In honor of Kings Mountain’s 150th birthday, Kings Mountain’s City Council, staff and attendees celebrated the sesquicentennial by singing Happy Birthday and enjoying birthday cake during the city council work session. The heartfelt rendition of the song started out slowly and improved as the song ended, as most renditions of Happy Birthday usually do.

On February 3, Kings Mountain Police Department (KMPD) and Kings Mountain Fire Department (KMFD) responded to a working structure fire located at 1314 Shelby Road (Roses).

The fire was quickly extinguished but not before a portion of the business received substantial damage. A joint investigation into the cause and origin of the fire was conducted by KMFD and the Cleveland County Fire Marshalls Office resulting in the determination that the fire was suspicious.

By Loretta Cozart The Kings Mountain Herald obtained the NC Office of State Fire Marshal’s report from Chief Deputy State Fire Marshal Mike Williams.

In the report, the cause of the fire at 400 Dixon School Road on January 2 was ruled undetermined.

The report shared the following items of fact: • On Tuesday, January 2, the Cleveland County communications center received a 911 call for a structure fire located at the Kings Mtn Truck Plaza at 400 Dixon School Road in Kings Mountain. The Kings Mountain Fire Department responded to the call and arrived on scene to find a commercial building with

heavy fire conditions coming from the rear of the building.

• The Kings Mtn Fire Department and several other mutual aid departments began suppression efforts.

The Cleveland County Fire Marshal’s Office and the NC Office of State Fire Marshal’s Fire Investigation Unit conducted an Origin & Cause investigation. The cause of the fire is listed as undetermined.

• On Tuesday, January 2, Cleveland County Fire Marshal Perry Davis contacted Office of State Fire Marshal (OFSM) Investigator Kevin Head to request assistance with the Origin & Cause Investigation. OSFM Investigator Marsh responded to the scene on Wednesday, January 2, to assist with the Origin & Cause investigation.

By Loretta Cozart Cleveland County Music Hall of Fame (CCMHOF) thanked Speaker of the House Tim Moore, Senator Ted Alexander, and Representative Kelly Hastings for supporting them with a $75,000 donation on Wednesday, February 7.

Their Board met with them on Wednesday at their Hall of Fame Building, at 1511 West Dixon Boulevard in Shelby.

“We are appreciative that they took the time to learn more about our plans for the renovation of the building and about preserving the History of Music in Cleveland County,” the CCMHOF shared.

The Cleveland County Music Hall of Fame was established in 2019. The mission of the Hall of

Fame is to honor the legacy of pioneers from Cleveland County whose talent has enriched the musical landscape of the area in which they live/lived while giving the tools needed to future generations of musicians to hone their craft. In 2021, Calvin and Teresa Hastings donated the WOHS studios on Hwy 74. In that building the Hall of Fame plans to house a museum, as well as recording studio and a learning center for students who want to play an instrument.

Cambridge Oaks Apts. fire Thursday night

By Loretta Cozart On Thursday, February 8, first responders received a call to a fire at Cambridge Oaks Circle.

Three fire departments, including Kings Mountain, Grover, and Bessemer City responded,

along with Kings Mountain Police and GEMS. According to Josh Wall, Kings Mountain Fire Department’s Interim Chief, Kings Mountain Police was first on the scene and were able to put a stove’s grease fire out. Interim Chief Wall

expressed his gratitude to KMPD for handling the fire quickly.

Afterward, KMFD firefighters attended to the situation, working with the residents, and taking care of the scene. Nobody was hurt in the incident.

Shirley Jean Wells KINGS MOUNTAIN, NC – Shirley Jean Wells, 76, of Kings Mountain, NC, passed away on February 6, 2024 at White Oak Manor of Kings Mountain.

Born in Cleveland County, NC, she was daughter of the late Arthur and Wilhelmina Summitt Sprouse.

