NOISY NEIGHBOURS

Today I intend to re-address a problem that probably generates more mail then any other….the NOISY NEIGHBOUR Every few days I get an email from someone complaining that the person next to them, 6

above them or just close to them is interfering with their quiet enjoyment of their home. What can they do to stop it? There are a number of different approaches depending on the situation, however the basics are all the same. Generally, people and pets are allowed to make reasonable noise during reasonable hours of the day. Check your local “quiet hours”, by calling City Hall or checking online. There are usually city
ordinances or by-laws, that prohibit excessive, unnecessary and unreasonable levels of noise. If your neighbours or tenants are making noise outside these bylaws, police can be called. For noise outside of these quiet hours if you are in a rental situation, you can make an application to your local Landlord and Tenant Board. In order to do so, the noise must be deemed unreasonable. In a condominium to the condominium corporation
and the management company, in a freehold the City By-law enforcement office or the police. What does this mean? This interpretation should apply even if an owner in a situation where the neighbour is right next to you or nearby. Generally, take into consideration the level of noise, the frequency and whether steps can be taken to reduce the noise. Another factor will be demonstrating how the excessive noise impacts you and the effect this has. For example, in a case called The Owners, Strata Plan LMS 4555 v. Chan (L040727 BCSC), that is a condominium case, but applicable, loud piano playing was considered an excessive and unreasonable noise; however, once sleepers were installed into the piano to minimize the noise, the Court decided that it was a reasonable noise level even though the noise had not been completely eliminated. Another example could be loud footsteps from your neighbours or their pets above you due to wood flooring. In a situation like this, the noise could be brought down to a reasonable level by the purchase of a rug by the noisy tenant. In a condominium high rise building often there are rules for the building ensuring wood floors are covered. Ok so the moral here is that whether a tenant, an owner in a high rise, a semi, town or even freehold, you have to prove that the bad noise is happening if you
want to take up the issue with the appropriate authority. How do you do that? You should make a log of the time and dates of the noise and make it as detailed as possible (an “Incident Report”). You can record the noise and have witnesses available to substantiate the situation, if necessary. You should report excessive noise to your Landlord, or condominium management company and board, Bylaw officers, police as applicable; records of complaints are evidence! You should find out if other neighbours are impacted in order to bolster your case. In all probability, if the noise is too loud for you, other people in your building or on your street may be experiencing the same problems. There is an order of escalation you need to follow with respect to this kind of issue. The first step should be to talk to your noisy neighbour. This is often the simplest way and sometimes it is all that is required. Your neighbour or Tenant may not even realize the amount of noise they are making. If that does not work complain to the appropriate authority. Provide a documented, chronological memorandum with backup (remember the Incident Report). It is hard for people to shrug off evidence. If that does not work take it formally to: a) if a tenant – the Landlord and Tenant Board (Note: Only a Landlord can take noisy neighbours to the Landlord and Tenant Board. Tenants need to bring an application against the
Landlord if the Landlord does not take steps to stop the offending Tenant.) ; b) if in a condominium -to the Board or as in c) to By-law enforcement or the Police. What if non of it helps? If it is bad enough go and see a litigation lawyer to start Court proceedings. Last resort but usually gets results. Noisy neighbours are a terrible disease on the urban landscape. I suppose we can only hope that civility and a recognition that we are in this together, will ensure that good manners and respect for each other become important again and we can eliminate this issue. I hope everyone that reads this article takes the time to think about it and not become a noisy neighbour. While there are tons of benefits to purchasing a pre-construction home, in most cases the closing costs are higher when buying a new property than a resale home. To avoid unexpected surprises on the day of closing, it’s important to make yourself fully informed of all expenses associated with your purchase, along with the standard closing costs like land transfer tax, legal fees, title insurance. 10

