Letter from the President & Chair Welcome to the summer edition of the Windsor-Essex Regional Chamber of Commerce’s Business Briefs! We’ve had a busy few months that brought in a lot of success. In May, the Windsor-Essex Regional Chamber secured province wide Chamber support for key local agricultural and small business issues (Perishable Agricultural Commodities Act and the Travel Rebate Incentive Plan) at the Ontario Chamber of Commerce Annual General Meeting in Cornwall, Ontario. This was a very successful AGM for the agriculture sector, small business and Windsor-Essex Region. We have to grow our agri-food business, tourism and our local economy and these steps will help contribute to the success of our business community. We are also continuing to strongly advocate for an Auto Strategy for Ontario and met with Minister of Economic Development, Employment and Infrastructure Brad Duguid on the issue in April.

Also in May, the Windsor-Essex Regional Chamber held a Distinguished Speaker Luncheon featuring VIA Rail where guest speaker Yves Desjardins-Siciliano, President & CEO, VIA Rail Canada addressed the future of VIA Rail in the region. In June, we held our last After Business networking event until the Fall. This took place at the lovely Canadian Club Brand Centre. It was the 79th year for our Annual Golf Tournament, held this time at Kingsville Golf and Country Club. We had a great day of golf and networking on the greens. Coming up for the Chamber, we have our All Candidates Debates in September for the Federal Election as well as lots of After Business networking events and luncheons on the horizons. Windsor-Essex Regional Chamber Secures Province Wide Chamber Support for Key Local Agricultural and Small Business Issues: PACA and TRIP at the Ontario Chamber AGM
Windsor-Essex Regional Chamber and Province Wide Coalition Urge Government to Expand Definition of Ontario Pension Plan Comparability to Protect Jobs
The Windsor-Essex Regional Chamber of Commerce secured province wide support for two key local issues to help create and maintain a competitive business environment for agriculture and small business in the region.
The Windsor-Essex Regional Chamber of Commerce in partnership with the Ontario Chamber of Commerce (OCC), and a coalition of major Ontario employers are calling on the provincial government to broaden its definition of a comparable pension plan under the Ontario Retirement Pension Plan (ORPP), to be implemented in 2017.
1. Perishable Agricultural Commodities Act (PACA). The Windsor-Essex Regional Chamber held an information session in February regarding the U.S. government’s decision in October 2014 to remove a long standing trading privilege in place for 75 years for fruit and vegetable growers under PACA. Effective as of now, Canadian companies will have to pay twice the amount they are owed to get access to unpaid funds. For example, if a local grower was owed $50,000 for tomatoes they would have to post a $100,000 bond in order to make a claim to get their unpaid money. Many small businesses cannot post that kind of money. If they were under PACA they would not have to pay the double bond. Previously, it was only $100 to start the process under PACA. The Ontario chambers agreed with the Windsor-Essex Regional Chamber that Canada should implement a similar system to the U.S. so that Canadian companies are covered under PACA. Agriculture is the number one or number two industry in Ontario and the number one industry in the County of Essex. 2. Travel Rebate Incentive Plan (TRIP). This is a proposed tax rebate plan that would encourage U.S. residents to visit Canada by offering a 5% rebate (equal to the GST) on purchases made during their trip. It is for travelers passing through land borders. Tourism spending by Americans is down by nearly 33% over the past 10 years or so and this is an opportunity to get that business back. “This was a very successful AGM for the agriculture sector, small business and for the Windsor-Essex Region,” said Windsor-Essex Regional Chamber President and CEO, Matt Marchand. “We have to grow our agri-food business, tourism and our local economy and these steps will help contribute to the success of our business community.” For more information, visit www.windsoressexchamber.org.
