uying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future – but don’t forget, it’s also legal transaction. The term “get it in writing” has never been more important in the case of the new-home purchase, since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon. Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is
no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements, so contracts can vary from one builder/ developer to another and from province to province. Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.

e and other industry sources in New Home & Condo Guide (see page 28) have been writing more and more recently about Development Charges, trying to bring attention to this increasingly important topic – and what buyers might be able to do about it. DCs are the fees applied by various levels of government when homes are built, to pay for new roads, transit and other infrastructure. Now, we’re happy to report, home builders are getting creative, looking for ways to give buyers a break on rising new home costs. In one example in Toronto, Edilcan Development Corp., found a way to freeze DCs at 2013 levels at one its

projects – a master-planned community that involves townhomes and three condominium towers. We don’t expect that all home builders will be able to find similarly innovative solutions, but the initiative is a shining example of what can be done – while home builder associations across the country lobby government on behalf of new-home buyers. Given that these rising fees are almost always transferred right on to you, the new-home buyer – along with your associated mortgage costs – such creative efforts should be applauded. As you’re out there scouting about for your new home, ask your builder how it is handling DCs, and if there are any opportunities to save.

If you’re looking to buy a new home or condo, you might want to hurry: prices in many markets are about to take a bit of a jump, and it has nothing to do with supply and demand. Nor will you get any more bang for your buck. The cause of the increases? Development Charges. The City of Ottawa, for example, is proposing a whopping 31-per-cent increase to Development Charges – the fees applied by various levels of government when new homes are built, to pay for new infrastructure such as roads, transit and other necessities (see page 28). Builders pay the charges, but typically pass on the cost to buyers. With the increases, the new fees will increase $8,500 per home, to a total of almost $34,000. It’s not just an Ottawa problem, either. In Mississauga, Ont., prospective buyers of new lowrise homes in that market are looking at a 54-per-cent increase in Development Charges – to an average of about $26,000, up from $16,000. For condos, buyers will be on the hook for more than $17,000 in DCs, rather than $13,000. In Toronto, City Council late last year voted to increase Development Charges by 75 per cent, to almost $30,000 for a semi or single-detached home. These new fees began to be phased in on Feb. 1, 2014 and are to be fully implemented by Feb. 1, 2016. Development Charges are even steeper further out in the GTA. According to a recent report from Altus Group, an economic consulting firm, municipal fees and charges collected by Toronto, Markham, Oakville, Brampton, Bradford-West Gwillimbury and Ajax average out to about $116,200 on a new single-detached home, representing 22 per cent of the cost. For a new highrise, the fees average $64,000 – or 20 per cent. In Vancouver, the various government taxes, fees and levies range from 16 to 27 per cent of the cost of a new home, depending on the city and the type of housing. “Development Charges are a tax,” Bryan Tuckey, president of the Building Industry and Land Development Association (BILD), Toronto, told New Home & Condo Guide. “The rates have increased exponentially, and it has shifted the burden of paying for critical infrastructure onto the newest residents and businesses moving into a neighbourhood. It is not fair that new homeowners are the only ones paying for new and upgraded infrastructure when all residents – new and old – will be using it.”

Though the problem may differ slightly from one city and province to the next, with critics arguing the fee increases are largely arbitrary, the concern is universal: new-home buyers are picking up a disproportionate part of the tab for infrastructure development. “As costs associated with building new communities increase, it is becoming increasingly difficult for buyers to find a new home they can afford to purchase,” says Tuckey. “While we understand that growth must pay for growth, the building industry has expressed the need for these fees to remain reasonable, fair and accountable to new-home purchasers.” Some builders are even resorting to freezing the Development Charges they pass on to buyers at the existing rates, even while the increases take place, to give consumers a break. So, as you’re out there scouting for your prospective new home or condo, ask your builder about DCs, and if there’s a tangible benefit to buying sooner than later.

