HAVE YOU BOUGHT, or are considering buying, a new home and want to build a fence, shed or deck or otherwise spruce up your residence? Here’s why you might want to check your property boundary first. A recent analysis conducted by Krcmar Surveyors Ltd. showed that about 49 per cent of residential properties in the Greater Toronto Area, for example, have boundary discrepancies with significant potential to cause disputes between neighbours. Horror stories of feuding neighbours, litigation nightmares and tens of thousands of dollars in legal costs are not just the stuff of Hollywood movies – it really does happen. And yes, even with new homes. Sometimes, it’s just difficult to tell where one property ends and another begins. “It’s not as easy as one would think, in a muddy construction zone with no fences and rudimentary driveways, curbs and roads to delineate land parcels,” says Sasa Krcmar, executive director of Krcmar Surveyors Ltd., whose company has helped launch protectyourboundaries.ca, a site designed to help homeowners prevent and resolve property boundary issues. Although legal iron bars are set to mark out each lot prior to construction, they often get knocked out, moved or buried during the building phase. “Many homeowners, naturally and incorrectly, assume that the wooden 8 YPNEXTHOME.CA

stakes that dot the perimeter of their property represent the boundary, and use them as a guide to start planting a hedge or put up a fence,” Krcmar told New Home & Condo Guide. “However, these wooden stakes are generally used for site grading. And while they are likely located near the property line, they can’t be relied upon to determine the legal boundary.” Here, then, are a few tips for new-home owners to avoid property boundary issues. » Get the Surveyors Real Property Report: Your property boundary will be recorded in the Surveyors Real Property Report (SRPR) that is performed after the foundation walls are poured (approximately a foot above grade) and the soil is backfilled around the home. The SRPR is your official documentation of your building location and the property

» Protect the iron survey bars that define your property: Protect the iron survey bars that define the corners of the property. They are legal monuments that provide the most important evidence of your property boundaries. Don’t remove or move them, or allow others to. » Be a good neighbour: Be a good neighbour, while at the same time ensuring that your neighbours don’t establish a pattern of using part of your property for their routine activities. » And, if all else fails: Visit protectyourboundaries.ca, where, for a cost that varies depending on the surveyor (usually $200 to $300), homeowners can find their exact property boundaries.

Understanding the agreement Buying a new home offers an opportunity to get exactly what you want. It can be a dream come true and an investment for the future – but it’s also a legal transaction. The term “get it in writing” has never been more important. Your contract outlines everything your new home will have in it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms between you and your developer and/or builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon.

Since building a home is much more complicated than a resale transaction where the home already exists, there is no set Agreement of Purchase and Sale or standard contract. Builders often prepare their own agreements so contracts can vary. Before you sign a contract, review it carefully and ask questions to make sure you fully understand it. Take it to a real estate lawyer. Once it is signed, it becomes a legal document, so seeking the services of an experienced lawyer is an important step toward ensuring that your dream home becomes a reality.

WITH MOVING COMES PACKING, and

with packing comes decisions. Some people want to pack their own items, while others prefer to leave the task to a pro. There are, of course, advantages to each approach, so it is important to weigh the pros and cons. The Professional Packer Most who choose to pack themselves do so because it saves money. This is true only if your items make it from Point A to B in one piece. Moving companies will not be responsible for items damaged due to your poor packing skills. The most critical element in packing is taking into consideration how far and long the items will remain in the boxes during transit. Consumers often underestimate just how much jostling their items will endure on the road. Accessories like lamps may seem to be packed well, but may shift inside the carton and break or chip as a result. Professional packers make it their business to know what is best for various categories of items, depending on the size and distance of the move, and they pack accordingly. They can also provide tips on how to mark your boxes for ease of unpacking, and advise on the items to pack last and therefore, unpack first. Having your mover pack your belongings offers the peace of mind in knowing that if the damage happens, your possessions will be repaired or replaced. C14 YPNEXTHOME.CA

The DIY Packer If you are willing and able to pack yourself, ensure you have the proper materials and containers to help with a successful move. Although you can obtain boxes from places like grocery stores, check with your mover, who may sell proper packing materials that will save you work and worry. There are also significant considerations to keep in mind, such as not packing explosive or flammable items. Your list of essentials will include tape dispensers, packing paper, markers, pads, blankets, bubble wrap, and or course, there are many sizes and strengths of boxes available.

