Wegner, Ron Arad, Poul Kjaerholm, Charles and Ray Eames, Jasper Morrison, Lissoni, Cappellini, Minotti, Nube Italia, Philippe Starck, Guido Drocco and Franco Mello, Piero Fornasetti and Kartell. A highlight has to be the Poul Kjaerholm PK24 chaise lounge (illustrated previous page, lot 34) originally manufactured in Denmark in 1965 by Fritz Hansen. Poul Kjaerholm was employed at Fritz Hansen, where he designed a number of noteworthy chair prototypes. In 1955, Poul Kjaerholm initiated his collaboration with manufacturer Ejvind Kold Christensen, which lasted until Poul Kjaerholm’s death in 1980. In 1982, Fritz Hansen took over the production and sales of ‘The Kjaerholm Collection’ developed from designs produced between 1951 and 1967. Minute detail and an aura of exclusivity, culminated in the sophisticated and highly refined PK24, big brother to the PK22 chair. The PK24 is supported on a stainless steel frame and is made of natural wicker with an adjustable leather headrest with a counterweight in steel. Its curved lightweight form adds elegance to any environment. The particular chair featured in the catalogue was manufactured in 1995 under licence by Fritz Hansen (the original label is affixed to the frame).

Quirky items include a collection of limited-edition art toys features designs by Tony Oursler, Chiho Aoshima, R. Crumb, Alex Katz, Rita Ackermann and Kurt Vonnegut (lot 124). Director, Te Tuhi Centre for the Arts James McCarthy is the current Director of Te Tuhi Centre for the Arts in Manukau City. Past lives include contemporary dance, performance, scratch musician, and furniture designer, as well as holding a variety of professional roles in the art world. A practicing artist he has exhibited and performed most recently at the Govett Brewster Art gallery, the Gus Fisher and is a current member of Vitamin S improvisation collective.

Editor, Urbis Magazine Nicole Stock is the Editor of Urbis, a trained architect, whose interests moved towards publishing and writing. While her interest naturally skews towards architecture, she has always been interested in product and furniture design. With her role at Urbis, she has been able to develop her knowledge of furniture design further, as well as develop an interest in art, car design, technology and graphic design which are all covered in the magazine.

A blend of cabernet sauvignon, merlot and malbec; the wine delivers harmony, fragrance, length and seamless integration of character. The Antipodean brings the originality and diversity of ‘New World’ wine production to ‘Old World’ grape varieties and winemaking techniques. 750mls are available in 1987, 1992, 1993 and 1994 vintages and these carry estimates of $100 - $120 per bottle. After completing a Bachelor of Arts in Art History and English at the Melbourne University, Nick joined Sotheby’s at ground level. Gaining operational responsibility for both the Melbourne and Sydney salerooms and with a thorough knowledge of antiques and decorative arts from 18th – 20th century, Nick brings a wealth of knowledge and experience to Webb’s decorative arts team. Peter Stichbury is something of a modern-day social satirist. His sometimes fictional, sometimes real-life characters often consist of saccharine young women with smooth plasticine skins, gelatinous lips and creamy flowing hair or pale, vague, vulnerable-looking boys, all with perplexed, surprised or awkwardly dazed expressions. The artist is also partial to the odd intellectual, favouring the type that may scratch his head rather more than is necessary, wear glasses, carry an i-Mac tan and struggle to suppress a lisp or other speech impediment. Whoever is portrayed, there appears to be an inner uncertainty about them – an impressionability, naivety or curiosity. They are misfits and adolescents – people adrift in a sea of daily existential battles captured close up in a moment. Many of Stichbury’s characters seem engaged in their own personal monologue – as though the painting represents not a stranger visually interrogating the subject, but the subject visualising themselves, captured more in a mirror than by a camera or in a painting. Stichbury highlights the inherent urge to narcissism of the teenager, encouraged by advertising and the media to model themselves on magazine and pop-culture
examples, to insert themselves into toothpaste/anti-blemish cream/cola commercials, to make themselves fit the mould. In the case of the creatives and intellectuals, of which Ryan J Hobbs is one, there appears a more Antoine Doinel-style self-assessment going on. As the artist has remarked: “I’ve become increasingly interested in representing the underdog… In general, the privileged, wealthy and beautiful take precedence when it comes to representation, while other groups remain invisible. I’d like to address that balance” (Peter Stichbury The Times Interview – Peter Stichbury, Explain Yourself to Cameron Broadhurst The Times Online, Thursday 31 July 2008 www.times.co.nz). And they certainly provide a refreshing counterpoint. For all the sticky pop and surface, however, there remains in Stichbury’s work a strong connection with the history of portraiture, in particular the early work of Lucien Freud, all almond-shaped eyes, rounded faces and curious expressions, as well as Otto Dix, Jean Auguste, Dominique Ingres and Alex Katz. Like many before him, Stichbury is a commentator, a painter of people and their social values in a broad and culturally discursive sense, affectionately jesting at what it is to be a plural, incongruous and vulnerable – or perhaps perfectly well-adjusted – individual in our contemporary environment. “+ – is a huge canvas, black and slick. Painted mountains, soft and animallike in their steep curves and dark dips, are seen through the forms of the simple plus and minus signs of classroom maths, of economic cost-benefit analysis. It could easily illustrate the current splitting up of the South Island high country, the selling of prominent lands, the marketing of the New Zealand landscape.” Sally Blundell, Prole Art Threat (New Zealand Listener, 23 October 2004, pp. 38–41) + – comes within the context of a series of paintings de Lautour began to produce around 2002 featuring symbols omnipotent within the highcapitalist, logo-laden landscape of the early naughties. As Sally Blundell describes (above), the symbol of + – is open to interpretation. From her analyses, however, what becomes apparent is the existence, within the world, of an invisible balancing act, a natural order whereby something being added is invariably – and somewhat paradoxically – contingent with something being lost. Adding to the dictionary of possibilities already discussed, it could be suggested that + – represents the combination of + and – which forms a battery charge, thus making it a very literal logo for power. This aligns it with other, more lucid examples from the series such as the Nike tick, the @ symbol, and the McDonald’s M (seen in Webb’s May 2008 Contemporary Art sale)

