Your Mortgage in a Divorce or Separation – What’s the best Way to deal With the matrimonial home and mortgage? » by kris grasty

This is not a fun topic nor is it a desirable situation, but the fact is that 41% of marriages end in divorce according to Statistics Canada. And about 10,000 of these occur right here in BC. That figure doesn’t include people living as Common-Law, but the four in ten average is likely similar to this group as well. Whether legally married or living common law, if you both have ownership of the home and are registered on the mortgage together this information applies. It would be great if it was as easy as just cutting the home in half, but since you can’t, there are several options to consider when dividing your personal interest in the home. Here are the common options:
Retain your original mortgage while one party resides in the home – Many people without the proper guidance go this route due to the perceived ease of this transition, yet it has some potentially undesirable effects. Issues to be aware of – Both parties remain on the mortgage and on title, so both parties are liable to maintain the payments. If the occupier ceases to make payments or loses the ability to pay, then the former spouse is still on the hook financially to make these payments. This can lead to increased monthly costs and an undesirable foreclosure that could eventually cause damage to your credit.
Sell the home – You could list and sell the home, using the proceeds to pay off the joint mortgage and possibly some of the joint consumer debt accounts, then divide the remaining proceeds as agreed and move on in your different directions. Things to consider – There are several costs involved in selling the home; prepayment penalties owing to the lender by breaking the mortgage, Realtor fees, legal fees and closing costs associated with the transaction. You will have to carefully asses the current property value and existing equity remaining to accomplish the desired outcome. You must also requalify for your respective mortgages on your own if again pursuing homeownership. Buy out your former Spouse, yet remain in the home – If you 22 METRO VANCOUVER NEW HOME GUIDE | MAY 2 - 16, 2014
have enough savings to pay your former spouse their half of the equity then you could simply buy them out. The mortgage and title will still need to be adjusted and some legal protection put in place.
Assume the mortgage – The mortgage must
be assumable and your lender must agree to this change. You will be required to qualify for the mortgage on your own merit and must maintain the current payments at the current interest rate and amortization. “Assuming” a mortgage is less costly than refinancing or selling, but there is no flexibility in terms of other changes to the existing contract
Refinance the home – You can refinance
to access the equity required to pay out your former spouse. This method may have more flexibility due to being able to renegotiate rate, term and amortization but will require legal fees and you may incur penalties for breaking the existing mortgage contract. The spouse leaving may want to obtain a “Deed of Trust to Secure Assumption” allowing them to take back the home if payments are missed and would want to be notified by the lender of any arrears should they occur. The party retaining the home may want to have the former spouse sign a “Quit Claim Deed” relinquishing any rights that they have to the home. Do you know about SpouSal buy-out programS? As such, spousal buy-outs are treated differently than normal refinances and lenders will allow up to 95% of the home’s value to be refinanced as opposed to the 80% limit imposed by today’s lending rules. Both parties are required to have been on current title and the refinance is structured as a purchase with a legal sales agreement and may require a mortgage insurance premium.

When buying a home, you likely will consult with a team of trusted professionals – a mortgage broker, lawyer, perhaps a realtor or builder sales associate and maybe a home inspector. Then, assuming you move ahead with your purchase, eventually you will likely need a mover. People often don’t consider a mover as an important member of their team of professionals. However, given the critical role they perform – taking possession, at least temporarily, of all your worldly goods and moving them without loss or damage – it’s a function not to be taken for granted. Not doing your due diligence and taking the time to select a reputable mover can invite untold problems. Case in point: the following example, which admittedly doesn’t involve a new-home move, but the experience is all too common. So is the lesson learned – unfortunately, the hard way. I recently contracted a “professional” moving company to carry out a last-minute move of five pieces of furniture on behalf of my son, a university student. For a variety of reasons, we decided to hire movers rather than rent a truck. After calling several firms – including large, well-known companies and smaller, independent ones – I selected a moving company in Whitby, where the pick-up was to take place. Drop-off would be in Waterloo. We agreed on price ($350) and time (9 a.m.) – after I was very clear the move would involve an out-of-town destination. All details were confirmed in a “contract” exchanged via email. The crew was on time for the move the next morning, but almost immediately began talking about a higher rate – $360. Not a huge difference, but it immediately raised my suspicions. I’ll spare you all the gory details, but it’s important to share the lowlights of what happened next: » The company I originally contracted the job to the night before was inexplicably unavailable to actually do the move the next morning, and apparently passed it off to another firm. » My original contact, who was easily available on cell phone repeatedly the night before, suddenly was nowhere to be found. » Once the truck was loaded, the fee increased to $450. » Upon arrival in Waterloo, the movers said the fee was $500. “It’s taking longer than we thought, and the furniture is heavier.” » “Sure,” I said, “right after I call the police.”

