2022 Banquet Returns to Celebrate Best of UCANE

My family has been involved with UCANE for many years, so I have been fortunate enough to attend several annual UCANE Banquets. However, this year there was added anticipation and excitement for the event as it is the first time we have been able to hold the event since 2019. I’m sure our members and guests who attended would agree with me that UCANE’s 68 th Anniversary Banquet lived up to expectations as one of the highlights of the year. It was once again a first-class evening of great food and entertainment. As UCANE President, I was especially honored to look out over the crowd and welcome so many of our members back to the event.

This event sells out every year not only because it is a great time, but because members want to support UCANEs mission. As President, I was also able to see the behind the scenes support and planning that goes into this event each year. I want to especially thank all of our banquet sponsors, most notably C. N. Wood Company, Inc. and Komatsu, who have hosted our banquet for more than 20 years. It is only through our members’ generosity that this evening is made possible. I also would like to take the opportunity to offer my thanks and appreciation to the UCANE staff for their planning and hard work in making the evening a success. You can see a full recap of the evening along with pictures from our banquet in this month’s magazine beginning on page 36.

In addition, I would like to congratulate our 2022 Con tractor and Associate Member of the Year recipients who were this year’s honorees. UCANE’s Contractor of the Year is Richard Pacella, Jr. of R. M. Pacella, Inc. Rich has been a tremendous advocate and ambassador for our industry as a Board Member and during his term as President of UCANE, and he continues to work for the betterment of our industry. It is an honor to serve on the Board with him. This year’s Associate Member Award was presented to Gerry Carney, Jr. of C. N. Wood Com pany, Inc. Gerry is omnipresent at all UCANE meetings and events and always available to help. Both men are extremely well-deserving of the honor they received.

While we spent the evening celebrating a successful year, the work of UCANE continues. As I’ve written previ ously, it is critical that our elected officials know that the job is not done simply with the approval of additional fund ing through the Federal Infrastructure Bill, ARPA stimulus funds, and surplus tax revenue. We are very appreciative of these once-in-a-generation additional investments and will work to make sure they are utilized. However, we also need to continue to advocate for long-term dedicated rev enue for our drinking water, wastewater, and underground utility infrastructure so that we do not repeat the pattern of neglect we saw for so many years.

As UCANE members, we have much to be proud of. That includes our Scholarship Program. As you know, our Scholarship Program awards twelve $2,000 scholarships to the children and grandchildren of members and their employees. Because of our members unwavering support over the years, this will be the 49 th year of the program. Providing these educational opportunities to children of our members has become a part of our mission. Lastly, I’d like to wish you and your families well as the holiday season approaches and another construction season comes to a close. n

Massachusetts Legislature Passes Economic Development Bill; Significant Water Infrastructure Funding Included

Following through on their commitment to pass an economic development bill with significant funding for a variety of initiatives, House and Senate leaders did so at the start of November. The $3.8 billion package, which spends down the remain ing fiscal year 2022 revenue surplus and a portion of America Rescue Plan Act funds, was passed by the House and Senate during informal sessions. Of note, however, the legislation did not contain a variety of tax reform initiatives that both the House and Senate had trumpeted upon passage of the original bills in their respective branches.

Overall, the $3.8 billion legislation uses $500 mil lion in Federal American Rescue Plan Act (ARPA) funds, less than half as much as both branches ap proved using in July, and exhausts the rest of the tax surplus the state collected in the fiscal year that end ed June 30. Broad spending highlights include $350 million in aid for hospitals experiencing pandemic-in fluenced financial strain, $225 million for human service rate increases, $195 million for nursing facilities and rest homes, $540 million for clean energy and climate resilience programs, $409.5 million for af fordable housing, and $112 million to help the MBTA make federally mandated safety fixes. The House and Senate did not include $500 million in one-time tax rebates aimed at middle-income families or an other roughly $500 million annually in estate tax reforms and permanent tax breaks for renters, seniors, caregivers and others.

Of particular note to UCANE members, the eco nomic development bill appropriates $115 million of new funding for eligible water infrastructure projects that include, but are not be limited to, improvements to drinking water systems, per- and polyfluoroalkyl

substances remediation and combined sewer over flow projects. In providing this funding, the legislation states that a “preference shall be given to projects related to per- and polyfluoroalkyl substances reme diation and that not less than 25 per cent of funding shall be expended for grants to qualified census tract communities, environmental justice communities and communities disproportionately impacted by the 2019 novel coronavirus.” Within the same line-item, the legislation provides that not less than $15,000,000 of the appropriated amount shall be expended for costs associated with planning and implementing water pollution abatement projects in any watershed des ignated as a nitrogen sensitive area. The legislation continues to fund port infrastructure improvements with an additional $100 million and includes an as sortment of water and sewer improvements in other line-items.

