UCANE Member’s Support is Steadfast and Overwhelming It’s hard to believe that three months have already gone by since I became UCANE president. Although most underground contractors were slowed a bit by the winter season, there has not been any slowdown in UCANE activities or any decrease in the size of Board and Government Relations Committee agendas.

If

I’ve heard it once I’ve heard it numerous times in conversation with UCANE members who belong to other trade and business groups that our Association is very unique and stands out among other associations that they are affiliated with. This is not news to me but only reaffirms what I already know, that UCANE is “member driven and member run”. In this atmosphere, an individual’s construction knowledge and expertise is valued and is focused on the common benefit of all members and our industry. Member involvement in UCANE is not only welcomed, it is encouraged. As a result, there is an aire of professionalism that surrounds our Association, which is evident at meetings. While UCANE contractor and associate members are fiercely competitive in business, when it comes to supporting our programs or initiatives, or making industry-related decisions, discussions are usually followed by a consensus. It is very democratic and works well for us. In my experience at these meetings, it is evident that every person knows that the outcome may not be what they want. There is true compromise in favor of what is best for our industry. Because of this understanding, when we meet each month to review UCANE’s accomplishments or to discuss pending legislation affecting our industry, we are not meeting as individual businessmen and

women, rather we meet as UCANE members with a duty to do what is best for our industry. Ultimately, our Board members know that decisions that promote the good of the industry will trickle down to benefit all of us. During a typical month I speak with our Executive Director and she briefs me on important issues that have come up. Oftentimes I speak with other UCANE Officers or Board members to talk out an issue. From my interaction with them I have seen the sincerity and deep feeling of “belonging” that each member holds for our Association. This month I had an opportunity to read the congratulatory ads and well wishes from members whom I do not get to talk to personally on a regular basis. To say that I am overwhelmed by the display of our members’ support is an understatement.

I know that these words and well wishes are meant for all of our Officers and Board Members, and I want you to know that I am deeply moved by your expression of support, and will do everything in my power to maintain UCANE’s outstanding reputation and prestige. I am proud to serve as UCANE President and I find comfort knowing that we have the support of all of our members. Thank you. n

Baker-Polito Administration Announces $595,000 in Funding for Water and Clean Energy Innovation

he Baker-Polito Administration, in conjunction with the Massachusetts Clean Energy Center (MassCEC), recently announced $595,000 in funding to support clean energy and water technology innovation in six communities across the Commonwealth. The funding, which comes from MassCEC’s Catalyst and InnovateMass programs, will support clean energy and water projects in Bedford, Somerville, Cambridge, Amesbury, Scituate, and Boston. The programs that received funding support innovations as they progress through different stages of a company’s development cycle. Several former Catalyst awardees have gone on to receive InnovateMass funding, such as Menon Laboratories, Inc., who will receive funding again in this round. Catalyst, which is funded by MassCEC and managed by the Massachusetts Technology Transfer Center, provides grants for early-stage researchers and companies to help them demonstrate the commercial viability of clean energy and water technologies. Since the Catalyst program launched in 2010, MassCEC has awarded $2.45 million to 62 research teams. Past awardees have raised over $45 million in follow up funding, formed seven new companies, received 68 new patents, and issued 44 new research publications. For more developed early-stage companies, InnovateMass funds clean energy and water technology demonstration projects, which are designed to field test the real world applications of innovations. According to the press release issued by the MassCEC, InnovateMass has awarded $2.2 million in funding for demonstration projects across the Commonwealth since its launch in 2013, leveraging $3.1 million in other private and public investment. Organizations and researchers receiving $40,000

grants under the Catalyst program are: • AquaFresco (Boston), Dr. Alina Rwei: A water filtration system, focused specifically on regenerating wastewater in the cleaning industry that contains detergents. The technology has the potential to save over 3 trillion gallons of water in the United States annually by allowing previously wasted water to be reused. • Evaptainers (Somerville), Quang Truong: A mobile refrigeration system that runs without electricity, which is ideal for low-income and off-grid areas. • MultiSensor Scientific (Somerville), Dr. Allen Waxman: An infrared imaging system capable of detecting methane emissions from natural gas leaks, which can be used to reduce energy losses. • Northeastern University (Boston), Dr. Mahshid Amirabadi: An inverter for residential solar electricity systems, which increases the lifetime of the system, while reducing costs associated with it. • SafvE (Scituate), Shirley Young: An environmentally-friendly, cost-effective polymer coating that treats and sanitizes water by reducing the amount of live bacteria to less than 0.001 percent of the original concentration. • Sandymount Technologies (Cambridge), Dr. Ronan McGovern: A filtration technology that allows beverage makers, such as breweries, to remove water from beverages before shipping without affecting taste. Removing the water before shipment and rehydrating later reduces shipping costs and energy used during transport. • Semlux Technologies (Bedford), Dr. Jagannathan Ravi: A process that reuses previously-wasted silicon to manufacture new solar cells, using 90 percent less energy than the current industry standard. continued on page 9