TARION WARRANTY FEE
DEVELOPMENT CHARGES
Tarion warranty covers a variety of items from defects in finishes and major structural deficiencies, to deposits. They also investigate homeowner warranty claims and assist in resolving disputes between homeowners and homebuilders. The warranty enrolment fee does come as a cost to the purchaser (I’ve only ever seen one developer cover this cost). The amount of the fee depends on the price of the home. For example, a $400,000 property enrolment fee would be around $1,080, while an $800,000 home would increase your closing costs by around $1,600.
This is typically the largest closing cost with pre-construction. Development charges are fees levied by the municipality on new residential, commercial and industrial projects. The fees are intended to cover the cost of growth-related infrastructure. Instead of taxpayers taking on these costs, they are charged to the developers and then later passed onto the purchasers, either partially, or in their entirety. In Toronto a lot of developers pass on the entire cost to the purchasers and this is where most of the horror stories occur. Thankfully, historically Ottawa

Keep in mind that if you are buying the property for strictly investment purposes and plan on renting it out right away then you will be responsible for paying those taxes on closing and then going through the rebate process yourself. Also important to note—there is a maximum rebate of $24,000. Of course, I advise that you seek a real estate lawyer and an accountant’s advice regarding this matter. MISCELLANEOUS FEES
developers have absorbed a lot of those costs by being more flexible when establishing a cap on these charges. In many cases the development charges are capped somewhere between $2,000-5,000. It’s extremely important to ensure that this is the case in the purchase agreement you’re signing. Depending on the market and the popularity of the project, you may have the power to negotiate this cap to a lower number. TAXES
While many experienced developers include all applicable taxes in the purchase price for
end-users, I suggest triplechecking this. I have seen developers charge additional taxes on parking spots, storage lockers and upgrades. With most big developers, the sales taxes are included in the price of the home. In which case, the homeowner agrees to assign all tax rebates to the developer. The developer then applies for these rebates on the buyer’s behalf. However, if the purchaser does not qualify for the maximum rebate amount provided by the federal and provincial governments, then the difference will be charged back to the purchaser.
Often times, there are a few other random costs sprinkled throughout the purchase agreements. Here are some examples: mortgage discharge fee for the vendor’s mortgage, utility meter installation costs, twomonths worth of condo fees (in order to build up the reserve fund). Hiring a lawyer who is comfortable with pre-construction contracts is very important. An experience real estate agent can also help you navigate through the purchase agreement and negotiate with the developer on your behalf.

Ottawa is in growth mode According to a new report from PwC and Urban Land Institute called Emerging Trends in Real Estate 2022, builders and developers should be looking at opportunities to build condominium and rental developments thanks to a wave of technology jobs and the second phase of Ottawa’s light-rail transit plan. The residential housing market has been particularly strong in Ottawa, says the report, with the work-fromhome movement creating an opportunity for people to move to the Ottawa area from more expensive regions of the country. Despite the work-from-home trend and hesitation from tenants to have workers return to the office, the report said many office landlords are making plans to 12

update their common spaces and amenities to retain and attract new tenants. How it will unfold depends on how the federal government plans on handling the issue says the report.

People often say it’s good to learn from your mistakes. But, when it comes to buying a home, you don’t want to leave any room for error. Whether you’re a seasoned homeowner or a first-time buyer, there are many common missteps that can occur throughout the mortgage and buying process, 14