With respect to tax relief, House and Senate leaders have suggested that they will revisit the issue in the upcoming 2023-2024 legislative session. In a joint statement announcing the economic development bill compromise, House Speaker Ron Mariano and Senate President Karen Spilka stated:

“With many economic experts predicting finan cial uncertainty in the year ahead, our agreed upon package is limited to one-time investments. House and Senate leaders are committed to re visiting the issue of broader, more permanent tax relief next session. This will help to ensure that our discussion of permanent tax relief can and will be informed by the views of a newly elected Legislature and Governor, while considering the looming challenges facing the Commonwealth.”

Realistically, this was probably the outcome that would have been easy for the House and Senate leaders to make in July, but there was an earnest be lief that a bipartisan tax relief package was possible. As Fall progressed, however, there was a change in thinking as certain realities appeared – whether it was progressives making noise about wanting to change Mass. Gen. Laws ch. 62F now; the Massachusetts Teachers Association advocating against any tax relief whatsoever; a difficulty in needing to create something palatable for an informal session or the likelihood of our millionaire tax increase ballot initiative, Question 1, passing. Politically speak ing, this development creates an opportunity for the Massachusetts legislature to work with the new likely Governor, Maura Healey, in delivering an early term win on tax relief.

Mayor Wu Announces New Environmental Standards for City Infrastructure, Requiring Use of Green Infrastructure

Late October saw Boston Mayor Michelle Wu announce a new policy to require that certain City of Boston projects include environmental benefits and stormwater mitigation through the use of green infrastructure. The poli cy establishes five new standard designs and the necessary accompanying maintenance resourc es to expand the implementation of small-scale green infrastructure installations in Boston. In dense urban areas where space in public sidewalks and roadways (referred to as the right-ofway) is limited, it is hoped that small-scale green infrastructure (GI) can be effective in reducing stormwater flooding, promoting groundwater re charge, and filtering pollutants from runoff. Ad ditionally, according to a City of Boston press re lease announcing the same, green infrastructure has numerous co-benefits, including increasing urban tree canopy, mitigating urban heat island

effect, and enhancing ecological diversity.

The new policy will apply to curb extensions, also known as neckdowns, bulb-outs, or bumpouts. Curb extensions improve safety at crosswalks by reducing the distance to cross from one side of the street to the other and pre venting vehicles from parking too close to crosswalks, making pedestrians more visible to driv ers. Curb extensions can also be used to ensure that crosswalks are accessible for people with limited mobility or in wheelchairs. Due to Boston’s compact nature, curb extension projects often result in the creation of small spaces not suited for other uses. Historically, these spaces have been paved with impervious materials.

rent design practices and ensure adequate maintenance so that GI can be integrated as standard practice into large-scale capital projects in the fu ture. The five design alternatives are as follows:

• Right-of-way (ROW) Bioretention. Curb ex tensions may incorporate green infrastructure in the form of Rain Gardens, Bioswales, etc.

• Infiltration Tree Pit/Tree Trench. Curb ex tensions may incorporate green infrastruc ture in the form of Infiltration Tree Pits or Infil tration Tree Trenches.

• Porous Paving. Curb extensions may incorporate Porous Asphalt, Permeable Pavers, Porous Paver Installations, and Porous Con crete Slabs.

• Subsurface Infiltration Area. Curb exten sions may incorporate Stone Subsurface Infiltration Areas (with or without perforated pipe).

• One-time Seeding. The area within the curb extension may be seeded once with a groundcover, low-grow fescue or wildflower mix.

Additionally, to help support the longevity of green infrastructure, two GI-specific mainte

nance contracts will be available for maintenance on new and existing public GI installations. The first is a contract for maintenance on porous paving installations. The second is a contract for landscape maintenance on “green” infrastructure features. These two contracts will provide much needed regular maintenance, including regenerative air vacuum sweeping for porous paving, as well as vegetation maintenance, replacement, and pruning for GI features in the right-of-way. They will also provide the flexibility required to perform maintenance as needed or requested by residents through the City’s 311 system.

The policy will also establish a volunteer program to assist in the maintenance of select GI sites. Prospective volunteers will be able to sign up through an online portal to “adopt” a GI feature. This program will allow volunteers to aid in litter removal and/or seasonal cleanups for GI features where they live, work, and play.

According to the City of Boston, this new in frastructure initiative will complement the City’s network of nearly 36,000 catch basins connect ed to roughly 600 miles of pipes beneath our streets, which is maintained by the Boston Water & Sewer Commission.

