Dr. Trisha Fasse-Neerhof Elected to WVMA District 3 Position
Dr. Trisha Fasse-Neerhof graduated from the University of Wisconsin School of Veterinary Medicine in 2005. Currently, she is practicing mixed animal medicine at Healthy Paws Veterinary Clinic in Sheboygan Falls, which she started in 2012. She has been a member of the WVMA since graduating from veterinary school. “In my 10 years of practicing veterinary medicine, I have faced many challenges, challenges I know other veterinarians have or will also face,” she says. “My goal is to address the many obstacles veterinary medicine, as a whole, faces every day. I want to be part of a positive change for the betterment of this remarkable industry.” She believes there are many important issues facing veterinary medicine. “The ever increasing economic stress that is placed on our veterinarians and practice owners is staggering. And with no end in sight, it is important that we continue to develop new ways to enable our fellow veterinarians to provide their clients with high quality Dr. Trisha Fasse-Neerhof veterinary care, and continue to attract the best and brightest to our field,” she says. She believes her experiences and skills as a practice owner will help her be a valuable addition to the executive board. “As a new practice owner I have a fresh perspective on the veterinary industry and the challenges facing the future,” says Dr. Fasse-Neerhof. Outside of veterinary medicine, Dr. Fasse-Neerhof enjoys spending time with her daughter and husband, taking care of their horse farm and equestrian activities. n

A Changing Season Dr. Jane Clark
As organizations grow and time passes, it is inevitable that things have to change to keep up. I wanted to take this opportunity in my column this month to inform our membership of the changes the WVMA executive board made February 7th to the WVMA committee make-up and structure to align them with our new strategic plan created in May 2014. The older SOP governing document consisted of 13 WVMA committees formed to conduct the business and interests of the WVMA. However, many new committees/task forces had been formed in recent years to meet the needs of an ever-changing profession. The WVMA committee list soon grew to 24 committees, a number that is too great to be effectively managed by the number of staff that we employ. To remedy this problem, the executive board took a new look at the existing committee structure and either kept the committee as is, eliminated the committee, combined committees, or created new committees to better fit with what we are trying to accomplish in our new strategic plan. To summarize the executive board changes:
1) The “Awards and Recognition” committee was eliminated and their work moved to the “Membership & Member Services” committee. 2) The “Membership & Member Services” committee was renamed “Member Services” and changed to include one WVMA member from each district, plus student and ex-officio members. 3) The “Veterinary Technician” committee was eliminated per the strategic plan. 4) The “Dairy Welfare” committee was eliminated, moving dairy welfare issues to the new “Animal Welfare” committee.
5) The “Animal Welfare” committee was expanded to include WVMA member representation for all species (dairy, small animal, equine, beef, small ruminants, swine and poultry) in one group. 6) The “Residue Task Force”, which created the WVMA copyrighted program “Food ArmorTM”, has been changed to a standing committee named “Food Armor™” to administer the Food Armor™ program. 7) The “Shelter Task Force” has been disbanded since its work has been completed. 8) The “Dane County Emergency Planning Task Force” has been disbanded since its work in developing an emergency contact book has been completed. 9) A “Business Management Task Force” was created to build advanced business management educational opportunities for members and will be housed under the “Professional Education Committee”. 10) A “Dues & Incentives” Task Force was created to assess membership categories and dues structures to see if any changes need to be made. To end my column this month I would like to thank posthumously Dr. Tom Howard for all the contributions he made to the veterinary profession globally and to the WVMA in particular. I met him when I first joined the WVMA executive board and have nothing but high praise for the manner in which he managed our finances as WVMA treasurer. Hard to believe he passed away suddenly one week after our last executive board meeting. We will miss you. RIP Tom Howard. n

