Ottawa, on the other hand, has plenty of all of that. Forget that there may be a short-term reaction to the recent Fair Housing Plan, longer term, the city and its real estate market will be just fine. Take, for example, the latest Metropolitan Outlook: Spring 2017, from the Conference Board of Canada, which confirms that Ottawa will be among the leaders in economic growth this year. Fueled by hiring in the public administration sector and strong tourism activity, GDP growth is forecast to reach 2.3 per cent in 2017. This would be the strongest gain since 2010. All of this provides Ottawa with a solid – indeed, enviable – economic foundation. Finally.

(OMB) has been in existence in one form or another for more than a century. In its most recent incarnation, it has been a quasijudicial body responsible for enforcing government planning and land use policies. The Board ruled on a wide range of commercial and industrial conflicts, but it was the residential domain where trouble has been C10 YPNEXTHOME.CA

brewing. This sector has become increasingly controversial over the past two decades as municipal and provincial governments introduced Smart Growth and encouraged intensification, while affected residents became increasingly hostile towards it. Because the OMB’s mandate was to enforce government planning policy, its decisions favoured projects that increased density. This was misinterpreted by project opponents as the OMB favouring developers and builders when in fact, the Board was only doing its job by favouring government policy. The “Not In My Backyard” (NIMBY) groups became increasingly frustrated and often took their anger out on municipal councilors. These

elected officials did not appreciate having an professional objective body make legal planning decisions that were in opposition to their political wishes, even though intensification policies were what they voted for in approving their Official Plan and zoning bylaws. Residential opposition to projects placed government in a difficult position because more densely populated cities are needed to achieve the ridership levels necessary to pay the operating costs of expensive LRT systems. If this isn’t accomplished, the additional costs will have to be absorbed by residents in the form of higher property taxes. This problem is so serious that the provincial government introduced a …continued on page C12

provision to deal with it in its recent announcement that prevents appeals of projects in close proximity to transit stations. Throughout the OMB review process, provincial ministers consistently advised industry that the existence of the OMB was not in question and their government was focused on making changes that would create a more user friendly, less expensive process to benefit project opponents. But on May 16, politics prevailed and these same ministers announced the elimination of the OMB to be replaced with a new body called the Local Planning Appeal Tribunal. The new tribunal will be mandated to give greater weight to the decisions of local councils. This would be achieved by eliminating “de novo” hearings for the majority of planning appeals. The term “de novo” has been used to describe how the Ontario Municipal Board deals with appeals of municipal land use planning decisions, by considering the same issue that was before the municipality as though no previous decision had been made. It was what allowed the OMB to ensure there was a consistently high quality urban environment across Ontario and prevented municipalities from creating fiefdoms. what the government has in mind but if this new Tribunal puts local politics ahead of Smart Growth planning, it will only serve to empower NIMBY councils to make planning decisions to get re-elected. The role of the OMB has always been to take the politics out of local planning and ensure that decisions are made based on evidence, good planning and conformity to provincial policy. To give more weight to local politics will detract from provincial goals. For more than 10 years, the provincial government has been demanding the increase of density and intensification in existing communities across Ontario. It is difficult to understand how the province hopes to achieve Smart Growth goals by eliminating the OMB when councilors are pushing back on intensification. If this new Local Planning Appeal Tribunal is simply going to be a rubber stamp for obstructionist councils, then the province’s demand to optimize housing supply and provide diverse housing options will fail. The result will be continued escalation of housing prices and affordability challenges. Marcus Gee wrote a column in the Saturday, May 20 Globe and Mail that described these problems and how the liberals were worsening the housing crunch.

