BASEMENT RENTALS CAN HELP YOU GET INTO THE HOUSING MARKET

by MICHELLE HOPKINS In 1989, Don Campbell and his wife purchased their first home and rented their finished basement as way to pay off their mortgage sooner.

“The rent from our basement suite buffered our income,” says the author and senior analyst with the Real Estate Investment Network (REIN). “In addition, we travel a lot, so knowing 24

someone was always home offered us a sense of security.”

Campbell is a huge proponent of basement suites as a way “to get into the housing market.”

If you’re wondering if you should finish your basement right away, Campbell says doing so can potentially increase the value of your home by a considerable amount.

Now, that’s reason enough.

Best of all, says the veteran financial expert, most banks will allow you to use the rental income for your basement suite to qualify for a mortgage.

That’s critical if you are a firsttime homebuyer and must prove you can afford the payments under the federally mandated Bank of Canada stress test.

DON CAMPBELL’S TIPS FOR FIRST-TIME LANDLORDS: 1. PROTECT YOUR PRIVACY

Ask yourself if you will be OK seeing a stranger walking around your property every day. Is this lack of privacy worth the extra money?

2. TRY TO AVOID RENTING TO FAMILY

As NICE as it sounds to help out, renting to a family member is fraught with potential relationship crushers. If a tenant stops paying or become a nuisance, there are ways to solve that problem. However, it is much more difficulty to use “eviction” or “collection” rules against a family member without destroying the relationship and having the repercussions ripple out into the rest of the family.

According to Campbell, the stress test means homebuyers with less than a 20 per cent down payment will need to prove they can afford mortgage payments based on which is greater – the Bank of Canada’s five-year benchmark rate or their contractual mortgage rate plus two per cent.

3. SIGN A PROPER WRITTEN LEASE

Never, ever, ever let anyone move in without both of you signing a proper lease that clearly defines rules, responsibilities and costs. And never ever let a tenant move in without providing you with the full security deposit and first month’s suite rent.

4. KNOW YOUR LANDLORD RULES

Before you dive into the rental market, make sure you study up on the rules and responsibilities. They are strict and they are clear, and so must you be from the beginning of the tenant relationship. You can find these rules on the provincial government website.

5. TELL YOUR HOME INSURANCE COMPANY

Critical. You must, in all cases, advise your insurance company that you are renting out a suite. If you don’t, and there is an incident where you need to use the coverage, you may likely get denied coverage.

MARSHALL DISCOVERS FRAME

For Marshall, buying a new home was all about change. “I’d been living in a two-bedroom condo in Lynn Valley on the North Shore for about 15 years.

It was great, but I wanted to upgrade to a threebedroom. And it was just a time for change.”

He already had number of friends who lived in Langley, so he knew that this was a municipality where he could get some serious bang for his homebuying buck. So he decided to take a closer look.

Marshall checked out a few resales, but nothing spoke to him. None of them said: “Oh wow, buy me.”

There was a large development under construction in Willoughby near where he was looking, but there were no corner suites available and the high density felt cold and impersonal.

Then a friend suggested a visit to Frame. “He told me the developer, Hayer Builders Group, had an excellent reputation, and it was just down the street from his place — which would be great.”

Since physical distancing rules had just been relaxed, Marshall was able to request a hardhat tour of the construction site. When he stepped into a D-Plan end unit, Marshall knew he’d found his new home. “I loved the open concept design, and 28

because it has a side-by-side garage, the main floor is more like a large square — most of the other ones I’d seen felt really long and narrow.”

Sealing the deal were Frame’s built-in air conditioning, a must-have on Marshall’s list, the central vacuum, and a gas hook-up on the patio. “I barbeque a lot in the summer, and this way I won’t have to be heading off to Canadian Tire every few weeks for propane,” he says with a grin of enthusiasm.

When he moves in at the end of October, Marshall says one of the first things he’s going to do is purchase all new furniture to suit the style and colour palette of his new digs. “I want to really make this place my own, a reflection of who I am. After all, that’s what making a change is all about.”

ESTATE PLANNING DURING THE PANDEMIC

JAYSON SCHWARZ One of the questions we receive frequently is, “Why do I need a will?” People stammer and start, don’t want to discuss it and avoid the topic completely. These days, it’s more important than ever. All of us who love our families have an obligation to take this simple step to ensure their continuity, if something should happen to them.

It is important that you make a will for the following reasons: • To prevent your estate from going to the provincial government • To make sure the people you want to leave specific items actually receive them • To avoid leaving your relatives with costly issues after your death • To allow you to choose people to act as adoptive parents or guardians, if you have young children • COVID-19 has brought with it a unique set of challenges when it comes to the preparation and signing of wills and Powers of Attorney As of April 7, wills can be witnessed by video conference.

Previously, two witnesses had to be physically in the presence of the testator (the person making the will) when a typed will is signed. The emergency 30

order from the government of Ontario now confirms that the “presence” may be by audio-visual communication technology.

Please note that at least one of the two witnesses must be a licensee of the Law Society of Ontario (a lawyer or a paralegal) (the “Licensee”). This will likely require a different affidavit of execution than pre-COVID-19. We recommend two separate affidavits of execution, one for the Licensee and one for the second witness.

