Even if you’re not taking up residence in your new home that day, you can bet the best and most competitive moving companies will be booked solid around this time. If you haven’t contracted your mover already, you’d better get on it. Unfortunately, this scenario also conspires to produce the perfect opportunity for unscrupulous movers to take advantage of unsuspecting consumers. Overcharging bordering on extortion, damaged or stolen possessions and other sordid tales are all too common. Indeed, moving scams are one of the top 10 complaints monitored by the Better Business Bureau.

As I write this, Ottawa is finally enjoying the summer sun! There are those of us who beat the heat in the comfort of our air conditioned homes, and then there are the lucky ones who enjoy splashing around in an inviting backyard pool. Which begs the question: Is installing a swimming pool a sound investment? I’ll give you the bad news first. From a purely financial standpoint, I’m afraid the answer is “probably not.” As desirable as a swimming pool seems during the dog days of summer, I can tell you that many buyers perceive pool ownership as a bigger hassle than a perk. Homes with pools often take longer to sell, because they eliminate some potential buyers right out of the gate. While pools may be the norm in the wealthiest neighbourhoods, and in warmer climates, this isn’t the case in typical Ontario communities. According to the Appraisal Institute of Canada, you’re not likely to recover more than 25 per cent of the money spent on pool installation when you sell your home. Having said that, there are always exceptions to the rules: I have worked

with clients who placed a swimming pool near the top of their wish list. And, as someone who lives to see happy homeowners, I wouldn’t discourage anyone from creating the home they truly want. As long as you’re going in with realistic expectations about recouping your investment, you should absolutely go for it. After all, how do you put a price tag on the years of enjoyment a pool can bring? If you’re eager to move forward, here are some things to consider: • •

Inground pools offer more visual appeal, prestige and room to swim; above-ground models are more affordable and far easier to remove. Don’t forget to plan for a safety fence that adheres to municipal bylaws – the more attractive, the better. Put lots of thought into new landscaping and your pool deck or patio. Inground pool installation will wreak havoc with your yard anyway, so it’s the perfect time to get creative. When it’s time to sell, work to have your pool looking as enticing as possible. Crystal clear water, a weed-free patio, a pristine pool liner and appealing patio furniture: these will have prospective buyers thinking about relaxation rather than maintenance.

Oil slump both good and a potential risk for Ontario » by WAYNE KARL Sure, we’re all loving the lower gas prices at the pumps in Ontario, but a prolonged oil slump could begin to affect the economy and housing here as well as in the oilproducing provinces. “Sustained low oil prices do provide an upside risk to Ontario growth, as Ontario consumers and manufacturers benefit from lower prices both due to more disposable income available for consumption and lower input costs for exporters respectively,” Ted Tsiakopoulos, regional economist for Canada Mortgage and Housing Corp., told New Home & Condo Guide, after the federal housing agency released its second quarter 2015 Housing Market Outlook. “Low commodity prices also keep the Canadian dollar lower, thus helping improve competitiveness.

“One cautionary note for Ontario is that one third of total exports (interprovincial and international exports) are geared for domestic markets, so less exploration and investment in the Prairies means less demand for financial and legal and accounting services whose head offices are located primarily in Ontario.” Indeed, oil is producing all kinds of economic challenges Canada-wide. “Lower oil prices are contributing to disparities between provincial housing markets,” says Bob Dugan, chief economist, CMHC. “A slowdown in housing starts and resale transactions in oil-producing provinces such as Alberta will be partly offset by increased housing market activity in other provinces, such as Ontario and British Columbia, which benefit from the positive impacts of declining energy prices, a lower Canadian dollar and continued low mortgage rates.” “Moreover, since the inventory of completed and unabsorbed units remains above the historical average, we expect the pace of new home construction to moderate over the next couple of years as builders focus on managing the existing inventory,” he adds. In Ontario, harsh weather dampened housing starts early this year, but are expected to pick up through 2015 with sunny days ahead, before slowing again in 2016. Starts will range between 56,800 to 64,200 units in 2015, and 54,500 to 63,600 units in 2016. “Apartment (condo) units under construction remain near historical highs, and builders must manage inventories so that under construction counts do not result in unsold inventories,” says Tsiakopoulos.

With condos, townhomes and semi-detached homes becoming more prevalent in many major centres, designers and manufactures alike are coming up with space-saving ideas and products to make living in a smaller space practical and beautiful. The first thing that needs to be established is flow. This can be done even before moving in. As a new-home owner, take the floorplan and decide how the space is to flow to get the best use of each area. This can be done the old fashioned way, by putting pencil to paper or by uploading your floorplan onto an iPad or tablet app that allows you to place furniture on the screen and configure the best set-up. It is important to consider how the space will be used and then plan separate areas for each major activity. Try to design these spaces so they feel separate by creating vignettes with different carpeting, furniture and accessories. Storage always seems to be a problem in small spaces, but this problem can be almost eliminated with build-in cabinets. Adding built-in shelving in several spaces does not take up any existing square footage and can go to the ceiling, almost immediately creating a plethora of storage. Built-ins are not only limited to extra storage; this idea can be used to create a desk or home office underneath a staircase, in a child’s bedroom, the kitchen or in a hidden space tucked away. Also, consider using a built-in to house the television and electronics to keep this visual clutter out of sight. Choose furniture that can do double-duty. With the sizes of living spaces in urban centres steadily on the decline, furniture manufacturers have stepped up their game. Think

