THE BEAUTY OF CONDO LIVING I live in a sweet 450-sq.-ft. condo. It’s the perfect size for one person; easy to keep clean, and made bright and airy by a huge picture window in the bedroom. For me, the beauty of condo living are my neighbours in this great little community and all the amenities I have access to right outside my door. Two floors down from my suite is a great library with wifi, comfortable chairs and tables, and fully stocked shelves of donated books. It’s all catalogued, organized and maintained by resident volunteers. There is also a gorgeous fourth-floor terrace with gardens, barbecues and picnic tables. On the main level is a beautifully appointed party room with entertaining kitchen, an equipped gym, yoga studio... there’s more, but I think you get the picture. Condo-living is not for everyone, but it is becoming the home of choice for many, from single professionals and young couples, to families and downsizers. In this issue, we have lots of information to help you in your new-home search, regardless of what kind of home you are looking for. NON-RESIDENT CONDO OWNERSHIP HIGHEST IN THREE CANADIAN HOUSING MARKETS New information released March 12 from the Canadian Housing Statistics Program (CHSP) sheds light on the prevalence of non-resident homeownership in three Canadian housing markets: British Columbia, Ontario and Nova Scotia. A non-resident owner is defined as a person who has their primary dwelling outside of Canada. “Condominium apartments had the highest prevalence of nonresident ownership, particularly in Vancouver and Toronto,” says Aled ab Iorwerth, Deputy Chief Economist, Canada Mortgage and Housing Corporation. “In general, non-resident ownership is more frequent in newer and higher value residential properties. I spend a lot of time with couples who are buying their first home together. It’s often enlightening to watch them agree, disagree and compromise until they’ve found the home that clicks for both of them. When the right decision has been made, both parties breathe a huge sigh of relief . . . for about two weeks. Then it’s time for round two: Whose stuff do you keep? Just a couple of generations ago, it was common for newlyweds to move straight from their parents’ homes into their own. That meant they needed everything, from teaspoons and teacups to a bedroom suite. Couples collected their belongings together, virtually from scratch. Today, this scenario is rare. While singles may not own their own homes – though many do – nearly all have rented their own places and amassed a good deal of furniture, appliances, et cetera, along the way. And, it’s human nature to become attached to our possessions. In some cases, one partner owns the obviously superior dining table. In others, when both partners love their belongings, there’s real potential for hurt feelings. My first rule of merging households is, be respectful. You don’t have to pretend to like the framed poster of dogs playing

poker, but express your feelings as diplomatically as possible. Accept that compromise is necessary on both sides. If you want to confiscate his decorative swords, you may have to surrender the dried flowers. You may be surprised to find that combining your styles can work, if your pieces are good and the scale is right. Pick up any decorating magazine and you’ll see antiques, vintage and contemporary furniture mingled together to beautiful effect. When your beloved things simply look wrong together, it may be necessary to “give” the bedroom to one partner while the other gets the living room. Ideally, you can come up with a furniture placement plan and sell your unneeded possessions before the big move. When opinions clash over a specific item, though, biding your time can be a less painful way to resolve the issue. As you naturally develop tastes in common, the pieces that don’t look quite right will
migrate to the basement, replaced by newly acquired pieces that both of you love. And one day, you may find your patience rewarded with these wonderful words: “Whatever you like, honey.”

Condos with at least one non-resident owner was at 10.4 per cent in British Columbia and 6.1 per cent in Ontario, and higher in Vancouver (11.2 per cent) and Toronto. In Vancouver, properties constructed in 2016-2017 with at least one non-resident owner is 15.3 per cent, compared with 11.2 per cent for those built between 2011-2015 and less than six per cent for properties constructed between 1961-1990. This figure is higher (19.2 per cent) for condominium apartments built in 2016-2017. In comparison, the share of Toronto properties constructed in 2016-2017 with at least one nonresident owner is 6.1 per cent, while the share for residential properties of all periods of construction is 3.8 per cent. In Nova Scotia, the proportion of properties that have at least one non-resident owner is higher in the rest of the province (7.1 per cent) than in the Halifax CMA (4.3 per cent), suggesting that non-resident ownership is more prevalent among vacationoriented properties outside of the province’s major urban centre. Under the CHSP, non-resident homeownership is measured in two ways: By residency ownership and residency participation. Under residency ownership, a property is classified as non-resident owned when the majority of owners are non-residents. Under residency participation, a property is classified as having non-resident participation when at least one owner is non-resident. These complementary concepts permit a more detailed understanding of non-resident activity. The concept of non-resident participation, in particular, illustrates the upper bounds of non-resident ownership in these provinces, as reported in the most recent Housing Market Insight (HMI) released by Canada Mortgage and Housing Corporation (CMHC).

In Ontario, the median assessment value of single detached houses owned by nonresidents was lower than those owned by residents by $35,000, but the data shows differently in Ontario’s two largest urban centres of Toronto and OttawaGatineau (Ontario part).

