We’ve packed this issue with expert advice, details on the newest developments and industry events, including the winners of Tarion’s Homeowners’ Choice Awards as chosen by you, the consumer. Tarion, which is the warranty program that backs your new-home purchase in Ontario, is poised to transform over the next six months according to details released in the provincial budget. The Ministry of Government and Consumer Services has proposed that Tarion initiate the following enhancements: • Updating the Ontario Builder Directory to include information about developers with a history of condominium project cancellations • Developing options to require developers to post information about their condominium development projects on their websites (e.g., information about outstanding approvals or other matters that could cause a project to get cancelled) • Working with the Condominium Authority of Ontario to educate prospective buyers about the condominium purchase process • Improving information collection on new-home construction projects. According to a news release, Tarion has been tasked to change its addenda to agreements of purchase and sale for condominium buyers within the next 12 months “to enhance disclosures for consumers about the risks of purchasing pre-construction condominiums.” This would include matters that could cause a project to get cancelled, such as outstanding approvals, project financing or restrictive covenants on title, which is good news for you. We always suggest researching the homebuilder and developers you’re considering. Whether you’re buying new or a resale property, there are always risks involved. We recommend that you visit a few of the projects completed by a builder and talk to people who purchased a home or condo from them directly. As always, we hope you enjoy this issue.

OntariO’s toprated builders earn 2019 Homeowners’ CHoiCe awards Recipients recognized for customer service excellence by homebuyers Tarion, the not-for-profit private corporation that administers the Ontario New Home Warranties Act, just announced its annual Homeowners’ Choice Awards for outstanding builders who received the highest ratings from homebuyers across the province. These are the only awards that focus solely on customer service and are based on feedback from homeowners. The recipients of the 2019 Homeowners’ Choice Awards are: • Brookfield Residential – High-Rise Category • Hayhoe Homes – Large Volume Category • Timberland Homes – Medium Volume Category • Chris King and Sons Construction Ltd. – Small Volume Category In 2017, Tarion introduced a new honour – the Ernest Assaly Award – for an Ontario builder who demonstrates a commitment to building quality and innovation, customer service and community involvement. Similar to a lifetime achievement award, a builder can only receive this recognition once. In 2018, Tarion polled 54,518 new home buyers asking them about their builder’s performance before, during and after they moved into their new home. More than 11,376 homeowners responded, and their feedback determined the recipients for outstanding customer service in the four categories. Since 1976, the provincial new home warranty program has registered close to two million homes and paid out hundreds of millions of dollars in warranty claims. The Ernest Assaly Award recognizes the highest level

of excellence in Ontario home building while honouring the legacy of Ernest Assaly, a highly respected leader in the residential building industry who was Tarion’s first Chair. Only a select number of Ontario builders met the rigorous criteria required to even receive an invitation to make a submission. The recipient of the Ernest Assaly Award is determined by Tarion’s Board of Directors. “A well-built home backed by excellent customer service equals a satisfied homeowner,” said Bogach. “Through Tarion’s awards program, these happy homeowners are able to recognize their builders for going the extra mile and this helps build confidence in the new home building industry as a whole. The board of directors sit at the heart of a condominium corporation and oversee its business affairs. As they are members of the condominium corporation, it’s important that owners hold the board accountable for its decisions. ELECTIng THE BOARD OF DIRECTORs

Owners hold supervisory power over the board of directors through elections. Board members are elected at the Annual General Meeting (the AGM). If an owner wants to run for a position on the board, they should notify the board ahead of the AGM. The owner’s name will then be included in the AGM package sent out to residents before the meeting. At the meeting, candidates will introduce themselves prior to the vote of residents. A board must have at least three directors, since odd numbers help prevent issues during board votes. The number of directors is specified in the condo declarations. Each board member’s term can be up to three years, but terms are set typically so that they do not all expire at once.

Is THIs TRAInIng AVAILABLE FOR COnDOMInIUM BOARD MEMBERs? Directors elected or appointed on or after November 1, 2017 are required to take online training offered by the Condominium Authority of Ontario. Directors must uphold a standard of care. This means they must perform duties with care, diligence and skill. If a board member is not doing their job or is acting inappropriately, they can be removed. To have a director removed, a meeting of owners must be called for the purpose. In order to remove the director, a majority of all owners must vote in favour of removal, either in person or by proxy. If the owners vote to remove a director, the owners may elect any person qualified to be a member of the board to serve the remaining term of the director who has been removed, according to the condo corporation’s by-laws dealing with the election of directors.


