LIVING IN A ‘REAL’ SIMCITY In 1989, Maxis came out with an open-ended citybuilding video game called SimCity. In a nutshell, the game allowed players to develop a city on a patch of undeveloped land. TAX INFORMATION IF YOU BUY OR SELL A HOME Tax season has officially passed, but the Canada Revenue Agency (CRA) has information if you plan to buy or sell a home in the future. PRINCIPAL RESIDENCE EXEMPTION

If your home was your primary residence for every year that you owned it, you do not have to pay tax on the profit (capital gain). Your principal residence can be: • a house, cottage or condominium • an apartment in an apartment building or a duplex • a trailer, mobile home, or houseboat In order for a property to qualify as your principal residence: • You must own, or jointly own it. • You, your current or former spouse or common-law partner, or any of your children must have lived there at some time during the year. To benefit from the principal residence exemption you must report the sale on your income tax and benefit return. How you do so varies depending on whether the property you sold was your principal residence for the entire time you owned it. Only one property can be designated as a principal residence per tax year per family unit. HOMEBUYERS’ AMOUNT

You can claim the homebuyers’ amount of up to $5,000 for a particular year if: • you or your spouse or common-law partner acquired a qualifying home; and • you did not live in another home

owned by you or your spouse or common-law partner in the year of acquisition or in any of the four preceding years (firsttime homebuyer). You do not have to be a firsttime homebuyer if you are eligible for the disability tax credit or you acquired the home for the benefit of an eligible relative who is eligible for the disability tax credit. HOME BUYERS’ PLAN

You may be eligible to participate in the Home Buyers’ Plan that allows you to withdraw funds from your registered retirement savings plans (RRSPs) to buy or build a qualifying home for yourself. The 2019 budget proposes an increase to the Home Buyers’ Plan withdrawal limit to $35,000, available for withdrawals made after March 19, 2019. Buyers have up to 15 years to repay the amounts they withdraw.

You do not have to be a firsttime homebuyer to participate in the Home Buyers’ Plan if you are eligible for a disability tax credit or if you are helping a relative who is eligible for the credit buy or build a home. The purchase or construction must be done to allow a person with a disability to live in a home that is more accessible or better suited to their needs.

To qualify for the Home Buyers’ Plan, you have to: • be a first-time homebuyer • have a written agreement to buy or build a qualifying home for yourself

If you bought a newly constructed home from a builder, you may be able to claim a new-housing rebate for some of the goods and services tax/harmonized sales tax (GST/HST) you paid. For more information, refer to guide RC4028, GST/HST New Housing Rebate.

You are considered a first-time homebuyer if, in the preceding four-year period, you did not live in a home that you or your spouse or common-law partner owned. You must intend to live in the qualifying home as your principal residence within one year of buying or building it. HOME BUYERS’ PLAN FOR PERSONS WITH DISABILITIES

furniture with sleeker pieces. In the bedroom, you’re better off showing a queen-sized bed and two small bedside tables than a king with none. To find the right pieces, you can beg, borrow and, if necessary, lease. Bright paint or outdated wallpaper? Replace them with neutral wall colours and add vibrancy with throw pillows and vases. Splurge on fresh, sweetly scented flowers for an open house; they’ll pay for themselves. Mirrors are a wonderful tool for filling empty walls. And, whatever the décor in your bathroom, thick white towels will lend a hotel-like vibe. For extra curb appeal, give your front door a fresh coat of paint and temporarily take your storm door off the hinges. Invest in two urns; plant them with pretty, seasonal flowers. In winter, cedar branches draped with ribbon are just as beautiful.

As if purchasing a new home isn’t intense enough, homebuyers (with the exception of first-timers) also have to sell their current properties. The fact is, few homes are ready to go on the market as-is. It’s not just a matter of tidiness – though that’s certainly crucial. It’s about helping potential buyers to connect emotionally with your space. That means making your home welcoming to as many people as possible, often at the cost of your own personal taste. This isn’t easy, but a professional stager can help; your realtor may even have one on staff. If a stager isn’t in the cards, there are steps you can take on your own. First off, de-clutter. Chances are you have twice as much stuff as you need to show your home to its best potential. In addition to removing obvious messes, this includes things like extraneous furniture, children’s toys, knickknacks and family photos. This can be emotionally difficult but remember, the goal is to make it easy for potential buyers to imagine their own possessions in your space. Next, fix unfinished projects. If buyers see loose floor tiles and cracks in the wall, they’ll wonder what other issues are lurking under the surface. Don’t give them cause to worry. To make rooms appear larger, replace puffy, over-sized