which allude to those who hold power in our socio-economic landscape. “These ‘copywrite (sic) paintings’ are yet another reflection on the looted arcadia – and the commodification of art” Andrew Paul Wood, Dark Paradise: Notes on the Paintings of Tony de Lautour (Art New Zealand, Issue 105, Summer 2002–03, p. 65) Within its formation, the landscape is idealised and regulated, and conforms to the bounds of its outward appearance, its literary, symbolic, message. It floats like an artificial beacon for what it attempts to market – similar to tourist images of New Zealand which represent a simplified, idealised and somewhat cartoon-like version of this rugged and wild, pillaged and pimped, culturally confused little island. It looks not like a natural land but a surreal exercise in corporate control – terrain that has been mapped and tamed cartographically, heightened by the ambiguous numerical references which Blundell attributes to the page “ reference numbers from the atlas that was used” (ibid). Employing de Lautour’s signature white paint, the work has a strongly graphic quality. There is a gothic sensibility to the severe contrast of the vacuous black void behind the floating ciphers; it is like a black sea, a dead sea, a dark abyss of the unknown. The islands could be the postapocalyptic iron relics of civilisation in outer space, all that is left when the world has combusted under its own super-capitalism: dispassionate, otherworldly totems floating within the sublime infinity of the cosmos. A widely exhibited and distinctive contemporary artist, Australian-born Nike Savvas has been the subject of numerous solo shows throughout Europe, Scandinavia and the Pacific and has participated in significant international group shows, including the 1998 exhibition ‘New Contemporaries’ at the Camden Art Centre, London. Significant site-specific works, comprising shimmering curtains of light-reflective, metallic discs that gently twirl, shine and deflect light as well as bright, candy-coloured expanses, employing carefully strung ping-pong balls, have been completed for many public and private institutions, mesmerising audiences at Selfridges, London, as part of Fashion Week 1998, and captivating visitors to Auckland’s own Lumley Tower. Her delicately constructed paintings, such as House of Love, similarly achieve an unreal sense of movement, suspension and depth within a twodimensional arena, featuring the signature spots in bright kaleidoscopes of colour. Here, the vibrant red ground projects forward as though the particles or dots are suspended in red refracted light, giving the illusion that fainter, more transparent-hued spheres float in receding space, often eclipsed by those more opaque that appear at the front. Other transparent baubles huddle in clusters, creating delightful mini colour palettes. All seem to move. All seem random, nonsensical, chaotic particles, wafting around uncontrolled, unordered and bumping into one another to various, unexpected effect. It is the zoom effect – up close it seems only chaos but from afar it is ordered, beautiful, correct – a harmonious image. In both Savvas’s sculptures and paintings, her repetitive circular form has a wildly diverse set of reference points from high art through popular culture and beyond. Titles have acknowledged the 19th-century French Pointillist painter, Georges Seurat, though Savvas’s own sculptures also share something of the hypnotic installations and drawings of Yayoi Kusama and, of course, the current ‘Prince of the Dot’, Damien Hirst, with his recent paintings featuring them. A natural correlation can also be considered, closer to home, with the work of Aboriginal practitioners such as Angelina Pwerle and her Bush Plum Dreaming paintings. IMOGEN KERR