In a letter addressed to Premier Kathleen Wynne, a coalition of over 150 businesses, sector associations, chambers of commerce, and boards of trade are today urging the government to expand its definition of pension plan comparability to include capital accumulation plans, including (but not limited to) Defined Contribution plans. This move would ensure that companies in Windsor-Essex that have an existing pension plan for their employees would not be forced to incur this new cost of doing business. “We need to be mindful of the overall cost structure of doing business in Ontario,” said Matt Marchand, President & CEO of the WindsorEssex Regional Chamber of Commerce. “The Chamber Network and major employers in the province have come together to advocate for a solution that will protect vulnerable Ontarians while ensuring that we sustain a business climate that fosters growth and job creation,” Marchand added. With the provincial government set to clarify details of the ORPP in the coming weeks, Ontario’s business community has moved swiftly to provide recommendations that will balance the government’s policy objectives with the concerns of employers. The Ontario employer community supports the government’s policy objective -- to tackle the undersaving challenge and help all Ontario workers save for retirement. “This letter presents an opportunity for government to better understand the concerns of Ontario’s business community,” said Allan O’Dette, President and CEO of the Ontario Chamber of Commerce. “It is important to recognize the contributions that many employers have already made, and continue to make, to their employees’ retirement savings.” The Windsor-Essex Regional Chamber and its network partners will continue to work with the provincial government in the design of the ORPP and in managing its impact on the economy. The Community Donations Fund, dedicated to assisting community organizations in delivering programs and projects, has invested over $100,000 back into Windsor and Essex County over the past five years. In May 2015, through WFCU’s Harold Hewitt Scholarship (HHS) program, the credit union presented 16 local youth with a total of $5,000 in post-secondary school scholarships. Recipients were selected from over 330 submissions. Over the past 13 years, WFCU has presented 192 youth in the community with postsecondary school scholarships through the HHS program. New Law Makes Employers Responsible for Temp and Unpaid Worker Safety Ontario’s recently-proclaimed Bill 18, Stronger Workplaces for a Stronger Economy Act, expands your health and safety responsibilities. Some are already in effect. Here’s what you need to know. The act provides greater protection for temporary and unpaid workers. For instance: •
Here’s a sample list of ways to protect these workers and implement the changes: 1. Inform yourself about the contents of Stronger Workplaces for a Stronger Economy Act. 2. Review your health and safety management system for opportunities to improve protection for temporary and unpaid workers. For example:
If you hire unpaid workers, such as interns and co-op students, you are now just as responsible for their health and safety as you are for your paid workers. The Stronger Workplaces for a Stronger Economy Act amends the Occupational Health and Safety Act (OHSA) to include temporary and unpaid workers under its definition of workers.
• If you hire temporary workers, an amendment to the Workplace Safety and Insurance Act (WSIA) means you and not the workers’ temp agency could become responsible for any workplace injury costs the workers incur - for the purposes of experience and merit rating programs under section 83 of the WSIA. Implementing this change would involve proclaiming into force related provisions of the act, and establishing a regulation. Some employers may falsely assume unpaid and temporary workers already have all the skills and experience needed to perform the tasks they were hired for. Consequently, these workers may not receive the necessary training and supervision they need to meet the workplace’s health and safety performance standards. For these and other reasons, new workers are three times more likely to be injured on the job during the first month of employment than at any other time. They can also put other workers at risk.
How the OHSA amendment affects employers Essentially, employers are now expected to protect these workers as they would their permanent workers. For workplaces with a comprehensive and fully compliant health and safety system in place, the implications may be minimal. For workplaces still building their health and safety system, the changes present an opportunity to enhance the health and safety of all their workers. The outcome for all workplaces: a safer, more productive organization.
• Know your duties as an employer under the Occupational Health and Safety Act.
• Ensure all employees understand their roles and responsibilities under the act.
• Provide the same orientation training to unpaid and temporary workers as you would to any new worker.
• Assess the job and hazard-specific training needs of unpaid and temporary workers, fill any identified training gaps, and integrate these workers into ongoing training and educational activities. • Encourage them to ask questions and express concerns.
• Encourage their supervisors to observe and coach whenever an opportunity arises.
• Create a buddy system that pairs them with seasoned employees.
3. Make your whole organization aware of the changes and their impact.

Healthy Creations Inc., located at 333 Dougall Square (Dougall and Cabana) is a specialty bakery focused on gluten-free and totally delicious baked goods. Healthy Creations also provides their customers with egg free, milk free, soy free and nut free options. Their recipes are the result of over 20 years of experience. Healthy Creations’ products are all hand made from scratch. In addition to all their bread products they also offer special order cakes for any occasion and a variety of cupcakes, too. Healthy Creations began in 1998 as a “made-to-order” business and moved to a commercial building in 2009. They now have two locations. Their second store is in London at 502 Springbank Dr., Unit 2. The company participates in many local functions and donates gift cards and baskets to local charities. Recently, Healthy Creations had a booth set up at The Lung Association’s BikeTrek at the Ciociaro Club.
