For the third consecutive year, Toronto remains the busiest city for incoming traffic among do-it-yourself movers, with Calgary, Montreal, Edmonton and Ottawa rounding out the top five. The migration trends data comes from more than two million one-way U-Haul truck sharing transactions that occur annually. The company counts down its ‘Top-10 Canadian Destination Cities’ leading up to July 1, which is one of the busiest dates for residential moves in Canada. Lessons from Tokyo Dave WiLkes Exploring how other cities and countries approach housing, planning and development can often provide us with insight to enable us to better meet the housing needs of the residents of the Greater Toronto Area (GTA). In early June, a Building and Land Development Association (BILD) delegation visited Tokyo and came away with quite a few impressions. The population of the city of Tokyo is just shy of 10 million people and the population 12 New Home + Condo Guide | July 6–Aug. 3, 2019
of the Greater Tokyo Area is approximately 38 million with a population density of 6,158 people per square kilometre. This compared to Toronto’s three million and the GTA’s 6.4 million with a population density of 4,457 people per square kilometre. So, while we have challenges in the GTA, you can you can well imagine the magnitude of the task of housing, moving and providing places to work, shop and play for 38 million residents. One of the first impressions of Tokyo is the transportation infrastructure. It is simply humbling to behold. Thirteen subway lines carry 8.7 million riders daily, by
elevated trains and mono-rails, an integrated commuter rail system that fans out from multiple stations to all corners of the region and tripled stacked highways that snake through the heart of the city and bypass sensitive areas with tunnels. It’s enough to leave the average Ontarian with infrastructure envy. Tokyo makes it work. Their transportation system is efficient and it’s amazing. The second impression is the typical built form for housing. There is literally housing that we refer to as missing middle in the GTA, everywhere in Tokyo. and housing work together seamlessly. Homes are built near transit stations that form hubs around neighborhoods. Everything is within walking distance of rapid transit of one form or another and balances the impact of the movement of people between automobiles and public transportation. While traffic congestion occurs, it’s nowhere near what we experience across the GTA on a daily basis. Lastly, is the approach of the Japanese toward land use and built forms. At the risk of gross oversimplification, land use is flexed to requirements and when
needs change so too do the buildings. They are torn down and rebuilt to accommodate a differing or changing need. It means there is change in housing stock, urban renewal and the concept of a “stable neighbourhood” like we have in Toronto doesn’t generally exist. There are many lessons to take from Tokyo, and as our region’s population grows by almost 40 per cent through 2041, these lessons should be kept in mind as the GTA plans to house these people in the future.

What if Something is Wrong? JaySon SchWarz
As the purchaser of a brand new pre-construction home or condo you have the opportunity in most cases to choose the elevation, the lot, the floor location and the various specifications and finishes. You expect that what you have chosen will be what you will receive on closing. Now imagine that your new home has just been built and you have just completed your pre-delivery inspection with the builder’s agent and you have noticed that the builder has – without any advance notice to you – made numerous changes 22 New Home + Condo Guide | July 6–Aug. 3, 2019
to the finishings, colours and/or layout of the home. This is clearly not what you bargained for. What do you do? What can you do? The first reaction is to threaten to not close. Bad decision. Be advised that most builders’ agreements contain a clause that limits or restricts the remedies available to the purchaser in the event of a breach of the agreement by the builder. Many such clauses also permit the builder to substitute materials, and to make various changes to the plans and specifications relating to the subject property. From the point of view of builders, such clauses are necessary to offer them some degree of flexibility to deal with unforeseen circumstances that often arise in the course of new
home construction or with the requirements of the Municipality. Without getting into a long commentary on the law of contract rescission – which is extensive to say the least – the courts have generally held that where a builder has breached a fundamental term of the contract, he cannot hide behind his exclusionary clauses. While what constitutes a “fundamental term” is often figured out by a judge, suffice it to say that the test is very tough and purchasers seeking to get out of their builders’ agreements on breach of contract grounds (called “rescission”) often end up with the short end of the stick. With that said, here are a few of the factors to examine in determining when rescission will likely be granted by the courts:

1. Motivation: Courts are generally unlikely to grant purchasers rescission for a construction deficiency or modification in circumstances where they believe that the true factor motivating the purchaser is something else (like lack of money, change of mind, etc.) 2. Builder’s Prior Knowledge: Courts are more likely to grant purchasers rescission, where they can demonstrate that the possibility that the unwanted modification would be necessary was known to the builder at the time the agreement was signed and was not adequately brought to the purchaser’s attention at that time 3. Rectifiable Deficiencies: Courts are less likely to grant a rescission as a result of incomplete construction, or as a result of deficiencies that can be remedied without seriously inconveniencing the purchaser. This is especially the case where the builder has obtained an occupancy permit from the local municipality If you do not close and a court determines that rescission is not available, not only will you lose your deposit, you will also be found responsible for all of the builder’s consequential damages and legal costs. This is an especially significant issue where the value of the home is declining. All in all, prospective purchasers of new homes should be aware of the fact that rescission is generally not granted.