Canadians still optimistic
about housing market: BMO
According to the 2014 BMO Housing Confidence Report, 44 per cent of homeowners intend to buy a property in the next five years. This represents a slight drop from 2013, but still signals a high level of confidence in Canada’s housing market – particularly among those under 30 years of age.
However, results vary widely in Canada’s major city centres: » I ntent to buy has surged in Montreal, with 63 per cent planning to purchase a property in the next five years – up 13 points from last year » Half of those in the Greater Toronto Area (51 per cent) plan to buy in the next five years, a decline of eight points from 2013 » Further west, intent to buy in Calgary is up five points to 54 per cent, while Vancouver is down four points to 54 per cent » A fter seeing an increase of 15 points last year, Atlantic Canada dropped notably; intent decreased by 18 points to 29 per cent. “The dip in overall intent could reflect expectations of higher interest rates, while the drop in the GTA likely reflects concerns about valuations and a possible price correction,” says Sal Guatieri, senior economist, BMO Capital Markets. “The improvement in buyer confidence in Montreal should help to absorb a moderate overhang of condos in that market.” After seeing an improvement in affordability between fall 2012 and spring of last year, this measure has flattened in 2014, with 45 per cent of homeowners cutting back or dipping into their savings to pay their mortgage. “Seeing consistency in terms of affordability year over year is encouraging, however, interest rates are likely to begin moving up in the near future, resulting in households potentially facing some strain down the ...continued on pg 24

But, on occasion, a client comes along whose demands are so specific and uncompromising that a custom home is the only way to satisfy them. Mortgage loan insurance is not to be confused with mortgage life insurance, which guarantees that your remaining mortgage at the time of your death will not be a burden to your estate. The CMHC Mortgage Loan Insurance premium is calculated as a percentage of the loan and is based on the size of your down payment. The higher the percentage of the total house price/value that you borrow, the higher percentage you will pay in insurance premiums. If you’re putting down five per cent as a down payment and mortgaging the balance, your loan-to-value (LTV) ratio is then 95 per cent. Generally speaking, the higher the LTV, the greater the premium for mortgage loan insurance. For example, for an LTV of 95 per cent, the standard premium is 2.75 per cent of the purchase price; for an LTV of 90 per cent, it’s two per cent; for an LTV of 85 per cent, the premium is 1.75 per cent, and so on. The premium can be paid in a single lump sum or it can be added to your mortgage and included in your monthly payments. Without mortgage insurance, you may avoid the insurance premium, but you could also pay higher interest rates for the mortgage, as well as additional administrative fees. At the end of the day, for the vast majority of borrowers, the cost of CMHC Mortgage Loan Insurance is more than fully offset by the savings achieved. Under the CMHC Green Home program, buyers may qualify for a 10-per-cent premium refund and extended amortization period without surcharge, for mortgages used to finance an energy-efficient home. Why does a new home in Ottawa cost so much?” Readers might be surprised to learn that about half the price of a new home is comprised of land and taxes, and the profit margin is very small. Housing affordability is becoming a serious problem, and many people are beginning to ask why. Parents whose millennial aged children are still living at home are concerned – and they should be. During the period from 1981 to 2011, the number of 25- to 29-year-olds living at home increased by 123 per cent. Over the same period, the number in this age group living independently as couples fell by a third. In many cases, house prices have been increasing faster than people’s ability to save the down payment. Another contributing factor has been the federal government’s concern with what it believed to be an overheated housing market and its consequent tightening of mortgage rules. We often say that hindsight is 20/20, because sometimes it’s only when we look back that we can accurately understand how we arrived at today’s dilemma. Some might say Ontario’s housing affordability problem began as early as 1961 with the introduction of the first sales tax. This tax moved up and down slightly over the following decades, but by itself was manageable. In January 1991, the federal government introduced its own seven-per-cent GST, and housing taxation began to get complicated. Initially, new-home buyers were assured the new tax would be indexed to insure that taxes would not increase with housing prices. Unfortunately, that didn’t happen. The Canadian Home Builders’ Association continues to lobby on this issue, but given government’s need for increased tax revenue, it’s unlikely indexing will ever happen without greater public pressure. In the late 1980s, Ontario introduced the Land Transfer Tax, which allows the government to take a percentage of the transaction cost for every piece of land sold in the province. Also in the late 1980s, the province introduced the Development Charges Act, which allows municipal government to collect a tax on every new home to fund municipal infrastructure. It started out small, averaging about $2,000 per home, but quickly grew into the biggest tax of all. The combined effect of all federal, provincial