LIVABILITY IMPORTANT TO CANADIAN HOMEBUYERS: REPORT SHOPPING, DINING AND GREENSPACES TOP LIST FOR MAJORITY SURVEYED

Crystal Beach ranks as the top hidden gem neighbourhood, while Orleans, Barrhaven and Blackburn Hamlet rank as the top three neighbourhoods for affordability and good supply of housing inventory. A separate survey of RE/ MAX brokers based in major Canadian cities reveals that all cities rank high in at least one livability factor. Brokers in 10 out of 15 markets ranked access to greenspace as high, including Ottawa, London, Saskatoon, Edmonton, Calgary, Victoria and Nanaimo. While housing affordability ranked low in Toronto and Vancouver, it is either medium or high in every other market, with Ottawa, Hamilton, London, Winnipeg, Edmonton and Calgary offering high levels of affordability.

This rate is higher among Baby Boomers compared to Gen Z, Millennial and Gen X Canadians. “While price and value are always top-of-mind for buyers, there are some aspects about a home that you can’t change,” says Alexander. “These livability factors are what make your home more than just the place you live. They are at the heart of the Canadian experience, especially when you consider the survey results.” In Ottawa, Mooney’s Bay, Downtown Ottawa and The Glebe rank as the top three neighbourhoods for access to greenspaces and parks, walkability, retail and restaurants and the ease of getting around/public transit.

Canadians love where they live and celebrate the livability factors — things that give homeowners the true satisfaction of his/her home within the context of a neighbourhood — when it comes to choosing a property to buy and live in. In fact, according to a recent RE/MAX survey conducted by Leger, 89 per cent of Canadians would recommend their neighbourhood to others. The latest RE/MAX report examines a variety of quality-oflife factors and how they impact Canadians’ homebuying decisions. “Housing is often a contentious topic in Canada, with affordability and inventory being persistent problems from coast to coast,” says Christopher Alexander, executive-vice president, RE/MAX of Ontario-Atlantic Canada. “However, when buyers are looking for a home, the search begins at the neighbourhood level. And the good news is that Canadians have lots of choice when it comes to ‘livable’ cities and neighbourhoods.” Six-in-10 Canadians put easy access to shopping, dining and greenspaces at the top of their livability criteria. Proximity to public transit (36 per cent), work (30 per cent) and to preferred schools (18 per cent), as well as cultural and community centres (18 per cent) follow as the top neighbourhood wants and expectations. It’s no surprise that Canadians – and Ottawans – love where they live. According to a survey conducted by Leger for RE/MAX, we genuinely celebrate the livability factors — the qualities that give us true satisfaction of our home within the context of a neighbourhood — when it comes to choosing a property to buy and live in. Released May 2, the study reveals that a whopping 89 per cent of us would recommend our 18  New Home + Condo Guide  |  May 11–25, 2019

neighbourhood to others. “When buyers are looking for a home, the search begins at the neighbourhood level,” says Christopher Alexander, executivevice president, RE/MAX of OntarioAtlantic Canada. “And the good news is that Canadians have lots of choice when it comes to ‘livable’ cities and neighbourhoods.” And nowhere is the choice of livable neighbourhoods as flush

as in the Ottawa region. The city’s new-home landscape is growing, with juicy pickings for anyone looking to become a homeowner. And the sweet spot is, affordability and livability go hand-in-hand, especially in master-planned communities. A CHANGING LANDSCAPE

Master-planned communities are not a modern-day housing invention, although how they are developed now is different than from a half-century ago. Then, it was typical to see one builder with a large swath of land build and sell all the homes, says Ron Desjardins, a senior advisor at the real estate sales and marketing firm, PMA Brethour in Ottawa. “Over the last 50 years we have had master-planned communities synonymous with one builder having a large tract of land and putting a master plan on that. Now, five or six builders all own a few acres [of land] and that group comes together to hire all the expertise and develop a secondary plan. It evolves in a different way than they used to. In the green fields of the suburbs, it has become the norm.” Another change includes the different types of homes being built. Previously, a community would consist of a 60 to 70 per cent mix of singlefamily homes. “Blocks were set aside for townhouses, parks and shopping but very little higher density,” explains Desjardins. “In recent times, as municipalities look at urban sprawl and try to reduce the amount of land used, they require developers to increase density in these master-planned communities.”

