FILM BY DUBUQUE NATIVE UP FOR OSCAR By MARY STEGMEIR DUBUQUE — There’s a small bay off the coast of Taiji, Japan, separated from the public eye by high rock cliffs and a barbed wire fence. There, hundreds of thousands of dolphins have been slaughtered, their underwater cries heard only by other sea creatures. That is, until director Louie Psihoyos recently revealed the practice in “The Cove.” The Dubuque native’s documentary has been nominated for an Academy Award. “There’s a wonderful poem by (William) Blake which says: ‘You can see the world in a grain of sand,’” said Psihoyos, a former National Geographic photographer and founder of the Oceanic Preservation Society. “I think you can see the oceans in this one single cove by analyzing what goes on there.” From September through March, a handful of Japanese fisherman herd migrating bottlenose dolphins to the inlet. Trainers buy a few of the animals, and the rest are killed. The meat, much of which is used in school lunch programs, contains dangerous levels of mercury — a result of our use of fossil fuels, Psihoyos said. Tests of the Taiji population found that residents have 10 to 20 times the normal amount of mercury in their bodies. While working on the film Psihoyos, a vegetarian who eats seafood, PULSE: ISSUE 037 | 10
also discovered he had abnormally high levels of the chemical in his blood. “The ocean absorbs the CO2, making it incredibly acidic,” said Psihoyos (rhymes with sequoias). “And even in land-locked states like Iowa, where you get a lot of your energy from coal, fresh water lakes become toxic. It’s not just a Japanese problem, it’s a worldwide problem.” “The Cove” was inspired by the actions of Ric O’Barry, a former dolphin trainer who worked with the five animals that played “Flipper” on the ‘60s television program by the same name. After one of the show’s stars committed suicide in his arms by voluntarily closing her blowhole, he began a quest to free the world’s captive dolphins, creatures he considers to be intelligent and self-aware. For years, O’Barry had pleaded with the media to investigate Taiji’s dolphin trade. Before Psihoyos, 52, arrived in Japan, a handful of journalists from across the world tried and failed to document the killings. During the filming of the “The Cove,” the director and his crew used camouflaged cameras, underwater microphones and night vision devices to finally reveal the truth. “It’s not just a story about dolphins and what we do to them,” said Psihoyos, who now makes his home in Colorado. “It’s actually a story about humanity and what we do to the Earth.”
LONDON (AP) — The Beatles’ Abbey Road Studios has been officially declared a historic building, a move that will help preserve the cultural landmark that is a magnet for fans worldwide. The crosswalk outside the iconic north London studios draws tourists with cameras daily, and the facilities have also hosted Pink Floyd, Jeff Beck and Radiohead and are still popular with orchestras. But their cash-strapped owner EMI Group Ltd. says the studios have been losing money for years and has only recently shelved plans to sell them. Former Beatle Paul McCartney said he hoped it could be preserved, while English Heritage — the body that oversees buildings of historic interest — appealed to the government to name it a historic building. English Heritage spokeswoman Helen Bowman said the government’s move “has probably been sped up” by recent speculation over the studios’ future. In a statement, English Heritage Chief Executive Simon Thurley said the Georgian building housing the studios “acts as a modern day monument to the history of recorded sound and music.” “Some of the most defining sounds of the 20th century were created within the walls of the Abbey Road Studios,” he said. “It contains, quite simply, the most famous recording studios in the world.”

After tragedy, ALICE IN CHAINS celebrates a new chapter
Seattle rockers Alice in Chains looked like a wrap after the 2002 death of lead singer Layne Staley, ending a storied career that included hit singles, multimillion-selling albums and a Grammy Award.

“We’re having fun and we’re rockin’ it,” Inez says. “It’s a testament to our friendship that we wanted to do it. It was a record we didn’t have to do. None of us were losing our houses. But in a different way, we had to do it. It’s a process the three of us had to go through, and I’m glad we did.” Inez concedes that “Black Gives Way to Blue” was a difficult record to make. Walking into the recording studio without Staley was tough for the band. “He was a family member,” Inez says. “We run this band like family. It wasn’t just about his voice, but his personality. There was so much dark written about him. People don’t know he was nice and funny and loved life.”
The band auditioned DuVall and a few other singers, but it made sense to select DuVall, who had played in Cantrell’s solo band. The first song they attempted with DuVall was an oldie, “Love, Hate, Love.” “He made it his own,” Inez says. “He didn’t try to emulate Layne. That’s what drew us to him.” Rather than jump right into a new CD, the musicians decided to try out the new lineup with the acoustic tour. Inez says he told DuVall early on that the only way to win over fans would be at gigs, face to face and one at a time. “Fans sat there with their arms crossed, and he went for it,” Inez says. “A couple of songs and their arms came down and, by the end of the show, their arms were up in the air. He won them over gradually. That solidified the band to later go in and do the record.” Inez calls the new album a mix of vintage and new Alice in Chains. The band will play about a half-dozen of the “Black Gives Way to Blue” songs at concerts in its 2010 North American tour and also will resurrect many of the hits made famous with Staley. Compiling a set list for each show is a monumental task for the band. “It’s a good problem to have so many songs,” Inez says. “We didn’t realize we had so much. We all sit there before the show and go down the list and decide which are the favorite kids we have to kill off the set list.”