WHAT ARE THE ROLEs AnD REspOnsIBILITIEs OF THE BOARD OF DIRECTORs?

Your board of directors meets regularly to conduct condominium business. Meetings typically occur once a month. The board of directors must ensure the corporation is run in compliance with the Condominium Act. A director will immediately be disqualified from acting if a lien is registered against their unit or they become bankrupt. The condominium corporation’s by-laws may also include additional conditions for qualification and/or disqualification of directors. While the board of directors holds great power within the condominium corporation, owners are the check and balance. It’s important to attend AGMs, vote for board members and run for positions to ensure your home is well maintained for years to come. As development in our region intensifies, public art is flourishing in our communities. Besides beautifying the places where we live and work, these sculptures, murals and LED installations create a sense of community, evoke civic pride and invite tourism. Many of these works are the result of creative partnerships between our industry, municipalities and artists. In the City of Toronto, a large 20  New Home + Condo Guide  |  Apr. 27–May 11, 2019

proportion of public art is funded through the Percent for Public Art Program, which has developers contribute one per cent of the gross construction cost of projects to public art. In return, the City may allow them to increase the height of a building or build a denser development, an exchange permitted by Section 37 of the Ontario Planning Act. Depending on the size of the contribution, it may be used to commission an art installation on site, pooled in the City’s Public Art Reserve Fund, or a combination of the two options. In the last five years alone, the program has seen the completion

of approximately $25 million in public art, with additional funding secured that has not yet been spent. Since its inception, the Percent for Public Art Program has enriched Toronto with more than 150 pieces of public art. Another remarkable piece of art that people can enjoy as a result of collaboration between industry and the City is Guard with Balloon Dog, a stencil attributed to the anonymous graffiti artist Banksy, which is on display in the PATH system near 1 York Street. It was found on the wall of a former office building in the Harbourfront area. Before the building was demolished, the developer salvaged the panels, had them professionally restored and eventually had them installed, along with a commissioned companion piece, as a public art contribution accompanying its major mixed-use project in the area. Other municipalities in the GTA are also building their public art collections thanks to partnerships with our industry, despite the fact that public art contributions are voluntary. example, in Mississauga, a two-part metal and glass sculpture called “Migration,” depicting birds in flight, forms a gateway over Duke of York Boulevard where it meets Burnhamthorpe Road. The work was jointly funded by developers behind two nearby condo projects and the City of Mississauga. And in Markham, kids and kids at heart can ride a colourful piece of public art, a merry-goround featuring characters that evoke Canada, such as a beaver, a Mountie, a moose and a salmon. The carousel, made by Canadianborn California-based artist Patrick Amiot, is called Pride of Canada, and was made out of repurposed materials collected across the country. It is the centrepiece of an extensive public art initiative that is being spearheaded by the developer behind the major mixeduse development in downtown Markham. The eclectic public art collection includes street art photography in an underground

parking garage and a floral light sculpture over the entrance of a shopping centre. I could fill several more columns with examples of art that we all get to appreciate because of innovative partnerships between our industry and municipalities. As our region continues to grow, we will need more of this kind of collaboration to create thriving complete communities where people can live, work and enjoy their leisure time.

Why Brand neW and newly built condo prices are different

I gave a presentation to a group of potential real estate buyers in early April, and I discussed how the rate of growth for new condominium apartments has finally started to calm down after a multi-year run-up. Unsold new condo prices jumped 40 per cent in 2017 and 15 per cent in 2018. The next speaker at the event after me was developer Brad 24  New Home + Condo Guide  |  Apr. 27–May 11, 2019

Lamb of Lamb Development Corporation, he talked about the rise in municipal development charges and construction costs. Lamb told the audience when he started his Harlowe condominium in 2015, he had hard construction costs of $190 per-square-foot (psf), when he started his East 55 project in 2017, construction costs were $275 psf, and now on the precipice of starting his new Woodsworth project (which has no parking), construction costs are $315 psf — over 65 per cent more than four years ago! Less than a week later, I attended an event called “Dive in