Legislative Update continued from page 7 Organizations receiving up to $150,000 in funding under the InnovateMass program are: • Menon Laboratories, Inc. (Somerville): Aims to install and field-test a water filtration unit at the Massachusetts Alternative Septic System Testing Center in Barnstable County that will evaluate membrane performance for wastewater treatment. • Resolute Marine Energy, Inc. (Amesbury): A seawater-compatible hydraulic pumping system, which will generate power to purify seawater. • WindESCo (Boston): A software technology that

is expected to improve performance of a largescale wind farm in Cohocton, New York. Funding for these programs comes from MassCEC’s Renewable Energy Trust. The Renewable Energy Trust was created by the Massachusetts Legislature in 1998 as part of the deregulation of the electric utility market. The trust is funded by a systems benefit charge paid by Massachusetts electric customers of investorowned utilities, such as Eversource and National Grid, as well as municipal electric departments that have opted to participate in the program. The average monthly charge is 32 cents for an average residential ratepayer. continued on page 11

Aging Infrastructure – Lead Pipes Still in Use in Certain Areas

T

he Boston Globe recently highlighted one of the facts about the Commonwealth’s aging water infrastructure when it published an article highlighting the existence of lead pipes and the leaching of lead into the water supply. Thought to be the harbinger of decline to the Roman Empire, the effects of lead contaminated water can be significant, particularly to children. The potential presence of lead and other impurities in the water supply has been more closely scrutinized in light of the Flint, Michigan water infrastructure crisis. According to estimates by the Massachusetts Water Resources Authority (MWRA), more than 20,000 buildings in its service area — many built before 1940, when the older service lines were phased out — are fed by lead service lines that run from the main municipal water line into a house. Malden is thought to be the community with the highest percentage of service lines made of lead; 47 percent of the city’s 11,682 service lines are lead. The next

highest rates are in Medford (28 percent), Somerville (22 percent), Marlborough (19 percent), and Winthrop (11 percent). Charged with providing water to the greater metropolitan area, the MWRA water is virtually lead-free when it leaves reservoirs on its way into communities. Water mains, the large pipes that carry water through each town and city, also do not add lead to the water as mains are made of concrete, iron, or steel. Instead, the area of concern focuses on the smaller service lines. As reported in the Boston Globe, in Massachusetts, the installation of lead service lines — narrower pipes that connect mains to individual properties — stopped largely by the 1940s. Steps have been taken in recent years to replace lead service lines. But there are obstacles. Replacing them can be expensive for homeowners. The MWRA, for its part, alters the chemistry of its water, a practice that began in 1996, to make it less continued on page 13

To monitor lead levels in water, the MWRA conducts tests in about 450 homes across its system annually. Each must meet criteria that makes them likely to have high levels of lead. The US Environmental Protection Agency requires that no more than 10 percent of the samples contain levels of lead above 15 parts per billion or corrective measures will be mandated. In 2015, only 2.3 percent of MWRA samples were above the threshold.

Mayor Walsh Signs Executive Order to Increase Use of Minority and Women Owned Businesses in the City of Boston

A

ccording to a press release from his office and various media outlets, Mayor Martin J. Walsh signed an Executive Order to ensure that minority and women entrepreneurs are afforded fair and equitable opportunities when competing for City of Boston contracts. Mayor Walsh also released the City of Boston Economic Inclusion and Equity Agenda, which focuses on programs, policies, and initiatives that have been initiated or carried out by the Walsh Administration to address racial and economic disparities in the City of Boston. The Executive Order, which can be found at: http://files.ctctcdn.com/e7a569b1501/462c83b0224f-4439-98cb-c8bcaecbd54d.pdf, sets spending goals for minority and women owned businesses competing for contracts in construction, architecture and engineering, and professional services. Additionally, the City will provide training and assistance to minority and women owned enterprises to encourage successful bidding and performance on City contracts. In particular, the Executive Order requires each department and agency head to prepare specific goals in annual M/WBE plans that encourage utilization of M/WBE firms in contracting, purchasing, and public works contracts. The department and agency heads must seek to achieve these specific goals based on demonstrated and significant historical underutilization of M/WBE firms in the following City contracts: 1. 15-20% MBE and 15-20% WBE utilization in architectural and engineering subcontracts; 2. 10-15% MBE utilization in construction prime contracts under $500,000; 3. 20-25% MBE utilization in architectural and engineering prime contracts under $500,000; 4. 15-20% WBE utilization in architectural and engineering prime contracts under $10,000; 5. 25-30% WBE utilization in professional services prime contracts under $500,000; 6. 10-15% MBE utilization in professional services prime contracts under $25,000. In addition to affirmatively marketing all procurements in the prime contract areas listed above to at least three M/WBE firms, the Executive Order re-

