NOW at the Local Theatres

Family Law Myths We often get asked about family law myths, here are two of the more common.

We’re not married but I am a common law spouse

The Maltings Theatre

Les Liaisons Dangereuses 12th - 23rd Oct Two former lovers come together in prerevolutionary France to corrupt the innocent and virtuous for selfish kicks and fresh sexual conquests. Shocking, seductive and hilariously funny. £19, child £15 Vinegar Tom 28th Oct - 6th Nov A renowned “witch-finder” arrives in a village held by a grip of superstition and slander, and it’s not long before almost every woman in the village has the finger of suspicion pointing at them. This bold musical drama was first performed in 1976 and continues to resonate today. By turns beautiful, brutal, funny and moving. £19 Maltings Shopping Centre, St Albans AL1 3HL www.ovo.org.uk

Wheathampstead Dramatic Society

Faith Healer 14th - 16th Oct Hardy, an itinerant Irish faith healer, his wife, and his manager tell stories that don’t quite gel with each other, leaving you to wonder about truth and memory, lies and storytelling. The play was voted as one of the 100 most significant plays of the 20th century in a poll conducted by the Royal National Theatre. Tickets 01582 621357 Memorial Hall, Marford Road, Wheathampstead www.wheathampsteaddramaticsociety.co.uk

Barn Theatre A Bunch of Amateurs 15th - 23rd Oct A comedy with a twist, featuring a fading Hollywood hero who is keen to boost his flagging career. Jefferson Steele arrives in England to play King Lear but instead of Kenneth Branagh, Dame Judi Dench and John Cook, the cast are a bunch of amateurs trying to save their theatre. www.thebarntheatre.co.uk

Abbey Theatre

G&S Gems 22nd & 23rd Oct St Albans Chamber Opera return with a new Gilbert and Sullivan evening. The first half will be presented by regulars Leila Saleh, Katy Bingham-Best, Peter Martin and Des Turner, then the full company will perform a staged production of Trial by Jury – with some modern twists! £12 www.abbeytheatre.org.uk 12

Let’s be clear – there is no such thing! When a couple who were not married or in a civil partnership separate, the Courts’ powers are limited. Separated partners can ask the Courts to deal with ownership and sale of property on principles of Trust and Property Law. They can potentially seek financial support from their expartner for the benefit of their children and can apply for Child Arrangements and other Court Orders under the Children Act 1989. Unfortunately that’s about it though, the Courts are not concerned with fairness, the overall picture or maintenance for the benefit of one or other partner. Here’s the good news however - a proposed Cohabitation Rights Bill started its journey through Parliament in 2020, so it’s possible the draft Bill may become law in the future!

Pre-nuptial agreements - not worth the paper they are written on?!

Another myth! Although English law states that pre-nuptial agreements are not automatically binding, there is supportive case law. If properly prepared, pre-nuptials may be upheld. So what does ‘properly prepared’ mean? It must be freely entered into (each party taking independent legal advice) The couple must understand the implications of the agreement (so full financial disclosure, clarity on future claims either may be relinquishing) It must not be unfair to uphold the parties to their agreement in the circumstances at the time of the divorce. Pre-nuptial agreements are more likely to be upheld in short marriages – they are less likely to become out of date or be superseded by unforeseen events during the marriage. So, if considering a pre-nuptial, seek independent legal advice and make sure the agreement is done properly for your best chance of it being upheld.