Shirley worked for many years doing clerical work at Kings Mountain Hospital, was a longtime Sunday School teacher, and was also active as a volunteer for

Debbie was a current member of Bethlehem Baptist Church and a former

She was a longtime member of Family Worship Center and most recently attended Midview Baptist Church of Kings Mountain.

Despite staying busy with work and serving others, Shirley still managed to be an exemplary homemaker. Her extensive collection of cookbooks helped her to be an amazing cook for her family and friends.

Shirley was a wonderful mother for her children and the best Mamaw for her grandchildren. She always thought of others before herself. Her love, warmth, and affection will be missed by all those who knew and loved her.

She is survived by her husband of over 57 years: Steven Wells, of the home; children: Trent Wells of Kings Mountain; Steven Scott Wells (Nichole) of Statesville; sister: Debbie Mauney (Kemp) of Kings Mountain; grandchildren: Emma Morgan Royer (Brent); step-grandchildren:

She was a private person with a small circle of friends that meant the world to Debbie. She had a gift of restoring flowers back to their natural beauty and loved Christmas movies, no matter the time of year.

Porch Pirate caught on camera On Thursday, January 25th, Kings Mountain Police Department received a report of a larceny of a package from a residence on Landing St in Kings Mountain. At approximately 2:46 a.m., an unknown black male subject approached the residence and removed a package from the front porch.

GCPD needs help identifying larceny and card fraud suspect An unknown black male stole a wallet from a vehicle parked at 1744 Lane Road in Mount Holly on Tuesday, February 6, at 1:30 p.m. The suspect was wearing a bright, shiny red, puffer-style jacket with a hood, a black ball cap with a logo on the front and a reflective sticker on the top of the bill, a black shirt, black pants, and multi-colored tennis shoes with different shades of blue and magenta. The suspect was also wearing a necklace with a pendant around his neck.

The suspect was driving a dark-colored, 4-door passenger car, possibly a Nissan Maxima.

The suspect used a financial card from the stolen wallet multiple times following the theft. A video was taken from one of the stores where the suspect used the stolen financial card.

Prisoner who walked off job site in Marion captured

A prisoner who walked away from a jobsite at Marion CorSMITH rectional Center on Wednesday, February 7 was captured in Asheville five hours later, according to WLOS TV. The station reported that Rutherford Correctional Center offender Billy Lee Smith abducted a woman in Marion and forced her to drive him to Asheville. Once there, he released the woman and fled on foot and was later caught near the Richmond Hill and Emma communities.

Smith, 42, is a minimum custody offender serving a 10-year sentence for drug trafficking after his conviction in Buncombe County in 2022. His projected release date was April 27, 2028.

He is originally from Leicester in Buncombe County.

Smith was working near

a maintenance shed on the grounds of Marion Correctional when a staff mem-

ber checked on him around 11:35 a.m. and discovered he was missing.

Hardee’s dining room reopens

By Loretta Cozart On Tuesday, January 30, Hardee’s dining room at 509 E King Street in Kings Mountain reopened its dining room to customers.

According to staff, the

restaurant’s dining room is repaired and ready for business. They welcomed customers back, saying, “We hope folks will visit and bring friends and family to enjoy our dining room.”

On July 17, 2023, a driver lost control of their

vehicle and slammed into the southwest corner of the restaurant, smashing glass, injuring customers, and made a general mess of things. Three months later, the drive through reopened on October 23.

Leaf season ends on February 15 City crews will survey the streets on February 15, and piles of leaves out that day will be vacuumed the following week. The Leaf Truck should be thru your area by February 15.

