Consumer confidence is key to our economy. Without it, our interest in purchasing high-ticket items such as cars, homes or luxury goods, plummets. In the new-home industry, consumer confidence was given a boost last month with the passing of the ‘Rebuilding of Consumer Confidence Act’, or Bill 159, which essentially overhauls the entire Tarion program to better serve and protect new-home and condo buyers. The Tarion warranty program covers every brand-new home and condominium in Ontario. It is mandatory, with the cost of the program typically built into the price of a new home. The overhaul of Tarion is designed to give buyers the highest level of protection they can get when buying ‘new’ based on a number of recommendations made by the province’s auditor general. In recent months, Tarion has taken steps to improve protections for consumers, including: • Enhanced disclosure for purchasers buying pre-construction condominiums; • Updates to the Ontario Builder Directory to help prospective buyers make informed decisions; • Public disclosure of compensation to improve transparency. And, there’s more to come. The Tarion.com website has a ton of great information for new-home and condo shoppers, and the directory includes background information about builders all across the province. Be sure to check it out, and always have a real estate lawyer review your offer before you sign on the dotted line. BRIGIL SUPPORTS COMMUNITY GARDENING PROJECT BY DONATING SPACE The Mooney’s Bay Community Garden was a project spearheaded by the Riverview Park Community Association, supported by River Ward Councillor Riley Brockington. It is temporarily located at the vacant grocery store at the Riverside Mall – a location generously donated by Brigil as they confirm plans to redevelop the land. A ribbon-cutting ceremony took place July 13. Local families are excited to tend to their own garden plots, with a portion of their harvests designated for donation.

ESTATE PLANNING DURING THE PANDEMIC by JAYSON SCHWARZ LLM & JACQUELINE MONETA

JAYSON SCHWARZ One of the questions we receive frequently is, “Why do I need a will?” People stammer and start, don’t want to discuss it and avoid the topic completely. These days, it’s more important than ever. All of us who love our families have an obligation to take this simple step to ensure their continuity, if something should happen to them. It is important that you make a will for the following reasons: • To prevent your estate from going to the provincial government • To make sure the people you want to leave specific items actually receive them • To avoid leaving your relatives with costly issues after your death • To allow you to choose people to act as adoptive parents or guardians, if you have young children • COVID-19 has brought with it a unique set of challenges when it comes to the preparation and signing of wills and Powers of Attorney As of April 7, wills can be witnessed by video conference. Previously, two witnesses had to be physically in the presence of the testator (the person making the will) when a typed will is signed. The emergency order from the government of Ontario now confirms that the

“presence” may be by audio-visual communication technology. Please note that at least one of the two witnesses must be a licensee of the Law Society of Ontario (a lawyer or a paralegal) (the “Licensee”). This will likely require a different affidavit of execution than pre-COVID-19. We recommend two separate affidavits of execution, one for the Licensee and one for the second witness. The new emergency order now confirms that Wills and Powers of Attorney can now also be witnessed in counterpart (than means signed at different times). By using video conferencing and counterpart, wills and powers of attorney can be fully executed remotely, giving immediate validity to the documents. These new processes allow for lawyers and clients to adapt in these unprecedented times but increase work for everyone. All instructions need to be in writing and signed off. Clients need to review their will and ask questions on the phone or

virtually. Finally, signing using audio video technology requires the lawyer to keep detailed notes, likely thorough the use of a checklist, or record the meeting. Whether signing one copy of the will via video conference, or using counterparts, it’s important that both the witnesses actually see the testator, sign the will, and that the testator actually see both witnesses subscribe the will. This may require up to two additional video conference calls with the testator to ensure compliance and validity. A new Engel & Völkers report shows there is a spike in demand for luxury real estate as Canadians emerge from lockdown. Its newly released Mid-Year 2020 Canadian Luxury Real Estate Market Report finds adaptation to the new ‘normal’ is causing Canadians to rethink how they live and seek out spaces that offer flexibility between work and leisure while staying home. Low inventory is driving up prices in major metro areas. Amidst stock market fluctuations, Canadian real estate is proving to be a solid investment. Virtual tours have proven to be a valuable tool for vetting real estate, and Engel

& Völkers is reporting the virtual element is here to stay. The market report provides an analysis on residential real estate through April, May and June across five major cities, including Ottawa. It discusses luxury real estate across three price segments of under $1 million, $1-4 million and over $4 million as listed in the Multiple Listing Service (MLS). Ottawa proved to be an outlier with the healthiest rebound and biggest price gains as a result of its sustained stable economic environment during the pandemic. Multiple offer situations continue to grow on tight inventory with 56 per cent of listings sold over asking