quires department and agency personnel to require bidders on City purchasing, consultant, or public works contracts to adopt the City’s M/WBE Inclusion Plan, when applicable, in order to sustain and improve participation of M/WBEs in City contracts. The first in a series of policies targeting procurement reform, this order is also a precursor to a new disparity study to analyze racial, ethnic, and gender bias in City procurement. The study is expected to launch by the end of this year and will lead to the further examination of policies and goals that encourage the use of minority and women owned businesses. Governor Baker Files Annual Municipal Road and Bridge Funding Measure

I

n what has become a rite of passage signaling the upcoming start of Spring, Governor Baker recently filed a $200 million local road funding bill. The bill also includes a request to authorize $50 million for a five-year program targeting approximately 1,300 municipally owned bridges between 10 and 20 feet long. At the Joint Committee on Transportation hearing on the same matter, municipal officials urged legislators to include an extra $100 million and a written multi-year commitment. According to the Massachusetts Municipal Association’s written testimony, “[a]n analysis by the MMA in 2014 documented that cities and towns across the state need to spend at least $639 million every year to maintain and bring 30,000 miles of local roads into a state of good repair. Currently, municipalities spend far less because, for most cities and towns, Chapter 90 is the main or sole source of funds for road construction and repair. Funding the Chapter 90 program at $300 million annually, with an inflation-based adjustment, will close a portion of this huge gap.” For his part, Governor Baker has said he will file a $200 million bill annually for the next three years. Before the bill was filed, municipal leaders had urged him to put forward a multi-year bill, a call that was repeated during the hearing. In the past years, municipalities clashed with then Governor Deval Patrick over road and bridge funding with respect to the timing of the funding and the amount.

Massachusetts DOR: Tax Amnesty Period April 1 – May 31, 2016

T

he Massachusetts Department of Revenue (DOR) recently announced that MA TAX AMNESTY 2016 will be open to all individuals and businesses to catch up on back taxes and save on penalties. This program allows taxpayers to file delinquent returns or amend prior tax filings; pay only the tax and interest you owe (i.e., Tax penalties and any interest due on those penalties will be waived); and benefit from a three-year limited lookback period. Amnesty is available to any individual or business who has not currently registered with the Massachusetts DOR, who has not filed a tax return, or who has not reported the full amount of tax owed on a previously filed return for any tax return due on or before December 31, 2015. Amnesty is not available to individuals or businesses who are, or have been, the subject of a taxrelated criminal investigation or prosecution, who have previously filed a false or fraudulent return or statement, or who file a fraudulent amnesty return. The current tax amnesty period does not cover existing tax liabilities. Taxpayers who participated in the 2014 or 2015 tax amnesties are not eligible for the same tax types or tax periods for this amnesty. This exclusion will not impact most taxpayers. All tax types administered by DOR are included, with the exception of Preferred Provider excise and taxes covered under the International Fuels Tax Agreement (IFTA ). Senator Benjamin Downing (D-Pittsfield) Senator Downing was first elected to the Massachusetts Senate on November 7, 2006. He represents the 52 communities of the Berkshire, Hampshire, Franklin, and Hampden District. He grew up in Pittsfield, and received a bachelor of arts in Political Science from Providence College in 2003. In May 2008, he received a masters in arts from Tufts University’s Department of Urban and Environment Policy & Planning. Before returning to Pittsfield and eventually running for office, he lived in Washington, D.C. working for former U.S. Representative William Delahunt (D-Quincy) and U.S. Representative Richard E. Neal (D-Springfield), before joining the staff of former U.S. Representative John W. Olver (D-Amherst) as a senior advisor. Senator Downing’s family has a long history of public service, which has given him a strong appreciation for the good work government can do.

Q:

Representing 52 municipalities before the Massachusetts Senate, you understand many of the issues that impact municipalities. Can you share your thoughts about the importance of maintaining the Commonwealth’s water infrastructure?

