When you buy new, you don’t inherit somebody else’s worn carpeting, personal taste in kitchen appliances or paint colour preferences. You get a fresh, clean space that’s waiting for your personal imprint. If you’ve always fantasized about buying a brand new home, here are a few tips that can help you make the process a pleasant one: ›› Shop the mortgage market to see what you can afford before you start your hunt; ›› Obtain a lawyer who is willing to review your offer and close the deal; ›› Don’t be persuaded by high pressure sales tactics while you’re out shopping; ›› Determine which options and upgrades you want as part of your offer and ensure your lender will finance what’s required, if needed; ›› To save money, consider which upgrades you could purchase and install yourself after the sale closes. Some upgrades such as rough-ins and wiring inside the walls are easier to do before construction. Factors such as the cost of the home, neighbourhood, lot size and special features play a big role in your final decision. Determining which features your new house absolutely must have, and which features you could live without, should be among your first steps in the home-buying process. Planning to buy new? Now is a good time to buy a home in the GTA, and here’s why
I
f you’re in the market to buy a home, you no doubt are paying attention to news about interest rates, the housing market and whether Canadian real estate is in for the proverbial soft landing or something more severe. Recent predictions, from various bodies, called for steep declines in sales and prices; the Organization for Economic Co-operation and Development went as far as to say Canadian home prices were 64 per cent overvalued. A bold claim, indeed. Such reports might spook even the most confident and well prepared homebuyers to wait – to see if any adjustment occured and prices came down. In the new home sector, as opposed to resale, however, prices are highly unlikely to come down at all. What’s affecting new lowrise home sales is not a slowing market, rather land supply, development charges and other issues specific to the home building industry. Tight supply and high demand means available new lowrise homes are snapped up quickly by consumers. You’re more likely to find a builder offering incentives on remaining inventory than you are discounted prices. If you’re financially prepared and well qualified, now is a good time to buy.

What would you say if I told you that more than one-
fifth of the cost of a new home goes to the government through various fees and charges? The issue of home affordability poses a significant challenge for new homebuyers in the GTA. So, we commissioned a study, by Altus Group and released last week, to help make sense of the variety of fees and charges collected by municipal, provincial and federal governments and the impact of those costs on the affordability of a new home in the region. The study looks at a variety of fees and charges in six municipalities across the GTA – Town of Oakville, City of Brampton, City of Markham, Town of Bradford-West Gwillimbury, Town of Ajax and the City of Toronto. The rates can vary in each municipality, so the report lists the value of fees and charges like development charges, planning and building permit fees, parkland dedication, property and land transfer taxes, mortgage insurance, HST and more. To calculate fees and charges based on the land or home value, the average price of a new low-rise or a highrise home in that municipality was used. On average, the total government charges and fees amount to onefifth the cost of a new home. In one case, they represent 27 per cent of the cost of new home. In dollars, the average adds up to $119,200 on a new single-detached home and for a new high-rise home, it’s roughly $66,000. 14 New home guide GTA | june 22 - july 20, 2013
Here’s why it matters: right now, municipalities across the GTA are looking at how they are going to pay for critical infrastructure like roads, bridges, sewers and public services, that will be used by not only new residents, but existing residents as well. Increasing development charges and other government fees is not the answer. These facts show that new homebuyers across the GTA are already doing their fair share to support the development of essential public infrastructure. It is estimated that in 2012 alone, the industry, new homebuyers and businesses contributed more than $1 billion toward the construction of growth-related infrastructure like sewers, roads and transit in the GTA through development charges paid to municipalities. The largest government fee on new homes is development charges, according to the study. Since 2004, for the municipalities studied in the report, development charges have increased between 143 per cent and 357 per cent. As I write this, many municipalities across the GTA are proposing further increases to their rates. Everyone needs and wants the public services these government fees and charges fund, but it’s time we all contact our government representatives to tell them how important it is to keep the rates affordable, so that future generations of new homebuyers will one day be able to put these services to good use.