with Developers” hosted by PSR Brokerage that included several of the GTA’s top developers. Stephen Price, the President and CEO of Graywood Developments remarked that when they are setting the unit prices for a new development, they have to price it against a margin, they have to push values up to make the minimum profit required to get bank financing. of Alterra Group of Companies noted that competition for land is fierce, and they have no choice but to pay more for land than current unit sales prices would suggest. He said he has to plug his nose and buy, or he’d have no product to sell. Some people understand that costs are putting upward pressure on new condo prices, and that the 125,000 net population growth in the Toronto CMA last year has brought a lot more housing demand, but what they don’t get is why you’d buy new at a higher price than a recently completed new condo project. I’ll give you an example —in the Toronto’s downtown east, a project called Grid was completed and registered in 2019 — resale units have traded in that building for about $975 psf. In March, The Garden District Condominiums just to the south of Grid released 26  New Home + Condo Guide  |  Apr. 27–May 11, 2019

units at about $1,060 psf. The problem with this comparison is you’re comparing apples to oranges. The Garden District isn’t occupying until 2023, so you’re putting down 20 per cent now for the right to close on a unit in four years. If you think resale prices are going to be less than $1,060 psf in four years, you shouldn’t buy, but many investors believe resale prices will be higher than $1,060 psf in 2023. If resale prices increase by 3 per cent a year in the area, values will rise from $975 psf in 2019 to $1,065 in 2023. Resale condo prices have been going up more than 3 per cent annually, and if prices went up 5 per cent annually, that 602 sf unit priced at $620,000 at Garden District would be worth about $680,000 in 2023. Determining if you want to take that risk is an individual choice, and I’d recommend talking to an experienced realtor that

specializes in pre-construction sales. Ask them for the resale comparisons in the immediate area, ask them about pricing of the competitive projects, and ask if they’ve bought any units themselves, and if so, where? There are lots of choices out there, so do your research. Good luck.

Whatever stage of life you are at, you will likely own a condo at some point. Take empty-nesters and retirees, many of whom see selling their large low-rise homes to realize equity. Many are moving into condos for their price points, and also because of the carefree lifestyle these residences offer. Leaving behind exterior maintenance is a big attraction of the condominium. The money they bank from selling their low-rise asset(s) can go toward traveling and other fun. Another consideration is the simple fact that most condo suites are singlelevel designs, which is great for aging seniors who find climbing stairs a challenge. As mobility issues arise, being able to head to

the fitness centre for an aerobics class, or meet friends for a game of bridge in the lounge can be as easy as an elevator ride. Families today are also realizing the benefits of going condo. Interior decorator Carly Heung shares insight on why the hexagon continues to be a hallmark feature in the design world.

From decorating hundreds of small spaces, I’ve learned to incorporate nature’s clever spacesaving designs through the use of hexagons to create beautiful spaces. Its shape adds angular interest, symmetry and contrast and brings modern inspiration and tranquility to any space. These geoshapes have taken on quite a statement in the last few years but they are truly a trend that is here to stay. Not only is the hexagon pattern modern and appealing, but this shape holds a very special meaning in life all around us. In nature, inside the beehive, each honeypacked cell is built by tiny bee engineers to take on the shape of a hexagon. They do this for a very clever reason – because of packing efficiency. The hexagon shape allows bees to optimize the space they have. If a series of circles were used instead, there would be empty spaces between them. Turtles are also another creature that helped inspire the hexagon. Their magnificent shells, made from one of the strongest compounds in nature, protect them from predators. These shells are fully covered by subunits of hexagons. PoP-uP exhibition celebrates unique story of neon in toronto With plans for a permanent museum in downtown Toronto well underway, Neon Museum Toronto partnered with Slate Asset Management and Neon Demon to bring the Pop-Up Neon Gallery to the Junction House Sales Gallery earlier this month. The Pop-Up Neon Gallery at Junction House features signs and art pieces from the collections of Neon Museum Toronto and Neon Demon. The exhibition celebrates the unique story of neon in Toronto, while raising awareness around the efforts to bring a permanent museum to the city. “Downtown Yonge BIA has been working for five years to establish a permanent home for the neon signs that once lit up Toronto’s streets,” says Downtown Yonge BIA Chief Operating Officer and Executive Director Mark Garner.