Please keep brush, limbs, and sticks piled separately from loose leaves. When these items are piled together or one on top of the other, it

Don’t fall for Artificial Intelligence scams When a new technology emerges, scammers are the first to exploit it to target unsuspecting consumers, warns NC Attorney General Josh Stein. “Our office has been hearing reports of bad actors using Artificial Intelligence (AI) to clone popular figures’ voices to try and trick you out of your money or personal information. They may even clone the voice of someone you know. NCDHHS distributed funds to county School social worker in Gaston DSS for kids with complicated needs County publishes children’s book The North Carolina Department of Health and Human Services distributed funds this week to county social services departments to help improve placements for children with complex behavioral health needs in DSS custody. These critical funds come when an average of 32 children live in DSS offices each week because there is no place for them to go that is appropriate for their care.

"Some children in the care of social services have particularly complex needs and can get stuck waiting in emergency departments or sleeping in government offices," said NC Health and Human Services Secretary Kody H. Kinsley. "We are providing our county partners flexible funding to replicate and expand programs already working in pockets of the state to help ensure these children get the right care at the right time."

The DSS Emergency Placement Fund is a pilot program funded by the NC General Assembly in the 2023 North Carolina state budget. The program provides nearly $2.3 million this year and $5.5 million next year to assist county DSS offices in creating better, more reliable placement options for children in their custody with behavioral health needs. The funds will help improve outcomes by preventing children and youth from staying in a DSS office overnight while they await

placement into Medicaid-funded treatment.

"We are grateful to our partners at the General Assembly for providing these funds so we can help our county DSS offices who have been using every resource they have to make sure children in their custody are safe," said NCDHHS Deputy Secretary for Children and Family Well-Being Susan Osborne. "We all want children to have the resources and health care they need so they can thrive, and this pilot program is one step forward in improving the lives of children in DSS care."

The DSS Emergency Placement Fund improves care options by enabling DSS offices to implement practices that have been shown to support better placements for children with complex behavioral health needs. These practices can include: • Maintaining a crisis placement provider on retainer who can provide a temporary emergency placement that is suitable to a child’s behavioral health needs until a treatment placement can be located.

• Providing short-term rate increases to placement providers who care for children with behavioral health needs requiring exceptional supervision.

These funds will be used to improve the placement provider’s ability to meet the child’s needs.

• Implementing local

solutions that prevent a child in DSS custody from spending a night in the DSS office while awaiting an appropriate placement for behavioral health treatment. These alternate practices are to be submitted to the NCDHHS Division of Social Services for approval.

Allocations were made based on each county’s percentage of the foster care census to ensure sufficient and equitable funding for all counties. Funds were available beginning Feb. 1, with reimbursement beginning in March 2024.

The DSS Emergency Placement Fund is one initiative within $80 million allocated to directly support child and family well-being with specialty treatment programs and intensive supports for children with complex behavioral health needs. These investments mean fewer children boarding in DSS offices, more children in DSS custody living in a home setting appropriate for their behavioral health needs and potentially fewer emergency department visits or stays for children experiencing a behavioral health crisis.

The work is made possible by the Medicaid expansion signing bonus, which provided a historic $835 million investment to transform behavioral health for everyone in North Carolina, including children and families.

G a s ton County Schools social worker Heather Pierczynski has added published author to PIERCZYNSKI her resume.

Her holiday-themed children’s book, “A Creature Was Stirring,” went to press in September and was released by Harper Collins Publishing in time for the recent Christmas season.

The book is a take on the “’Twas the Night Before Christmas” tale, and it tells the story of a mouse whose night of stirring almost ruined Christmas. Luckily, Santa stepped in to make everything right.

“Children can relate to it because it is hard to go to bed on Christmas Eve with all of the festivities, the presents, and Santa Claus. It is understandable why children – and the mouse in the book – are so excited,” explained Pierczynski.

Getting to the point of having a published book has been 15 years in the making for Pierczynski, but her interest in writing goes back to her days as a student in Gaston County Schools. She first discovered a love for writing while in Paula Dixon’s second-grade class at Robinson Elementary. A self-described “writer and storyteller at heart,” Pierczynski also credits Sally Griffin, her creative writing teacher at Forestview High School, for providing the inspiration to set her sights on writing professionally.

