-19 confirmed cases arising from these super-spreader events. This therefore means that if you attended any of these rage events, you are now regarded as a contact,” Mkhize says. He urged all the rage attendees to immediately go into a 10 day quarantine period
as per the Department of Health Guidelines on Quarantine and Isolation. “We also urge that all rage attendants test for Covid-19. We also encourage parents to take their children who have attended rage for testing as soon as possible. We warn South Africans that this is a clear illustration that large gatherings which involve the consumption of alcohol are a major risk and continue to undermine our efforts to contain the spread of the virus. “Whilst government makes an effort to contain this virus, we now plead with all parents to also exercise their parental prerogative and set boundaries on activities that their children (specifically the youth) can participate in. It is clear that in these entertainment activities, most participants are not constantly conscious of good behaviour. “This means that our youth is not only exposing themselves to the risk of contracting Covid-19, but they also put the lives of their parents, grandparents and other loved ones living with co-morbidities at risk,” he said in a statement.
Should you experience any mild symptoms, we encourage you to visit your nearest facility.

Christmas lunch for needy goes ahead KAILIN DANIELS @k10daniels
T
his year’s annual Christmas lunch for the homeless, elderly and needy in Brooklyn, Milnerton, will be going ahead as planned. According to Elizabeth Capes, one of the planners for the Christmas lunch, this year has seen many challenges due to Covid-19. “Unbelievably another year is nearly over, and it has been hard on everyone especially the needy. It’s been a year of challenges and dangers, and yet we have all pulled through with the grace of God. Even with Covid-19, we are still doing the yearly Christmas lunch for the homeless, elderly and needy in Brooklyn,” she says. The group will be taking precautions this year with masks, hand sanitiser and social distancing. However, instead of the gathering they have every year, they have resorted to a food parcel hand-out. “This will be sanitised before being given
out. There will be no hanging around, just a food parcel hand out. Unfortunately this year there will be no clothes or toys accepted due to Covid, only food items,” she told TygerBurger. In order to make this a success, the group is in need of assistance. “We need your help more than ever before. We are not looking for a hand out. We simply need the community to help with whatever they can spare. We understand that at this time we don’t want people risking themselves going out, so we are open to donations of any kind for the first time ever. For those that wish to help, with a tin of food, a packet of potatoes, a chicken - we are happy to collect, with precautions of course. We are open to vouchers for donations, only for this year and Covid-19 and for safety sake you can visit Pick n Pay or WebTickets from the safety of your home,” Capes says. For more information, contact Capes on 084 653 7309 or via email at eacapes@gmail.com.

Long service awards at MHS: Staff members at Milnerton High School recently received long service awards. The school thanked the staff for the vital role that they play in educating and supporting students. “We recognize and honour you all for your tireless efforts,” the school said. Roadworks underway The City of Cape Town’s transport directorate is implementing recovery plans to address the backlog caused by the Covid-19 national lockdown and winter rains. Blaauwberg and Clifton are next on the list, with roadworks which started on Monday, 7 December in both areas. The work in Blaauwberg includes the resurfacing of Blaauwberg Service Road between Marine Circle and Otto du Plessis Drive, and is scheduled to take five days to complete, pending unforeseen delays and inclement weather. Work will take place between 08:00 and 17:00 from Monday to Saturday. Traffic moving in both directions will be affected and flag personnel will regulate traffic in one direction at a time through a stopand-go system.
Work areas will be demarcated to regulate traffic flow, as well as pedestrians; vehicles may be parked in driveways as usual, if and when access is available. No congestion is expected, but it is recommended that road users consider alternative routes. The City’s Mayco member for transport, Felicity Purchase, says the road maintenance programme was delayed due to the national lockdown as roadworks were not considered as an essential service during Alert Level 5. “Thus, no work could be done during that time and this resulted in a backlog. I am happy with the way the roadworks are progressing in the different areas since we were allowed to have 100% staff capacity,” Purchase says.

Spesialis sê virus is nie moeg nie CARINA ROUX
Dr Emille Reid (voor) ondersteun nog steeds die inisiatief “Frontline Fridays”, waarin The Daily Coffee Shop koffie en ’n koekie aan gesondheidswerkers verskaf as blyk van waardering.
A
Sommige pasiënte was reeds sterwend.

Fair Cape raises funds with golf day M
uch-needed funds for its social welfare projects were raised with the annual golf day of Fair Cape Cares Foundation. The golf day was held on Friday 20 November at the Durbanville Golf Club and is a highlight on the social calendar for all involved. Ongoing beneficiaries of the foundation include Durbanville Children’s Home, the Atlantic Hope Sanctuary for Abandoned Babies, and the Saartjie Baartman Centre for Women and Children. This year, to help counter the economic devastation brought on by the Covid-19 lockdown, the foundation has also partnered with Cape Talk twice to donate a total
of R600 000 worth of dairy products to feeding schemes in the Cape Town area. Joel Serman, a trustee of Fair Cape Cares Foundation, says “doing the right thing” is a fundamental driving force of Fair Cape Dairies with social welfare being one of its brand pillars. “The foundation was established to raise and disburse funds to ensure the future sustainability of its beneficiary organisations. It is extremely rewarding to play a role to add social value to these communities and the various fundraising events that we host every year are what make our welfare projects possible. We sincerely thank all participants for their contributions toward these causes,” Serman says.

