What is surrogacy and are surrogacy agreements enforceable
in the UK?
Surrogacy is when a woman carries and gives birth to a baby for another person or a couple. In the UK surrogacy agreements are not legally binding. Following the birth of a child, if there is a disagreement as to who should care for the child, an application would need to be made to the family court; every case is concerned with what is in the child’s best interests in that particular case.
Who are the child’s parents at birth?
The UK will recognise the surrogate (and potentially her spouse if she has one) as the legal parents upon the child’s birth. If the surrogate does not have a spouse it may be possible for one of the intended parents to be registered as the father or second parent. After birth the intended parent(s) can then apply for a parental order. One of the intended parents must have a biological link to the baby and the surrogate must unconditionally consent to the parental order. This transfers legal parenthood from the surrogate (and her spouse if applicable) to the intended parents.
If the intended parents do not obtain a parental order, they will not have parental responsibility, which is the legal authority to make key decisions about the child (eg medical or educational) and may need to involve the surrogate in future decisions.
How can a solicitor assist?
It is against the law for a solicitor to prepare a surrogacy agreement for payment. Solicitors can however assist intended parents with:
Understanding how the law works from the outset and the process for obtaining a parental order.
Preparing court applications for them to be recognised under UK law as the lawful parents of a child.
Assisting with legal issues potentially arising post birth but prior to transfer of legal parentage from a surrogate to intended parent(s).