in June compared to 43 per cent in May. These conditions resulted in a steady price incline with June seeing house prices rise 15 per cent and condo prices rise 17 per cent year-over-year – the highest across all major Canadian markets. Despite the pandemic, Ottawa has only strengthened its position as a seller’s market, maintaining its status as one of Canada’s fastestgrowing real estate ecosystems. In April, the pandemic’s impact triggered a year-over-year decrease in residential home sales by 55 per cent in Ottawa. At the close of May, average prices for residential units in the Ottawa region rose by 13.8 per cent compared to last year. June saw recovery back to normal levels with a mild two per cent drop in unit sales year-over-year, a drastic improvement from the 55 per cent drop in April, and a 44 per cent drop in May. June saw Ottawa’s house prices rise 15 per cent year-over-year and 17 per cent in the condo segment, boasting the largest price increases in Canada, as was predicted by Engel & Völkers in its spring 2019 forecast. as one of the most attractive for investment by virtue of its stability and healthy economic environment. Overall, the Canada market proved resilient within all major metropolitan markets showing stark improvements following a significant pause by COVID-19. Despite April being marked by generational lows, May and June quickly rebounded showing positive trends in overall home sales, prices and consumer confidence. Busy spring markets have shifted into the summer and optimism is on the rise nationally. “Canadian markets are proving their resiliency. Demand in Halifax, Toronto, Vancouver, Montréal and Ottawa held through the pandemic, with high-demand

price points selling quickly with multiple offers,” said Anthony Hitt, president & CEO, Engel & Völkers Americas. “COVID-19 has caused Canadians to rethink how they want to live, causing a shift in buyer preferences and habits in real estate. This is reflected in rising demand for properties with flexible living spaces to meet both work and lifestyle needs and amenities such as pools, entertainment rooms and outdoor living spaces and entertainment spaces. We’re seeing a trend toward cottage country and the suburbs, creating a temporary buying opportunity within the urban condo market as people prioritize properties with more space.”

In this space, our 60-per-cent colour, otherwise known as the dominant colour, is off-white, which is chic and sleek in any scenario. Covering about 60 per cent of the space, walls and sometimes large furnishings are the usual suspects for the dominant hue, which is frequently a neutral colour chosen for its versatility and its wide-ranging appeal. The 30-per-cent colour, or secondary colour, should cover about 30 per cent of your space. As a general rule, select a colour that contrasts your dominant colour. We chose a few different shades of grey for furnishings, area

rugs and some accessories, which really “pop” against the white backdrop. Grey also happens to be another trending neutral these days, so it delivers the trend factor with the eternal appeal of a neutral colour, making it the ideal choice for big-ticket furnishings such as a sofa. Now for the smallest, yet arguably the “biggest” colour of your palette: The 10 per cent of your trifecta. Also referred to as the accent colour, this is the wow factor for your space. Though it only occupies 10 per cent of your view, your eye is instantly drawn to these small but steady punches of colour, often appearing in accessories such as textiles, artwork and curios on display. Our choice for the accent colour is a dusty rose pink. We love how this hue instantly warms up the otherwise cool palette of white and grey, making its small but not-so-subtle appearance in every room. An accent chair in the living room sofa; pops of pink books and accessories; a cosy cushion and rug in the bedroom. When it comes to choosing a colour combination for your home, consider how a particular colour affects your mood, and how you want to feel when

you’re in a specific room. If you’re having trouble nailing down that perfect combination, draw inspiration from a piece of art, a rug or a fabric swatch that you love. Ultimately, there’s no right or wrong choice. If you love it, then it’s right!

or the first time in years, welcome to the inside of the “Miami� home of TV’s The Golden Girls. Although the lush subtropical landscaping surrounding the home was in keeping with the Miami environment, where the golden girls supposedly lived, the house itself was actually located in Los Angeles. While we were convinced that the comedic adventures of Blanche, Dorothy, Rose and Sophia took place inside the home we knew so well from the outside, in fact it was a set and not the original house. Now we have the opportunity to see that the actual house is far larger in volume and is a mix of mid-century modern, Japanese and Hawaiian architecture cleverly designed to reap the most from the mild California climate. Now for sale by the estate of the

Celebrity Homes + Condos original owner, The Golden Girls TV home is priced at $2.9 million. Still going strong on cable television 28 years after the final episode, the sitcom that ran from 1985 through 1992 and won more awards than almost any TV comedy on record, revolves around three slightlyover-middle-aged women who find themselves single again, plus the elderly mother of one, who struggle to be viable in a youth-oriented world. The four strong characters include Dorothy, the sensible one; Rose, the innocent airhead; Blanche, the consummate man-crazy flirt; and Sophia, the spry, sometimes too active mother of Dorothy. Their interactions between each other and the script’s formula was a handsdown winner. The actresses: Bea Arthur, Betty White, Rue McClanahan and Estelle Getty each received at least one Emmy Award for their work on the show. Little did we know that the real interior of The Golden Girls house had a completely different interior than that of the set. Instead, the 2,901-square-foot, four-bedroom, four-bath Brentwood home has huge open rooms and tall vaulted ceilings enjoying the feeling of wide-open space, unlike the small-cozy rooms we came to know through the sitcom. The home was built in 1955 by the Hawaiian architectural firm of Johnson and Perkins. The original design features include floor-to-ceiling glass, oak floors, sliding Japanese shoji screens eliminating the need for drapes, and a wonderful green-and-turquoise

kitchen cheerfully displaying the epitome of a cool 1970’s look. The Hawaiian element brings the outdoors in with vanishing threshold and large covered patio with skylights to protect from the occasional raindrop.
