Benidorm through to ‘Accessible Destination Award’ finals by Andy Mansall

Later this year, Benidorm will compete with cities from across Spain to be proclaimed as the most accessible destination in the country. The resort has been chosen to represent the Valencian Community through an online poll conducted by the Thyssenkrupp Home Solutions organisation, which recognises cities that create tourism without barriers for people with mobility issues. In the first round of polling, which closed recently, Benidorm received 6,142 votes, far ahead of its nearest challenger Cullera, which only achieved 2,789. Prior to inclusion in the competition, which is now in

its fifth year, the city had to prove to Thyssenkrupp that it had a comprehensive and progressive accessibility plan enabling visitors with reduced mobility to move around and enjoy all the attractions without physical barriers. Benidorm city hall spokesperson, Ana Pellicer thanked residents for their support and stressed that the award organisers were happy that the resort met all the essential competition requirements. “In the last two and a half years, Benidorm has initiated numerous and continuous actions towards universal accessibility within the tourism and urban scene”, said Pellicer,

drawing particular attention to areas such as the removal of lugs and downspouts and the upgrade of traffic crossings adapted for deafblind users. She also explained that the city had been included in a guide to ‘Accessible Urban Getaways’, issued by the national state run association for people with physical disability (PREDIF). Fines of up to 500 euros for noisy Motorcycles POLICE are looking for the driver of a car who fled the scene after a crash which resulted in a motorcyclist losing a leg. The accident took place last week on Calle Llobarro in La Nucia, a quiet residential area in the Marina Baixa town. The 44-year-old motorcyclist had to swerve off the road after a dark Seat crossed into his lane. He then lost control, mounted

the kerb and hit a tree. His leg was badly fractured and he was also haemorrhaging seriously. He was transferred to the Intensive Care Unit of the local hospital where his injuries were judged as so bad that his leg had to be amputated. In a witness statement the victim said that the driver stopped briefly and then drove off,

despite the motorcyclist being in obvious distress. The wounded man cried out for help, which started dogs barking and eventually a local resident found him and contacted the emergency services. The vehicle that left the scene has been described as a dark Seat Toledo with an Alicante (A) number-plate. A dark haired youth was

driving and a blonde girl was also in the car. As well as looking for witnesses the police are checking CCTV footage from cameras in the area, public and private. The family of the victim have also asked that the driver turns himself in – they have speculated that if he had received help sooner their relative may not have lost his leg.

Authorities in a Marina Baixa town have begun a clampdown on noise pollution caused by loud motorcycles and scooters. A month long campaign, launched by the traffic department of Villajoyosa town hall, will target two wheeled vehicles breaking accepted noise levels within the municipality. A series of posters, leaflets and radio adverts asking motorcycle owners

Easy Come – Easy Go (but Adiós isnn´t always so easy) by Hugh Robertson

Divorce will never be easy. “For better or worse” they say,with presumably the “worse” bit being the divorce. Last week I wrote about divorce in the UK, so here comes the version of how they detango in Spain. For many ex patriots living in Spain the dream continues but sadly for others there is often a rude awakening. The property crash which hit Spain 10 years ago – and yes it was that long ago – brought great strain on many relationships as hopes, dreams and marriages were shattered. It was not only ex-pats who suffered but in this article I will focuson issues that need to be considered by them.I must stress that this article is neither intended to nor can constitute the advice of a qualified Spanish lawyer experienced in family law which must be taken in all cases before any action is taken.

In simple terms, anyone may obtain a Spanish divorce if one of the couple is a Spanish resident or a Spanish National. There are complex rules though.

On the plus side, unlike in the UK, under Spanish law there is no need or requirement to allege any cause or reason forthe divorce.There is no requirement for a couple to be legally separated and in the case of physical or psychological violence application can be made any time after the marriage, and if agreement , after three months.Spain has a no fault divorce process and there are two types, Uncontested and Contested. Naturally Uncontested Divorce (known as a Divorce by Mutual Accord )is the quickest and cheapest . It is availableon the basis that the parties have agreed all issues.The lawyer will prepare the key document which is the

‘ConvenioRegulador’ a formal statement which sets out the agreement reached on all of the following - The amount of cash to be paid as a lump sum and any future maintenance payable (to include any child maintenance) - If there are children of the marriage,custody (care and control) arrangements and the access rights of the other parent - Arrangements regarding the family home which may include its sale or deferment of sale until a child or children reach a specified age and payments to be made in respect of its upkeep. As you can imagine the above may be not only complicated but involve detailed negotiation which will

often need to be conducted between the lawyers acting for the parties. It is for the judge to be satisfied that the ConvenioRegulador has satisfactorily dealt with all issues and the power to give that approval and grant the actual divorce is for the judge alone. The more expensive resolution isnaturally, a Contested Divorce(known as a Contentious Divorce). In the absence of agreement,

one party applies for divorce and the process may take a few months or drag on for years with mounting cost.

