Even though we’re winding down the chamber year, we’re still going full steam ahead with our events. our After Business at the Bloomin’ gardener takes place thursday may 8 and promises to be a great evening of networking on one of Essex county’s state-of-the-art greenhouse production and outdoor nursery facilities. Also coming up is the First-Ever windsor-Essex regional chamber of commerce Policy & solutions Forum, presented by the university of windsor on thursday, may 15. this half-day Policy Forum will feature four in-depth policy solution sessions with industry leading guest speakers and a keynote address from Frank ingratta, former deputy minister of Agriculture, and marks the coming together of the business, labour, and academia communities.

Eric hoskins, the Annual Economic outlook luncheon with craig Alexander (senior vice President and chief Economist for td Bank group), as well as successful After Business networking events in February and April. the chamber has continued in its advocacy for business in the windsor-Essex region. we were a key player in the behind-thescenes deal that brought highbury canco to the leamington heinz plant and wrote a letter to tim hudak voicing concerns over his comments about chrysler. we also released our regional Agri-Food Paper (AFP), our fourth comprehensive research paper since February 2013 focused on windsor-Essex business priorities. other released papers are the regional transportation Paper (rtP), the regional Energy Paper (rEP) and the municipal Finance and tax Paper (FtP). this is available on our website at www.windsorchamber.org. we’re looking forward to advocating further for our members in the coming months and hope to see you at our outstanding events soon!

windsor-EssEx chAmBEr rElEAsEs rEgionAl Agri-Food PAPEr The Windsor-Essex Regional Chamber of Commerce released its Regional Agri-Food Paper (AFP), its fourth comprehensive research paper since February 2013 focused on Windsor-Essex business priorities. Other released papers are the Regional Transportation Paper (RTP), the Regional Energy Paper (REP) and the Municipal Finance and Tax Paper (FTP). Key recommendations: •

In order to be globally competitive and meet the Premier’s challenge of doubling Agri-food exports by the year 2020, the Ontario greenhouse industry has to operate year-round rather than the current 9-10 months. This can be accomplished in part by improving the energy infrastructure and access to its electricity grid for the Agri-food sector and ensuring a reliable, modern and efficient supply of energy at competitive rates. The Chamber appreciates the recently announced improvements to the region’s power infrastructure. The governments of Ontario and Canada can improve the overall regulatory environment by properly costing out new proposed regulations in consultation with stakeholders relevant to the Agrifood industry. The Chamber recommends continuous review of the regulatory environment and simplifying regulations. The Chamber welcomes government initiatives, such as the recent Ontario Open for Business initiative, that continue to reduce the regulatory burden and red tape for business.

The growth and competitiveness of the Agri-food industry in our region in large part depends on the long term stability of its workforce. The industry would benefit from investment in new post-secondary programs and training opportunities directly related to the needs of the Agri-food businesses in our region. The Agri-food industry also needs improved access to foreign workers and internationally trained professionals.

The Chamber is calling for the Canadian Food Inspection Agency (CFIA) to provide more comprehensive information and support regarding the evolving regulatory framework. Stakeholder information sessions are one way to help address business concerns. The Chamber is prepared to facilitate potential CFIA stakeholder meetings.

Windsor-Essex wine producers need a more economically viable access to the Ontario Marketplace. Any modernization of the wine system in Ontario, including the LCBO and the VQA, should among other things lift restrictions in the areas of distribution, warehousing and be more adept in providing representation by all wine producers in the Province.

cAnAdA’s Anti-sPAm lEgislAtion (cAsl) Canada’s Anti-Spam Legislation (CASL) establishes rules for the sending of commercial electronic messages (CEMs) and the installation of computer programs. CASL also prohibits the unauthorized alteration of transmission data. The rules that apply to CEMs come into force on July 1, 2014 while the rules governing computer programs take effect Jan. 15, 2015, followed by the private right of action on July 1, 2017. What You Need to Know About Sending Commercial Electronic Messages •

CASL applies to everyone—individuals, incorporated and unincorporated businesses, not-for-profit organizations, etc.— who sends electronic messages for commercial purposes.

Under CASL, electronic messages can include emails, SMS text messages, instant messages and messages sent through social networks.

CASL defines a CEM as a message that encourages participation in a commercial activity. This includes advertisements and information about promotions, offers, business opportunities, events, etc.

Under CASL, consent is required before sending a CEM. Yet, an electronic message that is sent to obtain consent to send a message for commercial purposes is also considered a CEM.

Consent can either be express or implied. •

Express consent means someone actively gave you permission to send him/her a CEM.

Implied consent means it would be reasonable to conclude you have someone’s permission to send him/her a CEM based on prior relationships. Implied consent could also apply to someone who has conspicuously published his/her email address, say on a website.