Approximately half of properties in British Columbia, Ontario, and Nova Scotia had two owners, while properties with three or more owners made up a small share of properties in the three provinces. Most resident-owned properties in Vancouver had two owners, while non-residentowned properties tended to have one. Vancouver had a much higher share of single-detached properties with one owner built between 2011 and 2017 (39.9 per cent) compared to Toronto (25.8 per cent). In Nova Scotia, most properties had two owners, followed by properties owned by a single owner. Properties with three or more owners represented 4.5 per cent of the total stock, a figure higher than both in British Columbia and Ontario.

UNDERSTANDING YOUR CONDO DOCS by JACQUELINE MONETA JD & JAYSON SCHWARZ LLM New disclosure requirements in the Condominium Act provide owners with more information than ever, but all of this information can quickly become overwhelming. What are all the documents and what do they tell you? The following is an overview of the rules and regulations governing condo living.
A declaration can only be changed if over 80 per cent of the owners agree to the change. This makes subsequent changes to the declaration difficult and rare.
CONDOMINIUM DECLARATION
BY-LAWS
The declaration is like the constitution of a condo. It provides information regarding each suite’s boundaries and share of common expenses expressed as a percentage of the total budget. The declaration also describes any recreational facilities and how they will be used. It can also contain restrictions on the use or occupation of the units and common elements. A review of the declaration will tell you exactly what you are buying.
The by-laws control how condominium corporations are run. They outline the qualifications of condominium directors, their remuneration (if any), and the quorum necessary for a meeting. The by-laws may

also outline when and how the condominium can borrow money. This is important if there is ever a special assessment levied. As an alternative to a special assessment the condo may be able to borrow funds, if allowed in the by-laws, rather than makeup any shortfalls from the unit owners. By-laws can be passed, appealed or amended by the board of directors. Before becoming effective, by-laws must be approved by a majority of the units of the corporation and registered with the land registry office. CONDOMINIUM RULES
The board of directors can also make, amend or repeal rules. The rules govern the safety, security
or welfare of the owners and the property or assets of the corporation. They typically prevent unreasonable interference with the use and enjoyment of the common elements or units. It’s common for the rules to prevent owners from renting out their units for short periods of time (i.e. Airbnb) or restrict visitors’ use of the common elements. It is also increasingly common for the rules to limit the number and/or size of pets allowed in the building. Rules can vary greatly in each condominium, so even if you are familiar with condo living it’s important to review the rules in each building you buy into. They can impact lifestyle choices, which while not legal issues, should be considered carefully as they can have a large impact on your dayto-day life. STATUS CERTIFICATE
Perhaps the most important document you’ll receive is the status certificate. This document gives buyers details of the financial and legal circumstances for the condominium building. A status certificate will include information regarding increases in common expenses, law suits against the condominium corporation and any upcoming large expenditures for repairs.
A status certificate will also have information about the individual condo unit. It indicates if the current owner is in default of paying common expenses and if any increase in common expenses has been declared by the condominium board. While sifting through these documents may seem overwhelming, careful review of the rules and regulations governing your condo could save you a lot of time and unexpected cost down the road. You should also seek the advice of a real estate lawyer and accountant who can point out abnormalities or possible red flags. Don’t forget the best help you can get is from a real estate lawyer who understands condominium law. Be careful and find someone who is knowledgeable and cares about you and your family. Two-thirds of Canadians are worried about their finances, according to an economic poll conducted in February on behalf of two non-profit organizations, the Financial Planning Standards Council (FPSC) and Credit Canada. Titled The Kitchen Table Forecast, the Leger poll asked 1,515 Canadians about a series of ‘kitchen table’ issues – financial concerns that confront people on a daily basis, such as bill payments and debt, the cost of living, job security and bankruptcy. The results show Canadians feel stressed about their finances and are often at a loss to improve their situation. This hopelessness can cause people to do nothing, and possibly make their condition worse. Uncertainty about an ever-changing job market and economy only undermines the average person’s confidence and ability to handle the ebb and flow that life inevitably presents. Shawn Todd, partner, VP and Certified Financial Planner with Ecivda Financial Planning Boutique, is also concerned about the potential state of many household plans. ”It comes as no surprise that many families just shut down in some mode of financial paralysis when these issues and stresses arise.” According to Todd, potential 26 New Home + Condo Guide | Apr. 27–May 11, 2019
home and condo buyers can better position themselves for the home they are excited about by asking themselves a key question: ‘Can I afford this new purchase?’ “It’s easy to fall in love with a new home or building. At the end of the day, you need to be able to know that you can afford it along with the bills that come with it,” says Todd. “Quite often, we are asked by clients, ‘How do I know if I can afford this new mortgage payment?’ It would always be a great step to take the mortgage numbers you are working with, and stress test them in this fashion: “How would you feel if the value of your potential property was 10-15 per cent less in a year after the purchase, and your mortgage payment was one- to-two-per cent higher? If those numbers work nicely in your plan, and your budget still works, you’re
most likely sitting in a very comfortable situation. “Running this exercise may allow you to worry less about 2019’s economy, and how it may look in the next two, three, and four years. I encourage our clients to check their budget, and note items like lines of credit, credit cards, their next car purchase, and their mortgage payment can all change fairly quickly during interest rate hikes.”