about using an ottoman or cube for a coffee table, so when extra company comes, this can turn into extra seating. Consider an ottoman that opens up to allow for storage of throw pillows and blankets inside. Moving away from the family room, there are a lot of great storage and furniture ideas for the kitchen. Many kitchen tables can easily be folded up and tucked away after a meal. This idea is also been seen in desk design. Many desk designs include versions that can be folded up and stored when not in use. If a home office is not needed, this idea also works great with home beverage centres or bars. Creating separation in a small space can make the space appear larger. This can be done by hanging a drape from the ceiling to act as a wall between distinct areas like the eating area and the family room. This allows the area to feel separate, but not boxed in because the walls are not permanent. This can also be done with shelving, but, make sure to use open shelving as not to make the small space feel too closed off. And finally, adding mirrors or mirrored furniture to a small space can reflect extra light to make a small space feel brighter. In addition, adding artwork with perspective or depth in them, hung strategically on visual walls can create a sense of openness or direction. Whether moving into a house or condo, size doesn’t always have to matter. There are several design tactics and products on the market to make your space feel as big as you need it to.

You might have read or heard speculation about the City of Ottawa’s intention to appeal a recent Ontario Municipal Board (OMB) decision on the Centretown Community Design Plan. On April 29, 2015, the Ontario Municipal Board ruled that building height limits did not belong in the Centretown Community Design Plan. The OMB’s decision on the Centretown (CDP) has signif icant implications for Ottawa’s future. Our recently updated Off icial Plan (2014) contains very prescriptive building heights. The decision to include building heights in Ottawa’s Off icial Plan was criticized by Ottawa’s home builders. The OMB ruling on building heights in Community Design Plans could be used to challenge building height limits in Ottawa’s Official Plan. Given what’s at stake and the fact that you’re going to be hearing about this in the media, we thought it useful to provide Ottawans with a short primer on land use planning. ONTARIO’S PLANNING ACT

Ontario’s Planning Act sets out the ground rules for land use planning throughout Ontario. It is the foundational document that governs how land uses may be controlled and who may control them. Like a constitution, it outlines the set of fundamental principles according to which people are governed. The Planning Act serves as the basis for the planning policies and rules that guide future development in Ottawa. The authority to create zoning by-laws, plans of subdivision and official plans, flows from the Planning Act. All of these planning instruments play prominently in Ottawa’s land use debates. OTTAWA’S OFFICIAL PLAN

Ottawa’s Official Plan (OP) is the City’s policy on how land in Ottawa should be used and provides a vision of the future for the city and its physical development. Ottawa’s current Official Plan “provides a policy framework to guide its physical development to the year 2021.” Official plans are intended to be descriptive in nature, not prescriptive. 34 NEW HOME & CONDO GUIDE EASTERN ONTARIO | JUN 13 - JUL 11, 2015

Official plans are of critical importance to planners, homebuilders and landowners as they provide a roadmap for the future of a city’s growth and development. They shape how and where cities grow, and provide home builders with an understanding of what types of land uses will be encouraged. COMMUNITY DESIGN PLANS

The purpose of a Community Design Plan is to tailor the principles and policies of an official plan to the needs or characteristics of a community. A CDP is a supplement to an official plan. A CDP can focus on the character of the business district through the treatment of building facades, the design of pedestrian areas, “streetscaping” and lighting. When developing a CDP, the municipality works with the community, landowners, local businesses, school boards and other interested parties. A CDP must be approved by the municipality’s council. Community Design Plans must conform to the Planning Act. When it came to the Centretown CDP, the Ontario Municipal Board decided that the plan’s building height limits did not belong in a CDP, rather they belonged in a zoning by-law. OTTAWA’S COMPREHENSIVE ZONING BY-LAW

Ottawa’s Comprehensive Zoning By-Law controls the use of land in Ottawa. The zoning by-law is a


The purpose of a Community Design Plan is to tailor the principles and policies of an official plan to the needs or characteristics of a community rules-based document that outlines things such as: how land may be used; where buildings and other structures can be located; the types of buildings that are permitted; the use of buildings, lot sizes and dimensions; parking requirements; building heights; and setbacks from the street. According to the Government of Ontario: “an official plan sets out [a] municipality’s general policies for future land use. Zoning by-laws put the plan into effect and provide for its day-to-day administration.” A zoning by-law is prescriptive in nature, not descriptive. When a landowner wants to develop land in a way that is not permitted by the zoning by-law, they can seek an amendment to the zoning by-law. These are commonly called “rezonings.” Rezonings are governed by a process that requires strict notification for affected residents and often involve community and industry presentations to the planning committee and then approval by city council. THE ONTARIO MUNICIPAL BOARD

The City of Ottawa has the responsibility and legal authority for land use planning in Ottawa. The City’s authority over land use planning flows from the Planning Act, which is a provincial government law. Th is means that the City must abide by the Planning Act when it creates community design plans, official plans and the zoning by-law. When landowners and the City cannot resolve their disagreements over planning issues, they can take these disagreements to the Ontario Municipal Board. The Ontario Municipal Board is an independent tribunal that conducts hearings and makes decisions on matters that arise under the Planning Act, such as official plans, zoning by-laws, subdivision plans, consents and minor variances.