“Essentially what you want as an ideal is to have different housing types in a community at different price points…” Jason Burggraaf, vice-president of the Greater Ottawa Home Builders’ Association, says increased density increases the diversity of the community. “Essentially what you want as an ideal is to have different housing types in a community at different price points,” says Burggraaf. “That means some lowrise, some single family, some townhomes. With the city density target numbers they now have, you need a mix of housing type.” Turning a master-planned community from a grassy acreage

into homes, sidewalks, roads and services doesn’t happen overnight and in fact, takes years. “It’s about time lines and the approval process, from roads to transport to environmental issues before you start developing the site and building the homes. A housing development from concept to the moment the first homeowner purchases a lot, can take up to five years, if not more,” says Burggraaf. “Housing is one of the most regulated industries and the city has a lot of influence on how many homes, what types of homes there will be. A plan for the sub-division has to check off all the boxes of density targets and account for all the things the city wants to accomplish on the land. “You have to take certain provisions, have so much for park land and put that aside, scope out so much for schools, hand over that land to the school board to develop.” …continued on page 20 nexthome.ca  19

VP of operations, Rahul Kochar, says this means benefits all around. “Combining our marketing efforts results in greater exposure for the community as a whole,” he explains. “The volume that the three of us can build in a single community means buyers can see it come to life that much faster. “Also, a master-planned community typically features nicer amenities as the joint builder group can share the cost

across the whole site. This means a warmer feeling community with more impressive features.” eQ Homes has been building homes for 10 years and Tobin Kardish, marketing and product manager for eQ Homes, says the ability for first-time homebuyers to be able to afford a new home is what makes the master-planned communities so attractive. “Because Pathways is a newer community and pricing is competitive, we’re seeing a lot of first-time buyers putting down roots. It’s really exciting for us to be part of that journey. “We’re also hearing from many people who already live here and love the neighbourhood. They want to stay here and come to us when they’re looking to downsize or move to a bungalow.”

So now it’s the end of the day. You lean back in your big chair. You light that big fat doobie you’ve been thinking about all day at work and now you can really chill. Wait! There is a knock on the door. You get up to answer it and it’s condo security. “I am sorry ma’am, there is a rule, no smoking of cannabis in this building.” Oh my, you own the unit, yet… The Cannabis Act (the “Act”) came into effect on Oct. 17, 2018. The purpose of the Act is to strictly regulate, restrict access, and legalize cannabis in Canada. It creates a regulatory and legal framework for controlling the production, possession, sale and distribution of cannabis in Canada. However, it is up to the provinces and territories to determine how cannabis is distributed and sold within their jurisdictions. In Ontario, you must be 19 years of age and older to buy, possess, use, and grow recreational cannabis. You are able to have a maximum of 30 grams of dried cannabis in public at any time and allowed to grow up to four cannabis plants per residence. The real question is how does this apply to ownership and use of your condominium unit? Not surprisingly, there are different interests at stake. On the one hand, there are the unit

owners and residents who believe it is part of their “quiet enjoyment” to be able to smoke in their units and common areas. On the other hand, there are those who believe smoking would impede on their “quiet enjoyment” insofar as it

on the democratic choice of the owners in the building expressed through the Board. If the owners decide they want a cannabis-free building, the condo corporation has two options. First, the rules may be amended. This is the easier option. Pursuant to Section 58(1) of the Condominium Act, 1998 (“the Condo Act”), the board may make, amend or repeal rules for the use of the units, the common elements or the assets of the corporation. This is done in two ways. Subsection 58(1)(a) allows for the promotion of safety, security or welfare of the owners, the property and the assets. Subsection 58(1)(b) allows for the prevention of unreasonable interference with the use and enjoyment of the units, common elements or the assets. Reasonableness must prevail according to Subsection 58(2) and one may argue the rules would be consistent with the Condo Act. As per Subsection 58(7), a rule becomes effective 30 days after the board has given notice of the rule to the unit owners. This is true 26  New Home + Condo Guide  |  May 11–25, 2019

unless the unit owners requisition a meeting within the 30 days after notice was provided. Second, the declaration may be amended. Pursuant to Subsection 7(4)(b) of the Condo Act, the declaration may contain conditions or restrictions on the occupation and use of the units and common elements. One may suggest restrictions on recreational cannabis would fall under this provision. However, this is not easy to achieve. According to Subsection 107(2)(e), the condo corporation may amend the declaration if 80 percent of unit owners approve and consent to the proposed amendment. WHAT DOES THIS ALL MEAN?

Condo corporations have the choice to further regulate the use of recreational cannabis within their units and common elements. When buying a condo unit, this is something to consider. In the end, if you are a smoker of any kind, you need to really look into whether you can use a unit you buy in the way you want.

Having reviewed Status Certificates, it is becoming commonplace that rules are being amended to prohibit smoking and cultivating recreational cannabis. There is normally a medical cannabis exemption. However, not all Status Certificates and condo corporations are the same. How important this is depends on where you fall in the competing interests spectrum previously mentioned. Always ensure your offer includes the opportunity for your lawyer to review the Status Certificate. Happy home hunting!!!
