Viewing TIMES Viewing by appointment. BUYER’S PREMIUM Buyers shall pay to Webb’s a buyer’s premium of 15% of the hammer price plus g.s.t on the premium. The sale is subject to the Conditions of Business printed elsewhere in this catalogue. Condition of wine Goods are described as accurately as can be ascertained by Webb’s at the time, however Buyers of older wine must make appropriate allowances for natural variations of ullage and the condition of corks and labels. Webb’s has made every effort to describe any bottle that is not in excellent condition. Each Lot is sold by the Seller with all faults and defects (if any) and with all errors of description and shall be at the Buyer’s risk on the fall of the hammer and neither Webb’s nor the Seller shall be accountable for any deficiency, damage or loss which may arise thereafter. BIDDING All bids and price estimates are per bottle (excepting sets), not per lot. For example if you make a bid of $10 per bottle on a lot containing 12 bottles you are making a total bid of $120. All prices are in New Zealand dollars. Successful bids attract a 15% Buyer’s Premium plus GST (only on the BP). Bidding is per bottle and you must take the entire lot on offer unless the auctioneer states otherwise. All wines are checked prior to consignment. Phone bidding is by prior arrangement with minimum bid of $500 NZD. Payment is Cash, Bank Cheque, EFTPOS or Money Transfer. Online Bidding We now offer an online bidding service which is available from at least one week prior to the sale date and closes midday on the day of the sale.

We accept Visa and MasterCard for all wine purchases in this auction. AMEX is also accepted, however at an increased buyers premium of 16.5% Payment must be cleared prior to collection of wine and is due at the end of the week of the sale, at the latest. This includes all buyers either Absentee Bidders or those present on the night. Please fill out your Absentee Bidding Form carefully to ensure it is correct.

Key RP Ratings Robert M Parker Jr. rating out of 100, i.e., 95/100 is 95 points out of 100. Ullage The term that refers to the gap between the bottom of the cork and the fill level of the wine. All wines listed in this catalogue have Ullage level of “Into Neck” or higher. If the level is lower it is stated in the catalogue. Top shoulder (TS) - A good level in any wine 20 years or older. Upper shoulder (US) - Indicates slight natural reduction through easing of the cork and evaporation through cork and capsule. Mid-shoulder (MS) - Indicates some weakening of the cork and therefore some risk. This is not unusual in wines over 50 years old and estimates will take this into account. Low-mid shoulder (LMS) - Indicates high risk and will attract low estimates.

CONDITIONS OF SALE FOR BUYERS 1. The highest bidder shall be the purchaser, subject to the auctioneer having the right to refuse the bid of any person. Should any dispute arise as to the biddings the lot in dispute will be immediately put up for sale again at the preceding bidding, or the auctioneer may declare the purchaser, which declaration shall be conclusive. 2. No person shall advance less at a bid than the sum nominated by the auctioneer and no bid may be retracted. 3. All lots are sold subject to the right of the seller or his agent to bid or else to impose a reserve. 4. The purchaser shall complete a bidding card before the sale giving name and address. Immediately after the sale the purchaser shall pay 10% of the purchase price in part payment and shall pay the balance within ten days of the date of the sale unless prior credit arrangements have been made. 5. The purchaser shall pay to Peter Webb Galleries Limited. (Webb’s) a premium of 15% of the hammer price together with G.S.T on such premium at the current rate. 6. All lots are sold as shown and with all errors to description, faults and imperfections whether visible or not. Neither Webb’s or its vendor are responsible for errors of description or for the genuineness or authenticity of any lot or for any fault or defect in it and make no warranty whatever. Buyers proceed upon their own judgement. 7. Webb’s act as agents. They have full discretion to conduct all aspects of the sale and to withdraw any lot from the sale without giving any reason. 8. Each lot is at the risk of the purchaser from the fall of the hammer and is to be taken away at the purchaser’s expense immediately after the sale. If this is not done Webb’s will not be responsible if the lot is lost, stolen, damaged or destroyed. 9. No goods are to be removed while selling is in progress. Receipted invoices must be produced prior to delivery of any lot. The auctioneers reserve the right to request identification in the case of any purchaser not known to Webb’s who pays by cheque. 10. No person purchasing any item which falls within the provisions of the Antiquities Act 1975 or the Arms Act 1958 shall be entitled to take possession of the item unless and until such person has produced to Webb’s a license under the appropriate Act. 11. If a purchaser fails either to pay for or take away any lot Webb’s shall without further notice to the purchaser, at its absolute discretion and without prejudice to any other rights or remedies it may have, be entitled to exercise one or more of the following rights or remedies: (a) To issue proceedings against the purchaser for damages for breach of contract (b) To rescind the sale of that or any other lot sold to the purchaser at the same or any other auction. (c) To resell the lot by public or private sale. Any deficiency resulting from such resale, after giving credit to the purchaser for any part payment, together with all costs incurred in connection with the lot shall be paid to Webb’s by the purchaser. Any surplus over the proceeds of sale shall belong to the seller and in this condition the expression “proceeds of sale” shall have the same meaning in relation to a sale by private treaty as it has in relation to a sale by auction. (d) To store the lot whether at Webb’s own premises or elsewhere at the sole expense of the purchaser and to release the lot only after the purchase price has been paid in full plus the accrued cost of removal, storage, insurance and all other costs connected to the lot. (e) To charge interest on the purchase price at a rate two percent above Webb’s bankers’ then current rate for commercial overdraft facilities, to the extent that the price or any part of it remains unpaid for more than seven days from the date of the sale. (f) To retain possession of that or any other lot purchased by the purchaser at that or any other auction and to release the same only after payment of all money due. (g) To apply the proceeds of sale of any lot then or subsequently due to the purchaser towards settlement of money due to Webb’s or its

vendor. Webb’s shall be entitled to a possessory lien on any property of the purchaser for any purpose while any money remains unpaid under this contract. (h) To apply any payment made by the purchaser to Webb’s towards any money owing to Webb’s in respect of any thing whatsoever irrespective of any directive given in respect of, or restriction placed upon, such payment by the purchaser whether expressed or implied. 12. Bidders deemed principals. All bidders shall be held personally and solely liable for all obligations arising from any bid, including both ‘telephone’ and ‘absentee bids’. Any person wishing to bid as agent for a third party must obtain written authority to so do from Webb’s prior to bidding.

INSTRUCTIONS TO BID AT SALES

Absentee bids These are accepted by Webb’s and carried out free of charge. Lots will be bought as favourably as is allowed by the bidding in the saleroom and any reserve imposed. “Buy” (unlimited) bidding directions will not be accepted. Webb’s require confirmation in writing or by fax of bidding directions prior to the sale. Telephone Bids Webb’s will use its best endeavours to take telephone bids from buyers who have made proper arrangements prior to the sale. Because this method cannot be entirely free from the risk of communication cutoff Webb’s cannot be responsible for losses arising from missed bids. Telephone bidding is not available on lots with a low estimate below $500.
