The Greater Toronto Area (GTA) pre-construction market is incredibly active this fall with a number of new launches and groundbreakings occurring weekly. We’re covering the market in print, online and on social, daily, and as you’ll see in this jam-packed issue, condominiums continue to dominate the market. Thanks to plunging interest rates over the last year, demand continues to outnumber the supply of more affordable housing, such as condominiums, however, townhomes and well-priced semis and detached homes outside of the city continue to sell quickly, too. One of the many reasons the GTA continues to be a very tight and busy housing market is the incredible selection of mortgage products which offer low mortgage rates. Remaining at almost record-low levels, these favourable rates, at least for the moment, are sticking. I would advise any savvy homeshopper to lock in now, even if you’re only shopping for a home or condo and not at the buying stage just yet. That way, all the major paperwork is done, and when it’s time to buy, there’s no hesitation. As with any major purchase, it is important to do your homework before you venture out to shop. Know what you need and what you want. Visit a lending institution or a mortgage broker to pre-qualify for a mortgage. Know the answer to the following questions beforehand: • What monthly payments would you be comfortable with? • How much money do you have to put down? • Will you be using your savings? RRSPs? A government incentive program? Once you have determined the maximum mortgage you qualify for, be sure to ask how long the financial institution is going to protect your interest rate. If mortgage interest rates drop, your lender should allow the rate of your mortgage to drop as well, and best of all, your rate should stick if there is a rate hike. Condo living is all about efficient use of space. Retailers like IKEA promote their compact, multifunctional furniture and other space-saving solutions specifically to condo owners who need to figure out how to pack all their essentials into a limited footprint. If you’re planning the future layout of your condo based solely on the marketing materials however, you might be in for a surprise. There is a chance that the 14  New Home + Condo Guide  |  Sept. 14–28, 2019

floor space may be a little less than expected. Dimensions are a common issue, often discovered when you show up with your trusty tape measure to figure out how to get all your furniture into a 600-square -foot unit. To understand why your small condo might seem even smaller, it’s important to understand how floor space calculation works. Let’s begin with the fact that builders aren’t required to include the square footage of condo units in their materials. It’s only if they voluntarily choose to include the information in the Agreement of

Purchase and Sale (APS) that they need to follow certain calculation guidelines. In fact, what you may see in the sales materials is a standard clause along the lines of “Actual usable floor space may vary from the stated floor area.” Tarion’s Builder Bulletin 22 is an educational tool for new homebuilders that lays out the rules for calculating floor space. When calculating area that meets an exterior wall or corridor wall, the measurement starts from the exterior face of the outside wall. New book and petition addresses housing crisis Concerned about the rising costs of homeownership in Ontario, real estate professional R. Scott Davie (right) is helping to raise the red flag in a timely book entitled The GTA Affordable Home Ownership Crisis. “With this in mind, the reason I wrote the book is because I wanted to make a significant difference in solving the GTA affordable homeownership crisis,” says Davie in an interview with New Home + Condo Guide. “I truly believe that the solution begins with the public understanding of why the crisis is so important, what the drivers of the problems are, and the pathways to the specific solutions.” His goal is to raise 5,000 signatures in support of efforts to find solutions to affordable homeownership in the GTA and submit the petition to all levels of government. “This is why I undertook this nonprofit information campaign,” says

Davie, who like many Canadians, believes that the majority of the middle class count their home as their largest asset. “Without public understanding, I do not believe that the government, non-government organizations, and developers will have the ability, or the political will, to make the needed changes,” he said. “As a 30-year veteran realtor and as a father, I am concerned about the next generation’s ability to afford to own their own home in the current environment of rising prices.” For details, visit Davie’s website at affordablehomeownership.ca

Bank of Canada holds rate at 1.75 % Don’t expect an interest rate cut anytime soon. The Bank of Canada announced last week that it is holding its overnight rate at 1.75 per cent. Economic growth in the second quarter was strong and exceeded the Bank’s July expectation, said a press release from the Bank, although some of this strength is expected to be temporary. “The Bank noted the rebound in the mortgage and housing market, fueled by the current

low interest rate environment,” says James Laird, co-founder of Ratehub Inc. and president of CanWise Financial mortgage brokerage. “They don’t seem concerned with a possible return to an overheated housing market, since the mortgage stress test encourages manageable household debt levels. This throws some cold water on the prediction that we could see a rate cut as soon as next month,” says Laird.