“Mrs. Griffin helped me realize my potential. She believed in her students, and she let us explore and make mistakes, which was an important part of learning about how to write,” said Pierczynski, who majored in English at N.C. State University and says her success is due in part to the support of her Gaston County Schools teachers at Robinson, Grier, and Forestview.

According to Pierczynski, the idea for “A Creature Was Stirring” came about while talking to her colleagues at Holbrook Middle School. Instead of having a mouse inside a school, she adapted the idea to make the main character a mouse inside a house at Christmastime. She wrote the manuscript in 2020. Spending more time with family during the COVID-19 pandemic and seeing how much her young son enjoyed reading time “reinvigorated my love for writing,” she said.

Writing a book does not happen overnight nor does getting it published. Pierczynski was persistent in her pursuit of a publishing deal, despite getting rejection letters from publishing companies or no response at all.

“It is my dream come true,” said Pierczynski of seeing “A Creature Was Stirring” in published format. “I knew it would be a long shot, but no matter how far-fetched dreams are, you have to go for it. It is never too late.”

With a master’s degree in social work from Winthrop University, Pierczynski spent 12 years working for social services. Now in her fourth year as a school social worker, Pierczynski enjoys supporting students – she’s at Holbrook now, but served the Gaston Early College High School previously and is temporarily covering the social worker duties at Cramerton Middle School.

If you want to obey God, love one another. If you want others to know you are a follower and disciple of Christ, love one another with the love of Christ. In a society where we are often consumed by individualistic goals and focused on ourselves, acts of kindness and Christian love can change the world. Practicing God’s love can break down barriers, build bridges, and foster community. So, let us consciously love one another and share the good news of Jesus Christ with others. So finally, my dear friends, I leave you with this, “Let all that you do be done in love ” (1 Corinthians 16:14).

KM Little Theatre and Harris Funeral Home present CLUE: ON STAGE Based on the iconic 1985 Paramount movie which was inspired by the classic Hasbro board game, Clue: On Stage is a hilarious farce-meetsmurder mystery. The tale begins at a remote mansion where six mysterious guests assemble for an unusual dinner party where murder and blackmail are on the menu. When their host turns up dead, they all become suspects.

Led by the butler Wadsworth, the guests - Colonel Mustard, Mrs. White, Mr. Green, Mrs. Peacock, Professor Plum, and Miss Scarlet – race to find the killer as the body count stacks up. Though discouraged from revealing personal information, it is soon discovered that all of them have fallen victim to the same blackmailer, their very host of the evening. What follows is a madcap, slapstick evening full of murder, mystery and laughs as they seek to puzzle out the culprit amongst criminals.

ITALIAN CHICKEN Karen Roper 1 bottle Zesty Italian dressing 4 boneless chicken breasts Bread crumbs Little melted butter Marinate chicken breasts covered in dressing for 8 hours. Remove from dressing and dip in breadcrumbs. Place breasts in a greased baking dish. Drizzle melted butter over the top. Bake in 400-degree oven until meat browns for 1 hour.

Brown chicken on both sides. You may drizzle a little more dressing and butter over the top while it is baking.

HASH BROWN CASSEROLE Judy Grindstaff 2 lb. frozen hash brown potatoes ½ cup melted margarine 1 tsp. pepper 1 tsp. salt 2 cans celery soup 1 (8 oz.) carton sour cream 2 c. grated sharp cheese 1 (8 oz.) pkg. cream cheese, cubed TOPPING 2 ½ TO 3 C. Special K or corn flakes 1/3 c. melted margarine Defrost potatoes. Toss with margarine, salt, and pepper.

Mix remaining ingredients and add to potatoes. Place in 9x13-inch casserole dish. Put topping on casserole. Bake, uncovered,

at 300-degrees for 45 to 50 minutes.