New Federal Funding for Hudson PFAS Plant Upgrade Highlights Impact of PFAS on Funding Decisions

At a recent in-district event, Congresswoman Lori Trahan (MA-03), State Senator Jamie Eldridge, and State Representative Kate Hogan toured the Town of Hudson’s Chestnut Street PFAS Treatment System to highlight $1 million in federal American Res cue Plan Act (ARPA) funding that will be used to up grade the plant’s PFAS remediation capabilities.

In 2019, PFAS levels in the Town’s groundwater supply were first detected at levels above the feder al Health Advisory Level. Since then, the Town has been providing water with non-detectable levels of PFAS to consumers and deployed a temporary treat ment facility while the current, permanent facility was designed and constructed.

The Town of Hudson’s Chestnut Street Water Treatment Plant secured this ARPA funding through the Clean Water Trust’s ARPA Water Infrastructure Grants. In 2021, the Baker-Polito Administration and the Massachusetts Legislature allocated $100 million in federal ARPA funding for the Clean Water Trust (CWT) to be used as grants for water infrastructure projects. In February 2022, the CWT approved $66.8 million in grants to 52 projects beginning construction in 2022. The grants were delivered in the form of loan forgiveness for projects on the State Revolving Funds for Clean Water and Drinking Water.

The funding and subsequent award demonstrate the impact PFAS is having on water infrastructure issues. Not even a consideration during the semi nal Water Infrastructure Finance Commission’s 2012 report, PFAS remediation has contributed to ris ing costs for addressing the Com monwealth’s water infrastructure.

In 2020, the Massachusetts leg islature appointed the PFAS Inter agency Task Force to investigate water and ground contamination of per- and polyfluoroalkyl substanc es across the Commonwealth. The Task Force held nine public hear ings throughout 2021 and heard testimony from a wide range of stakeholders, including research ers, advocacy groups, community members, municipal officials, state agencies, public water systems and industry groups. The final Task Force report, which included a re quest for additional funding, can

Baker-Polito Administration Announces

$143 Million for Economic Development Projects

Governor Charlie Baker and Lt. Governor Karyn Polito announced the awarding of more than $143 million in grant awards to support 337 local economic development proj ects in 169 communities in October. The grant awards were made through Community One Stop for Growth, a single application portal that provides a streamlined, collaborative review pro cess of 12 state grant programs that fund eco nomic development projects related to commu nity capacity building, planning and zoning, site preparation, building construction and infrastructure. MassWorks is the largest program in the One Stop portfolio and is awarding $100 million in grant awards this year.

Through this round of the One Stop, the Executive Office of Housing and Economic De velopment received 523 applications from 207

communities representing every region of the Commonwealth. Of the 337 applications award ed, 31% are located in a rural or small town; 32% are located in a Gateway City; and 43% are lo cated in a Housing Choice Community. Among this year’s Mass Works’ projects, 39 are reactivating underutilized sites, 31 are supporting transit-oriented develop ments, and 30 have a mixed-use component. Additionally, 17 communities are receiving their first ever MassWorks award.

Including this year’s round, the Baker-Polito Administration has awarded 391 MassWorks grants to 197 communities, investing over $709 million in public infrastructure projects throughout the state. These grants have directly sup ported the creation of over 26,000 new housing units and tens of thousands of construction and new permanent jobs, while also leveraging approximately $17 billion in private investment.

• Groups Sue US EPA Alleging a Failure to Fully Protect Boston Rivers. The Conservation Law Foundation (CLF) and Charles River Watershed Association (CRWA) filed a lawsuit at the beginning of November against the United States Environmental Protection Agency (EPA) for failing to take actions nec essary to protect three Boston-area rivers from polluted runoff. The CLF and CRWA ar gue that stormwater runoff from private prop erties with large areas of paved surfaces, like big box stores, strip malls, private universi ties, and major apartment complexes, were not previously enforced by the EPA. Ac cordingly, the same groups argue that since these properties contribute a disproportion ate amount of polluted runoff to nearby rivers, the EPA should regulate the aforementioned properties along the Charles, Mystic, and Neponset Rivers.

• October Revenue Numbers Are In; Revenue Continues to Increase. The Mas-

sachusetts Department of Revenue (DOR) announced that preliminary revenue collections for October totaled $2.359 billion, $85 million or 3.5% less than actual collections in October 2021, but $293 million or 14.2% more than benchmark. FY’23 year-to-date collections totaled approximately $11.565 billion, which is $369 million or 3.3% more than collections in the same period of FY’22 and $529 million or 4.8% more than the yearto-date benchmark. In general, October is among the lower months for revenue collec tion, because neither individual nor business taxpayers make significant estimated pay ments during the month. Historically, roughly 6.5% of annual revenue, on average, has been received during October.

