TERMS AND CONDITIONS of AUCTION The following, as amended by any posted notices, specific bills of sale or similar instruments relating to a transaction or oral announcements during the sale, constitutes the entire terms and conditions on which property listed in the catalogue shall be offered for sale or sold by Murad Auctions, the auctioneer conducting the sale on behalf of any consignor for whom we act as agent. DDFAA (as subsequently defined) is not an auctioneer and is not conducting the auction or arranging any resulting transaction. In these Conditions of Sale, “We” and “Our” refer to Murad Auctions. 1. As used herein the term “bid price” means the price at which a lot is sold to the purchaser and the term “purchase price” means The aggregate of (a) the bid price, (b) A PREMIUM PAYABLE BY THE PURCHASER OF 17.5% of the hammer price (or 20.5% Buyer’s Premium for anything purchased online) and (c) unless the purchaser is exempt by law from the payment thereof, any Texas or local sales tax (or compensating use tax of another state) and applicable taxes. Murad Auctions has been authorized by the consignor to retain, as part of our remuneration, the premium payable by the purchaser. 2. On the fall of the auctioneer’s hammer, the highest bidder shall be deemed to have purchased the offered lot, and title to the lot shall pass to the purchaser, in accordance with all of the conditions set forth herein and thereupon the purchaser (a) assumes full risk and responsibility therefore (b) if requested will sign a confirmation of purchase, and (c) will pay the purchase price in full in cash for all lots purchased. To prevent misdelivery and inconvenience in settlement of a purchase, no lot may be transferred. All property shall be removed from our premises at the purchaser’s expense immediately following the sale. If not so removed we may, as an accommodation to the purchaser, transfer the property to a public warehouse or other premises under our control or the control of DDFAA at the purchaser’s sole risk and expense. Each sale made pursuant to these Conditions of Sale will be deemed to constitute a grant of security interest by the purchaser to us in, and we may retain as collateral security for the purchaser’s obligations to us or our assignee, any of the purchaser’s property in our possession, and we may apply against such obligations all monies held or received by us for the account of, or owing to, the purchaser. Each purchaser consents to the filing of public notices or our lien. Whenever the purchaser pays only a part of the total purchase price for one or more lots purchased, we may apply such payments, in our sole discretion, to the lot or lots we choose. Payment will not be deemed made in full until we have collected all amounts due in cash or good funds represented by cleared checks or cashier checks. If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to other remedies available to us and the consignor by law, including but without limitation, the right to hold the purchaser liable for the purchase price, we at our option may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or b) resell the property with a three day notice to the original defaulting purchaser, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs and expenses of both sales, our commission at our standard rates, all other charges due hereunder, attorney’s fees and incidental damages; or (c) take any measures it deems necessary. If Murad Auctions must resell the property, the original defaulting purchaser will be held responsible for any deficiencies in the purchase price, including any and all associated expenses including reasonable attorney’s fees, warehousing, commissions or any other costs associated with the default. No actions by us or any third party before or after the auction shall be deemed a waiver of any of the foregoing. 3. We reserve the right to withdraw any property at any time before the actual sale. Unless otherwise announced by the auctioneer at the time of sale, all bids are per lot as numbered in the catalogue and no lot shall be divided for sale. 4. The auction will be conducted by Louis Murad TXS 13362. We reserve the right to reject any bid

from any bidder. The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of any dispute between bidders, or in the event the auctioneer doubts the validity of any bid, the auctioneer shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, our sales records shall be conclusive in all respects. 5. If we are prevented by fire, theft or any reason whatsoever from delivering any property to the purchaser, our liability shall be limited to the sum actually paid therefore by the purchaser and shall in no event include any incidental or consequential damages. 6. Some lots are offered subject to a “reserve,” which is an undisclosed minimum price below which the lot will not be sold. If a lot is offered subject to a reserve, the auctioneer may implement such reserve by bidding on behalf of the consignor, whether by opening bidding or continuing bidding in response to other bidders until reaching the reserve. 7. Unless prior arrangements have been made with Murad Auctions, there may be a seven day waiting period if purchasing artwork with a personal or company check. These lithographs were based on a painting Hogue created in 1940: Spindletop Runs Wild. In Alexandre Hogue, An American Visionary, by: Susie Kalil ©2011; on page 91 Kalil notes: “Life magazine commissioned [Hogue] to execute a painting based on the 1901 Spindletop oil boom. Hogue spent months of intensive research on the subject, even meeting eyewitnesses of the event in Beaumont… ‘The last person interviewed at Beaumont was an aged lawyer, Judge P.A. Dowlen, whose story through the years had grown better and better until it took on the gloss of a folk tale.’ ” *This historical depiction of the first ever, major oil strike in the state of Texas is a rare pairing of these lithographs as Hogue usually titled the piece in graphite:

“Spindletop.” Hogue notes on the back of “Swindeltop” “This is one of only two ‘Swindeltop’ in existence.” The Dallas Museum of Art has number 19/50 from the edition of Spindletop in it’s permanent collection. 87 DICKSON REEDER (Am. 1912-1970) Three Kings oil on canvas 26 x 22 unsigned $3,000 - $6,000 Fort Worth native, Dickson Reeder studied at the Art Students League in New York in 1930. He then traveled to Taxco, Guerrero, Mexico where he studied with Wayman Adams. In the mid 1930s he studied in Ireland, London and Paris. He studied print making at Atelier 17 in Paris which was frequented by Pablo Picasso, Marc Chagall, Max Ernst and Joan Miro. He was widely exhibited in Texas and the East coast, including the Metropolitan Museum of Art, in the 1940s. In 1945 he established the Reeder School of Theater and Design for children. He closed the school in â&#x20AC;&#x2122;58 and returned to the Atelier 17 to produce a great number of new and innovative prints and paintings, which he exhibited in Germany and France. He then returned to Fort Worth, TX in 1960 and exhibited across the state and Southwest. The artist was prolific and worked in many mediums. Works can now be found at Dallas Museum of Art, Modern Art Museum, Ft. Worth, Brooklyn Museum and the Art Institute of Chicago. 87