The lawyers will attempt to negotiate settlement terms to enable a ConvenioRegulador covering all aspects as in an uncontested divorce to be presented to the Court.

Ultimately if such agreement cannot be reached it will be for the judge to make a determination and that will deal with any children of the marriage. The interests and well being of the child/children is the paramount issue and it is normal for younger children to be placed in the care of their mother unless it is shown not to be in their best interests. Again, visitation rights must be established and areas

in where the parents will share responsibility. The question of maintenance (alimony) will be decided where one party is by virtue of the marriage dependent on the other financially and will consequently suffer as a result of the divorce. It is for the judge to determine the amount relying upon the evidence produced. As a rough ‘rule of thumb’ the amount payable is likely to fall

between 15 and 40% of the paying spouse’s income. Determining true income can be a complex and delicate business if some or all of that income is in cash and undeclared for tax purposes. Dividing up the assets of the parties will generally depend upon the law of the Autonomous Region in which the parties are established. Obviously this is a critical matter for many people and the need for specialist advice is obvious. Generally the Court will rule that assets owned by a party before the marriage should be that person’s property. Assets acquired within the marriage or jointly in its contemplation will often be split in the proportions in which the cost was contributed in some regions. However the Courts will attribute financial value as a notional contribution reflecting homemaking and looking after the family, including of course childcare.In other regions the Courts split the assets acquired in the course of the marriage equally between the parties.

Another effect of divorce in Spain is that neither party retains the right to inherit any assets of the other.

In the early stages of the divorce process the parties do not necessarily need to be in Spain and much can be done by post although this can slow the process. However both parties should normally attend the Court hearing unless a specific power of attorney has been granted. This is something else to take advice on at an early stage. I must make a comment in conclusion. Whatever divorce law applies or court is involved, one thing is certain. The parties can save themselves a fortune in legal costs let alone emotional trauma if they can reach agreement on the issues between them.This may sound difficult but with good will and sometimes the helpof a mediator it can be achieved. Life is short – find peace as quickly as you can.

Finestrat choreographer a Eurovision winner! Last Saturday’s Eurovision Song Contest may have been a disaster for the UK and Spanish entries, but for one local dancer/ choreographer, the night couldn’t have gone any better. The UK’s entrant SuRie, who had to deal with a protester rushing onto stage during her performance of ‘Storm’, finished in 24th place, whilst Spain’s ‘Tu Cancion’, sung by real life partners Amaia & Alfred fared little better, ending one place higher in 23rd spot. However, local celebrity, David Bujalance, 34, who lives in Finestrat with his partner Santos, came up trumps by choreographing the dance routine for winning song ‘Toy’ by Netta for Israel. David is no stranger to Eurovision, as he has been involved in the contest on five occasions in the past, choreographing entries from Sweden in 2009, Romania in 2013, Azerbijan and Israel in 2015 and most memorably in 2016, when he helped the Russian entry ‘You are the one’, by Sergey Lazarev, which featured the singer, dancing on a wall, reach

third position. The choreographer, who has worked at both El Molino and Benidorm Palace in Benidorm, was in two minds when he was approached to work with Israel this year, as he has recently been undergoing treatment for cancer, “It was a difficult decision, because I am in poor health”, said David, “ but I could not let the opportunity escape and luckily I accepted”. The slightly bonkers Israel song, from quirky singer Netta, won with 528 points and featured a crazy chicken dance which stayed in the memory long after the performance finished. “I could say the chicken dance was my thing, but the truth is it was already in the video of the song before i got involved”, said the choreographer who worked with the three dancers accompanying the winner. David believes the key to success in the contest is to, “Seek

Best planting time is the autumn from about the middle of September onwards when you can expect temperatures to drop and rain to fall. All this is assuming that you are planting trees, shrubs or other perennials that you hope to keep going for a number of years. Annuals which will die after flowering will manage without special treatment as long as they are watered while vegetables for eating are something else altogether and will be dealt with separately. You should try to buy small plants that are balanced in growth with only as much above the pot as there are roots in the pot and preferably not growing in a peat or similar based compost. This tends to shrink away when dry leaving the

Home sales figures decline in March, seasonality partly to blame

The Spanish equivalent of the expression “born with a silver spoon in his mouth” is “born with a “barra” (loaf of bread) in his hand” which I find a rather amusing illustration that Spain doesn´t suffer from such intense class divisions (and tea addiction) as the Brits do. Not sure how tasty the bread would be though for Juanito. Lately I have been visiting “posh

schools” in the Costa Blanca. As in “private” schools or nonsensically called “public” schools in the UK (I think this confusing description stems from the introduction of non-religious schools). AnyhooI have been visiting these English language schools to do games workshops and sell signed copies of my book (shameless plug again “Gadgets Away – 100 Great Games” Available on Amazon) I am a proper “lefty” and have never approved of the private education sector. A level playing field seems fair to me.Secondly I feel that going to a comprehensive school gave me the ability to interact with people from all walks of life. When as an adult I started to meet “hoorays” I detested their over-confidence and the way that they would lounge back in chairs with their legs wide apart as if they owned the world. Is private school a good investment? The Social Market Foundation shows that children from fee-paying schools will have earned almost £200,000 more on average than state school pupils by the time they reach middle age. Going back to confidence though, exam results are not what makes young people employable; private schools teach people to interview well, debate well and be presentable. This is what state schools need to learn to do. Give confidence. Buthopefully not too much!