which could end up costing you thousands of dollars. To ensure you’re prepared to take the plunge, here are six common mistakes to avoid when buying a home. NOT GETTING PRE-APPROVED FOR A MORTGAGE
Getting pre-approved for a mortgage isn’t exactly mandatory, but it offers many advantages for homebuyers. It establishes how much you can borrow early on in the process. Understanding your home affordability not
only makes for a more efficient home search, but it allows you to set a realistic budget so you’re not overspending. A pre-approval will also benefit you in the case of a bidding war – something very common in today’s hot market. When a buyer is pre-approved for a mortgage, a seller is often more likely to accept their offer because it shows credibility and that they are serious about making the purchase. And, if you’ve already been pre-approved, it’s also a good idea to consider
these common errors so you can ensure final approval upon your home purchase. FAILING TO CONSIDER OTHER COSTS
Coming up with a down payment is only one piece of the puzzle, and while it’s very important, many buyers lose sight of other expenses that come with buying a home. These often include closing costs, insurance fees, property taxes, legal fees, monthly living expenses, moving costs and the list continues. If you plan to purchase in a highrise building or a lowrise property, it’s worth noting that maintenance fees and other costs will differ – making it even more important to understand the difference and evaluate your budget accordingly. Failing to factor in these costs or allocating too much of your monthly income toward mortgage payments might make it difficult to meet other household expenses after moving in. To avoid this mistake, review your savings and consider all of these expenses before beginning the process. Getting pre-approved is a good first step because it allows you to create a budget to factor in these unforeseen costs. LIMITING YOURSELF TO ONE LENDER
One of the most common mistakes many homebuyers make is not shopping around for different lenders. Mortgage terms and products vary between lenders, which is why shopping around gives buyers the benefit of comparing options so that they can make the best choice. In some cases, many homebuyers think that getting a mortgage can only be done with the big banks. However, there are many mortgage lenders in Canada, such as credit unions and monoline lenders that may have better mortgage options than the banks.
So, before heading to your local bank, it’s recommended to shop around to see what’s available in the market. The Canadian government has many great programs to help firsttime buyers in the homebuying process. Believe it or not, doing this can save you thousands of dollars if you were to ever switch your mortgage, break it early or make a lump sum prepayment. For example, let’s say you’ve recently received a monetary gift of $10,000 from your parents and would like to use that extra money to pay off your mortgage faster. This would require you to make a prepayment, which is possible but might result in a penalty fee if you don’t have prepayment privileges in your contract. Effective ways to make your powder room pop

On the contrary, they can make a stylish and bold statement that complements the vibe and flow of the rest of your home.

As a designer, one of my favorite spaces to tackle is the powder room, as this little jewel is where homeowners are often willing to take a risk. This allows us to stretch our design muscles and have a little fun. The powder room is the only bathroom your guests will see so, lets knock their socks off!
Statement tile There are many options on the market today for lovely, patterned tiles. Everything from authentic encaustic cement to less expensive ceramic versions that are a little easier to maintain. Tiling the wall can have a huge impact on the overall look of the space. In this powder room, we brought the dramatic tile up onto the walls. This classic black small-scale herringbone creates texture and drama in this small space, and connects nicely with the warm wood of the vanity and floor.
Wallpaper wow While tile can definitely make a statement, wallpaper can really wow! In a powder room, you are not dealing with the moisture and humidity from a bath or shower, so almost any wallpaper can work. A bold floral, makes a huge statement and encases you in beauty when you walk in the door. While you may not want this much pattern and colour in a more frequently used room, it works well for a powder room, as you stop in for just a moment, appreciate the beauty and then head out again. A perfect pop of drama in your day.
This large-scale organic pattern is the ultimate showstopper, and the ring light provides the perfect light to touch up your makeup.
In this beautiful powder room, we took a simple white hexagonal tile and wrapped the wall and floors for maximum impact. The black grout really makes it pop and helps bring further drama to the space.

Other elements to consider in your powder room are the accessories and details. Beautiful soap dispensers and luxury towels will give your guests a moment of pampering while in your space. Just purchase large format hand soap refills to top up your pretty pump. Its more environmentally friendly, too. Win-win. A vase with fresh flowers or dried pampas grass can add that final bit of finish to create a unique space.
Etc. We’ve covered tile and wallpaper, so what else is there? Well, what about the trim? Or paint? Or both! In another powder room, we designed a beautiful asymmetric trim wall and then painted it a lovely shade of blue. (See it reflected in the mirror there?) This colour is repeated in other areas of the home, so the powder room feels cohesive in its design, but special all at once. Such a great, budget-friendly trick.
Art can also provide a beautiful backdrop and bring a space to life. These details are present in almost every powder room we create for our clients, and while they might not be obvious, they really can create the most stylish of spaces.