A few weeks ago I wrote about the lessons learned from BILD’s Housing Tour of Tokyo. Our friends at the Ontario Home Builders’ Association (OHBA) conducted their own housing tour this past spring in Copenhagen, Denmark and Malmö, Sweden with an objective to cross-pollinate innovative ideas in terms of sustainability, urban design and architecture. Here are some of the key learnings from their trip. Don’t 20  New Home + Condo Guide  |  Sept. 14–28, 2019

be afraid to make mistakes when it comes to innovation. Cities are for people, and be daring and creative when it comes to architecture and infrastructure. Taking risks must be part of the Nordic DNA as both the public and private sector in Copenhagen and Malmö are quite innovative when it comes to planning and design. Innovation does not occur from doing the same thing repeatedly. The Danes and Swedes are not only unafraid to make planning or design mistakes; they practically welcome them as part of the evolutionary process of city building. When the city of Malmö introduced cycling and pedestrian

focused infrastructure, they didn’t have a debate, they didn’t run a pilot, and they didn’t get bogged down in red tape. They just did it. If it worked, it worked. If not, they’d try something else. Pioneering urbanists like Jan Gehl have helped lead a 50year transformation of creating cities for people. Gehl believes in sustainable cities in which, through their public spaces, people are invited to have a unique and diverse life. Infrastructure like stormwater management isn’t very interesting, but the Swedes are changing that. Stormwater management practices help minimize the impact of rain and snow runoff flowing into lakes and streams. Typically, in the GTA we see hard concrete culverts, sewers, and in newer suburbs, large stormwater management ponds. An emerging trend in Sweden is a natural green infrastructure through “low impact development” to deal with stormwater runoff. These features were clearly well thought out and incorporated as part of the 22  New Home + Condo Guide  |  Sept. 14–28, 2019

design, and ultimately presented as a public amenity across newly built communities. Danes also don’t appear to be afraid of wild and daring design. Beauty is certainly in the eye of the beholder, and while some of the buildings visited were spectacular, others might be a little too avantgarde for our taste. In Canada, we tend to have a rather conservative appetite for architecture. This is starting to change in Toronto with more developers commissioning international architects and some bright young local firms growing in confidence. Both the private and public sector share in the responsibility to bring confidence and flair to buildings in the GTA. On the public sector side of the equation, an abundance of urban design guidelines are often treated as ‘regulations’ rather than ‘guidelines’ and strict zoning by-laws can literally shrink-wrap a site in terms of very specific set-backs and

heights, thereby limiting creativity. Many of the most interesting buildings visited would not likely be proposed by a private sector developer here, and even if they were, they would never make it through the approvals process without being completely watered down. Let’s be bold and take the lead from our Scandinavian friends and bring some innovation, creativity and flair when it comes to architecture and urban design. It took a While, but the Single-Family market iS Finally Back!

In April of 2017 the market for new single-family housing in the Greater Toronto Area (GTA) went a bit nuts, prices were up 45 per cent year-over-year, and unsold supply dipped below 1,000 units, the lowest level of inventory in over 20 years. Earlier that year, prices growth had topped 25 per cent annually and investors came out of the woodwork. There hadn’t been investor-buyers of lowrise housing for many years, but they hoped to capitalize on the bubble-like conditions in the market, which sent prices from up 25 per cent annually, to up 45 per cent annually in a few short months. After seeing this huge jump in prices, the Liberal government introduced a “Fair Housing Plan” intended to cool the market. It did just that, and new lowrise sales ground to a halt. As a result, 2018 is referred to as “the lost year” for single-family housing as sales were nonexistent. The average unsold new single-family home declined from $1.32 million at the peak to $1.14 million at the end of 2018. Part of what contributed to the total lack of sales and the price drop was many developer’s conscious strategy of “protecting their closings.” What exactly does that mean? Because so many 34  New Home + Condo Guide  |  Sept. 14–28, 2019