A 1.5-cu.-ft. box is often referred to as a book or record box. It’s fairly small and is designed to hold small, heavy items like food jars or cans, flatware, CDs and the like. The next size up is a lamp or lamp shade box, which is three cu. ft. in size. The sizes go up from there, to 4.5 and six cu. ft. for lighter objects like pillows. Whether you choose to pack your own items or have your mover do it, be sure you choose a company with a solid track record for providing topnotch service. IT’S NO SECRET that one of the most enjoyable aspects of shopping for a new home is touring the builder’s decorated models. A well-designed model can help you envision living within its walls, as well as providing excellent inspiration for the decoration of your own space. In these ways, models constitute a valuable resource for purchasers. On the flipside, builders are well aware that model homes are one of the most powerful selling tools at their disposal. It’s clearly in their interests to dress these homes up to the nines – both to increase their appeal, and to encourage purchasers to splurge on the featured upgrades. They’re banking on an emotional response, and they usually get one. In order to stay objective, what should you be looking for when touring a model home? With the recent proliferation of television shows about staging and “flipping” homes for sale, you’re probably aware that there’s a real science to creating alluring spaces. Through judicious use of colour schemes, mirrors and wellproportioned pieces, decorators are able to make homes appear larger and more luxurious. But it’s the lavish application of upgrades that can be really misleading. Many models feature a laundry list of stunning decorating options: hardwood and slate flooring, stone fireplaces, intricately tiled steam showers and well-finished basements. On the home’s exterior, stone may be substituted for brick, elegant front C16 YPNEXTHOME.CA

doors installed and the lawn lushly landscaped. The accumulated cost of so many high-end features can run upwards to over $250,000 in some cases pending the type of housing product you are viewing. It’s easy to imagine losing perspective at the prospect of living in such an incredibly appointed home. That’s why it’s crucial to have a grasp on which features are standard and which are upgrades. Don’t be shy: ask the sales representative to walk you through the home and have them write down exactly what is upgraded, and at what cost. If the builder has a design centre, it should be simple to compare standard selections with available upgrades. Go over the standard specifications with a fine-toothed comb, so that you understand exactly what is included in the asking price; ask for a menu of upgrades with clearly marked pricing. Next, take this information home with you and consider carefully. Will this upgrade add value to my home when I sell it in the future; will it increase my home equity? How much will this feature enhance my lifestyle? Can this feature be easily added at a later date?

Be careful not to “over-upgrade” your home. This may seem counterintuitive but, when it comes to resale value, it’s not necessarily an advantage to own “the castle in the neighbourhood.” Often, those buyers who can afford a spectacular home desire an equally spectacular neighbourhood. As a general rule, upgrades that recoup their initial expense include hardwood floors, fireplaces, finished recreation rooms and double showers in master ensuites. But above all, keep to your budget; you won’t be doing yourself any favours by overextending yourself financially. Tarion aims to provide greater access with a virtual 2016 annual public meeting IN A HISTORIC FIRST, TARION

Warranty Corp. is holding its 2016 Annual Public Meeting on May 31 as a webcast. This will provide unprecedented access to residents across the province, including new home buyers and new-home owners, who have an interest in Tarion’s work. Beginning on Tuesday, May 31, at 7 p.m. members of Tarion’s corporate leadership team will be providing an update on the warranty, policies and processes over the last year. The Tarion ombudsperson will also present his report for 2015. After the formal presentations, a live question and answer period will be conducted. Stakeholders from across the province are encouraged to send in their questions in advance of the meeting by visiting research.net/r/APMQA2016 “Holding a virtual Public Meeting makes sense,” says Howard Bogach, president and CEO of Tarion. “After listening to feedback from the public, reviewing the cost benefits and recognizing that we can reach so many more consumers, we made the decision to web cast this year’s meeting. In the past, most participants were from the Greater Toronto Area, and only a few new home owners came from outside the city – some having to travel for many hours. Since we provide consumer protection to new home buyers across the entire province, it’s important that our Annual Public Meeting be similarly accessible.” This new format is consistent with improvements Tarion has made to the warranty process over the years. Moving to online channels has significantly increased home buyers’ satisfaction with the warranty process as they find it more convenient and accessible. It also allowed us to respond to many individual questions well in advance of the meeting and to connect with those unable to attend. This year, Tarion plans to post a recording of the meeting on its website after the event. According to Siloni Waraich, Tarion’s vice-president of stakeholder engagement, “Over the years, Tarion has continuously sought new ways to expand our outreach, and interact with all our stakeholders. Earlier this

