To celebrate Family Day this year, we are looking into what it means to be an urban family in Metro Vancouver, and hopefully before too long we can get back the right balance between work, school, family and friends. Habitat Ground-breaking Porte Communities, in collaboration with Hudson and fabric, is excited to announce that construction has started at Habitat on East Broadway in East Vancouver. INNOVATIVE MORTGAGE AND INVESTMENT STRATEGIES

Most people believe that being mortgage-free is their plan for retirement. That means paying off your mortgage as fast as possible becomes the priority and having other forms of investments are considered only after your property is paid off. It is important to decide what option will give you the balanced diversification and protect you from the real estate market and economic fluctuations. One strategy is to be mortgagefree, so you will have minimal property expenses when you retire and have 100 per cent of the value of your home in equity. You will then have extra funds when you decide to down-size to a smaller home. But by putting all of your eggs in one basket, you could be limiting the ability to use other investment options that could give you a higher return on investment and would help you achieve your retirement goals faster. By focusing on making extra payments towards your mortgage, making lump sum payments on your mortgage, or increasing your payments regularly, you would shorten the life of your mortgage, yet you are not investing into your RRSPs. Here is the best of both worlds: By investing in your RRSPs, you pay less taxes, get a refund, and with that money you could make 22  New Home + Condo Guide  |   Feb. 20–Mar. 6, 2021

a lump sum payment on your mortgage every year. Another option would be to put the equity in your home to work for you by using a HELOC (a home equity line of credit). This will give you access to your equity whenever you need it and would be a perfect investment vehicle. Having a HELOC separate from your actual mortgage, gives you the flexibility to use it for investment purposes, therefore, the interest you pay on funds that are drawn from the home equity line of credit are tax-deductible. Here are some investment ideas: Use the funds from the HELOC to purchase an investment property, and with the rental income you could cover the mortgage payments and property costs. The rental property would then pay for itself and you have a vehicle to help with your retirement goal. Another idea is doing the “Smith Manoeuvre”. PATTI AND SY DISCOVER BRICKWATER by SUSAN M BOYCE

Three and a half years ago, magic happened at the Brickwater presentation centre in downtown Maple Ridge. Already proud grandparents of an eight-year-old grandson, Patti and Sy were just beginning to consider downsizing from the single-family home where they’d raised two daughters. “Patti can’t drive any longer, and she really wanted to be able to do things on her own without being so dependent on me,” Sy explains. “When I saw the sign go up at Brickwater, I thought what a great location this would be for her because everything is walking distance.” That weekend, the couple popped into the newly opened presentation centre to investigate further. The floorplans wowed them — especially one corner suite with a massive balcony and panoramic views from Mount Seymour in the northwest to Mount Baker in the southeast. “I’m not really a condo person,” Sy admits. “But we made an offer on the spot. After all, we could always rent it out if we didn’t want to live there ourselves.” It would be almost two years before construction was complete. Still, Patti admits that she and her daughters were all wondering what “Daddy” would actually say when he walked through the front door of their new home. She smiles fondly at her husband. “We needn’t have worried. You should have just seen his face. The suite was breathtaking — so spacious and tastefully finished. And the views… every room, including the kitchen, has a view of mountains or trees. I told him there was no way we were going to rent out a place that was this gorgeous.” In June of 2021, Patti and Sy will celebrate their second anniversary at Brickwater. Despite the excitement of getting handed the keys to your new condominium, many new purchasers of new development condominiums are surprised to find out that title to their property may not be transferred at the same time. New construction condominiums in Ontario have two closings: The interim occupancy closing, and the final closing. InTERIM OCCUpAnCy CLOSIng

construction is complete on some of the units or after completion but before registration. This is called interim occupancy and it is governed by the Condominium Act (the “Act”). As buildings are ready for occupancy, the builder will advise you of your interim occupancy date. Once the interim occupancy date arrives, you must take occupancy. However, it is important to understand that you don’t own the unit until final closing; you are in effect a tenant in your soon-to-be-owned unit.

Ownership can only be transferred if the condominium has been registered on title, which occurs once the majority of units are occupied. Interim occupancy periods can be a few weeks or a month, or up to years. All is dependent on the completion of construction, and occupancy depends on how quickly construction is complete on all units. InTERIM OCCUpAnCy FEES

During the interim occupancy period, you must pay your builder


or seller an interim occupancy fee, whether you move into the unit or not. The monthly interim occupancy fee is based on: The interest (calculated on a monthly basis) on the unpaid balance of the purchase price at the prescribed interest rate (set out in the Act and Regulations thereto); estimated monthly municipal taxes for the unit; projected common expense fees for the unit. DELAyED OCCUpAnCy

Construction can sometimes be unpredictable and this could result in delays in condominium development projects, and you may be unable to move into your unit as expected or close within the time frames set forth in the Agreement of Purchase and Sale (“APS”). Your APS must include a Tarion Addendum that

sets out important dates for your agreement, including your occupancy date. These are set out in the statement of critical dates. You need to determine when you are buying whether you are buying with a Firm or a Tentative Closing Date. There are two addendums available from Tarion: READ THEM CAREFULLY, as they set forth exactly what can happen and what delays can accrue if any. Delays can affect financing, accommodation notices, budget, etc. In this market, you need to be prepared to deal with the results if an extension occurs. If the builder complies with Tarion, you will have no remedy to compensate yourself for the inconvenience or the additional expense. The consequence of these delays can be quite upsetting. I recommend that everyone buying a new home prepare himself or herself

when they make the original offer and continuously thereafter, for extensive delays and that way, you face no surprises. Remember, most builders want to give you what you contracted for and will work with you to achieve mutual satisfaction. In closing, please use your lawyer to the fullest extent, and remember, only your lawyer can give you legal advice.
