It is no secret that expert witnesses have an acknowledged and consistent problem with recovering their invoices from instructing parties, a problem that has not improved in decades. In many cases, there is simply no reasonable excuse for non-payment and is simply an act of contempt or carelessness on the part of the debtor. Covid-19 has only exacerbated the issue. Something as simple as obtaining your debtor’s specific entity from the outset can make all the difference and with that in mind, here are some tips and suggestions on how to improve your own credit control: - Obtain your debtor’s specific entity (Smiths Ltd, Mr John Smith t/a Smiths Solicitors etc.) - Credit check new clients and regularly review. - Ensure your Terms & Conditions are made available prior to any agreement and perhaps even request they be signed by your client. - Ensure that your expectations for payment are clearly laid out in your terms and conditions. - Have a pre-determined (but flexible) process in place that is ready to action in the event of a late payment. - Do not delay! Regular and timely credit control efforts will be more successful than a ‘’do it as and when’’ approach. - Incentivise prompt payments with discounts or late payment charges/interest for overdue accounts.