BRAGGARTS NEVER WIN In all likelihood, convicted murderer Paul Powell would have been sentenced to life in prison for his 1999 crime, but he could not resist gratuitously ridiculing the prosecutor. Powell’s original sentence of death was overturned because of a technicality in Virginia law: The “aggravated” circumstance in a murder that warrants the death penalty must be committed against the actual murder victim (whereas the prosecutor had proved only that Powell had also raped the victim’s sister). Powell assumed that the prohibition against “double jeopardy” thus ruled out the death penalty and so decided to gloat, calling the prosecutor “stupid” and taunting him with details of his crimes. For the first time, Powell admitted that he had also raped the murder victim. That was evidence of a new aggravated circumstance (i.e., no “double jeopardy”), and the prosecutor obtained a death sentence. In January 2010, the U.S. Supreme Court rejected Powell’s appeal. FBI’S ‘OFFICIAL’ REQUESTS In January, the Justice Department’s Inspector General released a long-anticipated report detailing the FBI’s post-9/11 corner-cutting in obtaining individual Americans’ phone records. Federal law permits such acquisition only with a “terrorism” subpoena (“National Security Letter”) unless the FBI documents emergency (“exigent”) circumstances to a telecom company. The Inspector General found that, from 2002-2006, the FBI had representatives of three telecom companies set up in the FBI unit so that agents could request phone records orally, without documentation, and in some cases merely by writing the requested phone numbers on Post-it Notes and sticking them on the telecom employees’ workstations. Some of the acquired records were uploaded to the FBI’s database. INEXPLICABLE Police are still baffled by how Gregory Denny, 37, was able to “deport” Cherrie Belle Hibbard from her home in Hemet, Calif., in January, back to her native Philippines. According to Hemet police, Denny, with a gun and fake U.S. Marshal’s badge and shirt, knocked on Hibbard’s door and convinced her that he was there to escort her to the airport and out of the country and that Hibbard’s husband had to buy her the ticket. Denny then accompanied Hibbard through airport security and put her onto a flight. Upon questioning by police later, Denny apparently remained in character, continuing to insist that he is a Marshal. Denny was arrested on suspicion of kidnapping, impersonating a peace officer and several other charges.

N E W Y O R K — A rare copy of the first comic book featuring Superman sold Monday for $1 million, smashing the previous record price for a comic book.
A 1938 edition of Action Comics No. 1, widely considered the Holy Grail of comic books, was sold by a private seller to a private buyer, neither of whom released their names. The issue features Superman lifting a car on its cover and originally cost 10 cents. The transaction was conducted by the auction site ComicConnect. com. Stephen Fishler, co-owner of the site and its sister dealership, Metropolis Collectibles, orchestrated the sale. Fishler said it transpired minutes after the issue was put on sale at around 10:30 a.m. Eastern time. He said that the seller was a “well-known individual” in New York with a pedigree collection and that the buyer was a known customer who previously bought an Action Comics No. 1 of lesser grade. “It’s considered by most people as the most important book,” said John Dolmayan, a comic book enthusiast and dealer best known as the drummer for the rock band System of a Down. “It kind of ushered in the age of the superheroes.” Dolmayan, who owns Torpedo Comics, last year paid $317,000 for an Action Comics No. 1 issue for a client. That purchase is considered the “official public record” for a comic book sale, said Mark Zaid, the marketing director for the Comic Book Collecting Association, which was launched Monday. There have been other private sales in the $300,000 to $450,000 range, he said. Monday’s copy fetched a much higher price because it’s in better condition. It’s rated an 8.0 grade, or very fine, on a scale that goes up to 10. Dolmayan said he didn’t buy this copy but he wishes he could have.
“The fact that this book is completely unrestored and still has an 8.0 grade, it’s kind of like a diamond or a precious stone. It’s very rare,” he said. There are only about 100 copies of Action Comics No. 1 believed to be in existence, and only a handful have been rated so highly. It’s rarer still for those copies to be made available for sale. “The opportunity to buy an unrestored, high-grade Action One comes along once every two decades,” Fishler said. “It’s certainly a milestone.” The sticker shock was astounding to Fishler, nevertheless. “It is still a little stunning to see ’a comic book’ and ’$1 million’ in the same sentence,” Fishler said. “There’s only one time a collectible hits the $1 million threshold.”