There are many advantages to buying a new home: choosing your location, layout and appliances; selecting special finishes such as cabinets, carpets and kitchen counters; and taking advantage of efficient new building products – from heating systems to windows – that are designed to work better and last longer than ever before. When you purchase a new home, you get added peace of mind because almost all new homes in Ontario come with a builder’s warranty backed by Tarion. I say almost, because there are some exceptions to the types of homes that are covered by the warranty program. Let’s look at what homes are covered. Freehold homes Fully-detached, semi-detached or townhomes that are entirely owned by the homeowner fall into this category, as long as the home is a self-contained, one-family unit. It may be a home in a new subdivision or one constructed on a vacant or cleared lot. Condominiums These can be highrise, midrise or lowrise buildings, townhomes, semi-detached or detached homes in a condo community. In a condominium, the owner pays a monthly fee for the upkeep of the common elements, which are shared areas that include lobbies, parking garages and recreational facilities. Each unit has its own warranty coverage. Condos also come with a separate warranty that applies to the common elements of the building or community. While warranty coverage for your unit begins on the date you take occupancy, common element coverage takes effect when the condo is registered as a corporation. Contract homes When someone hires a builder to construct a new home on a property, this is called a contract home. Contract homes are generally covered by statutory warranties so long as the builder constructs the home from foundation to the finished stage. However there are reasons why a contract home may not be covered. For example, if you act as your own contractor or supply essential elements of the home, it could be classified “owner-built,” making it ineligible for coverage. 16 New home guide GTA | june 22 - july 20, 2013

If you are considering having a contract home built, have your lawyer draw up a formal contract with the builder before beginning construction and make sure you understand whether any involvement you have in the building process will impact your warranty eligibility. Certain types of homes are not eligible for coverage under the statutory warranty. They include: • Owner-built homes • Homes built and previously occupied by the builder or by rental tenants • Homes built on foundations where the pre-existing foundation exceeds 40 per cent of the new home’s footings • Kit, modular or mobile homes (unless placed on a permanent foundation and installed by the vendor that sold the home to the homeowner) • Seasonal or log homes (unless they meet the year-round provisions of Part 9 of the Ontario Building Code) Condo conversions Condo conversions are condos that were previously used for other purposes, such as commercial properties, hotels, apartments or schoolhouses. With varying degrees of refurbishing and new construction, they are turned into condo units and sold to new owners. Condo conversions are currently not covered under the warranty program, but we are in the midst of studying the feasibility of extending coverage to these units. We are in the early stages of this review and expect to share the findings with the Ministry of Consumer Services later this year. Other types of condos There are also types of condominiums available – such as common element condominiums and vacant lot condominiums – for which coverage is not uniform. You can read more about these types of condos on Tarion’s website. If you are considering purchasing a common element or vacant lot condo, you should check with your lawyer and Tarion to ensure you understand your warranty coverage. If you’re unsure about whether your new home will qualify for warranty coverage, email ismyhomecovered@ tarion.com and include a copy of your contract/agreement of purchase and sale; the builder’s name; the homeowner/ purchaser’s name; and the municipal address of the home.

University of Toronto has unveiled plans to transform one of
Toronto’s most iconic landmarks, One Spadina Crescent, to become the new home of the John H. Daniels Faculty of Architecture, Landscape and Design. The revitalized building project is designed by Nader Tehrani, principal of internationally acclaimed firm, NADAAA, and his collaborator Katie Faulkner. The university has received an additional personal contribution of $10 million from architect, developer and philanthropist John H. Daniels (BArch 1950, LLD Hon. 2011) and his wife Myrna Daniels, adding to their $14-million gift that initiated planning for the expansion and named the Faculty in 2008. These two benefactions totaling $24 million are the largest gifts designated to architecture programs in Canadian history. In addition, The Daniels Corporation, on behalf of the company’s management and staff, will contribute $1 million to the U of T’s current fundraising campaign evenly divided between capital and The John and Myrna Daniels Scholars award program.