• Daylight Savings Time Reminder: Fire Officials Urge Everyone to Check Fire Alarms. With the end of daylight savings time in early November, Massachusetts fire officials issued a seasonal reminder to check smoke and carbon monoxide (CO) alarms and change the batteries. According to the State Fire Marshal’s Office, smoke and carbon monoxide alarms have the manufacturing date printed on the back of the device. Smoke alarms should be replaced when they’re 10 years old, and CO alarms should be replaced when they’re five to seven years old, depending on the model. Unless you have newer alarms with 10-year sealed batteries, the State Fire Marshal sug gests that it is a good time to replace the al kaline batteries in all of your alarms. n

Construction Safety & Compliance: An Interview with John Neil

Will you please tell us a little about your background, why and how you chose to get into the field of Construction Safety, and how you arrived at Skanska USA-Boston?

After graduating from UMass-Lowell with a BS in Industrial Engineering, I began my con struction safety career more than 35 years ago at Boston-based Liberty Mutual Insurance. While at Liberty Mutual I earned my MBA from Clark Univer sity. I spent over 19 years at Liberty Mutual primarily serving our largest contracting clients and became their Managing Director of Construction & Transpor tation. Their mission of “Helping people live safer, more secure lives” has stuck with me to this day. In 2007, I made the switch to the construction industry with stops at Shawmut Design & Construction and then The Walsh Group focusing on heavy civil con struction.

In 2017, I was fortunate to join Skanska USA-Civil in our Boston office as Area EHS Manager for New England. I am so proud to be a part of the Skanska organization where their “Care for Life” core value is all about the health and safety of people and our en vironment. It truly makes you feel good about waking up everyday to go to work.

Can you tell us a little about Skanska, and as one of 30 Skanska offices operating throughout the USA, what type of projects does Skanska-Boston pursue and construct?

Our parent company in Sweden, Skanska-AB, established in 1887, has grown into one of the largest contractors in the world with 30,000 employ ees working worldwide and generating revenues ex ceeding $17B/year. The USA subsidiary started in 1971. It consists of three main divisions, Building Op erations, Commercial Development, and Civil Proj ects. Skanska-USA now employs about 7,500 people and had billings of over $6B in 2021.

We most recently completed projects for MassDOT at Chelsea Viaduct, MBTA at Ruggles Station, Northeastern University’s Pedestrian Bridge, and are currently working on the Harvard Universi ty-Allston Campus, the RIDOT I-95 NB Providence Viaduct, and the South Coast Rail Commuter Line Project in Fall River

As EHS Manager for Skanska-Boston, what are your daily duties, and how many sites and workers might be active in an average week?

Skanska-Boston will typically have 5-10 large heavy civil projects actively working. That means multiple subs and anywhere from 50 to 300+ skilled craft workers in the field on a daily basis. As the Area EHS Manager, I’ll be communicating daily with our five EHS Managers and Coordinators, serving our project teams, our skilled craft trades, and subcontractors implementing our Environmental Health and Safety system.

Our EHS staff are my eyes and ears in the field and I’m so fortunate to have a very talented and experi enced team. Together with our project teams we are committed to a Plan>Do>Check>Act process and continuous improvement. Our comprehensive pro gram has several key elements and leading indica tors that guide our projects towards our goal of an Injury Free Workplace. Construc tion Work Plans, Daily Hazard Analysis, EHS Inspections, Crew Reviews, Project Safety Commit tees, Internal and External Safety Audits are just some of those key elements driving our program.

Additionally, Skanska empha sizes Executive Site Safety Visits (ESSV) to all of our projects. Cor porate wants all workers to know that the entire project team is in volved and engaged in Safety.

Can you describe the safety culture that exists at Skanska-Boston, and how safety programs and performances are coordinated between the home office (Skanska-AB in Stockholm, Sweden), Skanska USA (New York), and SkanskaBoston?

The safety culture at all the Skanska subsidiaries starts at the very top, Skanska-AB in Sweden. Every manager, supervisor, and skilled craft must make safety part of their daily routine. Skanska considers their employ ees to be their most valuable asset and that attitude must be transmit ted by every level of Skanska leadership to the skilled trades in the field.

We have been able to recruit not only talented professionals in key op erational and safety positions, but thanks to our union partnerships we are able to attract and retain skilled craft in key leadership and supervisory roles. People want to come to work for Skanska for many of the reasons I have stated above.

