Location (location, location) As you know, one of the biggest considerations you’re faced with when it comes to choosing a rental is your choice of location. Unlike furniture, paint and decor, it’s the one thing that you cannot change, so it’s important to choose well. There are so many personal variables. As an example, if it is just as important to you to be close to your children’s school as it is to your place of work, then look for a place that offers you the best of both worlds. If you own a car and want to use public transportation whenever

possible to save on parking and gas costs, a well-connected mass transit location may be a better option for you. If you’re a walker, close proximity to major amenities should be a definite consideration. Doing errands such as grocery shopping and banking on foot has many health benefits and gives you a chance to meet your neighbours and discover new places too. With rental supply in short stock and market prices going up, the investor condo market seemed like it was the solution to tight vacancy rates that would push the competition back into the renter’s favour with added supply to the market. Wrong. They were wrong. While the condo market brought more supply, it just didn’t put supply in pace with demand – though it did add a rental element that the market was lacking. It was upscale, it offered features and finishes that were in a new league. Buildings were new and fresh and luxurious.

It also showed rental developers that there is an appetite for new buildings – and it helped spur on new, purpose-built development. With market rents high, rentals could support the demand for hardwood floors and stone countertops, of soaker tubs and backsplashes. While we’re seeing a start to new buildings hitting the market, we’re also seeing a new vision of rental, and it’s gorgeous! HOPEFULLY DURING YOUR LIFE as a renter you haven’t had to rely on the Residential Tenancies Act too much. If that’s not the case, you’re likely well versed in some part of your rights, but maybe not all of them. Many of us renters rely on hearsay information we’ve picked up over the years and as it turns out, a lot of it is misconstrued or, in some cases, completely wrong.

MYTH 1: You cannot be evicted during the winter. One of the classic myths in today’s rental world is that you cannot be evicted during the winter months. In many cities across Canada, that would essentially equate to a six-month 2 4 YPNEXTHOME.CA

period. I admit, I thought this was true. As it turns out, a tenant can generally be evicted at any time as long as the landlord has followed the appropriate procedures outlined in their provincial Residential Tenancies Act. As in all eviction cases, the landlord would need to give the tenant the appropriate notice and the reasons for eviction need to be valid. The number of days of notice varies and because of this and the process in general, you might not actually be evicted during the winter, even if you were handed a notice in December. For example, if you owe rent in Ontario, your

landlord must give you 14 days’ notice (only seven days if you pay rent by the week or by the day) to pay the arrears. If you do not pay the arrears before the set date, your landlord can then submit an application to schedule an eviction hearing with the Landlord and Tenant Board. While you wait for a hearing, you can still live in the property. Bonus tip: A lot of people think your utilities can’t be shut off in the winter. While that is mostly true, the laws around this vary from province to province and there are instances to look out for. In Alberta, for example, electricity cannot be fully disconnected

between October 15 and April 15, but the electrical company can install a limiter – a limiter allows you to run your furnace and a few lights but nothing more. MYTH 2: You cannot be evicted if you’re pregnant. Another myth I’ve heard is that you cannot evict someone who is pregnant or who has small children. Generally speaking, if the pregnant person or parent with children has done something to merit eviction, they can be given notice to vacate the property. That sounds harsh, but if you think about it, if the law dictated that parents with small children couldn’t be evicted, that would mean that a parent with a baby could avoid eviction for years until the baby was no longer considered a small child. That wouldn’t really be fair to the landlord. Of course, when it comes time for the eviction hearing, the case for the parent can still be made and the eviction decision will be made based on specific circumstances. MYTH 3: You cannot be evicted because the landlord wants to use the property. Something you hear about often is landlords deciding they want you out because a family member needs to move in. In Ontario, family in this case means spouse, child, parent, spouse’s child, spouse’s parent or a caregiver for any of them. This is 100 per cent within their rights. They need to give you appropriate notice (in B.C., for example, this case requires a two-month notice) but there is no point in fighting this one as it’s perfectly legal.

MYTH 4: You can’t be evicted for Having a pet or getting a pet after moving in. Some provinces, like Ontario, have no laws prohibiting pets. In Ontario, you cannot be evicted for sneaking in your pet, unless you rent in a condo that has board-regulated pet restrictions. The caveat is that your pet cannot cause others discomfort. Your pet may be evicted if it’s causing allergic reactions or interfering with the enjoyment of the landlord or other tenants though. In B.C. and Alberta,

however, you can be considered in breach of your lease and can be evicted if you chose to disregard the no-pet clause. When it comes to evictions laws, it’s important to know your rights. It’s also important to be a decent tenant – we’ve all heard landlord horror stories, but there are tenant horror stories too. The landlord-tenant relationship is a reciprocal one, and a business agreement in the end, so all you can do is hope that you both hold up your end of the contract.

“CAN A RENTER THROW A HOUSEWARMING PARTY?” This

is a legitimate question that has crossed my screen on the interwebs. Just google housewarming and renters and you’ll find it too. Why this is even a question is beyond me, because the answer to this question lays within the question itself. It all comes down to an accurate definition of the word housewarming. Open up your dictionary (just kidding) - go to merriam-webster.com - and you will see housewarming is defined as “a party to celebrate moving into a new home” or “a party to celebrate the taking possession of a house or premises”. There is nothing in this definition that speaks directly to the act of buying a home or signing your soul to a mortgage broker. So why are renters questioning

it? Questioning their right to a housewarming. This definition is as significant to a buyer as it is to a renter. When you rent, you are moving into a new home and you are taking possession of a property be it for a determined or undetermined amount of time. Now of course, renters use your judgement and stick to the premise of this definition. Is your rental a place where you will be there short term – for a few months? Is it that place where you’re setting in to stay? Is it just a stop-over or will it really be your new home? If the answer is the latter, you have the right to want to celebrate this turning point in your life. It’s your new home, a fresh start and a place to begin making new memories. For the sake of all renters, throw a housewarming! An

apartment is a legitimate home. And let me be clear; call it a housewarming. Don’t back out and start making excuses to your friends and family like “I just wanted to get together” or “I’m only renting, but wanted to show you my new place anyway”. No, no, no… you are having a housewarming because as per the definition of housewarming, you want to celebrate moving into your new home! You don’t need to make excuses. Own your right to a housewarming like you don’t own your rental. And when your guests bring you gifts, tell them “thank you, you should have”, because you deserve a housewarming gift just as much as a buyer does. So there you have it renters throw a housewarming party, have a cake in the shape of your new home and eat it too.