“This pop-up is the culmination of a lot of recent momentum around the project and it allows us to offer the public a preview of what they can expect when the permanent museum launches.” The impetus to host the exhibition at Junction House came as Slate Asset Management continues to work with the city to bring a new, illuminated sign to The Junction. Sited at 2720 Dundas St W, just as the road begins to bend, Junction House is conceived as a new gateway into one of Toronto’s most vibrant neighbourhoods. The Junction House project itself offers one-, two-, and three-bedroom suites, as well as its signature House Collection, ranging from 500 sq. ft. to over 1,500 sq. ft. and starting from the $500s. “At Slate we take a city-building approach to development. That

means looking beyond the projectsite and understanding how you can positively impact the greater community. There is an artistry and history embedded in neon signs that the Neon Museum Toronto wants to showcase for the benefit of all Torontonians,” says Brandon Donnelley, VP of Development at Slate. “It echoes what we are trying to achieve with our sign and with Junction House as a whole. The cost of landscaping always seems to shock homeowners. Somehow people relate the cost of landscaping to the cost of gardening and are surprised to find out that decks and wood cost more than plants…not to mention the labour involved to install them. In speaking to several industry professionals, the average backyard renovation starts at around $20,000 with some projects crossing the million-dollar mark. With such a huge range, how do you know how much your outdoor landscaping should cost and how much should you 44  New Home + Condo Guide  |  Apr. 27–May 11, 2019

really be investing in your home? One of the biggest mistakes that a client makes is to envision what they want in the yard BEFORE they really set the budget. When I meet with a client, I start by asking what the approximate value of the home is. If you set your budgets based on percentages of your total home’s worth, than you know that you plans will stay in-line with property values in your neighbourhood. Front yards have been getting more attention by realtors and housing experts because of first-impression numbers. Several online sources place the value of curb appeal and a home’s first impression between 5-8 per cent of the home’s worth. Items like shade trees and front walkways contribute to higher returns, as

do front porches and sitting areas. While plants and gardens are important to the overall appeal, too many flowers in the front yard intimidate buyers looking for low-maintenance homes. As my general rule, I try to keep the front yard landscaping at 7 per cent of a homeowner’s budget. That number does not include the driveway, even though it may be at the front of your home. Backyards tend to be more about function than a front yard space. Good design can offset the shortfalls from the inside of the home with outdoor elements that meet the same need. For example, if a home has a small kitchen, adding an outdoor version with a barbecue or a smoker is a smart investment because it partially addresses


buyers concern when they see the inside space. Having a good deck or patio in your backyard that provides lots of living space can increase your home’s value by up to 12 per cent, according to Century21, Canada. You also need to consider the returnon-investment for your outdoor space. According to ‘Remodeling Magazine’s 2019 Cost-vs-Value Report’ a simple wood deck has an expected return of 75 per cent for the life of the deck, which averages 8-10 years in Canada. This number climbs when you invest in products like MicroPro Sienna; the brown-treated wood available at a majority of box and lumber stores. This wood uses a new treatment process of micronized preservative, which is able to penetrate the wood providing more protection from the elements. If properly cared for, using sealers and cleaning products, a MicroPro Sienna deck can last significantly longer, allowing the homeowner to see a return of 75 per cent of the initial cost for a much longer period. Unfortunately, the size of the deck matters when calculating the return on your investment. So how big should the deck or patio be? It comes down to what you want to use it for. I always tell homeowners to start with the patio furniture. At the store, large patio furniture is shown as compact as possible so that they can get more sets on the showroom floor. Don’t be deceived by this. Too often homeowners plan their outdoor space and can’t find the furniture to fit it. The easiest way to answer this question is to go to the furniture

store and pick out want you really want for your space and then measure it. Bring some friends and make sure to measure your potential set with people sitting in it. Also consider how much room you need to walk around the furniture if it’s being occupied. Here are my general rules…

• A four-person-square table needs a deck that is 12x12 feet. This might seem large but it is important to allow for flow around the table as well as enough space for guests to sit comfortably. Including the barbecue as you plan your space is also very important. • A barbecue needs to be away from a burnable surface by 36 inches when it is in use, so make sure to plan for an area to roll it out before you turn it on. • Four club chairs around a table or propane fireplace needs at least 15x15 feet because people tend to cross their legs or sit in a reclined position and taking up more room on the deck.

With the size of today’s furniture, aim to install a 750-1000 sq. ft. deck to include a six-person table, a decent sized barbecue, and an area for conversational seating. It might seem like a large investment, but all the experts (including this one) agree that creating usable space in the backyard is the key to seeing the big returns when it is time to sell. As you plan your spring projects this year, budget your dollars accordingly. I always tell homeowners to set aside about 20 per cent of their budget for the outdoors. This may seem like a lot, but with all of the housing market numbers showing solid returns in landscaping, you can take comfort in knowing that you money is being spent wisely.

The Ontario Home Builders’ Association (OHBA) welcomed the new Provincial Government 2019 budget, announced on April 11.