The new emergency order now confirms that Wills and Powers of Attorney can now also be witnessed in counterpart (than means signed at different times).

By using video conferencing and counterpart, wills and powers of attorney can be fully executed remotely, giving immediate validity to the documents.

These new processes allow for lawyers and clients to adapt in these unprecedented times but increase work for everyone.

All instructions need to be in writing and signed off. Clients need to review their will and

ask questions on the phone or virtually. Finally, signing using audio video technology requires the lawyer to keep detailed notes, likely thorough the use of a checklist, or record the meeting.

Whether signing one copy of the will via video conference, or using counterparts, it’s important that both the witnesses actually see the testator, sign the will, and that the testator actually see both witnesses subscribe the will. This may require up to two additional video conference calls with the testator to ensure compliance and validity.

As you can see, the entire process may not exactly be easy, but it’s certainly doable.

by SUSAN M BOYCE You’ve got mail. No wait, more specifically, you’ve got parcels… multiple parcels. A box of groceries, those two pairs of summer cycling shorts that were such a steal on e-Bay, and your new e-reader at last — all just waiting for you to claim.

With almost anything now available just a click away, internet purchases are booming. “Online shopping was already becoming mainstream,” says Bob Rennie, rennie marketing. “But Covid has elevated it exponentially. I believe we will soon see a minimum of one parcel per day per drop off address.”

It’s good news for companies like Canada Post, FedEx, and Purolator, but Rennie doesn’t hesitate to pose a question that’s often swept under the carpet — in a highrise that might have 100, 200, or even more units, what happens to all those packages if no one’s home to accept them?

It’s a problem to tax the best logistical minds.

Answer: smart lockers; also known as electronic parcel delivery rooms or, if you go with the proprietary version, an Amazon room.

The technology behind electronic parcel delivery rooms is surprisingly straightforward.

“When a delivery person arrives, they scan the parcel’s label and the system automatically opens a locker of the appropriate size,” explains David Wan, long-time project marketing director. “Once the package is secure in its locker, the system texts a randomly generated security code to the 38

recipient — a code they use to open the locker when they’re able to pick up their package.”

“It’s about a building’s livability,” Rennie notes. “For younger buyers, it’s already practically an expectation. But more mature buyers are also starting to see and appreciate the convenience.”

In addition to the enhanced security for residents, these delivery rooms also offer a financial benefit. “A concierge, even a part-time one, is expensive,” Wan says. “Having someone in the lobby full-time is

the equivalent of three to three and a half full-time jobs — which could easily cost a strata $100,000 or more per year. Those expenses can push strata fees up really fast.”

Forward thinking developers are already incorporating smart lockers into their designs.

Peninsula by Aragon was one of the first, Loma by ML Emporio Properties is one of the most recent. But there’s little debate that electronic parcel delivery rooms will soon be a de rigueur standard in urban living.

These new rules have the potential to cut the purchasing power of many Canadian homebuyers as it decreases their overall housing affordability. At face value, we can expect this to impact first-time buyers the most, as they’re more likely to make down payments of less than 20 per cent, as well as buy a home close to their maximum affordability.

SOME MAY NOT BE AFFECTED AT ALL

The mortgage rules technically apply only to lenders that use CMHC as their only insurer. In other words, not every lender (if any) will be following through with these new rules. Genworth MI Canada and Canada Guaranty are two CMHC competitors that have chosen not to adopt these stricter guidelines. So, depending on the lender you’re working with, Canadian buyers may not be impacted at all. In this climate, especially, shopping lenders and

finding an unbiased mortgage advisor has never been more important and encouraged.

Changes like this are the exact reason we work with more than 30 banks and lenders at Homewise.

Policies and lending guidelines are constantly changing, so having access to multiple lender options ensures that buyers can find the best mortgage for their unique needs.

Recently, we’ve received a lot of questions about how to navigate this situation. Given the many options we have available, we are able to guide our clients to the right lenders so they don’t have to worry about these new CMHC policy changes. Best of all, many top lenders with great features and rates don’t have to abide by this new criteria.

Given that these rules are new, we’re still learning how they can impact Canadian buyers.

For the time being, it’s evident there are other avenues for many purchasers to get a great mortgage without being impacted by these new guidelines.

At the beginning of June, Canada Mortgage and Housing Corp.

(CMHC) announced its decision to tighten the guidelines for insured mortgages as of July. This applies to mortgages with down payments of less than 20 per cent that require CMHC default insurance.

Given the recent COVID-19 pandemic, there have been varying outlooks of how the Canadian housing market will be impacted.

Evan Siddall, CEO of CMHC – who is also scheduled to depart from the organization later this year – strongly believes that Canadian housing prices will be lowering despite upward trends seen across the country. As a result, he implemented these new policies to stop borrowing from who he deems to be riskier buyers.

When he made this decision, there was a lot of disappointment among first-time homebuyers, as they believed this directly targeted them and negatively affected their ability to buy a home. Now that the dust has settled around this and these changes are in full effect, we’re gaining more insight into who may be affected, and how – some good news for those worried first-time buyers.
