Reasons for Putting Your Affairs in Good Order Ian Lees, Managing Director of Westminster Wills, gives 5 reasons why you should have an up-to-date will in place. For peace of mind and to pass your money down through the generations efficiently and effectively, you will require a written and valid Will. By not making a Will you are deciding to make a State Will. This means the courts will distribute your estate under the laws of intestacy. 1.Rights for unmarried partners -There is no such thing in law as a ‘Common law marriage’. Cohabitees have no automatic rights to the assets of their partners. Without a Will the courts will decide on and distribute all assets. 2. Divorce does not annul a Will - Following a divorce a Will is not revoked after the Decree Nisi. Without a new will the estate may be distributed to an ex-spouse by an existing Will.
12
3. Marriage or Civil Partnership annuls a Will A marriage or civil partnership automatically revokes a Will, unless there is a ‘contemplation of marriage’ built into it. A new Will reflecting the new relationship should be considered. 4. The cost of care - Many people feel aggrieved to be paying for their care in later life, especially when average fees are approx. £37 - £50k pa. One advantage of being a self-funder is that you have more choice in your selection of care home. 5. New measures to prevent ‘predatory marriages’ are being put forward to the House of Commons to protect usually more elderly and frail people. This was highlighted recently in a case of MrsX, a 91 year old with vascular dementia who married a man 24 years younger than her a year before her death. To discuss making or updating a Will please call 01727 867 888 www.westminsterwills.co.uk