To obtain express consent, you must: •

Clearly describe the purposes for requesting consent;

Provide the name of the person seeking consent and identify on whose behalf consent is sought, if different;

Provide contact information (mailing address and either a phone number or an email address) of those parties seeking consent; and,

Indicate the recipient can unsubscribe.

Under CASL, you must be able to prove you have consent. You must include the following in every CEM: •

The name of the person sending the message, and identify on whose behalf the message is sent, if different;

Contact information (mailing addressing and either a phone number or an email address) of the senders; and,

A mechanism that allows the recipient to easily unsubscribe at no cost.

Patio Palace, located at 2859-61 Howard Ave. in Windsor, is a familyowned group of specialty stores offering patio furniture, grills, and gas and electric fireplaces. Celebrating 32 years in business, Patio Palace opened in March 1982 and expanded into London, Ontario in 1985. The business began while co-founders Paul Fanson and Steve Gilboe were in their second year at the University of Windsor. FivE simPlE APProAchEs to PrEvEnting msds MSD (Musculoskeletal disorders)-related injuries affect the muscles, tendons, ligaments and nerves, and develop when the same muscles are used repeatedly or for a long time, the force exerted is high, or the job requires an awkward posture. Workers typically complain of back and shoulder pain, muscle strain, tendonitis, carpal tunnel, and tennis elbow: injuries that account for 40% of all lost-time claims in Ontario workplaces. Protect your workers from hazards that could lead to sprains and strains by: •

Recognizing and documenting MSD hazards (force, posture, repetition and duration)

Focusing on workstation design, equipment, tools, manual material handling, environmental factors, and how work is organized

Finding creative, practical ways to eliminate or reduce the risks

Four approaches to consider: •

Watch your language: Technical language can alienate employees and make it difficult for them to act on what you tell them. Choose clear, understandable, employee-centred language. Call the problem “sprains and strains” instead of MSDs. Make ergonomics personal by talking about it in terms of “reducing fatigue and soreness”—a concept every worker relates to.

Make the elimination of sprains and strains everyone’s project: When employees feel they have some control over change, they’re more likely to invest in it. Shift from “telling” to “facilitating” by involving workers, supervisors and other key people in the problem-solving and decision-making process. Staff often hold the answers to workstation dilemmas, so encourage them to share their ideas, accommodate their feedback whenever possible, and show how their input influenced the solution.

Coach and encourage: Muscles, like people, need retraining. Implement mini-coaching sessions: point out the risk, demonstrate a safer way, ask the worker to try it: continually coach, correct, reinforce, and encourage. Train supervisors first so they can serve as role models as they pass along the learning to their staff.

Communicate to sustain success: Make a habit of communicating with staff before and after shifts to share ideas for improvement. Build a workplace culture around listening carefully to ideas and motivating staff by recognizing them both for their intent to find solutions and for actual improvements. Share overall workplace results to show progress and successes.

AsK hr My workplace is becoming nasty. How can I get people to be civil with one another? Getting along with people at work is not always easy. Workplace relationships can be difficult but getting along with others is imperative for the success of every business. When relationships become dysfunctional, productivity and morale suffer. Think about the normal workday; employees spend more time during a work day with colleagues than they do with family or friends. Who wants to spend eight hours or more in a day with miserable people? When an employee is behaving in a negative manner, it can become infectious in the workplace. Others will sense the tension and rumours can begin to circulate. Before you know it, the workplace atmosphere can become quite strained. How do you prevent an escalation of negativity in the workplace? It is important that all employees know what behaviour is expected of them. Establishing expectations that require employees to communicate and relate to others in the workplace in a positive, open, honest and respectful manner is a great place to start. Such a requirement should be in every employee’s job description. When employees do not behave appropriately, their supervisor should intervene immediately to review behavioural expectations. Employee relationships can also be strained by the means of communication; and while today’s technology can speed up the transmission of information and communication, it can cause relationship and communication problems. It is quicker to send an email or text message than it is to pick up the phone and discuss a matter with an employee. However, the brevity of messages sent by these means can often lead to misunderstandings. I have heard managers tell me about the “emotion” of the message sent. For example, “his message was so rude…” Email and text messages can imply but do not necessarily confirm the intent of the sender.

What to do? There was a time when telephone discussions were more predominant as a means of communication than they are in many workplaces today. Even a face-to-face meeting with an unhappy employee is not as common in many companies as it was in past years. We need to give careful consideration to how we communicate, what we communicate and what the best means of communication is. For issues of relationship problems between employees, face-to-face meetings are preferred and if this is not possible, then a telephone discussion would be the next best means of communication. Trying to resolve differences electronically is not effective. So, let your employees know what is expected of them and be conscientious regarding the means of communication; ensure it is appropriate for the situation. And remember—as a supervisor or manager, your employees need those face-to-face meetings when there are issues to resolve!