My advice to anyone considering a career as a Safe ty Professional is if you enjoy helping people there is no more exciting, challenging, gratifying and reward ing career than the Construction Safety Industry; and there is a lot of work left to be done. n

I graduated from Ohio Technical College in 1986 and shortly after went to work for the Town of Groton, CT as a fleet mechanic. After being with Gro ton for over 20 years, I accepted a position with the City of Boston as Director of Central Fleet, oversee ing the City’s municipal fleet of over 1,200 vehicles. In 2015, I was appointed the Commissioner of Public Works in Newton, where I reside today.

Please give us a brief description of Newton regards make-up of the DPW, population, and infrastructure statistics?

Newton’s DPW is comprised of the Water/Sew er/Stormwater, Streets, Transportation, Engi neering, Sustainable Materials (trash and recycling), Customer Service, Business Office, and Fleet divi sions. The City is over 18 square miles with a popula tion of just under 90,000 residents and is served by 201 DPW employees with a $95 million annual oper ating budget. Newton has two major DPW facilities that service over 274 lane miles of streets with water, sewer and stormwater traversing through the entire area.

What do you currently see as the most pressing infrastructure needs for the City in the next few years, and is there a 5-year Asset Management Plan in place to address those needs?

Our most pressing needs are currently street and sidewalk rehabilitation and maintenance where we are currently spending $9.5 million per year to address these needs and bring our average Pavement Condition Index (PCI) to over 80 by

2028. We currently have an aggressive water/sew er cleaning and lining program in place, spending over $9 million a year. The most challenging need is addressing our phosphorus reduction required by the EPA. We have been incorporating new storm water infrastructure into all new projects along with increasing our street sweeping program to try and meet these aggressive and extremely costly NP DES requirements. We do have a 5-year Capital Improvement Program which is updated bi-annually and includes over $530 million of ongoing and up coming projects throughout the City.

Federal ARPA Funds and the recent Federal Infrastructure Bill are offering record-setting financial assistance to Massachusetts Cities and Towns for infrastructure improvements over the next several years. What is Newton’s typical annual capital improvement budget for horizontal construction projects, and are there some projects coming out to bid in 2023 that would interest UCANE contractors?

Just the water/sewer and streets annual spend ing is over $20 million. The City has received ARPA funding which the Mayor has appropriated to many areas across the City including street work, traffic calming projects, intersection and village en hancement projects all of which are in place, going to bid and/or in design.

Do you see any roadblocks or impediments that would prevent the City from accessing or utilizing the State and Federal funds in order to achieve the City’s current infrastructure improvement goals, and do you have any recommendations on how to address those impediments?

The ARPA funds have been distributed so we don’t see any issue accessing and utilizing those. Some of the federal funds and grants can be time consuming and complicated. To access these funds we have been contracting with our consultants that specialize in these areas and have the exper tise and knowledge putting us in a better position to receive the funding while reducing the required inhouse staff time. n www.jescoditchwitch.us

UCANE’s much heralded and long awaited 68th Anniversary Banquet was held on October 22, 2022 at the Newton Marriot Hotel. It was a beautiful New England night as more than 500 UCANE members and guests filed into the hotel. Our Banquet has always been a chance to relax with fellow members and friends as the end of the hectic construction season approaches, and the occasion to announce, honor, and respect our UCANE “Contractor Member of the Year” and our “Associate Member of the Year.”

Our Banquet is also the highlight of UCANE’s social calendar, and one could sense tonight’s attendees had more than the normal level of excitement and anticipation. COVID had forced the cancellation of the popular Banquet in both 2020 and 2021 – the only Banquet cancellations in UCANE’s 68-year history. So, our revelers tonight had gone three years without their favorite party and their extra excitement was understandable and on display!

Executive Director Jeff Mahoney and New England’s number one party planner Anne Klay man, and the UCANE staff, made sure that our members and guests would have a special night. The theme for the evening was “A Night in the Tropics.” The ladies were in their fancy dresses popping with radiant tropical colors while the guys wore their best suits highlighted with flashy colored ties. A memo rable night of camaraderie, great food, outstanding music and entertainment, and another “over-the-top” event was about to begin.

First stop of the night was the Commonwealth Ballroom for our Social Hour and a beverage. In addition to two bars, there was a special “Tropi cal Martini” bar serving colorful cocktails. Waiters traversed the room with a medley of tasty hot hors d’oeuvres. Guests surrounded the Hot Seafood Bar – do you like toasted lobster rolls and fried clams? – and the Cold Seafood Bar – fresh oysters and

shrimp anyone? - while others enjoyed the larg est arrangement of cheese, crackers, fresh veg etables, and other sumptuous snacks to be seen since Meghan and Harry’s wedding. It took a lot of self-discipline to leave the Social Hour and still have room for dinner!