Julian Dashper is well known as an artist who works in installation and painting. What may not be so commonly known is his passion for mid-century furniture. This table is created using the woodwork patterns of Gerrit Rietveld. In possession of a book of Rietveld’s patterns, Dashper was inspired to make a number of pieces, including copies of the Gerrit Rietveld Red, Blue Chairs. These were seen recently in Home magazine in the central Auckland apartment of Glenn Schaeffer. By painting them an ‘inappropriate’ colour, he made them his own unique works of art. As with much of his work, modernism is the subject matter rather than the reference; it is homage. EMMA FOX 52

Belonging to the series Revolution, Hartigan’s delicate spiralling tube of turquoise, orange and white neon pays homage to New Zealand artist Julian Dashper and, in particular, to an untitled screen-print by Dashper (see Lot 55) that features a similar palette. Indeed, the series to which Dashperion (Revolution 5) belongs comprises some 20 pieces with each work paying homage to a specific artist, artwork or series of artwork that also includes the likes of Marcel Duchamp, Joan Miro, Ralph Hotere, Don Driver, Piet Mondrian and Bruce Nauman. The curled nest of light is essentially a three-dimensional drawing in space – one whose exact positioning has been carefully considered by Hartigan. Emanating an ethereal, mesmeric glow, the work is somewhat akin to the large, colour-field paintings of the American Abstract Expressionist Mark Rothko. Like Rothko’s works, Daspherion envelops the spectator, bathing them in a warm pool of intricately coloured light. A strong influence on Hartigan’s Revolutions is found in the work of Marcel Duchamp and, in particular, the mechanical rotating vortexes that he created. One of these machines was in the Mary Sisler Collection that came to New Zealand in the 1962 QE2 Exhibition. Although Hartigan’s work doesn’t rotate or spin, the coiling neon does have a somewhat hypnotic magnetism like Duchamp’s vortex, attracting the prolonged contemplation of the viewer. JEMMA FIELD

In her seminal work A Natural History of the Senses, Diane Ackerman examines both the science of how the senses work, and the varied means by which different cultures have sought to stimulate the senses. Sara Hughes’ work suggests similar investigations. Although not so concerned about how our senses span distance or culture, Hughes’s work encourages us to question how our senses span time and, more specifically, how they are being engaged to navigate new form and structures of information. Grappling with the geometry of economics, whilst deciphering an optical sense of order, the promise of perfect information in Hughes’s work is often overshadowed with lush optical data that offers a sense of place rather than a precise measure of it. Blurring the boundaries of the real and the imagined, Seraphine Pick’s impressive canvas details an ordinary lounge albeit with some interesting additions. Everyday items such as the couch, curtains, television, ashtray and lamp lend the work a sense of familiarity while the casual, relaxed pose of the figure in the background adds an element of languid calm. The foreground, however, tells a slightly different story.
Sitting backwards on a chair, clad in a black hooded sweatshirt and jandals, a young girl concentrates intently on the floor where a small group of fantastical creatures – some winged and some horned and some with long ears – gathers in a small, fenced circle. Beautifully rendered, these hybrid creatures cluster on and around a plump, round cushion that is encircled by a miniature mountain range. The painterly treatment of the work is characteristic of Pick, with an apparent textured surface due to the wealth of visible brush strokes. Although the lamp casts a distinct pool of light, the entire work is infused with a soft luminous glow that adds to its alluring charm. JEMMA FIELD