With that, the sordid tale ended. The job not complete, left for us to move the furniture indoors, now the victims of one of the Top 10 scams monitored by the Better Business Bureau (BBB). “I could write a thesis on this,” John Levi, president of the Canadian Association of Movers (CAM) told me. CAM offers consumers the following tips on how to avoid being scammed by unscrupulous movers: » Find reputable movers through the CAM, BBB or provincial government consumer protection agencies » Ask three movers for estimates in writing » Get the terms and conditions in writing » Ensure your goods will be protected for loss or damage » Read customer reviews on movers’ websites and other forums “Consumers have recourse with their provincial government’s consumer affairs department and with the Better Business Bureau,” says Levi. “Both of these avenues are fraught with difficulties and often take many months to come to some form of resolution – satisfactory or otherwise. And often, the mover simply out-waits the consumer. “It’s far simpler and more effective to engage a reputable mover in advance rather than trying to fi x a bad situation after-the-fact.” My example, though painful and infuriating, is minor compared to other common horror stories involving similarly unsuspecting clients. Make sure you take the proper steps – and the time – to protect yourself.

packing tips To make your move a little easier • Gather boxes in all sizes from friends, neighbours and stores.
• Collect cushioning material such as bubble wrap, foam pellets, furniture pads, old blankets, plastic bags, tissue paper, newspapers and small towels to use as padding inside boxes.
• Create a “portable packing kit” with marking pens, a tape measure, packing tape, twine and scissors. Carry it with you as you pack up items in your home. • Reinforce the bottom of boxes with extra tape for added strength.

The Canadian real estate landscape, though it has experienced challenges in some areas and housing types, is proving resilient. Experts do not foresee a U.S. style crash, but a decline in sales with moderate price increases is likely for some areas. Quick flips and fast returns may be a thing of the past. First-time homebuyers should not try to time the market, but buy when you are ready and able. Leave market timing to the experts, if such a thing is possible. A home used as your primary residence is a great investment. From a financial and tax perspective, there are at least three good reasons. In Canada, the sale of a family home is tax-free. A home that is a principal residence that is subsequently sold at a higher price than initially purchased, will be exempt from income taxes. That’s right, Stephen Harper will not share in your good fortune. Secondly, pay yourself first, not a landlord. For many, mortgage payments are a way of “forced savings.” It makes more economic sense to fatten your pocket than a landlord. Thirdly, you can decorate and enjoy the home as you please. No money saved, but gratifying to the soul. However, before venturing out into the land of homeownership, it would be prudent to do some homework. There were changes introduced in 2012 by the federal finance ministry that affect mortgages and the housing industry:
›› Buy what you can afford Many times, the heart is bigger than the pocketbook. Know what price range is comfortable and try not to deviate. ›› Get the best interest rate and terms Shop around for the best rate and terms. Financial institutions want your business more than you need them. A half point rate differential can cost you thousands. So can a mortgage that is closed or not portable ›› Big down payment Put down as much as possible to avoid a high-ratio mortgage. Be aware of some new mortgage rules introduced in 2012, such as: 38 METRO VANCOUVER NEW HOME GUIDE | MAY 2 - 16, 2014
• Purchasers requires mortgage insurance
(CMHC) for less than 20 per cent down payment • Amortization period – reduced from 30 to 25 years. Could add several hundred dollars to monthly payments • Gross Debt Service Ratio (GDS) 39 per cent. Banks use this to determine what you can afford based on gross income to housing costs. Check if you are on-side. ›› First-time homebuyers should make sure monthly mortgage payments are manageable and will continue to be so even if interest rates rise as early as next year and payments increase ›› Closing costs Set aside an additional two to three per cent of purchase price of the house for closing such as, Land Transfer Tax, legal costs and unwelcome surprises. You do not want get caught short several thousand dollars on closing day in order to complete the deal. Speak to a real estate lawyer and he or she will give you some ideas ›› HST, Land Transfer Tax Under certain circumstances, first-time homebuyers can qualify for Land Transfer Tax and HST rebates. Remember, you pay 13 per cent HST on new homes, not resales. If you’re buying a new home, check if HST is included in price quoted. What happens to the HST rebate? Who gets it? ›› Home Buyers Plan (HBP) Use your Registered Retirement Savings Plan (RRSP) as part of the down payment. An individual and their spouse, provided they qualify, may withdraw up to $25,000 each, tax-free, from their RRSPs. You then have 15 years to repay the amounts to your RRSP, starting after the second year of your withdrawal.