year we held our fist webcast to home buyers in the London area, and received positive feedback from attendees. Evolving our Annual Public Meeting into a virtual event and posting a recording on our website will make this meeting more accessible to the various groups that Tarion serves across Ontario.” Members of Tarion’s leadership team will respond to a combination of presubmitted and live questions during the web conference. A team of Warranty Services Representatives will also be on hand to follow-up on individual questions about the warranty. THERE’S AN OLD JOKE in some circles that new-home buyers spend more time researching their next wireless device than they do a new home. Well, those days are over – or they should be, if you want to avoid a homebuying gong show. New homes and their warranty coverage are increasingly in the news these days, whether because of rising prices or other challenges, and are the subject of some debate. And not all provinces handle new home warranties the same way. In Ontario, the provincial government empowers Tarion Warranty Corp. as the sole new home warranty provider – the primary backer of about 50,000 new homes every year. Not everyone agrees with this approach, saying consumers should have more choice in who provides such coverage. In BC and Alberta, the situation is very different – about a half-dozen companies in each province provide new home warranty coverage. Should your new home warranty be any different than the insurance business, where consumers can contract their own car, home or medical coverage? Or should it be any different than when you buy a new car, and the warranty is provided by the manufacturer, or an affiliate thereof? Interesting questions, indeed. The importance of warranty coverage became frontpage news in Toronto recently when one builder was at risk of being de-registered by Tarion because of concerns over its customer service, high number of warranty claims and financial position. The company recently announced it had initiated restructuring proceedings under the Bankruptcy and Insolvency Act (Canada). Naturally, such developments worry new-home buyers, whether they’ve just put down deposits or have already moved into their new homes and expect warranty coverage. Rest assured, new-home buyers, Tarion still has your back. The status of the builder does not affect your warranty rights. “If the homebuyers receive a completed home, they will also receive the three warranties that come with that home – the one-year, two-year and seven-year warranties,” Tarion President Howard Bogach told New Home & Condo Guide. “This is in addition to possible delay compensation.

If buyers do not receive their home, their deposits are protected under the warranty up to a certain amount. For freehold homes, it is $40,000. For condominiums, it is $20,000 (condominium deposits are also protected by the trust provisions of the Condo Act, so condo buyers should receive their full deposit back). The bottom line, dear homebuyer, is that no matter where in Canada you’re located or who provides the warranty coverage – do you research.

New-home builder and warranty checklist » Is home building the company’s profession? Is home building the company’s primary business? Or is it a part-time or more recent focus? Home building is a serious business. It takes commitment to keep up with everything that is going on in the industry, and it requires solid business skills and a track record of satisfied clients. » What is your experience, and how long have you been in business? Good builders are proud of their track record, whether they have been in business for three or 30 years. They will tell you about their background, training and experience, strengths and what sets them apart from others. » Are they a member of the Canadian Home Builders’ Association (CHBA)? Membership in CHBA is an indication of a builder’s commitment to the industry, to the success of their company and, ultimately, to their customers. Members agree to a Code of Ethics that calls for fair and honest dealings with consumers. » Are they a member of a home warranty program? Warranty programs provide additional protection for the homebuyer’s investment. In some regions, there is a variety of warranties available. Ask the builder to explain the details – you want the warranty that best meets your needs for both the short and the long term. » Will they give you references from past clients? Contact past customers to find out how satisfied they are with their new home. Ask if the home was completed on budget and on time, what the builder was like to work with and about the company’s after-sales service.

WITH THE AVERAGE PRICE of a home

in Canada now costing more than $500,000, many young people need all the help they can get when it comes to coming up with the down payment for their first home. If you’ve just started saving and are looking for ways to give your down payment fund a boost, the five tips below will help you save more money faster to afford the home of your dreams and leave you with a smaller mortgage. 1. Make a tax-free withdrawal from your RRSP If you’re a first-time homebuyer, you can make a tax-free withdrawal of up to $25,000 tax free from your RRSP under the Home Buyers’ Plan (HBP). This means a couple purchasing their first house together can each withdraw up to $25,000 from their RRSPs, for a total of $50,000 towards a down-payment on their first home. The money must be paid back over a period of 15 years beginning in the second year after you made a withdrawal. 2. Use your tax refund If things such as unused tuition credits, moving expenses or RRSP contributions will net you an income tax refund when you file your taxes, resist the temptation to spend it! Instead, save it as part of your down payment fund. Your income tax refund is one of the easiest ways to quickly boost the balance of your down payment without putting any strain on your everyday budget.

Cutting your daily coffee from your budget will probably only save you a few hundred dollars per year, which won’t go far if you’re planning to buy a home anytime soon. However, if you’re spending more than $100 a month on expensive cable packages or pricey gym memberships, axing these from your budget and redirecting the cash to your down payment fund will give it a noticeable boost. You don’t have to give up everything to become a homeownership but you should prioritize the goal over non-necessities you won’t really miss.

Your parents raised you, took care of you when you were sick, and prepared you for life. While you may feel bad about asking for a handout, many young Canadians expect financial support when buying a home. In fact, a 2015 BMO survey finds that 42 per cent of first-time buyers actually expect their parents or relatives to help pay for their first home. And 40 per cent of first-time buyers say they wouldn’t be able to afford a home without financial help from family. For many young people, the down payment for their first home will be the largest sum of money they’ve had to save up so far, so it’s no surprise they find the task daunting. However, with commitment and a plan, you’ll be able to save up the down payment you need in order to afford the home you want. 4. Find a side hustle to fund your goals One of the easiest ways to really ramp up your savings for a down payment is to dedicate an income stream to achieving the goal. You might be reluctant to put a few more hours in at a second job if you’re already working full-time, but if working evenings and weekends will make your home ownership dreams come true, it’s a worthy sacrifice.