Next stop was the Grand Ballroom where the real festivities would be held. On cue, the band be gan a medley of familiar and lively tunes as the Ball room doors swung open and the guests entered. Every eye was wide-open and beaming as the crowd walked in and saw the incredible display of decorations that awaited them. From the sparkling huge balloons on the ceiling over the all-white cus tom dancefloor, to the glittering lights and shimmer ing hot pink sequined backdrop on the stage, to the huge flower arrangements at each decorated table, every attendee was treated to a visual experience that they would not soon forget.

After everyone was seated, UCANE President Ryan McCourt came to the podium and wel comed all to the gala, and then introduced Ex ecutive Director Jeff Mahoney. Jeff also welcomed everyone and he thanked the ladies for bringing the “Night in the Tropics” theme to life with their color ful attire. He also thanked Anne Klayman and the UCANE staff for all of the hard work that went into planning and executing tonight’s event.

Jeff thanked all the members for their support of not only tonight’s event, but for their continued sup port of our Association throughout the years, and especially during the last two years that saw COVID disrupt everyone’s lives. He thanked the Board members who persevered and conducted business via ZOOM meetings until in-person meetings resumed in 2022. Just as UCANE contractors continued most operations throughout the pandemic as government designated them essential businesses, UCANE staff and the Association’s mission continued uninterrupted. Although the pandemic was frightening at times, our members and their employees showed dedication, bravery, and resilience throughout those two plus years, and all deserve to be commended. Jeff reminded the audience of the Infrastructure Bill that

may have been the only bright light to come out of the pandemic, and certainly a reason for our industry to be optimistic into 2023 and years beyond.

Jeff also thanked the nearly 200 UCANE mem bers and sponsors who helped make tonight’s event so special, and in particular, Bob and Paula Benard and the C. N. Wood Company, Inc. and Komatsu who have Hosted our Banquets for the past 21 years. Jeff also thanked several other major contributors to to night’s festivities including Concrete Systems, Inc., Barletta Heavy Division, Dagle Electrical Construc tion Corp., and Pat DiCerbo and Northwestern Mu tual. Jeff then introduced and called to the stage UCANE’s 2022 Officers and Board of Directors. They received a well-de served round of applause for their commitment and dedi cation to our Association and to our industry.

Next on the night’s agenda was the much-anticipated an nouncement of the UCANE members who were voted (by their peers) as “Contractor Member of the Year” and “Associate Mem ber of the Year.” These award recipients are recognized for their dedication and contributions to our Association over the years. They exemplify the best qualities and high standards that any Association would look for from its members. They are members of an Association because they believe in teamwork and working toward common goals that will benefit our industry at-large over any individual company. They have unselfishly given up personal time and resources to strengthen UCANE and to advance the construction industry that, for most of us in this room tonight, provides a good living for ourselves and our families.

As is traditional, these winners are chosen by their peers through secret ballot. The winner’s names are only known to a few select members of our awards commit tee. The entire audience, including our recipients, have no knowledge of who the winners are until our Executive Director makes the announcement that night.

Our 2022 Associate Member of the Year Award was presented to Gerry Carney, Jr. of the C. N. Wood Company, Inc. Our 2022 Contractor Member of the Year Award was presented to Richard Pacella, Jr. of R. M. Pacella, Inc. (Please see separate articles on pages 54 & 57.)

Following the awards presentation, and some very moving acceptance remarks by our two recipients, UCANE Treasurer Chris Valenti (GVC Construction, Inc.) was called on to give the Invocation. As a large and professional waitstaff scurried about the room serving a delicious four course meal, anchored by a top shelf “surf and turf” dinner (Filet Mi gnon and Baked Stuffed Shrimp), the band took to the stage and lit up the Ballroom. Back by popular demand was one of Boston’s hottest groups, and a familiar face to many in the room, – “Decades by DeZyne.” They are a New England favorite and their ability to blast out oldies as well as current hits kept the party atmosphere going and the dance floor crowded all night long. The only break our band took was when they welcomed the night’s “Special Entertainment” – none other than A Tribute to multi-Grammy Award winner and 2021’s Latin Grammy Award winner for “Best Contemporary Tropical Album” – Gloria Estefan. The tribute entertainer, Julie Ellis, rocked the stage with a high energy performance singing a collection of Gloria’s greatest hits and elevated the night’s tropical theme to new heights.