outh Surrey is that place where fearless kids jump into the ocean off a wooden pier in July, and come January lace up their skates and play hockey atop the frozen Serpentine River. Active retirees love its mild winters, foodies adore its diverse palate of restaurants and families flock here as a destination to achieve the suburban dream of owning a single-family home and a patch of grass. About 12 years ago, our family became part of the South Surrey club — a society that seems to hold a similar portfolio of assets: mortgage, Nexus card and SUV to chauffeur kids to and from soccer games, field trips and violin recitals. With its beach-town vibe, top-rated schools, proximity to the US border, plus a plethora of parks, sports fields, golf courses, 54 METRO VANCOUVER NEW HOME GUIDE | MAY 2 - 16, 2014
outdoor shopping malls and trendy new restaurants — South Surrey tops the radar for families of all ages looking for a safe, clean, vibrant place to set down their roots. Charm is found in the juxtaposition of streetscapes – new family townhomes next door to hobby farms selling farm fresh eggs and bundles of garden dahlias for five dollars. “You really couldn’t ask for a better community to raise kids,” says Moe Johal, owner of CJ Auto Repair, who has lived and worked in South Surrey for 30 years. “I’ve seen a lot of changes over the years, from a community of grey hair to one that’s a healthy mix of young and old. It just keeps growing and growing!” It is small businesses like this — big on friendly service, which are impetuses for developing a healthy economic base in
South Surrey. Shop local is a way of life for many who live within its well-established neighbourhoods — Semiahmoo Town Centre, Crescent Beach, Ocean Park, Elgin, Grandview Heights, Morgan Creek, Rosemary Heights, Sunnyside and Douglas. Sure you’ll find big box stores like Winners and Walmart here, plus fashion boutiques and outlets galore at The Shops at Morgan Crossing, but when it comes to style; it’s the fabulous independently owned boutiques that have South Surrey women looking runway ready. When style connoisseur Christine Good goes to pick up her boys from school, she sports a new era in fashion – wearing locally sourced high-end, low-end, classic labels and up-and-coming designers all at the same time. The secret Good says, is knowing