Single-Family HoMe? Is It a Good Time To Buy a new

In early 2017, the average asking price for a new single-family house in the Greater Toronto Area increased by a whopping 45 per cent annually. I think everyone in the industry was wondering what was going on, because the values didn’t make sense in comparison to the resale market, despite the decade-low number of units available. As market prices bubbled up, the Ontario government decided it was time to intervene, announcing a 16-point Fair Housing Plan in 24 New Home + Condo Guide | July 6–Aug. 3, 2019
April of 2017. The plan included a non-resident speculators tax among the 16 new rules that were intended to stabilize the market. The impact on new single-family transactions was almost immediate, as buyers, and especially investors (that had recently increased their interest in suburban properties), became more cautious. The implementation of the new housing measures resulted in prospective buyers adopting a wait-and-see attitude. A slow sales environment in the lowrise housing market hasn’t been experienced in 10 years, and it left many developers wondering what strategy to implement. Should they build bigger houses for the same price, smaller more
affordable product, should they add more interior finishes while keeping the price unchanged, or offer incentives like lower down payments, no closing costs, or finished basements? The big problem is that the availability of single-family land for development is still limited and developers don’t want to fire-sale their inventory to move product. Unlike someone selling their resale house because they’ve taken a job in another city, many developers don’t have the same sense of urgency to lower their prices, they’d prefer to wait out the downturn, understanding that they need to keep the lights on at their office and they too have to pay their mortgage (on their land loan). A developer referred to
2018 as “a lost year,” instead of lowering prices to generate sales, developers and builders decided to wait until this year to see if conditions would improve. Developers that rushed to lower their asking prices in early 2009, during the global economic meltdown ultimately regretted their decision, as the market came rushing back quickly. According to the Altus Group, there were nearly 3,400 new single-family home sales from January to May this year, a 38 per cent increase year-over-year. However, the average asking price for unsold lowrise units continues to decline, now down 3 per cent annually from May of 2018. The market continues to send mixed signals, sales up and prices down – generally when you see more demand, you see higher prices. On the positive front, several builder releases experienced sales success, with Adena Views, Lotus Pointe, The New Lawrence Heights, and Whitby Meadows all
selling 90 per cent or more of their 2019 lot releases. So, what does that mean for you and a future new home purchase? Perhaps you’re waiting for the resale market to stabilize further, well May 2019 figures from the Toronto Real Estate Board showed that resale transactions for singledetached houses were up 25 per cent over the same month last year, and prices increased 1.1 per cent annually. There are other figures to look at to determine if further price reductions for new homes are on the horizon. The average price per-acre for low-density development sites in the GTA in 2018 was $1.69 million, and the average price through the first five months of 2019 shows a very small decline to $1.68 million. That’s a decline of about $241,500 per lot to $240,000 per lot. So, if the developer passed that $1,500 savings to you on the average priced single-family home of $1,109,500, you’d only pay
$1,108,000! Needless to say, it might not be worth it to wait. In conclusion, you’re not likely to see any big increases in new single-family house prices in 2019 or 2020, and you’re not likely to see any big decreases in new single-family house prices, either. So ask yourself, do I want that new house now, or later? Lastly, buy for the long term, buy what you can afford, and do your own research. Good luck. Cheyenne Samuel, strolling the trails of the Humber River. She and partner Julius Jack (working on this particular day), made their home ownership dreams a reality when they purchased a condo at The Humber.
