rented out his own. When we got married, we wanted to buy a place together that was ‘ours’. We took the decision to sell my house and use the proceeds as a deposit for our joint marital home. Matthew already had a settled tenant and so we left his property well alone – keeping it in his sole name. Upon discovering Matthew’s infidelity, I couldn’t believe I had been so naïve to have willingly tied up everything I’d ever worked towards in joint names.
I
N MY MIND, by Matthew doing this, he had crossed a line from which we could never return. There was no consideration of any kind of reconciliation from either of us. It was time to file for divorce. Being a situation I’d not experienced before, I was unsure of what to do. Fortunately, for me, at least, a close friend had not long been through a divorce herself. Barker Gotelee dealt with matters on her behalf and she said they made, what was clearly, an extremely emotional and upsetting time, as bearable as possible. I gave them a call and was really surprised to have been put through to one of the solicitors, Nicola Furmston, straight away. She was so kind and understanding and immediately made me feel comfortable with using them. Shortly after this, I met with Nicola and we went through everything in detail. I explained the situation with the houses and how worried I was. Nicola told me that in the case of short marriages, the courts would usually aim to return both parties to the same position they were in when they August/September 2013 Vanilla
first entered in to the relationship. She also made it clear that, whilst I obviously felt that he was the guilty party and the reason behind the divorce, this would not alter the way in which the assets would be divided. Nicola assured me, however, that she would, of course, work hard to ensure I was given a fair settlement and this would include taking Matthew’s house into consideration.

FTER SEVERAL WEEKS of discussions, working closely with Matthew’s solicitor whilst the divorce proceedings were going through, Nicola and her colleague, Amanda, proposed a settlement that Matthew and his solicitor, thankfully, agreed to. I was so relieved that we weren’t going to have to battle things out in a courtroom. Whilst I was clearly still immensely upset about what he’d done, I certainly didn’t want
to make what was already an unpleasant situation any worse. The agreed settlement meant that our house had to be sold, but it also meant that I could leave with my share of what I’d contributed towards it, therefore, allowing me to buy another smaller property. My biggest fear had been that he would walk away with his own house, plus half of the equity in our joint home. Thanks to Nicola and Amanda, this wasn’t the case. A year on, I’m now settled in my own little cottage and building a new life for myself. I’m hugely relieved to know that Matthew and I were able to make a clean break and thankful that I came out of the marriage no worse off, financially, than when I went into it. I will remain ever grateful to Nicola and Amanda for their support throughout such a difficult time and for the fair outcome that was achieved. Q