A:

Though it rarely grabs headlines, the maintenance and improvement of aging water and sewer infrastructure is an issue of critical importance to communities throughout Massachusetts. Fortunately, the Senate made legislation addressing this issue a top priority last session. As passed, Chapter 259 of the Acts of 2014, increased to $50 million the amount in loan authorizations that the newly-minted Massachusetts Clean Water Trust Fund can offer to municipalities in need of financing water and sewer infrastructure projects across the Commonwealth. Hundreds of Massachusetts communities and millions of residents are now benefitting from this change which enables greater investment in infrastructure that we rely on every day.

Q:

You have played a strong role in representing the interests of Western Massachusetts. The Drinking and Clean Water State Revolving Fund (SRF) are often not used by western communities,

whether because of eligibility or ability to finance. Can you discuss your efforts to assist Western Massachusetts communities?

A:

As Chair of the Rural Caucus, I have also engaged with my counterparts in the House in discussing how to secure MassWorks Infrastructure Program funding for the installation of public water and sewer systems in Western Massachusetts. As you know, the MassWorks Infrastructure Program is promoted as being a one-stop shop for municipalities and other eligible public entities seeking public infrastructure funding to support economic development and job creation. The program represents an administrative consolidation of six former grant programs: Public Works Economic Development (PWED); Community Development Action Grant (CDAG); Growth Districts Initiative (GDI) Grant Program; Massachusetts Opportunity Relocation and Expansion Program (MORE); Small Town Rural Assistance Program (STRAP); and the Transit Oriented Development (TOD) Program. In the past year or so, we have seen a greater interest by municipalities in the MassWorks program for its potential to fund infrastructure projects of all types. continued on page 21

As Senate Chairman of the Joint Committee on Telecommunications, Utilities, and Energy, you have played a critical role in the Commonwealth’s energy policy. Can you tell us about some of your work in the Committee and your thoughts about protecting our infrastructure?

A:

With the highest electric bills within the country, Massachusetts has been challenged to set an energy policy that is environmentally friendly and efficient. To that end, we have been looking at a menu of energy options. For example, promoting continued solar growth is essential to help the Commonwealth reach the goals for the reduction of greenhouse gas emissions established in the Global Warming Solutions Act. Solar energy is a win all around for Massachusetts. It's good for our environment and our economy. Over the past few years,

We heard testimony from residents impacted by the natural gas explosion in Springfield in 2012, which was the result of a worker puncturing a pipeline after responding to a natural gas leak. These events helped inform the Committee as the bill ultimately progressed to the Governor’s desk, and remains in the forefront as the committee tackles new legislation this session. n

His presentation contained important information including compliance with OSHA standards and regulations, the proper way to respond to an OSHA inspection, and the rights of employees and contractors. This year’s attendees were a mix of those who were there for the first time, and those who had previously attended one or more or our seminars. Tools of the Trade: Solutions for When Things Go Wrong at Construction Sites To err is costly in the construction world. Although contractors continue to improve their focus on risk management, accidents happen daily at construction sites all over the country, some resulting in tragic loss of life. There are, however, certain steps that can be taken to reduce construction accidents and their financial impact on contractors.

T

ake the case of a general contractor engaged in the construction of a $20 million utility substation. During installation, a $2 million transformer caused a huge fire, resulting in total loss of the facility including the transformer. A post loss investigation revealed that a subcontractor had installed the transformer improperly, thus causing the ensuing fire loss. Another recent example involved a concrete subcontractor that was erecting a four-story parking garage adjacent to a shopping center. Following project completion, part of the second level collapsed onto the first level, causing $500,000 in damages to the parking structure. What caused this costly loss? A subcontractor had installed the rebar improperly. Indeed, these two incidents avoided significant financial loss because they had the right insurance coverages in place. In the case of the transformer fire, a standard builder’s risk policy alone would have covered the damage to the building – but not the transformer.

Fortunately, in the months leading up to the incident, the general contractor’s builder’s risk policy was structured to provide coverage for damages for direct physical loss to a building caused by defective materials, methods, plans and specifications, or workmanship. This coverage applied regardless of whether the project was in the Care, Custody, and Control (CCC) of the contractor. As such, the $2 million loss, representing the value of the transformer, was fully covered. In the case of the collapsed parking garage, the $500,000 damage was also covered because the concrete subcontractor’s policy had been structured to include policy wording limiting the “Damage to Your Work” exclusion found in many general liability policies. The addition of “that particular part” to the policy language limited the excluded work product to only the defective or actively malfunctioning part of the work, instead of the entire work product. continued on page 31

Insurance Perspectives continued from page 29 Construction defect claims are a frequent source of headache for property owners and builders alike. They often present significant legal challenges, and the associated losses are not always covered by commercial general liability policies. In fact, coverage for such claims may be denied if they are not considered accidental “occurrences” or fall within one or more policy exclusions. The following solutions can help construction companies mitigate the financial impact of construction defect claims:

Blanket Installation Floater Blanket installation floaters provide coverage for such property items as materials, fixtures, machinery, equipment, items at the job-site, as well as in temporary locations or in transit during the course of construction. This is an important coverage due to the fact that trade contractors frequently do not provide coverage for their own materials, which can result in uncovered claims when there is damage to their materials and equipment during the course of construction.