PINEAPPLE CASSEROLE Carolyn Carringer 2 large cans crushed pineapple 1 ½ cups sugar 3 Tbsp. flour 2 sticks margarine 8 oz. grated Cheddar cheese 2 pkg. Ritz crackers, crushed Mix flour and sugar. Stir in pineapple. Add 1 stick melted margarine and mix well. Pour in buttered 9x12inch casserole dish. Top with grated cheese. Melt 1 stick margarine and toss in crackers. Layer cracker crumbs on topo. Bake at 350-degrees for 30 minutes.

BrightFarms Southwest Chipotle Salad kit recall In response to a voluntary recall initiated by Rizo Lopez Foods, Inc. who produces and supplies cheese products, BrightFarms is voluntarily recalling its Southwest Chipotle salad kit with best-by-dates between 12/31/23 and 2/22/24 due to potential contamination of Listeria monocytogenes in the Cotija Cheese, an ingredient found in the salad kit.

Listeria monocytogenes is an organism that can cause serious and sometimes fatal infections in young children, frail or elderly people, and others with weakened immune systems. Although healthy individuals may suffer only short-term symptoms such as high fever, severe headache, stiffness, nausea, abdominal pain and diarrhea, Listeria infection can cause miscarriage and stillbirths among pregnant women.

The affected cheese product is contained in a fully enclosed and sealed plastic “masterpack” placed inside the kit and contains a best-by-date through 3/27/24. The product comes in a clear, plastic container. Information about the “best by” date, UPC can be found at the bottom of the package. Pictures to assist customers in identifying the recalled products are found at the end of this announcement.

Consumers who have purchased the affected products should dispose of the “masterpack” containing the Cotija cheese or discard the full salad kit and present a photo of the product, receipt, or reference their loyalty card history at their place of purchase for a full refund. ALWS 2024 needs bat boys and bat girls

The American Legion World Series Executive Committee is seeking qualified students to serve as official bat boys and bat girls for the 2024 ALWS. Applicants must be 10-12 years of age.

The deadline to apply is April 15, 2024. The tournament is scheduled for Aug. 15-20 at Shelby High School’s Keeter Stadium. Applications are on the American Legion World Series website and Facebook page All applicants are required to be currently playing (2024) in an organized baseball or softball program (Little League, Dixie, City Parks and Recreation program, etc.).

A Bat Boy or Bat Girl has a responsibility to assist the players and coaches, and, ultimately, help speed up the game. Responsibilities include retrieving bats left in the dugout or on the

field; gathering arm and shin guards that batters drop; and participating in team pregame warmups at the discretion of the coach.

NCDHHS launches child behavioral health dashboard Last week, NCDHHS announced the launch of its Child Behavioral Health dashboard as part of its commitment to improve the health and well-being of North Carolina children and families.

North Carolina has been ranked 42nd among states with the highest prevalence and lowest access to mental health services for youth, and suicide is now the second leading cause of death for North Carolina youth ages 10-18.

Health dashboard builds a data and analysis infrastructure across child-serving sectors to provide a more complete picture of the state of behavioral health in North Carolina. An important feature of the new dashboard is users can drill down the data by geography, race, ethnicity, age and gender to provide additional visibility into child behavioral health in underserved populations.

The information shared through this publicly available tool will help the department, as well as be-

havioral health providers, policymakers and stakeholders, to identify and address gaps and disparities in behavioral health services for children. Metrics will continue to be updated quarterly, based on data from Medicaid claims, and yearly, based on the Youth Risk Behavior Survey.

• Be careful using a mailaway service. Understand all of the terms and conditions before mailing your jewelry. Take photos, list your items, and insure them before sending them. Know

how long it takes to receive an offer and how long you must accept or reject it.

• Know your worth.

Keep in mind that jewelers and pawnbrokers intend to resell your piece. You may be able to make more by selling to the public, but it comes with additional risk.

Don’t let your jewelry of different karat values be weighed together. Separate your jewelry by karat value before selling and be wary of dealers who weigh all jewelry together and pay you the lowest karat value.