Judy Millar’s work is bold, gestural and, even though it is pure nonobjective abstraction on a flat ground, it is still highly three-dimensional. Millar is one of New Zealand’s best abstract painters and is attracting huge international attention, especially in Europe. She is primarily concerned with the direct relationship of the body to the surface of the canvas and the viscosity and materiality of paint as it is initially applied and moved around using the side of her hand. This process allows her to get as close to the surface as possible resulting in an abundance of assertive movement, emotion and synaesthetic action. This technique allows the imagery to be created by a reductive process, the removal of paint. Breaking down conservative traditions of painting, where building up the layers has been the status quo, she paints backwards instead, removing and reworking the paint whilst it is still wet. This process is a significant development from her stripe paintings of the mid-nineties such as the Stroke series and masking-tape works,
which consisted of compositions made up of ordered horizontal bands. The fluidity and honesty of the surface in Untitled, 2005 allows viewers to immerse themselves easily in the painting. In this sense, the painting becomes a type of semi-permeable membrane; it evokes a desire for immersion rather than offering a superficial surface trick. This is a similar philosophical outlook to that was characterised by the American Abstract Expressionists, also called the Action painters, who originated primarily in New York from the thirties. It is an ideology which encompasses the philosophy of freedom, where spontaneous improvisation and individuality reigns supreme and the intellectual context becomes the subject matter. The all-over natural composition is even-handed and balanced, arranged to create a harmony in the parts of a whole. For me, there is a strong parallel with Colin McCahon’s Mondrian’s Last Chrysanthemum from the Kaipara Flat series painted in 1971. The frenetic brush strokes, which represent some kind of deathly storm warning, fill the entire canvas. This year, Judy Millar will be representing New Zealand at the 53rd International Venice Biennale. JONATHAN ORGAN

Dale Frank employs masses of swirling colours, pouring, pushing and manipulating the painted surface through alchemy and gravity. In his paintings, Frank does not set out to imitate nature; he instead bends forms, deconstructs shapes and juxtaposes primary colours next to highly artificial resins and metallic pigments. His title ‘The Problem in translating the loss of self in Giacometti’s walking under the rain when confronted Arp’s objects arranged according to the law of chance’ is art historically charged and philosophically loaded. The Italian sculptor Alberto Giacometti takes a hallucinatory journey into the biomorphic and Dadaist land of Hans Jean Arp. Psychoanalytical theories
come to the fore and are integral in Frank’s conceptual practice and oeuvre. He articulates signs, signifiers and myths creating avant-garde works tapping into the Freudian and Jungian unconsciousness. Frank does away with conscious censorship, tapping into the paranormal worlds of psychic automatism, where the artist paints automatically. This allows the paint to move in a random fashion, applying chance and accident to creating the image and having no rational control. Just as Giacometti’s bronze surfaces are scarred and pitted, so too is Frank’s palette. He creates these surfaces through the employment of commercially based enamelled paint that has been mixed with acrylic paint and at times heat treated. The result is a glossy, congealed, textured surface. Sinewy rivers of colour appear in the biomorphic shapes, reminiscent of Arshile Gorky. Frank creates a postmodern interpretation of the imagery found in European abstraction. Irregular forms float on colour fields of an immaterial universe. This work is of monumental proportions and is about the act of painting itself. JONATHAN ORGAN

Creatively and provocatively displayed, Cleon Peterson’s paintings let you discover a war, not The War (if there is such a thing) but a war nonetheless: a dramatically stylised, primitive and future-proofed struggle between power and submission. The violent, human, collective and alienating experience of a shuddering contemporary society is offered. However, there is no video-game enthusiasm here, instead all are victims possessed with a shared rage. The immediacy of each character’s impending anonymous death or act of brutality is set within a blood-soaked folk tale where children’s bedside stories have become the final stand between an infected cast of listeners, fashion gangs and sameness. Ultimate authority appears to be missing, suggesting that there may be no politic for the viewer to give meaning to the violence of which they are now a part, merely the discovery of war. Peterson exhibits extensively through the Northern hemisphere and was most recently invited to co-collaborate with Shepard Fairley on the 2009 Fifth Avenue project, New York. NEIL CAMPBELL