In all the mortgages that I
arrange, I find it surprising how few people actually ask me how I get paid. A recent study in the U.S. indicated that less than 10 per cent of people could properly identify how different types of mortgage providers get paid during the transaction. Don’t you want to know whether that person who is so eager to sign you up has a financial advantage to selling a particular product? You definitely should care – and here is why. Almost every single provider in the mortgage marketplace has a potential financial gain by selling a particular mortgage product and rate. To make matters worse, that financial gain or pat-on-the-back is often gained at the expense of the consumer. Let’s take a look at your main mortgage providers to see what to watch for: Bank branch manager This friendly and trusted advisor has a sales quota to hit just like everyone else (you did notice that Canadian banks do fairly well financially, right?). bonus and promotion depends on results. Typically, bank managers have sales quotas for particular products as well as growth targets on the loan/ investment portfolios. Their targets are often based on the size of their mortgage portfolio as well as the average term of the portfolio. The longer the term and larger the size of the mortgage, the better the Christmas bonus. Furthermore, these managers are increasingly being graded on the profitability of these portfolios. When you go to your old bank branch and it has moved to a new location, where do you think one of the bank managers went? Which one do you think they kept with the bank? The one with the great discounted loans and mortgage rates, or the one that is making the bank the most money? Bank mortgage representatives These are typically contract employees of the bank who are usually paid on a straight commission basis. Most only sell one bank’s mortgages, while some sell several. The ones that sell other bank’s products are often only permitted to do so once they have met a quota of their own bank’s products. These individuals are usually paid based on three criteria: the size of the mortgage, the term of the mortgage and the discount given. That means that these representatives can make more money by putting you in a longer term at a higher rate. Mortgage consultants/mortgage brokers These people are independent mortgage providers that theoretically work for you and not for one particular bank. They are paid a finder’s fee (or commission) from the institution that the mortgage is funded with. The problem is that not all banks are paying the same amount for each of the mortgage products. The lenders pay brokers based on the size of the loan and the term selected. The longer the term selected, the bigger the commission to the broker. On top of the different payoffs for the terms, some lenders also pay more for the same product. A broker could make more money funding a five-year term through one lender over another. Typically, there is no advantage to the broker if the consumer gets a higher rate, but there are exceptions to that rule. So now that you know how it works, who do you trust? When you go mortgage shopping, don’t believe that everyone is out to get you. While the incentive systems are there, many mortgage providers will look out for your best interest. A satisfied past client that refers family, friends and colleagues is worth a lot more than one big commission payout. Do your research, ask for testimonials, or ask your friends. A mortgage is a huge financial decision. Make sure it is a decision being based on your financial situation, and not your mortgage provider’s bank account.

Geranium Homes celebrates the renewal of its significant commitment to build to the new Energy Star for New Homes standard Geranium Homes recently joined by City of Woodstock
Mayor Pat Sobeski, Corey McBurney, President of EnerQuality, and guests celebrated the company’s commitment to build its homes to the new Energy Star for New Home (ESNH) Standard. The event was held at The Village at Sally Creek adult-lifestyle community in Woodstock, where five of an initial phase of 52 homes have been built by Geranium Homes. Boaz Feiner, president housing division for Geranium Corp., accepted a plaque from Corey McBurney which will be installed on an Energy Star qualified home. Guests were given a piggy bank for the occasion, which symbolizes the approximately 20 per cent energy savings Geranium’s future homeowners will enjoy in these new “best in class” Energy Star qualified homes. Geranium Homes was the first new home builder in 2012 to enroll multiple houses under the new ESNH program and is proud to be the first volume and production home builder in Canada to achieve Energy Star for multiple homes. Of the five homes constructed in Woodstock, three are fully furnished and decorated Model Homes by Toronto-based Interior Design firm, Bryon Patton and Associates. This year, my wife and I would like to get into our first home. We have saved almost $80,000 for a down payment. This was three years of eating at home, once per week dine out and no vacations. Movies and pub