Coverage for Resulting Damage from Faulty Workmanship Faulty workmanship occurring when a project is in the CCC of the general or trade contractor is normally excluded by insurance companies. However, coverage can be obtained by adding an “Amendment to Cost of Making Good” endorsement. This endorsement provides coverage for dam-

ages that occur as a result of direct physical loss to a building caused by defective materials, methods, plans and specifications, or workmanship even when in the CCC of a general or trade contractor.

Changing Policy Wording to Allow Coverage for Completed Operations Being able to negotiate a change in policy wording allows coverage for damage to contractor’s work or property in their CCC for completed operations. As mentioned in the case study above, this is done usually by amending the "Damage to Your Work” exclusion in the commercial general liability to include “that particular part.” In addition, the definition of “occurrence” can be amended to include construction defects as an occurrence regardless of state statute.

Removal of Endorsement CG 2294 The CG 2294 is one of the most complicated endorsements in contractors’ liability insurance. It essentially limits coverage for damage resulting from work performed by subcontractors.

Considering Veterans for Your Organization Many employers like the idea of adding veterans to their employee base but often times don’t have much knowledge about the military world. Offering jobs to veterans is an incredibly worthwhile endeavor, and can be mutually beneficial. Here are the answers to some of the most commonly asked questions about the process: How do I know if I have a position for which a veteran would be a good fit? Most likely, your organization doesn’t need to fill positions where understanding how to use a weapon or living in a war zone are required experiences. However, the training that all veterans go through during their careers, as well as their daily experiences, offer an incredible amount of transferable skills. For example, veterans in general have shown themselves to be incredibly resilient, loyal, and entrepreneurial. They are typically quite comfortable with making independent decisions and can be self-sufficient, but are also team-oriented and more focused on the whole as opposed to the sum of the parts. One tool that is particularly helpful in better understanding how veterans can fit in and thrive within your organization is by visiting www.careeronestop. org, a website sponsored by the U.S. Department of Labor. The site features a “civilian-to-military occupation translator,” which can identify civilian positions based on military occupation titles as well as identify specialized skills that are specific to certain military positions.

None of our other employees have military backgrounds. How can I make sure a veteran will fit into our culture? It makes sense to be concerned about any new employee fitting into your organization’s culture. For veteran employees, it’s also helpful to understand MARCH, 2016

the culture that they most recently left, and if no one else in your organization can relate to this, it might be worth investing in some education to better understand this very unique environment. Many opportunities to do so exist, either through the Veterans Administration or other related organizations that work to encourage employers to hire veterans. Private consulting organizations also offer specialization in this area.

Are there specific questions that I should or should not ask a potential candidate? In addition to the general framework of questions that should be followed for any interview, it’s helpful to keep some additional interviewing tips in mind when talking with a veteran candidate. Encourage veterans to talk about their military experience, and help draw connections between their achievements in the service with expectations within your organization’s position. As tempting as it might be, avoid questions that specifically ask about combat experience, injuries, or mental health, as they could not only make veterans feel uncomfortable but also might put your organization at odds with Equal Employment Opportunity guidelines.

MMA Members Endorse Two Policy Resolutions

T

he MMA membership on January 23 unanimously endorsed two policy resolutions on key issues: local aid and environmental issues. The resolutions send an important message to state leaders about municipal priorities and will guide the MMA’s work in the year ahead. The first – Resolution Ensuring a Strong and Enduring Fiscal Partnership Between Cities and Towns and State Government in Fiscal 2017 and Beyond – was developed by the MMA’s Fiscal Policy Committee. It includes priorities voiced by local officials from all parts of the state on municipal and school aid, local-option revenues, unfunded mandates, and many other areas where state and local governments intersect. The resolution points out that adequate and stable state revenue sharing through the Cherry Sheet and targeted appropriations and grant programs is absolutely necessary to ensure healthy and strong cities and towns. It also calls on the state to fulfill its funding commitments on items such as special education, school transportation, out-of-district voca-

tional education, the transportation of homeless students, PILOT, and charter school reimbursements. The resolution calls on the state to move quickly to phase in the recommendations of the Foundation Budget Review Commission to update the Chapter 70 “foundation budget” minimum adequate spending standards for special education and health insurance for school employees, and to add to the spending standard recognition for the cost of services for low-income, English Language Learner (ELL) and other students who would benefit from more intensive services. The resolution also requests a $300 million per year Chapter 90 local road and bridge program, indexed to grow with inflation, and support for new flexibility to adopt local-option taxes and other revenues. The second resolution – Resolution Supporting a Strong and Enduring Local-State-Federal Partnership to Protect the Environment – was proposed by the MMA Policy Committee on Energy and the Environment. continued on page 41