As the party rocked on, our Executive Director and MC for the evening, Jeff Mahoney drew names of attendees who had to be on the dancefloor when their name was called, and awarded some beautiful prizes to the lucky winners. Prizes included a Case of Wines of the World, a Ladies Sterling, Gold, and Diamond Bracelet, $250 Gift Certificate to the Capital Grille, a Pair of Ladies 14kt. Gold Earrings…, an Apple iWatch…, a 14kt. Gold Paper Clip Necklace, and a Chance to Win More than $10 Million with $250 in Lot tery Tickets! Party favors, hats, and sunglasses were distributed that added to the light show and to the fun atmosphere while our MC invited every guest to “put on your dancing shoes and let your hair down!”

Our members and guests only took a breath er from the dance floor long enough to cool down at the biggest Gourmet Ice Cream Sundae Bar south of Ben and Jerry’s or to gather up some sweets at our overflowing Candy Buffet.

UCANE’s 68th Anni versary bash at the New ton Marriot Hotel lasted late into the night and may

have gone into Sunday were it not for some “obscure” clause in our rental contract. Seriously, the night was a resounding success, came through as advertised, and added to the legend that is the UCANE Anniversary Banquet.

UCANE members proved they not only work hard every day building and supporting critical infrastruc ture projects, they know how to party hard too!

As always, this memorable evening was only made possible by the generosity of UCANE members. Our Association is one of the most respected underground construction groups in New England and has a history of proven results that benefit the industry. Our Contractors and our Associate Members are the best in the business! UCANE’s Contractor of the Year Award is the highest honor be stowed on a member by their peers. Previous recipients are some of the most respected men and wom en who continue, year after year, to work for the betterment of our industry. They each represent the high standard of business excellence that our Asso ciation has come to expect, and this year’s recipient fits this high standard perfectly.

Our members voted Richard Pacel la, Jr. of R.M. Pacella, Inc. as UCANE’s 2022 Contractor of the Year. Rich is a successful third-generation contractor who comes from a family whose name is synonymous with quality workman ship, and the ability to take on difficult projects.

In the early 1990s he began working at R. M. Pacella, Inc., the family business founded by his father, Richard Pacella, Sr., in 1977. In 1995, after completing his first two years of undergrad uate studies at Lynn University, Rich joined his father and mother full time in the business, while pursuing his bachelor’s degree in construction management at Wentworth Institute of Technology nights and weekends. In July 2004, he became president of the company.

Rich has carried on his family’s tradi tion of involvement and support of our Association. He has earned the respect and admiration of his co-workers and peers within the utility construction industry, and his ongoing commitment to UCANE is evident through his hard

work in effectively communicating the issues of vital importance to our indus try. He served on our Board of Directors prior to moving up the ladder and taking on the positions of Secretary, Treasurer, President-elect, and then UCANE President.

In his community, Rich serves as Commissioner for both the Foxboro Water and Sewer Commission and the Man sfield-Foxboro-Norton Regional Waste water District. Most importantly, his free time and weekends are dedicated to his family, his wife, Nancy, and children Isabelle, Sophia, Adriana, and Rocco, all of whom attended our Banquet and shared in Rich’s well-deserved honor.

His parents, Richard Sr. and Mary, who were also in attendance, wrote this about him: “As soon as he learned to talk, we knew the direction he would go in his career….His preschool teacher informed us that he was managing a construction project in the sandbox. The first Christmas picture he drew at school was a tractor trailer hauling a Christmas tree. His placement in the family is in the middle of two sisters, Stacey and Nicole. They would refer to him as boy wonder, and they were right…he was the boy wonder, and we are so proud of the man he has become.”

UCANE’s Associate Members are the business men and women who sell and service machin ery, supply materials, finance, bond, insure, litigate, and support our contractor companies, and we are fortunate to have some of the best and wellrespected companies in our industry as members.

Always a hard worker, as a kid, Gerry had a pa per route. Then, in high school, he rode his bike to a sand and gravel company where he would load bags of sand and stone into cars. Gerry also worked in his family’s sign shop doing graphic design work, and lettering machines and trucks. He attended the University of Miami where he received a Bachelor’s Degree in Architecture. After college, Gerry moved back to Cape Cod to continue working in his fam ily’s business, which subsequently led to his career in the construction equipment industry. He has worked with some wonderful people and companies over the years but ended up where fate and family intended him to be, at C. N. Wood Company, Inc.

Gerry met his wife Debra during his senior year at the University of Miami. They have been happily mar ried for 13 years, and live in Burlington, MA with their two children, Gerry III age 11, and Jane age 8, and their

black lab Addie. All were able to attend and be with Ger ry as he accepted this honor, except for Addie, who was assigned to guard duty back at the house!