nights were out, with the odd exception. Although the real estate market has changed, homes are pricier than three years ago. Is this the right time to buy? Or should we wait it out? The Canadian real estate landscape and recently hot cities such as Toronto and Vancouver are showing signs of losing steam and sales slowing down. Many experts do not foresee a U.S. style crash, but a decline in sales with moderate price increase for 2013. Quick flips and fast returns may be a thing of the past. The days of multiple offers are behind us for now, and buyers can be more selective. First-time homebuyers should not try to time the market, but buy when you are ready and able. Leave market timing to the experts, if such a thing exists. A home used as your primary residence is a great investment. From a financial and tax perspective, there are at least three good reasons. In Canada, the sale of a family home is tax-free. A home that is a principal residence that is subsequently sold at a higher price than initially purchased, will be exempt from income taxes. That’s right, Stephen Harper will not share in your good fortune. Secondly, pay yourself first, not a landlord. For many, mortgage payments are a way of “forced savings.” It makes more economic sense to fatten your pocket than a landlord. Thirdly, you can decorate and enjoy the home as you please. No money saved, but gratifying to the soul. However, before venturing out into the land of homeownership, it would be prudent to do some homework. There have been many changes introduced in 2012 by Finance Minister Jim Flaherty that affect mortgages and the housing industry: ›› Buy what you can afford Many times, the heart is bigger than the pocketbook. ›› Get the best interest rate and terms Shop around for the best rate and terms. Financial institutions want your business more than you need them. A half point rate differential can cost you thousands. So can a mortgage that is closed or not portable ›› Big down payment Put down as much as possible to avoid a high-ratio mortgage. Be aware of some new mortgage rules introduced in 2012, such as: - Purchasers requires mortgage insurance (CMHC) for less than 20 per cent down payment - Amortization period – reduced from 30 to 25 years. You do not want get caught short several thousand dollars on closing day in order to complete the deal. Speak to a real estate lawyer and he or she will give you some ideas ›› HST, Land Transfer Tax Under certain circumstances, first-time homebuyers will qualify for Toronto Land Transfer Tax and HST rebates. Remember, you pay 13 per cent HST on new homes, not resales. If you’re buying a new home, check if HST is included in price quoted. What happens to the HST rebate? Who gets it? ›› Home Buyers Plan (HBP) Use your Registered Retirement Savings Plan (RRSP) as part of the down payment. An individual and their spouse, provided they qualify, may withdraw up to $25,000 each, tax-free, from their RRSPs. You then have 15 years to repay the amounts to your RRSP, starting after the second year of your withdrawal. purchases and HST by jayson schwarz & Konstantine Chatzidimos Purchasers of new, resale and condominium homes who
visit our offices are often confused about the way the harmonized sales tax (HST) affects their transactions. This inspired us to write a few words in the hopes of demystifying this oft-misunderstood aspect of the new home purchase. Purchases of new freehold and condominium homes in Ontario – unlike resale or “used” homes – are subject to the HST. HST is a combination of the eight per cent Ontario provincial sales tax (PST) and the five per cent federal goods and services tax (GST). The percentage of HST applicable to the transaction is directly related to the purchase price of the home. However, homebuyers are able to claim a rebate of some of the PST and GST. For example, the rebate associated with the PST portion of the tax is available for new homes priced up to $500,000. The PST rebate for new properties under $400,000 is six per cent of the purchase price (or 75 per cent of the eight per cent PST portion of the HST), with the rebate amount reduced for homes priced between $400,000 and $500,000. There is a similar rebate mechanism for the five per cent GST portion of the HST. What is important to understand is that the vast majority of Ontario builders incorporate the rebated amount of HST in their purchase price. This is because the HST rebate is immediately available only to purchasers who are buying new properties with the intent that they will be their primary place of residence or the primary place of residence of a family relation. In this case, the purchaser does not have to submit a rebate application directly to the Canada Revenue Agency (CRA). The purchaser will sign the rebate application and provide it to the builder, which will then send the rebate application to CRA when the builder claims a deduction in its net tax calculation for the amount of the rebate. Structured this way, the HST is effectively a non-issue for purchasers as the builder takes care of all the paperwork. In cases where the