LIVING SMALL IS THE NEXT BIG THING The real estate world and its industry experts have been bantering about new catch phrases lately – downsizing, right-sizing, smaller environmental footprint. For those not familiar with these terms, it refers to a modern way of living, where the new big thing, it seems, is really about being small, or rather, living in smaller spaces. Many of us dream of owning large homes with spacious front and back yards, and that’s okay. But for various reasons, a growing number of people desire less square footage in which to live, heat, clean and maintain. Admittedly, living in a smaller space may require some getting used to, from finding creative storage solutions to sourcing furniture that fits. Decluttering and eliminating articles in a big home that won’t fit into a smaller one can be challenging. But as Marnie Bennett writes in this issue of NextHome (pg. C3), downsizing to live in a smaller space can be a magical, cleansing experience with surprising, luxurious results and benefits. For many downsizers, storage presents the biggest challenge. Investing in closet organizers, beds with built-in drawers and pieces such as storage ottomans can make a big difference. One tremendous benefit of purchasing a new home is that you’re usually presented with various storage options. If you feel daunted by limited kitchen and bathroom space, select extra-tall kitchen cabinets and vanities rather than pedestal sinks. Finally, I can’t stress enough how important it is to unload your excess possessions before you move. Difficult as it is, you must be merciless. If you haven’t used something in the last year, it should be donated to your local thrift store, or sold. For those who have difficulty parting with

A spacious two-storey on an ample lot: It’s what many of us aspire to. But a sprawling estate home isn’t for everyone. Many of my returning clients have found that once the children have grown up and moved away, the family home is far too large for their needs. A few have found themselves obliged to move due to a change in financial circumstances. And a small but growing group are interested in decreasing their ecological footprint; they want to live within walking distance of work and amenities, in a smaller home that requires less energy to run. Now, smaller doesn’t necessarily translate to more modest. I’ve seen jewel box condominiums that are incredibly luxurious and inviting, in part because of an intelligent use of space. During my years in the business, I’ve seen thousands of home interiors, exquisite and otherwise. I’ve seen what works and what doesn’t. And when I’m working with clients who are clearly nervous about moving to a smaller home, I like to pass along what I’ve learned. The most frequent mistake I’ve seen stems from downsizers’ reluctance to part with their large-scale furniture. Even the most expensive and beautiful chesterfield will look awkward if it dwarfs the rest of the room. As a rule, smaller rooms are complemented by furniture with

TYPES OF HOMES NOT ELIGIBLE FOR WARRANTY COVERAGE

Whenever I write about the Ontario new-home warranty program, I make the observation that almost every new home and condominium is covered under the seven-year, $300,000 warranty. However, there are exceptions to warranty coverage, and I thought it would be useful to remind potential new-home buyers about homes that are not covered. Perhaps the category of new homes we get the most questions about are owner-built homes. A home is considered ownerbuilt if the owners build the home themselves on land they own, and then occupy it. It can also be considered an owner-built home if the owners hire someone else to build the structure, but exercise “significant control” over the construction of the home and then move in after it is built. Significant control includes: Selecting, contracting directly with or terminating contracts with subcontractors, trades and suppliers; reviewing, revising, approving, supervising or directing work; and/or supplying materials. Whether the control exercised by the owner is significant depends on the nature, value and quantity of the work or materials controlled or contributed by the owner. There is a simple reason why owner-built homes are not covered by the statutory warranties: The vendor of the home (as defined 26 NextHome.ca
in legislation) is responsible for providing the warranty, and in the case of owner-built homes, there is no vendor. There are other types of homes and condos that are exempt from coverage, too. If an existing residential home has been renovated – for example, a new addition was constructed – the home is still not considered new and would not be eligible for statutory warranty coverage. Homes – even newly built ones – that have been previously occupied by the seller or the builder or rented by other persons before being sold to a purchaser, are not covered. A new home built on a preexisting foundation will also be exempt if that pre-existing portion of the foundation exceeds 40 per cent of the footings of the new build. Another category not covered by the warranty is the seasonal home. These are homes that don’t meet the year-round occupancy requirements of the Ontario
Building Code and are therefore not built for year-round occupancy. While condominium projects converted from existing nonresidential buildings are now covered by the warranty (this coverage was added Jan. 1, 2018), buildings that were originally rental apartment buildings do not qualify for coverage. It’s important to note that these warranty exemptions represent a small portion of newly built homes or condos on the market. If you’ve ever bought, sold or rented a property, you’re probably familiar with the term vacant possession. Giving vacant possession refers to a legal obligation to ensure that a property is in a state fit to be occupied at a given point in time. WHEN DOES VACANT POSSESSION HAVE TO BE GIVEN?
It’s common to see vacant possession as an express term in Agreements of Purchase and Sale or a lease. But vacant possession usually has to be given in the following circumstances: • When property is sold • When a lease is granted • When a tenant vacates at the end of the term However, the Ontario Superior Court has held that in the absence of an agreement as to a specific time of day on which vacant possession must be delivered, a seller can deliver vacant possession at any time before the day expires. Therefore, it’s important to be specific if you want to ensure that the property is vacant before midnight on the agreed day. WHAT DOES VACANT POSSESSION MEAN?
It seems natural to think that a property will be delivered with vacant possession if all of the occupants have left, but chattels, or movable objects, must also be emptied. However, depending on the 34 NextHome.ca
circumstances, vacant possession may still be given even if these requirements are not wholly met. The test the courts apply is whether the chattels left behind substantially interfere with or prevent the enjoyment of the right of possession for a substantial part of the property. The court is clear that not any impediment will do. It must be one that substantially prevents or interferes with the enjoyment of the right of possession of a substantial part of the property. Given the subjective nature of this test, it’s important to keep in mind that each case will turn on its own set of unique facts. In one Ontario Superior Court case, the court held that a Quonset hut, which remained on the land after the closing date, did not impede the delivery of vacant possession. In that case, the plaintiff was willing to accept the property with the hut remaining. However, the court conceded that even if the hut should have been removed, the purchaser would only be entitled to the cost of removing the hut as an abatement of the purchase price and nothing more. In a subsequent case, however, the court found that failing to remove equipment was a failure to provide vacant possession as required in the lease. The effect of this failure was to prevent the tenant from being able to carry on their business. In that case, the tenant was entitled to damages. WHAT HAPPENS IF VACANT POSSESSION IS NOT GIVEN?
Where vacant possession is being
given on the sale of property, a buyer has several options. A buyer can apply for specific performance, where the courts will enforce the contract, in addition to damages for any losses suffered. The contract may also be rescinded. But if the parties are willing to negotiate, they may be able to agree on an abatement of rent/the purchase price or a different closing date. Courts act more favourably toward sellers who have made attempts to deliver vacant possession, rather than those who make no effort to honour the terms of the contract. WHAT DOES IT MEAN TO ME?
Vacant possession is extremely important. Let’s look at some examples. You are closing your new resale home and the vendor has left a broken-down truck in the garage and all of his old furniture in house. The tenant of the vendor is still living in the basement. This is an example of a situation where you could apply to the courts to enforce your rights to specific performance. Every situation is unique and requires a holistic overview of what is involved, and then the application of both common sense and the law. This is the time your lawyer becomes very important.