Mountaineers post 104-70 win over Forestview Kings Mountain High’s men’s basketball team had a game the players will remember for years Friday night when the Mountaineers slammed Forestview 104-70 in a Big South Conference bout in Gastonia.

Ten different Mountaineers took part in the scoring

and six of them hit double figures.

Caleb Nixon led the way with 26 points. Bradley and Jordan Floyd scored 14 points apiece, Tucker Robinette and Kee’don Linney 11 each and Emmanuelle Toms 10. Toms’ threepointer put the Mountain-

eers up 100-67 and his final field goal accounted for the final score. Bradley Floyd dished out 11 assists and pulled down eight rebounds to go with his 14 points.

The Mountaineers led all the way except for an early 2-2 tie. They were up 24-10 after the first quarter, 50-30

at the half and 74-54 going into the fourth period.

Kings Mountain’s girls weren’t as fortunate as they fell to a good Forestview team 73-46. The Forestview ladies jumped out to a 20-8 lead in the first period, extended it to 46-22 at the half and led 59-36 going into the

fourth quarter.

KM Middle runs table in division, in Tri-County playoffs this week Kings Mountain Middle School’s boys basketball team finished the regular season undefeated last week with a 50-12 win over county rival Burns.

The Patriots took their perfect 12-0 record into a first round Tri-County Conference playoff game against the Crest Dragons Monday at KMMS. The perfect season in the division was the Patriots’ third in the past five years.

Kings Mountain led from the beginning and posted 21 points before Burns scored.

Carlos Boyce got the rout going with nine first quarter points. Silas Tate and KJ Bell added four apiece and Xavier Hutchens had six assists and three steals.

KM kept up its scoring pace in the second period.

Hutchens and Christian Jarrett scored five points each

as the Pats extended their lead to 39-7 at the the half.

The third quarter saw KM score nine points with Hutchens and KJ Bell scoring eight Kings Mountain’s bench got into the action in the fourth period. Ashtun Hall scored the final two points to account for the final score.

All of the Patriots had a good game. Bell finished with 13 points and four rebounds. Carlos Boyce had 12 points, three rebounds and two steals.

Hutchens finished with nine points, four offensive rebounds, eight assists and three steals.

Christian Jarrett had seven points, six rebounds including five on offense, and blocked five shots.

stride for stride against Andrew Wahlgren from Croatan High School and came out in second place by .07 of a second.

“It was a true photo finish and a race that no

one will forget for quite a while,” said Mountaineer head coach Rayvis Key. “Max set three new indoor school records this season.”

A huge surprise for the

women’s team was Zaniah Field, who had an amazing 17’3.25” long jump that placed her third in the state. Her time set a new KMHS indoor record.

KMHS wrestlers win 3A Regional, at State this week Kings Mountain High School’s wrestlers won the NCHSAA 3A Western Regional championship over the weekend at Pisgah High School in Canton.

It was the first time in over 20 years that the Mountaineers won the Western title.

Jalen Culp won his weight division and was named the Regional’s Most Outstanding Wrestler. He tied the all-time KMHS single season record with an unbeaten record of 55-0. He will have a shot at

setting a new career single season record this week in the State Tournament.

Second place finishers for the Mountaineers were Luis Davis, Will Varner and Elihu Lipscomb.

Javier Currie finished third and Emmanuel Ortiz fourth.

All of the above-mentioned Mountaineers will be competing in the state championship this weekend in Greensboro.

Swim Regionals and state finals On Saturday February 3 several of Kings Mountain’s swimmers participated in the Western Regional Championship.

To qualify a swimmer had to post a time in the top 24 swimmers in their region.

Kings Mountain had 3 individual swimmers and 5 relays qualify.

Mason Demetro qualified for the 200 yard freestyle and the 100 yard butterfly. Callie Stimpson

qualified for the 200 yard individual medley and the 100 yard butterfly. Thomas Spicer qualified for the 100 yard breaststroke.