I was interviewed by an incredible snob who owned the company (called Henrietta of course) but I had prepared lots of ideas for comedy items for the hosts and demonstrated my knowledge of comedy. After the interview she confided in the double-barrelledfriend

Those in favour of private education in the UK believe it´s not what you know, it´s who you know. Henrietta had been to college with Madonna. I just remember wanting to learn. Figures show that the majority of ex-pats send their children to state schools in Spain, but naturally many ex-pat parents understandably feel that they have no choice but to send their children to international schools as otherwise their children (especially aged 7 or over) would be over-whelmed by new schools and new languages (let´s not forget Valenciano – I will write another article about that soon!)I am now convincedthat international schools fast trackbenefits that are not just about the kids. I visited the XIC in Javea on International Day recently, when parents turn up and

cook for everyone in their own national style. I interviewed many families who had really made major financial sacrifices to pay the bills for their children to go to “private” school, none of whom had any regrets at all, and for some of whom it was a necessity not knowing how long they would be in SpainAlso helped by the fact that as we all agreed the primary school headmaster Steve Jarmanis a real gem. “International Day shows what XIC is all about and that we are a true family” says Steve. “To see so many parents from so many different countries mingling, cooking and eating together, reflects the diversity of our school. With 27 different nationalities in such a small school, it fosters an amazing environment for children to grow up in. Children often arrive with no English or Spanish, different accents and cultures. Consequently, they are growing up with no prejudices.” Steve makes a very important point here. Patience and acceptanceare virtues that are the biggest ones that children need to learn. (Apart from Mum being the boss!) Richard Wijeratne,the long-time and very popular head of the very well run but bigger international school Lady Elisabeth (where I have met many amazing teachers) also commented that his new workplace seemed to him to be primarily about support

ALFAZ FANTASY FOOTBALL LEAGUE The last weekend of the Premier League gave the Alfaz Fantasy Football League a shed load of points and plenty of excitement, with the average score reaching 36 points, the highest scoring week since January. There were 6 Mid-Week games and a full Premier League at the weekend which contributed to the A.F.F.L. 42 goals,10 clean sheets,34 yellow cards and 1 red one which was Arsenal’s Greek centre back Mavropanos who was sent for an early bath by Referee Graham Scott. With this Season’s Alfaz Fantasy Football League rapidly drawing to a close and only the F.A.Cup Final to come it’s fair to say Darren’s team Daz XI are worthy winners as they have extended their advantage at the top to a massive 77 points over his mate’s team Joe’s Keith Lard F.C. who have replaced Pauline’s Vodka Army in 2nd place. Darren is an avid Chelsea Fan and also Manager of one of our top Restaurants in Albir Saritas. His team took over the Summit 12 weeks ago and have never looked like losing the top spot. It is the same at the other end of the table where Laura’s Legends dropped anchor weeks ago and have shown no signs of catching Reggie’s Rejects who are 91 points above them. There was plenty of goals this week going into our Golden Boot League

but it didn’t change things at the top or bottom. Last Season’s Fantasy League Winner Wayne is in line to pick up another Trophy this Season with his team 2 Years Running, Maybe who has an impressive 73 point lead over Daz XI. Down at the foot of this Division Laura’s Legends are only 2 points behind Reggie’s Rejects so with the Cup Final to come they could surprise us and move off the trap door. Pauline’s Vodka Army will definitely be picking up some silver wear as they clinched our Mark Carter Ladies Section roundabout Christmas time. With just one week to go, they have a tremendous 97 point advantage over 2 teams who are fighting for the Runners-Up spot. Rachel’s Mrs. Max & Paddy and Isabel’s team The Bluebells.No prizes for guessing who is at the bottom Laura’s Legends are 91 points adrift of Reggie’s Rejects. One League that will definitely be decided on the Cup Final next week is our U.K.T.V. SPAIN Junior League. At the moment Wade’s team Alli Barbar have climbed back to the top spot and left Robbie’s team trailing by just 8 points. At the other end of the scale, Gian Luca’s team Messi or Tidy have managed to get out of the relegation zone and left Teigar’s Tigers battling it out with Harley’s Ginger Ninjar. Top scoring team this week is our

Champions elect Daz XI who waded in with a tally of 83 points while the lowest score went to Bob’s team Thalassians who only manages to score 3 points. Both teams will go into our Monthly wine Draw.