Gerry’s support of UCANE has been unparal leled. He has served on our Board of Directors, but whether he was on the Board or not, he has been omnipresent at all meetings and events, supportive of all Association endeavors, and always available for a call and asking how he can help.

Gerry’s sister Kerri wrote, “As a father, husband, brother and son, Gerry has been quite the role model for us all. He continues to strive for greatness, never settling for average anything. Constantly finding ways to make everyone laugh, Gerry still finds time to keep up with friends and family. We are all so very proud of Gerry’s accomplishments. Cranes and Lifting Material

When a crane is used to lift materials or equipment, it is commonly understood that a thorough lift plan is created and reviewed ahead of time. However, it is not universally accepted that all lifts must be thought out and planned ahead of time. All lifts must be reviewed to prevent injuries and/or property damage, whether a delivery truck or a mobile crane is used.

Aquick review of the headlines and we find "crane falls over, causing damage to two homes," "Truck crane tips over onto building under construction," "Crane falls to the ground," and more. Some of these incidents involved mobile hydraulic cranes, and oth ers involved delivery truck cranes.

The lift is planned out in detail in a typical crane lift. The weight of the item being lifted, the rigging details and weights, the ground bearing pressure of the outrigger floats, the details on the mats to be used under the outrigger floats, the radius and boom length of the crane, etc. The plan is reviewed before mobilization and then again on the day of the lift to ensure that everything is consistent with the plan.

When it comes to delivery truck cranes, some think that a lift plan isn't needed. Most delivery truck crane accidents are due to operating outside of the safe working area of the load chart or not having the crane set up correctly. As shown in the picture, the outriggers were not extended on the back side. In addition, the crane was operating outside the load chart's safe working area.

A load chart is a diagram that assists a crane op erator in determining the most appropriate configuration and positioning. The load chart diagram on the following page shows the boom length needed to pick up and lift a load. The range diagram is also helpful when setting up near structures. A load chart may appear like a diagram or a spreadsheet. In the

spreadsheet version, the numbers on the top row represent the boom lengths of the crane. The numbers in the left column represent the operating radius. The gross capacity of the crane can be determined by either following the radius column and intersect ing boom length or following the boom angle and intersecting the radius or boom length column. Each crane’s load chart will have specific footnotes pertinent to the particular crane type that must be consid ered to ensure the crane’s safe operation.

The capacities listed in a crane’s load chart are not the actual loads that can be lifted on the hook. The values given in the charts are “gross capacities: or “rated capacities.” The actual load the crane can

lift is referred to as the “net capacity.” The maximum load must never exceed the crane’s net capacity! The gross capacity must include the weight of anything, and everything mounted or stowed on the crane boom or hanging from the boom tip. These items are called “capacity deductions.” Some capacity deduc tions include:

• Weight of the main load block

• Weight of the headache ball or overhaul ball

• The effective weight of the jib (stowed or erected and not used)

• Weight of all hanging cable

• Weight of all rigging

• Weight of the load

A rule of thumb is that the load must never exceed 75% of the net capacity of the crane. Anything beyond 75% falls into a category known as a critical lift. When it comes to crane work, a small mistake could be costly. Take the time to properly plan all lifts and ensure that the equipment can complete the work. n

5 Tips for Solar Panel Energy Installations & Insurance Considerations

From government incentives for electric vehicles to saving money on electric bills with solar panels, green initiatives have become popular. As commercial and residential solar panels become more commonplace, it’s important that solar panel energy installers provide safe and efficient services.

Before installing, it’s important to research the in stallation location. If panels are being installed on the ground, the ground should have proper drainage and get enough sun for the panels to be effective. For roof panels, it’s also vital to make sure that ample sunlight is available. Observe any trees or obstructions that may decrease sunlight.

Operations and Maintenance Tips

Here are some tips that solar installers and con tractors can take to protect their company, staff, and the panels they install.

1. Make sure installation processes are followed. In general, processes are created to in crease safety and reduce accidents. It's espe cially important to follow established processes because solar panels can overheat, dislodge from mounts, or take damage from extreme weather if not installed properly.

2. Work with the right team. If working with a property management system, contractors or subcontractors, it’s important to ensure that everyone is certified and has the right insurance coverage.

3. Follow up after extreme weather conditions. After a storm, it’s important to make sure that the solar panels are still properly installed and work ing correctly.

4. Install monitoring software. A monitoring sys tem can help prevent problems with early alerts. Many monitoring software programs are compat

ible with computers and mobile devices.

5. Protect solar panels from cyber risks. Since solar panels connect to computers or mobile de vices and third-party monitoring software, make sure that steps are taken to reduce the chances of cyber-attacks.