The women’s 200 yard medley relay was made up of a team consisting of Naomi Houston, Noel George, Kallie Hope and Madisin Goble. The women also competed I the 400 freestyle relay with a team of Callie Stimpson, Madisin Goble, Naomi

Houston and Noel George.

For the men the first relay was the 200 yard medley relay. Jamari Vines-Nolan, Thomas Spicer, Wynn McConaghy and Bernardo Hernandez made up the relay. The men also competed in both the 200 freestyle relay and the 400 freestyle relay with a team made up of Jamari Vines-Nolan, Thomas Spicer, Mason Demetro and Bernardo Hernandez.

Two swimmers qualified to compete in the State Championship on Thursday February 8. Mason Demetro competed in both the 200 yard freestyle and the 100 yard butterfly.

Thomas Spicer qualified and competed in the 100 yard breaststroke. Demetro also qualified to compete in the State finals later that evening finishing 10th overall.

Patriots win 11th straight 52-3 over East Lincoln Kings Mountain Middle School’s boys basketball team ran its record to 11-0 last week with a convincing 52-33 win over the Falcons of East Lincoln.

In the first quarter KM’s KJ Bell got the Patriots on the board with an offensive put back. Silas Tate scored on a fast break layup on the next possession for a 4-0 lead.

Christian Jarrett’s buzzer beating three pointer gave the home team a 14-4 advantage after one period.

How to Fight Back Against Age Discrimination Dear Savvy Senior, What are the steps to take to fight against age discrimination in the workplace, and where can I turn to for help if I think I’ve got a case?

Passed Over Paul Dear Paul, If you believe your age has cost you in the workplace – whether it’s a job, a promotion, or a raise – you have options for fighting back. Here’s what you should know along with some steps to take against this illegal workplace activity.

ADEA Protection The Age Discrimination in Employment Act (ADEA) is your first defense against age discrimination. This is a federal law that says an employer cannot fire, refuse to hire, or treat you differently than other employees because of your age. Some examples of age discrimination include: • You were fired because your boss wanted to keep younger workers who are paid less.

• You were turned down for a promotion, which went to someone younger hired from outside the company, because the boss says the company “needs new blood.”

• When company layoffs are announced, most of the persons laid off were older, while younger workers with less seniority and less on-the-job experience were kept on.

• Before you were fired, your supervisor made age-related remarks about you.

• You didn’t get hired because the employer wanted a younger-looking person to do the job.

The ADEA protects all workers and job applicants age 40 and over who work for employers that have 20 or more employees – including federal, state and local governments as well as employment agencies and labor unions.

If your workplace has fewer than 20 employees, you may still be protected under your state’s anti-age discrimination law.

Steps to Take If you think you are a victim of employment age discrimination, you may first want to talk to your supervisor informally or file a formal complaint with your company’s human resources department.

If that doesn’t resolve the problem, you

should then file a charge with the Equal Employment Opportunity Commission (EEOC) within 180 days from the date of the alleged violation, but it may be extended to 300 days. You can do this online, by mail or in person at your nearest EEOC office (see EEOC.gov/field-office) or call 800-6694000. They will help you through the filing process and let you know if you should also file a charge with your state anti-discrimination agency.

If you do file, be prepared to provide the names of potential witnesses, your notes about age-related comments and other episodes.

Another option you may want to consider is mediation, which is a fair and efficient way to help you resolve your employment disputes and reach an agreement. The EEOC offers mediation at no cost if your current or former employer agrees to participate. At mediation, you show up with your evidence, your employer presents theirs and the mediator makes a determination within a day or less.

Once the charge is filed, the EEOC will investigate your complaint and find either reasonable cause to believe that age discrimination has occurred, or no cause and no basis for a claim. After the investigation, the EEOC will then send you their findings along with a “notice-of-right-to-sue,” which gives you permission to file a lawsuit in a court of law.