where to shop. A great pair of Mavi jeans can be scored at JJ + Whiskey in Ocean Park (128th St. and 16th Ave. ), a Halston Heritage handbag or pair of Louis Vuitton wedges at REwind Consignment (152nd St. and 19th Ave.) and the sexy vegan leather jackets at Jack & Jill (Grandview Corners) can be worn guilt free. On Saturday around 7pm, the lineup at South Surrey’s newest hot spot, Famosa Neapolitan Pizzeria (24th and Croydon) is stretched around the corner and down the block. For those with the patience to wait almost an hour for a table, the dining room is abuzz with conversation and rich pizza aromas. Manager Ken Mitchell suggests trying the Cavoletti, a pizza topped with oven roasted Brussels sprouts, gorgonzola cheese, dates, walnuts and a drizzle of honey.
The kids at the adjacent table would rather spoon rich vanilla gelato in their mouths. Next door, My Shanti (“Peace” in Hindi), is anticipated to open any day by acclaimed restaurateur Vikram Vij, known for turning skeptics into lovers of Indian cuisine. While South Surrey’s hipsters may not mind queuing up for a lamb popsicle, local foodies know there’s delicious plates being served up along other unassuming streetscapes. The Seahorse Grill on Sullivan St. in Crescent Beach has that “feels like home atmosphere,” and is a destination on Sunday nights for its prime rib special. The Sunflower Cafe on Beecher St. draws a loyal following for its real roast beef, turkey sandwiches with cranberry sauce, and homemade soups, while Tap Restaurant in the Rosemary Heights neighbourhood is a
high-end fusion of French cooking and West Coast ingredients. When the mood strikes for a basket of fish and chips, locals flock to Hooked Fish Bar at Crescent Beach or the Fish Boat along Marine Dr. in White Rock. Need an amazing homemade dessert in a pinch? Be forewarned: it’s near impossible to stop at just one slice of the chocolate ganache cake made at Michaels’s Artisan Bakery & Cafe. All this food talk may have you counting calories. With at least one or two gyms, personal trainers or rec centres found in each of South Surrey’s intermingling neighbourhoods, a balanced lifestyle is achievable. A trail run through the Sunnyside Urban Forest followed by a yoga class at the newly expanded South Surrey Recreation and Arts Centre is the perfect way to unwind. High end is $4.5 million for an estate in the Elgin Chantrell neighbourhood, and best apartment price to be found is $140,000 around Sunnyside Park. And then there’s the weekend. While hockey families commute back and forth to the arena, soccer parents take shelter under their umbrellas as the Coastal home team runs up and down the turf. For those times when you just want to get away from it all and enjoy the solitude of nature, Kwomais Point Park is a local secret – a romantic place to watch the sunset – tucked away behind 128th St. in Ocean Park overlooking the bay to Tsawwassen and beyond to Vancouver Island and the San Juan Islands. Barred owls have even known to be spotted in the forested trails that chicane through the park. Not far from
here is 1001 Steps (end of 15A Ave off 126 A), a great alternative to the Stairmaster as you zigzag downwards, over and under the train tracks onto a rocky beach where crabs and starfish are plentiful and harbour seals are known to sunbathe. Those with kids will want to plug the coordinates of Redwood Park into their GPS - 17900 20 Ave., an enchanting park with picnic tables, large playground for kids big and small, nature trails fi lled with beautiful trees — look closely for the fairy doorways, and even a tree fort that’s opened on occasion for summer story time. Of course there’s a few secrets too sacred to be shared — like the amazing hairdresser who works from her South Surrey basement, or the fishing spot where seasonally you’re sure to reel in a wild coho salmon. But once you move here, you’re sure to discover a few gems of your own.

Fraser institute school report card
2014 Rankings Spotlight Improving Schools Students can succeed despite perceived barriers to learning, finds the Fraser Institute’s annual school rankings. The Report Card on B.C.’s Elementary Schools 2014 ranks 982 public and independent elementary schools based on 10 academic indicators using data from the annual Foundation Skills Assessments (FSAs) administered by the B.C. Ministry of Education. According to the Report Card, 45 schools across the province showed improvement over the past five years, including Strawberry Hill, a public school in Surrey. Strawberry Hill posted an overall rating of 3.4 out of 10 in 2009, then improved steadily each year to post a 5.4 in 2013 even though 68.2 per cent of students were in ESL programs. “A school like Strawberry Hill in Surrey counters one of the misconceptions about student performance. It has a high percentage of ESL students, yet it’s improving every year. The Fraser Institute Report Card consistently demonstrates that any school can improve regardless of the challenges students face,” said Peter Cowley, Fraser Institute director of school performance studies. At compareschoolrankings.org, parents can measure their school’s performance over the past five years, noting areas of improvement and decline. They can also compare their school with schools across British Columbia. One good benchmark school might be W. D. Ferris, a public school in Richmond, which posted an overall rating of 7.9 out of 10 (and a five-year average of 7.8) despite a 58.2 ESL student percentage. Or Lord Roberts, a public school in downtown Vancouver, which posted an overall rating of 5.5 (up from 62 METRO VANCOUVER NEW HOME GUIDE | MAY 2 - 16, 2014
3.6 in 2009) even though 35.1 per cent of students were in ESL programs and an above average percentage of students had a special need. What’s going on at W. D. Ferris and Lord Roberts? Educators across B.C. should be eager to find out. “Our website provides parents and educators with objective information that’s hard to find anywhere else. If you’re a parent at a school with a consistently low ranking, or a school with declining results, you should ask the principal about improvement plans and when student performance is expected to improve,” Cowley said.
