When it comes to where we prefer to live — be it an urban, suburban or rural setting — that number seems to be evenly split according to the 2021 RE/MAX Housing Market Outlook Report. Roughly three in 10 Canadians prefer to live in each area, according to RE/MAX, and the numbers show that suburban markets across the country are being impacted by out-oftown buyers as a result of the demand. In fact, move-up buyers are expected to continue to drive market activity in the year ahead, particularly in the Ottawa area which has seen a massive spike in the demand for luxury (meaning larger) homes in the suburbs. Interestingly, a new breed of buyer, called the “move-over buyer” is also looking for more space, and they are willing to move away from the city to get it. Move-over buyers are different than move-up buyers for just that reason — they are willing to move well outside of the city to find what they want — a balance of affordability, lots of square footage, and access to amenities and infrastructure. If you’re in the market for a new home during this unprecedented time, I advise you call ahead to make an appointment before you visit. Many representatives will be available virtually or may be able to conduct a socially distanced visit. COVID-19 AND THE AGREEMENT OF PURCHASE AND SALE

JACQUELINE MONETA, JD, & JAYSON SCHWARZ, LLM COVID-19 has created a unique situation in the real estate market, not only for the buyer and seller, but also for realtors, mortgage brokers and lawyers. The current restrictions and limitations necessary to comply with physical distancing are having a direct impact on a buyer’s experience. Showings are conducted virtually, meetings with brokers and lawyers take place over Zoom, and everyone is working remotely. As a solution to some of these challenges, many real estate agents are now including COVID-19 clauses in Agreements of Purchase and Sale. But how do these clauses protect the parties and what should you look out for? COVID-19 clauses in Agreements of Purchase and Sale are meant to protect the parties from delays and interruptions to their deal caused by issues relating to COVID-19, including illness, self-isolation or delays with third parties. However, a COVID-19 clause, which is not carefully drafted and reviewed, may cause unnecessary confusion or delay. Consider, for example, a common clause which contemplates an extension of a real estate transaction where either party is subject to a mandatory COVID-19 quarantine and the agreement is automatically extended, at the request of either party, for a period of 14 days. 14

This clause doesn’t consider a situation where a party is still sick after 14 days or where a party has to stay in isolation as other members of their household remain COVID positive. In addition, most people self-isolate voluntarily, rather than it being mandatory. Would this put a party, who is self-isolating to mitigate the risk of exposure or transmission to others, in breach of the agreement? And what if the party was able to close the deal remotely, using audio-video technology? Would they be able to delay the transaction due to a quarantine despite their ability to close? So, what if your real estate agent includes a COVID-19 clause in an offer, or you receive one from a potential buyer? Discuss the clause carefully with your agent and seek the advice of your real estate lawyer before signing the agreement. It’s important to disclose what you are hoping to achieve should an unexpected situation arise. Certainly, there are ways to protect both the buyer and the seller from complications which may arise as a result of COVID-19. But it’s important that buyers and sellers are aware of the potential pitfalls with these clauses before

including them in any contract or Agreement of Purchase and Sale. The world as we know it has changed, and we must change with it. Protect yourself and your family by speaking to an experienced real estate lawyer, and they will guide you properly and protect you to the exclusion of all others from the dangers brought forward by COVID-19. A good real estate lawyer should also ensure you have a will or Power of Attorney. The minute any real estate deal is firm, ensure that at a minimum you have a Power of Attorney in place in the event that you are physically or mentally unable to complete the transaction. You must protect your family and yourself.

OUTLOOK 2021 WHERE MORTGAGE RATES ARE HEADED NEXT YEAR JESSE ABRAMS Mortgage rates have been a popular topic of conversation among Canadians, as they have continued to drop over the last 20 years – especially this year. Although rates temporarily increased above the three-per-cent mark at the beginning of 2019, they quickly came back down by the end of the year. Adding a global pandemic into the mix, and we have seen rates consistently drop for the majority of 2020. Given that the housing market in Canada is a keystone to the economy, the Bank of Canada has stepped in to purchase mortgage bonds, which lowered interest rates to stimulate homebuying. Today, as we continue to navigate through this pandemic, mortgage rates continue to sit at record lows. WHERE WILL RATES GO IN 2021?

During normal times, interest rates can be impacted by a series of social, political and economic factors, as well as rate changes from our U.S. neighbours. For example, the five-year Canada bond yield recently increased six basis points to 0.46 per cent on positive news of a potential COVID-19 vaccine and Joe Biden’s presidential win. Oftentimes, increases in bond yields are a leading indicator of rate increases. Conversely, in a pandemic environment, where unemployment is high and economic growth is weak, interest rates tend to be lower to stimulate homebuying, which is what we’ve seen over this last year. As a result, the government introduced a series of stimulus 16

efforts that have led to consistent interest rate decreases. As we head into 2021, the outlook remains uncertain, as the prospect of a viable vaccine has made things a little more optimistic than expected. If this vaccine works and decreases the number of COVID-19 cases in the first half of the new year, this could increase employment and positive sentiment in the marketplace, while decreasing the need for stimulus efforts. In this scenario, this could lead to slightly higher rates, but nothing too drastic, as recovery takes time. Given the effect COVID-19 has had on Canadians and the marketplace at large, it’s unlikely we’ll see major changes in interest rates as we head into the new year. Instead, it’s more likely that we will see stability and maybe slight increases or decreases based on seasonality. SHOULD YOU BUY NOW WHILE RATES ARE LOW, OR WAIT?

If you’re ready to buy a home, you shouldn’t let rates be the main determining factor. The truth is, no one has a crystal ball and you could find yourself spending more money by waiting things out. Home prices have consistently gone up over the last 20 years, and rates can unexpectedly increase at any time, so waiting for a decrease in interest rates might actually cost you more. That’s why the best thing to do is buy a home when you’re ready, and really focus on locking in a holistic full-feature mortgage that will save you the most money. rates is astute, you also want to take into consideration the features of your mortgage. Having a full-feature mortgage that includes prepayment privileges and low penalties is essential. It’s one of the best ways to save more money in the long-run and provide more flexibility with your mortgage. While a rate can save you hundreds, key features can save you thousands. Choosing the wrong lender or option can leave you with high penalties if you ever need to break your mortgage, whether you’re refinancing or selling your home.