She attended TCU and studied at the Ft. Worth

School of Fine Arts under Blanche McVeigh and Evaline Sellors in 1942. She served in WWII in the WAVES service. After the war she attended the Art Students League of New York and then further trained at the Colorado Springs Fine Arts Center and finally the Art Institute of Chicago. She later returned to Fort Worth until her death. She was widely exhibited across the state in museum shows and juried art exhibitions including: Annual Texas Artist Exhibition, Ft. Worth, Texas General Exhibition, Texas Painting and Sculpture Exhibition, Prints of the Fort Worth Circle and PanhandlePlains Historical Museum.

This is an excellent example of Schuman’s work. German native, Schumann moved to Galveston, TX in 1882 where he continued to paint primarily coastal scenes and scenes of fishing and marine life. His approach to oil on board, applying the paint with a palate knife, was indicative of the Impressionist movement, but the use of the palate knife was avant-guard and cutting edge for his time. This was likely influenced by his time spent in New York and on the East coast in the 1910s. J.W. Young wrote: “If Paul Schumann had been painting along the New England Coast instead of the Gulf of Mexico, his marines would have been known all over the world. His boats-coming to the Gulf ports from the seven seas are not boats sailing the seas of make believe. Gulf skies and Gulf storms he studied since boyhood, he loves them, paints them. He is doing for the Texas Gulf shores what Winslow Homer did for the Coast of Main.”

Enchanted Mesa, also known as Katsimo, was reportedly the home of the Acoma people. The Native American legend is the top of the mesa served as the home to the Acoma and each spring they would descend the mesa cultivate their crops. This is a disputed legend by many, as the ladder like pathway that to the top of mesa was destroyed and washed away by a storm c. 1890. The mesa has been scaled and summited at least 3 times since 1892 and it is reported there are no recognizable ruins found at the top. Nearby Acoma, NM also known as the City of the Sky, which is high, but does not reach the height of Enchanted Mesa which rises 7,000 feet above sea level, was in fact inhabited by the Acoma people. Each year on September 2nd, the day of St. Steven, patron saint of Acoma, the people would process over seven miles to the base of the mesa. This painting is believed to depict this procession.

Julius Woeltz, a San Antonio native was a painter, mural artist and art professor in the Art Department at the University of Texas, Austin. He studied at the Chicago Art Institute and studied independently in France and Mexico. His teaching and painting career also included the Art Colony, Alpine, Texas, 1933-1937; Head of Department of Art, Sul Ross State Teachers College, 1933-1937; and the New Orleans Art School, 1937-1940. This mural was commissioned by the poet Hugh Reveley to portray scenes inspired by his poem written in 1931 titled San Antonio. The mural depicts 6 panels capturing the different cultures and activities happening in San Antonio during the 1930s. San Antonio during that time was a cultural hub in Texas. “City of Haymarket Plaza… City of missions next to airports… City of a crooked river….City of parks… Okay, Mecca of the Southwest, put on the dog!...” (excerpt from poem by: Hugh Reveley) Woeltz exhibited at the following: International Watercolor Show, 1932-1941 in Chicago, IL; 1st prize at the Arts and Crafts Club, New Orleans, LA 1935. He was commissioned to execute murals for: Elgin Post Office; Section Fine Arts, Washington, D.C.; 6 murals in the Amarillo Post Office; Austin Club; Commodore Perry Hotel, Austin, TX 1949; and American Painting Today, Metropolitan Museum of Art, New York, NY, 1951. His art can be found in the following permanent collections: Dallas Museum of Art, Texas Fine Art Association and the Beaumont Art Museum.

She arrived in Taos in 1925 after which time she painted delicate landscape paintings. Ben Culwell was a San Antonio native and lived in Dallas most of his life. He studied at Southern Methodist University and Columbia University. Martha Simkins was a noteworthy painter in Dallas, in the early 1900s. Her painting career spanned over 80 years. The works in this auction, including this lot, were exhibited in the Martha Simkins Rediscovered Exhibition, 2002-2003, a traveling retrospective that featured over fifty of her portraits, landscapes and cityscapes, curated by Robert A. Horn of New York, in association with Martha Simkins, Inc.

Florida native, Simkins studied at the Art Students League, New York circa 1893 where she studied with American Impressionist William Merritt Chase and Kenyon Cox. She returned to teach at North Texas Normal School in Denton for a stint, and then returned to New York to study with Chase. She then traveled to Europe and studied with Cecilia Beauz, John Singer Sargent and Mary Cassatt. The then returned to Dallas in 1915, and painted in Woodstock, NY in the summers until 1924. Simkins has had her work exhibited in the following: Corcoran Gallery of Art, the National Academy of Design, the Charleston Museum, Charleston, SC; and several New York galleries.

Acapulco, 1958 casein on paper 11 x 15 ½ signed lower right: LaBauve $600 - $1,200 Louise LaBauve earned her BFA in 1960 and MFA art degrees from UT Austin in 1971. William Lester, and other members of the Dallas Nine were mentors, as well as David Adickes. In 1958 she took art courses at Mexico City College and made her way to Acapulco, which inspired her to create this piece. Her influence by Adickes is evident in this painting.