purchasers bought at the top of the market, there was worry that these purchasers would not be able to secure a mortgage for their new home when construction was finished. Many wouldn’t be able to sell their existing homes for as much as they anticipated, and lenders could conclude that their new home wasn’t worth what they paid, requiring them to make an even bigger down payment. If developer’s launched new phases at lower prices, it would make it just that much easier for lenders to know how far the market had fallen, and further increase the risk of missed closings and future litigation.

This results in a somewhat vicious cycle. No one launches new product, but new launches drive sales. So, no new product, no uptick in sales, and market reports show sales are very low. Because sales are very low, developers are scared to launch, buyers are scared to buy, and nothing happens in the market! The developers that were opening new single-family sites in 2018 were concentrating on firsttime buyers without an existing home to sell and introducing small product at enticing price points. This more affordable product reduces the average price in the


market, making it look like prices are slumping, when the reality is the composition of the sample is changing. It took a year and a half before we finally started to see a recovery in this downward spiral. According to the Altus Group, there were 566 lowrise house sales in July 2019, a 136 per cent increase annually. When looking at year-to-date figures, sales are more than double last year’s total, up 129 per cent. Prices are still adjusting, with the average unsold home at $1.09 million, down 4.5 per cent from July of 2018. However, a lot more new product is going to start hitting the market soon, as the need to protect closings no longer exists, because almost all of the 2017 sales have now been completed. We can see this through data from CMHC. The average absorbed singlefamily house price as tracked by CMHC was up 16 per cent annually in Q2-2019. This is a curious result considering the before-mentioned major slump experienced in the

new single-family market in 2018. However, it is important to note that these CMHC figures track the price at CLOSING, and not when the agreement of purchase and sale is signed, indicating that the market lag is very long between the actual sale and the completion and occupancy of the home. With single-detached and semi-detached properties taking 12 months to build on average per CMHC, the data suggests that many low-density housing units were spending one to 1.5 years in pre-construction prior to the commencement of the building process. This is a lot of information to take in if you’re in the market for a new single-detached, semidetached or townhouse. Some of you may be worried that the market is still adjusting, but it is important to note that just because the average price is declining, it doesn’t necessarily mean that demand is slowing, and vice-versa. It appears that the worst of the market slump is over,

and developers have come to accept the new values in the market. I suggest to all prospective buyers to do a lot of your own research, work with an experienced realtor to walk you through the different sales offices, floorplans, elevations, and merits of the project location. Look into the track record of the developer as well. There are a lot of opportunities to buy — choose wisely. Good luck.

So now it’s the end of the day. You lean back in your big chair. You light that big fat doobie you’ve been thinking about all day at work and now you can really chill. Wait! There is a knock on the door. You get up to answer it and it’s condo security. “I am sorry ma’am, there is a rule, no smoking of cannabis in this building.” Oh my, you own the unit, yet… The Cannabis Act (the “Act”) came into effect on Oct. 17, 2018. The purpose of the Act is to strictly regulate, restrict access, and legalize cannabis in Canada. It creates a regulatory and legal framework for controlling the production, possession, sale and distribution of cannabis in Canada. However, it is up to the provinces and territories to determine how cannabis is distributed and sold within their jurisdictions. In Ontario, you must be 19 years of age and older to buy, possess, use, and grow recreational cannabis. You are able to have a maximum of 30 grams of dried cannabis in public at any time and allowed to grow up to four cannabis plants per residence. The real question is how does this apply to ownership and use of your condominium unit? Not surprisingly, there are different interests at stake. On the one hand, there are the unit 38  New Home + Condo Guide  |  Sept. 14–28, 2019