Walking along the trails of the Humber River, Cheyenne Samuel is quick to remark how Weston Village already feels like home. She and her father had always wanted to move to the west end neighbourhood but never got the chance; after he passed away she decided to fulfill that dream by finding a rental in the area. Then she went one step further: in 2018 she and her partner, Julius Jack, were among the first purchasers at The Humber, an upcoming condo community on the banks of the river just south of Lawrence Ave. W and Weston Rd. from Options for Homes. “I love the Weston Road area. We walk the trails of the Humber River, we love the farmers’ market,” she says. “I don’t know how to explain it. You have to live here to really appreciate it.” Cheyenne, a civil servant in Vaughan, says she and Julius, who works at Pearson airport, were able to stay in the city and buy a two-bedroom condo for $483,500 because of Options’ down payment support. The non-profit developer helps people become homeowners by offering a down payment boost of up to 15 per cent. She’d first heard about Options when she was renting at another Options building. Family friends were purchasers at Lawrence Ave. W and Allen Rd. and she liked what she saw both in terms of the quality and the sense of community – a result of Options only selling to end users, not investors. “We knew from living at Shermount the quality of the building is amazing. I also really loved that everyone knew everyone there,” she says. “It’s not like the condos you see downtown where no one knows anyone. There was a community there and I like that.” In 2016, Cheyenne attended a Condos 101 session to find out more about Options for Homes. From that moment, they began saving for their 5 per cent down payment. That the next Options building would be in her desired neighbourhood of Weston, which is close to family, was a stroke of luck. Now as Cheyenne eagerly awaits the completion of The Humber, she says she and Julius – who are both originally from St. Vincent – can’t believe they were actually able to buy. “For us to get the help from Options to own a home it means a lot, especially knowing that we’re not born here,” she says. “To be able to establish ourselves and have our jobs and have a home that’s ours, it means so much.”

In 2017, I mentioned in my writing that a Toronto writer named Jackie Burns had published a children’s book entitled The Condo Kids – Adventures with Bob the Barbary Sheep. I applaud Jackie for breaking ground in children’s literature in this way. Highrise apartment-style living has been a staple in cosmopolitan centres around the world for
decades. Toronto and the Greater Toronto Area are finally catching on, as families are among the spectrum of purchasers opting for condominium living. Jackie’s first book was inspired by the experience of raising her first child in the first condominium she lived in, when he was a toddler. Today, Jackie, her husband and two sons are still condo-dwellers, plus, there are now three books in the Bob the Barbary Sheep series (www. thecondokids.com/). Children’s lives should be reflected in what they read, and growing up in a condo is one experience that has been neglected in most literature aimed at young
people. In fact, condominium living carries with it a lot of advantages for children. By virtue of a condo being a vertical community, children feel an immediate sense of belonging, with elevators, hallways and amenities becoming natural places to meet neighbours. In response to the demand for family-oriented condos, developers are offering three-bedroom and two-bedroom + den designs to accommodate their needs. We are even seeing kid-friendly amenities such as kids’ zones, climbing walls and the like. Kelly Cray: With the upcoming crosstown LRT to become Line 5 on Toronto’s TTC rapid transit maps, many developers are meeting the potential demand by establishing residences in the Yonge and Eglinton neighbourhood. We are designing interiors for Line 5 condos by Reserve Properties and Westdale Properties. These two towers, 36 and 33 storeys respectively, will be located in the area. They have been a real hit with the public with the 504 units selling out within two weeks of the sales launch. We are also currently working with Aoyuang International on