A guide for buyers Webb’s have set out the following information for the benefit of first time buyers and those who are unfamiliar with auction procedures. Important note: Please refer to full conditions of sale for buyers printed in the reverse of this catalogue and displayed in the saleroom. Registration: All intending buyers must complete a bidding form available from the reception desk Buying at Auction 1. Floor Bidders Ensure that you have registered and obtained a buyer number before bidding on the lot or lots you have chosen Be aware that a buyer’s premium of 12.5%+GST on the premium or 15%+GST is payable by all buyers in addition to the hammer price. Please make sure that you are aware of the amount of the buyer’s premium. Make your bids clear preferably by holding up your buyer number card. If you make a mistake e.g. the auctioneer takes a bid from you at a higher level than you had intended or you realise that you had bid on the wrong lot call out to the auctioneer immediately so that the bidding can be adjusted. Waiting until after the hammer falls is too late. If your bid is the highest and the lot is knocked down to you then you have entered a binding obligation to pay for that lot. 2. Sales Subject to Vendor’s Consent Where your bid is the highest but still below the reserve the Auctioneer may declare you to be the “buyer subject to Vendor’s consent”. This means that your bid is held as binding and will be communicated to the Vendor at the earliest opportunity. If the vendor accepts then there is a contractual obligation for you to pay for the lot. If the vendor does not accept you are released from any obligation however you will have first right to negotiate with the vendor through Webb’s until an agreement is reached and Webb’s will not present other offers to the vendor until your negotiations are ended. 3. Absentee Bids Webb’s will endeavour to ensure that your bidding instructions are executed but accept no responsibility or liability for failure to do so. Lots will be bought as favourably as is allowed by bidding in the sale room and any reserve imposed by the vendor. Please note that Webb’s cannot guarantee that another bidder will not be successful at your limit if in the course of competitive bidding someone else bids your limit first. Absentee bids are accepted by written instruction which can be sent by fax (e-mailed absentee bids are not accepted) up to l hour before the commencement of the sale. Absentee bids will be executed on the following basis: If your bid limit is equal to or above a reserve the Auctioneer may open the bidding at reserve on your behalf and will bid thereafter only in response to competition for the lot.If your bid limit is below a reserve the Auctioneer may open the bidding at your limit and if there are no further bids in the room may sell to you “subject to vendor’s consent”. In the absence of a reserve the Auctioneer may exercise your bid in advance of any opening bid or may open the bidding on your behalf at the Auctioneers estimate at the Auctioneer’s sole discretion.
Telephone Bids The same conditions as above apply to telephone bidders. Webb’s will telephone the number you have given several minutes before the lot you have request comes up for sale. If your phone is engaged or we are unable to make contact the auction will proceed without your bidding.
A guide for buyers
Our staff will ask you to hold when we have made contact. They will then tell you that your lot is about to come up. The bids will be relayed to you and you can enter the bidding at any time by making your call. Please note that the bidding at many auctions can be fast and furious. The auctioneer will not favour a phone bidder over and above buyers who are attending the auction by giving them more time to bid. You will need to establish your limit and make sure that you bid clearly and promptly. Telephone bids are only accepted for catalogued sales and on items with estimates over 500. Pre-Sale Estimates Estimates printed in the catalogue or given verbally are intended as a guide only and can be subject to revision nearer to the time of a sale. Webb’s staff are available during pre-sale viewing times and by appointment to assist prospective bidders with estimates and any aspect of the auction procedure. Condition Reports Webb’s staff will provide condition reports for out of Auckland buyers. However please note that no 6 in the Conditions of Sale for Buyers will still apply despite the obtaining of a condition report. Payment Payment for all items purchased is due on the day of sale immediately following completion of the sale. If full payment cannot be made on the day of sale a deposit of 10% of the total sum due must be made on the day of sale and the balance must be paid within 5 working days. Payment is by cash bank cheque or Eftpos. Cheques will be accepted but must be cleared before delivery of goods will be given. Credit cards are not accepted. Packing and Freight Webb’s do not pack goods in house. However we will arrange for your items to be packed insured and shipped by a professional agent. All costs associated with packing and freight are payable by the purchaser. Valuation Service Webb’s provide free market appraisals on Monday mornings from 9am-1pm or at other times by appointment. Webb’s appraisers will come to your home to view and appraise larger items. Webb’s will provide valuations for insurance matrimonial division family division etc. Please enquire at reception for charges. Valuation charges are refundable on occasion when goods are subsequently offered for sale within a reasonable period.
CONDITIONS of sale for buyers 1. Bidding: The highest bidder shall be the purchaser subject to the auctioneer having the right to refuse the bid of any person. Should any dispute arise as to the bidding the lot in dispute will be immediately put up for sale again at the preceding bid or the auctioneer may declare the purchaser which declaration shall be conclusive. No person shall advance less at a bid than the sum nominated by the auctioneer and no bid may be retracted. 2. Reserves. All lots are sold subject to the right of the seller or his agent to impose a reserve.
c. To resell the lot by public or private sale. Any deficiency resulting from such resale after giving credit to the purchaser for any part payment together with all costs incurred in connection with the lot shall be paid to Webb’s by the purchaser. Any surplus over the proceeds of sale shall belong to the seller and in this condition the expression “proceeds of sale” shall have the same meaning in relation to a sale by private treaty as it has in relation to a sale by auction.
3. Registration. Purchasers shall complete a bidding card before the sale giving their own correct name address and telephone number. It is accepted by bidders that the supply of false information on a bidding card shall be interpreted as deliberate fraud.
d. To store the lot whether at Webb’s own premises or elsewhere at the sole expense of the purchaser and to release the lot only after the purchase price has been paid in full plus the accrued cost of removal storage and all other costs connected to the lot.
4. Buyers’ Premium. The purchaser accepts that in addition to the hammer or selling price Webb’s will apply a buyer’s premium of 15 % of the hammer price (unless otherwise stated) together with GST on such premium, which combined sum shall be the total purchase price.
e. To charge interest on the purchase price at a rate 2% above Webb’s bankers’ then current rate for commercial overdraft facilities to the extent that the price or any part of it remains unpaid for more than seven days from the date of the sale.
5. Payment. Payment for all items purchased is due on the day of sale immediately following completion of the sale.
f. To retain possession of that or any other lot purchased by the purchaser at that or any other auction and to release the same only after payment of money due.
If full payment cannot be made on the day of sale a deposit of 10% of the total sum due must be made on the day of sale and the balance must be paid within 5 working days. Payment is by cash, bank (cashiers) cheque or Eftpos. Personal and private bank cheques will be accepted but must be cleared before delivery of goods will be given. Credit cards are not accepted. 6. Lots sold as Viewed. All lots are sold as viewed and with all errors to description faults and imperfections whether visible or not. Neither Webb’s nor its vendor are responsible for errors of description or for the genuineness or authenticity of any lot or for any fault or defect in it and make no warranty whatever. Buyers proceed upon their own judgement. Buyers shall be deemed to have inspected the lots or to have made enquiries to their complete satisfaction prior to sale and by the act of bidding shall be deemed to be satisfied with the lots in all respects. 7. Webb’s Act as Agents. They have full discretion to conduct all aspects of the sale and to withdraw any lot from the sale without giving any reason. 8. Collection. Purchases are to be taken away at the buyer’s expense immediately after the sale except where a cheque remains uncleared. If this is not done Webb’s will not be responsible if the lot is lost stolen damaged or destroyed. Any items not collected within seven days of the auction may be subject to a storage and insurance fee. A receipted invoice must be produced prior to delivery of any lot. 9. Licences. Buyers who purchase an item which falls within the provisions of the Protected Objects Act 1975 or the Arms Act 1958 cannot take possession of that item until they have shown to Webb’s a license under the appropriate Act. 10. Failure to make Payment. If a purchaser fails either to pay for or take away any lot Webb’s shall without further notice to the purchaser at its absolute discretion and without prejudice to any other rights or remedies it may have be entitled to exercise one or more of the following rights or remedies: a. To issue proceeding against the purchaser for damages for breach of contract.