owners and residents who believe it is part of their “quiet enjoyment” to be able to smoke in their units and common areas. On the other hand, there are those who believe smoking would impede on their “quiet enjoyment” insofar as it

creates a nuisance due to secondhand smoke and odours. There are many safety and other arguments for and against cannabis use. The answer for each condominium board will be based on the democratic choice of the


owners in the building expressed through the Board. If the owners decide they want a cannabis-free building, the condo corporation has two options. First, the rules may be amended. This is the easier option. Pursuant to Section 58(1) of the Condominium Act, 1998 (“the Condo Act”), the board may make, amend or repeal rules for the use of the units, the common elements or the assets of the corporation. This is done in two ways. Subsection 58(1)(a) allows for the promotion of safety, security or welfare of the owners, the property and the assets. Subsection 58(1)(b) allows for the prevention of unreasonable interference with the use and enjoyment of the units, common elements or the assets. Reasonableness must prevail according to Subsection 58(2) and one may argue the rules would be consistent with the Condo Act. As per Subsection 58(7), a rule becomes effective 30 days after the board has given notice of the rule to the unit owners.

This is true unless the unit owners requisition a meeting within the 30 days after notice was provided. Second, the declaration may be amended. Pursuant to Subsection 7(4)(b) of the Condo Act, the declaration may contain conditions or restrictions on the occupation and use of the units and common elements. One may suggest restrictions on recreational cannabis would fall under this provision. However, this is not easy to achieve. According to Subsection 107(2)(e), the condo corporation may amend the declaration if 80 per cent of unit owners approve and consent to the proposed amendment. What does this all mean?

Condo corporations have the choice to further regulate the use of recreational cannabis within their units and common elements. When buying a condo unit, this is something to consider. In the end, if you are a smoker of any kind, you need to really look into whether you can use a unit you buy in the way you want. Having reviewed Status

Certificates, it is becoming commonplace that rules are being amended to prohibit smoking and cultivating recreational cannabis. There is normally a medical cannabis exemption. However, not all Status Certificates and condo corporations are the same. How important this is depends on where you fall in the competing interests spectrum previously mentioned. Always ensure your offer includes the opportunity for your lawyer to review the Status Certificate. Happy home hunting!!!

in living colour Designer Rebecca Hay shares how colour inspires her decorating style, even in her own home!

As a designer, I love to infuse a healthy amount of colour in the spaces I design. And, when it came to decorating my own family home, I made no exceptions. With two young kids and a small furry dog, I wanted a space that felt friendly, yet looked polished — a place for neighbours to gather and kids to play. convey. Is it a calm, relaxed space or a warm, inviting space where dinner parties evolve? You don’t need a degree in psychology to figure out which colours are right for you. Trust your gut, and you will never go wrong, but it’s important to be mindful of the mood and energy you are trying to evoke. There’s no surprise that yellow is a cheerful colour that promotes optimism. While blue is associated

with tranquility, it also happens to be the preferred colour by men. I incorporated a little bit of navy for the men in my own home! For the living room, I wanted it to be bright and energizing as this is the main sitting and socializing area of the home. The drapery fabric was my inspiration and starting point. I knew we wanted to energize the space with yellow. We already had the retro navy chairs to work with, so I chose to balance the navy of the chairs with bright yellow custom drapery. Colour is an integral element to creating the right mood. When decorating with colour, it’s important to balance any bold colours with lots of neutrals. A little trick that I like to use is the 60-30-10 rule. When decorating a particular room, divide the colours into percentages: 60 per cent of a dominant colour, 30 per cent of a secondary colour, 10 per cent of an accent colour and you will never go wrong. The dominant colours in our living/dining space are beige, yellow and navy. I also chose to complement the blues with hints of orange in the living room. Adding a few “bonus” colours adds further interest. I found an old traditional wingback armchair on the curb once. It was in desperate