LEWENSKIEKIE
. Vermy alle alkohol en hou jou risiko so klein as moontlik. . Besluit vooraf dat jy nie by gesellighede alkohol of dwelms gaan gebruik nie. As jy kan, vat jou eie waterbottel of glas vol koeldrank. – Clyde Schroeder (maatskaplike werker by Ramot Rehabilitasiesentrum in Parow).
Vehicles a concern for years D’Urbanvale and surrounding immediate areas have a major issue which has been ongoing for years. D’Urbanvale is used as a thoroughfare and a racetrack (council has known about this issue for years). We are subject to road hogs pervading our areas. These are individuals who drive/ride high-powered vehicles through D’Urbanvale and along Vissershok Road. Vehicles entering or exiting D’Urbanvale proceed at break-neck speed. Heavy trucks continue to drive along Mosselbankriver as a through road. Is it justified that vehicles (cars and motorcycles) race to the first circle on Vissershok Road at high speed? High revving, back throttle, etcetera. This is besides the fact there is a school right at the circle. I know there are people that have issues and have not quite moved from adolescence to adults. As an example, (Saturday at 11:45) a red Jeep (powerful motor) approached the Vissershok circle turned left into Vissershok towards Durbanville and proceeded at break-neck speed. This is a minute example as this happens multiple times a day. In fact, this abuse also pertains to vehicles turning right towards the N7. Quite frankly, the residents of this area are gatvol of the constant abuse. To the Road Hogs, you have absolutely no respect and no regard for residents who have to keep enduring the abuse. If you have any personal issues, get help. EXTREMELY IRATE RESIDENT D’Urbanvale
Get vagrants off Goodwood streets In the TygerBurger of 25 November, the Goodwood Neigbourhood Watch chair Leona van Wyk said that there are only 25 true vagrants in Goodwood (“Shortage of patrollers”). Lady, I do not know where you live but it is definitely not in Goodwood. Here are literally hundreds of people living in and around Goodwood and they are sleeping and putting up their tents and makeshifts everywhere, even in front of the fire station across the street from me. I have asked time and again when this subject was brought on the cards – the question of ablution facilities for this people – but it is being avoided all the time. In front of the OK Bazaar in Hugo Street is a squatter camp, in Boulevard Street is one, next to Shoprite in Voortrekker Road there is one and how many other places. People urinate everywhere they go and do not even care if anyone sees them. People must walk there. The latest is now that they keep dogs, even on chains, or rather wires, where they squat. Calling the SPCA, I was told that they eat better then the squatters themselves. Food was not the point, if you are homeless you cannot keep animals. If I want to adopt a dog or cat there is an inspection to see how big my yard is, if I have a proper place for the animal to sleep, as a matter of fact they must sleep inside. They must get injections, must be spayed, get a chip and I must pay for them. I am not allowed to walk in the street with my dog without a chain but I am also being told by the SPCA that the dog is only chained when it is peak hour, otherwise they are loose. And the people who give them food are not
necessarily Goodwood people. There is a car who comes every day and gives out bread and clothes to the people living along Boulevard and behind the Roman Catholic church on Giel Basson. That bread and clothes ends up everywhere on the streets because they are not interested in it. They want money that the government now so generously handed out to them every month although they have never worked before, come to your house to beg but never asked for work. They are abusive, drunk, fights, uses foul language – not even to talk about the litter. Get them off our streets or do you want to show the tourists who drive along the streets in the open-air bus how third-world we really are. The City of Cape Town wants tourists. First clean up your city then you invite people, that’s how we do it in our houses, not so? DISGUSTED CITIZEN Richmond Estate
Questions raised on private function Willem De Haan’s letter (“Too easy to step on a racial toe” TygerBurger, 2 December) refers. His simplistic approach to this very contentious matter, requires further comment. The arrangement of a matric farewell falls under the auspices and is the responsibility of the school and its governing body and not any private person(s). There are laws and regulations governing schools and their control boards. As such, a school has an inherent responsibility of control and responsibility at these events which must be complied with and not delegated to whoever. A school which wishes to “subcontract” the arrange-
ments of the event, cannot be faulted as long as the subcontractor abides by official rules and regulations of the school. If it is a multiracial school, events must ipso facto reflect the multi-racialism nature of the school which is naturally reflected in sporting and all other activities of such school. Why on earth would the culmination of 12 years of study in a multiracial environment, require a separatistic approach to the farewell? Granted, private parties may be arranged according to the freedom of association clause as contained in the country’s Constitution, but I think the relevant question to be asked here is why was anybody allowed to arrange a private function while it is the schools responsibility to arrange the function. Willem, methinks you are tending to be a bit too forgiving in this instance.
LEON BASSON Brackenfell

Nine-hour Nine-hour race race yields yields success The South African nine-hour race was held at Killarney on Saturday 5 December. The start, with 51 cars entered, was always going to be a frantic affair, but amazingly there were no coming togethers into the first corner and all made it safely into the early part of the race. 2021: WEDSTRYDE VIND IN EERSTE SKOOLWEEK PLAAS
Skolekrieket begin vroeg SAREL BURGER
’n