MMA continued from page 39 Highlights of this resolution include the following: • Opposition to any proposals by the state or federal government that contain unfunded mandates or preemption of municipal taxing or revenue authority. • Support for the requirement that a fiscal note – including a cost-benefit analysis for communities – accompany any legislation proposed by the Executive Branch or Legislature. • Support for a $1 billion water infrastructure bond bill, which would fund water, wastewater and stormwater infrastructure improvements across the state and give authority to communities to establish water banks to build, maintain and repair their water, stormwater and sewer infrastructure systems. • Support for the examination of the Department of Environmental Protection obtaining delegated authority over the enforcement of National Pollutant Discharge Elimination System programs (e.g., MS4). • Support for the development of a long-term energy plan for Massachusetts that is sustain-

able and diversified, including raising the net metering cap. • Support for restored funding of the Drinking Water and Clean Water state revolving fund programs to fiscal 2010 levels. • Support for funding and assistance by the state and federal government for coastal communities to mitigate the cost of issues caused by pollution and rising sea levels. The resolutions were developed over the summer and fall by MMA policy committees comprising of local officials from across the state, and they were endorsed in November by the MMA Board of Directors. Some 300 officials representing their individual municipalities voted on the resolutions at the MMA’s Annual Business Meeting in Boston. While discussion was welcomed during the Annual Business Meeting, the policy committees that drafted the resolutions also solicited member comments for a four-week period prior to the meeting. Auditor Surveys Municipalities to Assess Water System Costs

unicipal officials were urged to respond to an online survey being conducted by the Division of Local Mandates in the state auditor’s office to examine the cost impacts of local water infrastructure maintenance. The survey closed at the end of February. In a letter to municipal officials, the Division of Local Mandates said the purpose of the survey is “to update the estimate of our state’s water infrastructure investment gap and to examine potential best practices, regulatory strategies and funding mechanisms designed to help close that gap … as well as to solicit local input on the current use of various funding sources and the embrace of new water system strategies and technologies designed to improve efficiency and manage costs.” The survey, which was launched on November 9, asks about drinking water funding and improvement programs, wastewater funding and improvement programs, and stormwater compliance and capacity programs. The auditor’s office will use the survey results to report on the ways that regulatory changes, climate change, and a growing backlog of water system upgrades are affecting municipal budgets. In a 2012 report, the Massachusetts Water Infrastructure Finance Commission identified an estimated funding gap of $21.4 billion for water and wastewater infrastructure over the next 20 years: $10.2 billion for drinking water and $11.2 billion for wastewater. These figures do not take into account new requirements that could be placed on municipalities through

the state’s Sustainable Water Management Initiative (SWMI) and changes to federal Municipal Separate Storm Sewer System (MS4) permit standards. It was estimated by the Water Infrastructure Finance Commission that it could take an estimated $18 billion in stormwater investments over the next 20 years for communities to meet the regulatory requirements. MMA Executive Director Geoff Beckwith said the Division of Local Mandates survey “comes at a critical moment in the discussion of water-related challenges” for many cities and towns. “The MMA has been pushing hard for greater awareness of the importance of enhanced water systems – drinking water, wastewater and stormwater – to the continued economic and environmental health of cities and towns,” Beckwith said. “We hope the survey will provide the data needed to understand the scope of challenges facing municipalities and the strategies needed to meet them. It’s time to take a fresh look at these costs, as well as exploring ways for the state to work with cities and towns to develop innovative, cost-effective, long-term plans to address this looming challenge. For cash contributions of $250 or more, a bank record won’t be enough to support the deduction. You’ll need a written acknowledgment, as mentioned previously, but this document must provide more details. The acknowledgment must be received before you file your tax return or the return’s due date (including extensions), whichever comes first. If the acknowledgment does not show the date of the contribution, you also must have a bank record or receipt that shows the relevant date. The acknowledgment letter also must say whether the donee organization provided any goods or services in exchange for the gift. If goods or services were provided, the letter must include a description of whatever was provided and a good faith estimate of the value of those goods or services. You can deduct the net amount. If you made more than one $250 contribution to a particular organization during the year, you must have a separate acknowledgment for each contribution, or a single acknowledgment that lists each contribution, the date of each contribution, and the total amount of the contributions.