and municipal new taxes over the past 25 years is an increase from about three per cent of the total cost of a new home to today’s 24 per cent. Development Charges are reviewed every five years when major increases can be made, but they also increase annually based on Statistics Canada’s construction price index. In Ottawa, the Development Charge Review was just finalized and approved by City Council. If the increase is calculated based on the charge adopted in 2009, it is 47 per cent; if calculated based on the most recent inflationary increase, it’s 31 per cent, or $8,500 per home, bringing the total charge to almost $34,000. Ottawa’s 31-per-cent Development Charge increase perpetuates government’s inability to grasp the alarming difference between constant tax increases and people’s ability to pay. Timing is also an important factor when considering the introduction of large tax increases. In Ottawa this year, new home starts are down by 38 per cent compared to last year. This is the largest decline in more than 10 years, and CMHC does not expect any significant recovery next year. More than 25,000 men and women are employed in the residential construction industry here, and many are naturally concerned about their jobs in this environment. So the question begs: is this a good time implement such an increase in DCs? The challenge in housing affordability isn’t just in Ottawa. From 2005 to 2011 the average price of a new home in Canada increased by 58 per cent, but the salaries of millennials, who represent the biggest percentage of new-home buyers, increased by only six per cent. The affordability gap continues to widen at an alarming rate. Instead of continuing to increase taxes, government needs to start controlling its spending. A recent article by the Canadian Federation of Independent Business noted that while population in Canadian municipalities has grown by 12 per cent since 2000, inflation adjusted spending over the same period has exploded by 55 per cent. Pride in homeownership is something Canadians have always enjoyed. But unless government begins to rein in its spending and gets taxation down to manageable levels, it’s clear that an increasing percentage of future generations in Ontario will be restricted to a lifetime of renting.

How to estimate your
home insurance premiums Like all insurance premiums, how much you pay for home insurance depends on a number of factors related to risk. Insurers analyze these risks, and figure out how likely it is that you – or a group of people with the same set of circumstances – will make a claim, and how much that claim will cost.

» Proximity to water Insurers are concerned about fire, and will look at how far your home is from a source of water (fire hydrant, fire station). If you live in an urban area, this is generally not a problem. If you live in the country and the distance is great, however, this will influence the cost of your home insurance. The sooner a potential fire can be put out, the lower the cost of restoring your home.
» Where you live Insurers keep records about such items as the number, type and cost of claims by neighbourhood. They can tell from past experience what the circumstances are in your neighbourhood, and how likely it is that you will have to make a claim. For example, if you live in an area where most people commute to work and homes are left unoccupied during the day, the statistics may show your neighbourhood has more
» Replacement cost The factor that will make the biggest difference in the cost of your home insurance is simply the size and composition of your house – as well as your contents. The larger the home and the more contents you have, the more it will cost to replace. In addition to the square footage, insurers take into account such matters as the quality of construction used to build your house, as that can vary greatly from home to home. » Heating Not usually an issue with new homes, oil tanks have the potential for causing costly environmental hazards, so your insurance representative will ask questions about the age and condition of your tank. » Electricity There are several factors concerning electricity. Do you have breakers or fuses? What is the flow of electricity coming into your house? And what kind of wiring do you have? Insurers know from experience that breakers pose less risk than fuses, and that a minimum of 100-amp service is better than a lower level of service, as a lower amp can lead to overloading and fire. » Pipes Galvanized or lead piping usually means that the plumbing is older, and older plumbing is more likely to crack, leak or run into other problems. Insurance companies generally prefer homes where the plumbing is made of copper or plastic. » Age of roof Not usually an issue with new homes, insurers generally prefer a roof that has been updated within the last 20 years. Some policies will pay only depreciated values, as low as 25 per cent of the replacement cost, for damaged roofs that are near the end of their designated service life. » Other uses of your home Insurers will want to know if you have built or are planning to build a secondary rental suite in your home; begin operating a business there; or make any other significant alterations to the structure or the way your home is used. » Other factors Insurers will ask if you have a security alarm and a fire alarm, and whether they are monitored by an outside service. They will also want to know if you have a swimming pool and other structures on your property, such as pool houses or storage sheds, that are worth more than 10 per cent of the insured value of your home.

» Basic or full coverage Once all of the above is taken into consideration, you can choose the types of coverage you’d like – which will also influence the cost you pay. While there are government regulations dictating how much insurance drivers must have, there are no such laws when it comes to home insurance. The only requirement may be one set by your bank or mortgage holder. From there, it’s up to you to decide whether you prefer basic or more comprehensive coverage. And this is something your independent insurance representative can help you with. The following factors typically do not affect what you pay for home insurance:
» Gas versus electric appliances The types of appliances in your home do not affect the cost of your home insurance.
» Brick exterior versus aluminum siding Most insurance companies do not use type of construction as a rating factor when calculating home insurance premiums. However, construction type is used when calculating the building replacement cost (what it would cost to rebuild the dwelling with materials of like kind and quality, if it were destroyed).