The government media release speaks volumes about its political priorities with the headers Faster, Fairer and More Affordable Planning Appeals; Free Legal and Planning Support; Sheltering Major Planning Decisions from Appeal; and Giving Communities a Stronger Voice. The number of Ontario residents concerned and affected by inner city projects is only a tiny fraction of those impacted by lack of housing supply and constant price increases but there is nothing mentioned about these issues in government’s media material. One unfortunate aspect of the changes being made is that it will take a considerable amount of time to demonstrate results. It will only be the cumulative results of dozens of appeals over many years that prove the negative impacts and even those will be subject to a degree of political interpretation. The government has clearly decided that the short term political gains leading into an election clearly outweigh the medium and long term downside of causing further damage to Ontario’s housing supply and affordability problems. towards purchasing a new home, you’ve come a long way! As you unpack your boxes, position your furniture and hang your artwork, you can feel this home becoming your own. You’re probably a little tired – but the exhilaration is enough to keep you going. Ideally, this feeling is strengthened with the confidence that your home has been built to meet both building codes and your own exacting specifications. In most cases, when you’ve chosen your home builder after proper research and completed a thorough pre-delivery inspection (PDI), you can rest easy that things are as they should be. Sometimes, however, items are missed during that initial inspection. When this happens, it’s important for you to understand the proper course of action. Ontario’s Tarion Warranty Program is structured to deal with homeowner complaints in a very specific manner; in order to take advantage of the program, it’s necessary that you fill out the appropriate forms and meet set deadlines. How to avoid your own moving horror story By Wayne Karl

WHEN BUYING A HOME, you will

likely consult with a team of trusted professionals — a mortgage broker, a lawyer, perhaps a realtor or builder sales associate and maybe a home inspector. Then, assuming you move ahead with your purchase, eventually you will likely need a mover. People often don’t consider a mover as an important member of their team of professionals. However, given the critical role they perform — taking possession, at least temporarily, of all your worldly goods and moving them without loss or damage — it’s a function not to be taken for granted. Not doing your due diligence and taking the time to select a reputable mover can invite untold problems. Case in point: the following example, which admittedly doesn’t involve a new-home move, but the experience is all too common. So is the lesson learned — unfortunately, the hard way. I recently contracted a “professional” moving company to carry out a last minute move of five pieces of furniture on behalf of my son, a university student. For a variety of reasons, we decided to hire movers rather than rent a truck. After calling several firms — including large, well-known companies and smaller, independent ones — I selected a local moving company, explaining that drop-off would be about 100 kilometres away. We agreed on price ($350) and time 20 YPNEXTHOME.CA

(9 a.m.) — after I was very clear the move would involve an out-of-town destination. All details were confirmed in a “contract” exchanged via email. The crew was on time for the move the next morning, but almost immediately began talking about a higher rate — $360. Not a huge difference, but it immediately raised my suspicions. I’ll spare you all the gory details, but it’s important to share the lowlights of what happened next: » The company I originally contracted the job to the night before was inexplicably unavailable to actually do the move the next morning, and apparently passed it off to another firm. » My original contact, who was easily available on cell phone repeatedly the night before, suddenly was nowhere to be found. » Once the truck was loaded, the fee increased to $450. » Upon arrival at the destination, the movers said the fee was $500. “It’s taking longer than we thought, and the furniture is heavier.” » “Sure,” I said, “right after I call the police.” With that, the sordid tale ended. The job not complete, left for us to move the furniture indoors, now the

victims of one of the top 10 scams monitored by the Better Business Bureau (BBB). “I could write a thesis on this,” John Levi, president of the Canadian Association of Movers (CAM) told me. CAM offers consumers the following tips on how to avoid being scammed by unscrupulous movers: » Find reputable movers through the CAM, BBB or provincial government consumer protection agencies » Ask three movers for estimates in writing » Get the terms and conditions in writing » Ensure your goods will be protected for loss or damage » Read customer reviews on movers’ websites and other forums “Consumers have recourse with their provincial government’s consumer affairs department and with the Better Business Bureau,” says Levi. “Both of these avenues are fraught with difficulties and often take many months to come to some form of resolution — satisfactory or otherwise. And often, the mover simply out-waits the consumer. “It’s far simpler and more effective to engage a reputable mover in advance rather than trying to fix a bad situation after the fact.” My example, though painful and infuriating, is minor compared to other common horror stories involving similarly unsuspecting clients.