need of TLC, and so I had it stripped down and recovered with a piece of bold contemporary orange fabric. It’s cosy, warm and inviting while adding some traditional sophistication to the space. Repetition is key to any successfully designed home. By repeating a colour multiple times in a space, it feels purposeful and comforting. We repeated the orange in the custom toss cushions and with smaller accessories. By having the same colour layered throughout the space, it creates a unified design. It’s a family space that is now an inviting and fun place for social gatherings or curling up by the fire. It’s proof that by taking the plunge and designing with colour, you can create a space that is visually beautiful, intriguing, and sometimes surprising.

Find out how you can learn to love decorating with colour There’s a definite art to bringing a burst of colour into a home’s neutral palette. One of the most common hurdles we face in our profession as interior designers is fear of colour. Honestly, we’ve heard it all: “It’s too bold; it’s too trendy; it’s too... colourful.” To all those excuses, we say, ‘you’re not afraid of colour; you’re just scared of the wrong colour!’ With that being said, here are some tried-and-true designer tips for choosing the perfect tone and shade, and how to incorporate it into your interiors to make your neutral rooms pop. So, where do you start? Colour has been proven to have psychological effects on people. As you dive into the pool of paint swatches, think about how your top colour choices make you feel, and how you want to feel in your space. The same room can have a completely changed ambience in a new hue. For example, cool colours such as blues and greens draw out feelings of tranquillity, reliability and calmness. In this small but sweet urban space, we played with a combination of colours to bring out the homeowners’ sense of

youth and modern fun. High ceilings, huge windows and neutral walls play perfectly with the complementary palette of warm greys peppered with pops of coral, blue and green – and a vibrant sunny yellow taking the spotlight. To create a sense of continuity through the home, we used the same sunny shade of yellow in every room, albeit in small doses. It instantly draws attention and lends a wonderfully warm hint of sunshine to the otherwise cool and contemporary backdrop. The


cosy living room enjoys some yellow sofa cushions and some subtle, strategically placed, sunny accessories tucked away on the bookshelf. As you move through the kitchen, a yellow tea kettle perched on the countertop is just enough to catch the eye as you pass through. In the bedroom, we echoed the same shade in some pillows and a playful pillowcase that picks up pops of yellow. A modest sitting area is inviting and instantly alluring, though you may not immediately know why. (Hint: it’s definitely the yellow!) We even carried our colour theme into the great outdoors, onto the balcony barbecue area, where a couple of yellow cushions invite sunny thoughts, even on cloudy days. It’s easy to introduce colour into a neutral space, despite common fears. Play around with different hues before you commit and remember, colour is subjective. You make the rules!

Adjustable-rate and fixed rate mortgages There are generally two types of conventional mortgages – a fixed-rate and an adjustablerate mortgage. An adjustablerate mortgage means the interest rate can change over the term of the loan. A fixedrated mortgage simply means that the interest rate stays the same through the entire term of the mortgage and is “locked in”.

Assessed value

In addition to the actual price of a home, there are also closing costs, which will typically make up about two to five percent of the purchase price, not including the down payment. Examples of closings costs include the mortgage processing costs, title insurance, and excise tax, and legal fees.

Freehold ownership

This is how much a home is worth according to a public tax assessor who makes this determination in order to figure out how much city or state tax the owner owes.

Condominium ownership is real estate that is independently owned and sellable, but the owners of the individual units also collectively own the common areas, amenities and utilities which are managed collectively by the owners as outlined in the Ontario Condominium Act.

Gross debt service ratio The percentage of your gross monthly income that housingrelated payments (mortgage, property taxes and heating) eats up. Depending on your situation, to qualify for a mortgage, your GDSR should be 39 per cent (or less) of your gross monthly income.

Closing refers to the meeting that takes place where the sale of the property is finalized. At the closing, buyers and sellers sign the final documents, and the buyer makes the down payment and pays closing costs. It is advisable to have a lawyer facilitate closing.