Calculating the Contribution When you are determining whether your contribution is $250 or more, don’t combine separate contributions. Example 2: Sarah Wilson gave her church $20 by check each week last year, for a total of $1,040 in 2015. When Sarah deducts these contributions, she does not have to combine those payments. Instead, she treats each $20 payment as a separate contribution, so the rules for contributions of $250 or more don’t apply. If you make your donations by payroll deduction, the deduction from each paycheck is treated as a separate contribution. continued on page 49

any people save for retirement by putting pretax dollars into an employer-sponsored retirement plan, such as a 401(k). Those dollars may be rolled into an IRA, perhaps at retirement or after a change in jobs. An IRA rollover can maintain the tax deferral. Ultimately, those pretax dollars will be withdrawn and reported as taxable income. If you are retired then, in a lower tax bracket because you no longer have earned income, the entire process might have saved you considerable amounts of tax. That’s not necessarily the outcome you’ll experience, though. You might find your income is relatively high when you take IRA distributions.

Example 1: Meg Parker saves industriously in her company’s 401(k) plan and rolls the balance to an

IRA when she retires. Meg continues to leave her IRA untouched, in order to let the account grow for more years, tax-deferred. However, beginning when Meg reaches age 701⁄2, she must take at least required minimum distributions (RMDs) each year, according to an IRS table. In this hypothetical example, Meg’s IRA has grown so large that her RMDs plus her other annual income place her into a higher tax bracket than she had during her working years. Thus, her IRA distributions will be taxed at a higher rate than Meg expected. Other circumstances also might increase the tax rate on Meg’s IRA withdrawals. Overall tax rates might be higher when she takes money from her IRA. Meg might have moved to a state with a high income tax rate; she might be married to a spouse who reports substantial income on their joint tax return. For these and other possible reasons, it can make sense to take steps to withdraw money from your IRA and other tax-deferred accounts in a tax- efficient manner. continued on page 51

Financial Management continued from page 49 Avoiding Penalties The best time to take money from your IRA may be when you’re between the ages of 591⁄2 and 701⁄2. Once you pass 591⁄2, you can take IRA withdrawals without owing a 10% fine for early distributions. Meanwhile, you don’t have to take RMDs until you reach 701⁄2. In the interim, you can take as little or as much from your IRA without owing any penalties. One possible tactic is to make the most of relatively low tax brackets, in a calendar year. Example 2: Paul King is 62 years old in 2016. He files a joint tax return with his wife Lynn, who is 57. The Kings reported $125,000 of taxable income on their 2015 tax return, and they expect their taxable income to be about the same in 2016. If so, the Kings will be in the 25% federal income tax bracket this year, which ranges from $75,300 to $151,900 of taxable income. In this example, Paul could take $25,000 from his IRA, bringing the couple’s taxable income for the year to $150,000. Therefore, the Kings would remain in the 25% tax bracket for the year, and they would owe only $6,250 (25% of $25,000) on his IRA withdrawal.

The Kings could spend those dollars, or Paul could move the money into a Roth IRA. Because Paul already is older than age 591⁄2, after five years he would be able to take as much as he wants from the Roth IRA, tax-free. Such a strategy can be implemented every year, to provide the Kings with extra cash flow in retirement or to accumulate funds within a Roth IRA. Moreover, drawing down a traditional IRA during those years will enable Paul to reduce the size of his account and decrease his future taxable RMDs. Note that taking $25,000 from his traditional IRA will increase Paul’s adjusted gross income (AGI) as well as his taxable income. A higher AGI, in turn, could add to the Kings’ tax bill in other areas—they might lose medical deductions, for instance.

Earlier Distributions In example 2, the money came out of Paul’s IRA rather than Lynn’s IRA. At age 57, Lynn would trigger a 10% penalty by taking money from her IRA, negating the benefit of the relatively low tax bracket. However, there are many exceptions to the 10% early withdrawal penalty. If you can qualify for one of them, you might be able to take IRA withdrawals at a modest tax rate, at any age. continued on page 53

Thus, Gregg and Lois could take $15,000 from their traditional IRAs and remain in the 15% tax bracket. They would not owe a 10% early withdrawal penalty because that $15,000 withdrawal does not exceed their qualified higher education costs. Other exceptions to the 10% penalty for IRAs include those for the account owner’s death or disability, qualified first-time home purchases (up to $10,000), certain medical insurance premiums paid while unemployed, unreimbursed medical expenses that exceed a certain percentage of your adjusted gross income, payments due to an IRS levy and qualified reservist distributions. There are also services that can securely transfer sensitive files, if you prefer not to send them as an email attachment.