purchased property will not be the principal residence of the buyer or a family relation of the buyer, but will instead be an investment property, it is the responsibility of the buyer to inform the builder. This is because the builder must add back the HST rebate to the purchase price which will have to be paid by the buyer upon closing. This does not mean that the HST rebate is lost to the buyer as they will have a two-year period in which to claim the HST rebate directly from CRA, provided certain guidelines are met such as a ‘reasonable expectation’ that the first use of the property is – or will be – by a tenant occupying it as their primary place of residence for at least one year. Required supporting documentation will include the Agreement of Purchase and Sale, the Statement of Adjustments, the insurance policy on the property, as well as the lease with the first tenant. The rebate in this case is calculated in the same manner it is in respect of owner-occupied dwellings. It is important to note that while investor-purchasers of new long-term rental accommodation are eligible for the HST rebate, speculators are excluded. Anyone who buys and rents a new freehold or condominium home must repay the full amount of the rebate (plus interest) if the property is sold within one year – unless the new purchaser acquires it for use as their (or a relation’s) primary place of residence. 42 New home guide GTA | june 22 - july 20, 2013

If you do this and the CRA finds out, you will be liable to pay back the full amount of the HST rebate you received on closing plus applicable interest and penalties. Choosing a builder and making the
right decision
You’ve made your decision – You’re
ready to buy a new home, and you want to purchase one that’s new. But with literally thousands of builders of all shapes and sizes to choose from, how do you know which builder is right for you? Choosing the right builder can be just as important as choosing your new home. When you purchase a home, you also “buy” the company that will build it for you. Their experience, skills and commitment to customer service will play a key role in determining how satisfied you are with your condo and with the whole buying experience. Canada Mortgage and Housing Corp. (CMHC) offers the following tips on how to find and select a new-condo builder that will meet your needs and expectations:
To begin your search, check the Homes section of your local newspaper to find out which companies are building in your area, the types of homes they offer and the prices you can expect to pay. (Editor’s note: New Home Guide is a great place to start!) Ask friends, family members and co-workers for names of reputable builders they have dealt with. You can also check the websites of
the Building Industry and Land Development Association (BILD) or Tarion Warranty Corp. When you visit a builder, ask how long they have been in business, how many homes or condos they build each year and what kind of background and experience they have. Make sure the builder belongs to an industry organization and has the licences and registrations required for your province. Ask for references, and contact them to find out if they are satisfied with the homes they bought and the service they received. Once you have narrowed down your list, visit the builders’ models. Go through each one in detail, carefully noting down what you like and what you don’t. Take your time, and if you feel you don’t know enough about construction, bring someone with you who does. Read through each builder’s website and other information materials to get a clearer picture of the company and what they have to offer. If possible, request a tour of a work site to look at a condo that is currently under construction. If you’re considering buying in a new development, go on a tour of the community or take a close look at the master plans. Ask yourself if this is the type of community where you could see yourself living or raising a family for years to come. Always bring a notebook or even a camera with you. Ask as many questions as you can think of, and write down the answers to review later. Aft er all, you’re choosing the place your family will call “home” for the next five, 10 or perhaps many more years. Take your time, and make sure you make the choice that’s right for you. The way RBC’s affordability measures work is, the higher the measure, the more difficult it is to afford a home. For example, an affordability measure of 50 per cent means that home ownership costs, including mortgage payments, utilities and property taxes take up 50 per cent of a typical household’s pre-tax income. A decline in the measure represents an improvement in affordability. For the Ontario market, homeownership affordability deteriorated very slightly during the first quarter of 2013, in detached bungalows (to 43.5 per cent) and standard two-storey homes (to 49.5 per cent). In condos, on the other hand, affordability improved slightly, to 29.2 per cent. For the Toronto market, specifically, condos was the only housing category to improve – down 0.5 per cent (meaning it