b. To rescind the sale of that or any other lot sold to the purchaser at the same or any other auction.
g. To apply the proceeds of sale of any lot then or subsequently due to the purchaser towards settlement of money due to Webb’s or it’s vendor. Webb’s shall be entitled to a possessory lien on any property of the purchaser for any purpose while any money remains unpaid under this contract. h. To apply any payment made by the purchaser to Webb’s towards any money owing to Webb’s in respect of any thing whatsoever irrespective of any directive given in respect of or restriction placed upon such payment by the purchaser whether expressed or implied. i. Title and right of disposal of the goods shall not pass to the purchaser until payment has been made in full by cleared funds. Where any lot purchased in held by Webb’s pending i. clearance of funds by the purchaser or ii. completion of payment after receipt of a deposit the lot will be held by Webb’s as bailee for the vendor risk and title passing to the purchaser immediately upon notification of clearance of funds or upon completion of purchase. In the event that a lot is lost stolen damaged or destroyed before title is transferred to the purchaser the purchaser shall be entitled to a refund of all monies paid to Webb’s in respect of that lot but shall not be entitled to any compensation for any consequent losses howsoever arising. 11. Bidders deemed Principals. All bidders shall be held personally and solely liable for all obligations arising from any bid including both telephone”and absentee bids”. Any person wishing to bid as agent for a third party must obtain written authority to do so from Webb’s prior to bidding. 12.”Subject Bids” Where the highest bid is below the reserve and the auctioneer declares a sale to be “subject to vendor’s consent” or words to that effect the highest bid remains binding upon the bidder until the vendor accepts or rejects it. If the bid is accepted there is a contractual obligation upon the bidder to pay for the lot. 13.