Protection Points In addition, your company should take steps to protect against malware: hostile or invasive software that may be used to steal personal information and commit fraud. You can reduce your risk in this area by installing antivirus software and keeping it current. Your company also can implement policies regarding the types of websites and data that employees may access while on a company network. The U.S. Chamber of Commerce offers suggestions for establishing policies for employees’ acceptable use of electronic devices. ohn is Vice President of the Robert B. Our Company, Inc., one of Cape Cod’s largest and most respected general contractors. As a second-generation family member in the business, he is providing the construction knowledge, experience, and expertise to guide his company to take on the more difficult infrastructure projects while continuing to further the company’s reputation for business excellence. John serves as a role model for the third generation of the Our children, many of whom have also assumed roles in the business. John has been a UCANE member since 2005. Before his election to the office of UCANE President, he first served on our Board of Directors and later served as UCANE Secretary, Treasurer, and President-Elect. Also during this time, he was a member of UCANE’s Budget, Executive, Government Relations, Insurance, Membership, Safety, and Specifications Committees. Some of John’s goals for the coming year include, securing increased state contributions to the SRF to assure that the maximum number of projects are put out to bid; assisting the MassDEP and other state agencies whenever possible to help cities and towns fund needed underground infrastructure projects; and promoting UCANE’s in-house safety programs while advocating for employee safety on the jobsite. Together with our Board, he will continue our legislative agenda by pressing for the passage of our Interest on Retainage and Dig Safe bills. John is committed to strengthening our Association in the coming year by increasing membership. His goal is to enlist 25 new members and has requested our member’s support to help him achieve this. John is a highly respected contractor in our industry, and is viewed as someone who is hard working, dedicated, and has a wealth of construction knowledge. He believes strongly in UCANE and its goals and future, and has committed to continue the work of those who served before him who have strived to make Massachusetts’ clean water and drinking water infrastructure a model for the rest of the country.

aul is Vice President of Albanese D&S, Inc., Dracut, MA. The company has been a UCANE member since 1992. Paul earned his degree in Civil Engineering at Merrimack College and pursued his MBA at Suffolk University while working full-time. He has been a UCANE Board Member since 2008, and during that time has served as UCANE Secretary and Treasurer, and he currently serves on our Budget, Executive, Government Relations, and Nominating Committees. On several occasions Paul was called upon to provide testimony before State Legislative Committees on behalf of UCANE. Paul has earned the respect and admiration of his co-workers and peers within the utility construction industry. His ongoing commitment to UCANE is evident through his hard work in effectively communicating the issues of vital importance to our industry.

Treasurer Richard Pacella, Jr. - R. M. Pacella, Inc.

ichard is President and General Manager of Construction Activities at R. M. Pacella, Inc., Plainville, MA and is a third generation civilutility contractor. The company was founded in 1977 by his father Richard Pacella, Sr., who is semi-retired, and his family has been UCANE members since its inception. Richard graduated from Wentworth Institute of Technology with a degree in Construction Management. He currently serves as Foxborough, MA Water and Sewer Commissioner and Mansfield-Foxborough-Norton Regional Wastewater District Commissioner. He also served on UCANE’s Board of Directors and later moved up to Secretary. He is currently serving as our Treasurer, and is also a member of our Budget, Executive, and Government Relations Committees. Like so many other UCANE members before him, Richard intends to carry on the family tradition of involvement and support of our Association. He is a dedicated member who brings commitment, enthusiasm, and new ideas to our industry…ingredients that are vital to every organization!

Secretary Marcella Albanese - Albanese Brothers, Inc.

M

arcella is President of Albanese Brothers, Inc., Dracut, MA. Marcella’s father Marco and his brother John founded the company in 1978. Marcella, along with her siblings Maria and Dino, represent the second generation of Albanese contractors who are highly respected for their ability to take on difficult projects. Since Marco retired in 2010, Marcella, Maria, and Dino have continued to grow the family business, working on projects throughout Massachusetts as well as New Hampshire. Albanese Brothers, Inc. is also WBE/DBE accredited. Marcella has been involved in UCANE since she began working at Albanese Brothers. She has served two terms on our Board of Directors, and now has taken on the additional responsibilities of Secretary. Her knowledge of issues facing the construction industry is invaluable, and for that reason her peers voted Marcella UCANE’s 2015 Contractor Member of the Year. She and her family continue their strong support of UCANE and our industry.