their first GTA project called M2M. It won the award for People’s Choice at this year’s BILD Awards. It’s an exciting project as it will transform the Yonge and Cummer neighbourhood with five new
residential towers and incorporates family-oriented features such as a daycare and play areas. The development will also integrate a new park to further enhance the (community) lives of residents. We are also proud to be part of the Maverick project, led by Empire Communities. It’s a 49-storey condominium to be located in Toronto’s King Street West’s ‘restaurant row’. SL: In terms of amenities, some builders and developers are going to the mat and implementing features that are very hotel-like to add value to purchasers. What are some examples? KC: That’s absolutely correct. With so many vertical communities being built simultaneously, it’s becoming a very competitive market and developers are thinking of ways of setting themselves apart. One way of doing this is to offer specific lifestyle-engineered amenities. Lobbies are no longer a thoroughfare experience. Expanded lounge areas are being incorporated to allow for flexibility, encouraging residents to relax and check emails before meeting with friends; while co-working niches provide an opportunity to work outside of your suite, or host a meeting. These types of functions are very appealing to the young entrepreneur who doesn’t necessarily have surplus funds to rent office space. Often these lobbies tend to be grand, and double storey, similar to a hotel. Rich materials such as marble, stone and porcelain provide a luxury feel, while water features and one-of-a-kind lighting and art installations encourage residents to enjoy the ambiance. KC: As more families are opting for condominium living, due to the steep prices of single-family homes in Toronto, developers are increasing the number of larger suites, as well as providing kids clubs, arcade and games rooms. new hoMe sales in the gtA continue strong, inventory dips in May The GTA new home market saw strong sales in May, continuing the momentum of recent months, the Building Industry and Land Development Association (BILD) announced last week. Total new home sales, with 4,794 new homes sold, were up 94 per cent from last year, and up 27 per cent from the 10-year average, according to Altus Group*, BILD’s official source for new home market intelligence. There were 1,004 new single-family homes, including detached, linked and semi-detached houses and townhouses, sold in May, up 211 per cent from last May but still 32 per cent below the 10-year average. This is the seventh month in a row that new singlefamily home sales have increased year-over-year. Sales of new condominium apartments in low, medium and highrise buildings, stacked townhouses and loft units, with
3,790 units sold, were up 76 per cent from May 2018 and 64 per cent above the 10-year average. “It was the highest number of total new home sales for May since 2002,” said Patricia Arsenault, Altus Group’s Executive Vice President, Data Solutions. “New condo apartment sales were brisk among the near-record number of units launched in April. At the same time, new single-family home sales broke the 1,000-unit threshold for the first time in two years.” Remaining inventory dipped slightly in May, to 12,537 condominium apartment units and 4,574 single family homes. Remaining inventory includes units in preconstruction projects, in projects currently under construction and in completed buildings. “The sales numbers of the last few months show that the underlying demand for new homes, both condo apartments and singlefamily homes, was there all along,”
said David Wilkes, BILD President & CEO. “Our challenge as a region is to continue to develop innovative policy solutions that will allow us to build enough housing supply to meet that demand.” The benchmark price of new condominium apartments increased slightly from last month, to $779,687, up 2.8 per cent over the last 12 months, while the benchmark price of new single-family homes decreased slightly from last month, to $1,109,501, down 3 per cent over the last 12 months. With 1,500 member companies, BILD is the voice of the home building, land development and professional renovation industry in the Greater Toronto Area. The building and renovation industry provides $33 billion in investment value and employs 271,000 people in the region. BILD is proudly affiliated with the Ontario and Canadian Home Builders’ Associations.