Issues Related to Compounded Drugs Used in Veterinary Practice Kim Brown Pokorny
Recently, numerous WVMA members have asked for more information regarding state and federal laws that apply to the storage, use and dispensing of compounded drugs in the practice of veterinary medicine. Our legislative counsel, Jordan Lamb, pulled the following information together for our members. Drug compounding for animal patients is regulated by both the federal government (Food and Drug Administration/FDA) and state government (Wisconsin statutes and the Wisconsin Pharmacy Examining Board). At the federal level, the FDA regulates compounding for animal patients as a subpart of its Extralabel Drug Use (ELDU) Rules. The FDA says it generally defers “day-to-day regulation” of compounding by veterinarians and pharmacists to state authorities. OVERVIEW OF STATE LAW
Under Wisconsin law, compounding is defined and regulated under Wis. Stat. Chap. 450. A. Under Wisconsin law, what constitutes a compounded drug?
Under Wis. Stat. § 450.01 (3), “compound” means to “mix, combine or put together various ingredients or drugs for the purpose of dispensing.
B. Under Wisconsin law, who can prepare or dispense a compounded drug?
“Practitioners” can “prepare, compound, dispense or prepare for delivery for a patient any prescription drug.” Wis. Stat. § 450.11 (3). A “veterinarian” is a “practitioner,” because practitioner is defined to include any person who is licensed to administer or prescribe drugs. Wis. Stat. § 450.01(17). Accordingly, licensed veterinarians, as practitioners licensed to prescribe or administer drugs, can “compound” or “dispense” any prescription drug. What to do When You Receive a Visit from an Investigator Part 2 of a 2-Part Article Stephen A. DiTullio, DeWitt Ross & Stevens s.c.
In the first part of this two-part series, I addressed issues concerning OSHA inspections. This article will focus on what occurs after the OSHA inspection has been completed. OSHA inspectors are required to conduct a closing conference which may take place immediately after a very simple inspection or may follow a major inspection by several weeks. During the closing conference with the OSHA investigator, you should promote your clinic’s safety programs and overall commitment to safety and health. If you have had no prior citations, point this out, as it is a factor in establishing penalty amounts. Be a good listener and take notes on all of the specific violations listed by the inspector. You may be asked to establish timelines for corrective action/abatement for alleged violations. Be cautious in setting dates and allow ample time for corrective action/ abatement. Point out any obvious mistakes of fact or disputed issues with respect to citations, but do not enter into a discussion or arguments with the inspector at the closing conference. OSHA requires the issuance of citations whenever the agency believes that, on inspection, an employer has violated an applicable safety standard, health standard, a recordkeeping requirement or OSHA’s “general duty” clause. Citations must be in writing and describe the nature of the violation “with particularity,” and provide a reasonable time for abatement. OSHA has six months from the date of the alleged violation to issue a citation. You will have an obligation to post each citation at or near the location of the alleged violation even if you disagree and dispute the violation. Citations will generally be classified as follows: • Other Than Serious or Other— lowest OSHA classification, defined as not likely to cause serious injury. Usually no penalty amount is assigned. • Serious—most common form of citation and classified as any condition that may cause serious physical harm, but this is broadly defined by OSHA. • Repeat Citations—any violation of the same standard within three years with substantially similar facts. Even a second “other than serious” citation can be the basis for a repeat. • Willful Citations—not necessarily an intentional flaunting of the regulations. Defined as an understanding of the OSHA requirements and knowing noncompliance. The potential penalties OSHA can impose generally relate to the gravity of the potential for harm to workers if the employer fails to comply
with the particular standard cited. After a workplace health and safety inspection is completed, the OSHA Area Director uses the compliance officer’s notes as a basis for calculating the penalty amounts to be assessed for any alleged violations found during the inspection. Penalties for citations are: • Other Than Serious—maximum $7,000; most OTS penalties are either zero or a few hundred dollars. • Serious—maximum $7,000; under OSHA penalty calculation guidelines virtually every serious penalty will exceed $1,000. • Willful or Repeated—maximum $70,000. • Failure to Abate—maximum $7,000 per day. • Egregious Violations—the penalty times number of exposed employees. The maximum penalty amounts set by OSHA are reduced during the calculation process by applying several “penalty factors,” including the gravity of the violation (severity of injury or illness that could result and the probability that an injury or illness could occur), the size of the business, the clinic’s history of violations and the good faith the employer exercised during the investigation process (which is one reason not to refuse inspection until warrant is secured). Abatement dates will either be immediate (i.e., immediately upon receipt of the citation) or will specify a future date. You may request an informal conference to take place with the Area Director within 15 working days of the receipt of citation. These are very informal across-thetable meetings. Attorneys sometimes participate, but it is not always necessary depending upon a number of factors, including the number of cited items, the penalty amounts and whether an injury to an employee or third party occurred. The following are potential advantages of an informal conference: • Possible penalty reduction • Possible extension of abatement dates • Possible deletion of citations • Possible reclassification of citations • Clarification of abatement procedures or alleged violations • Public relations opportunity with Area Director • Discovery of more facts to ascertain whether to contest the citation >>> Continued on page 11

Two Generations, One Passion Many children look up to their parents and dream to be just like their Mom or Dad. New dreams and life changes lead people in different directions and down other career paths. But sometimes the passion for a career can start at a young age and never burn out. Drs. Dean and Ray Pawlisch are one father-son pair with the same passion for the veterinary medical profession. Both faced hurdles and difficulties while pursuing their doctorate in veterinary medicine. They found an area they loved to practice in, witnessed change in agriculture and veterinary medicine and both gave back to their profession by serving as president of the Wisconsin Veterinary Medical Association (WVMA). Growing up in North Freedom, Wis., Dr. Dean Pawlisch, always had an interest in animals and thought farmers needed help with their sick animals. Dr. Dean did not realize how hard the road to becoming a veterinarian would become. Two years of his education were interrupted while he served in the U.S. Navy during World War ll. “The first words from my advisor, Bonner Bill Morgan, were, ‘Are you sure you’re willing to spend four years here at the University of Wisconsin – Madison before getting into a vet school?’” says Dr. Dean. “I told him, ‘Whatever it took!’” There were 209 other pre-veterinary students on campus when Dr. Dean started his schooling. Only a few became veterinarians. Dr. Dean became discouraged and frustrated during his journey to veterinary school. “After submitting letters to many colleges, Michigan State wrote back that I lacked seven credits of European history, Kansas State only took students west of the Mississippi River, Illinois was just starting and would only accept straight ‘A’ students. Some schools would only accept resident students,” says Dr. Dean. “Finally, I was accepted by the University of Minnesota College of Veterinary Medicine and graduated in 1954.” During veterinary medical school, Dr. Dean completed an internship in Waukesha, Wis., which he still greatly values. “I learned a lot during that internship,” says Dr. Dean. “I still highly recommend that students complete internships so they can get hands on experience.” Upon graduation, Dr. Dean went into partnership with a fellow veterinarian and started practicing in the Brodhead area. The practice was originally operated out of a converted chicken coop and was later moved into a three car garage. Several years later, a clinic was built. With the diversity of animals on farms, Dr. Dean found himself treating a wide range of animals including cattle, horses, sheep, goats, pet pigeons and turtles. “There were a lot of pigs in this dairy country and it seemed every farm had a few chickens that needed attention,” says Dr. Dean. Throughout the course of his career, Dr. Dean witnessed great changes

Drs. Dean and Ray Pawilisch in agriculture and the clients he served. He witnessed the first bulk milk tank and the first automatic barn cleaner. During his career, free-stall barns started to replace the traditional tie-stall barns on farms. Today, robotic milkers are starting to be more common on farms. “There were 20 dairy farms on one road. They all raised families and made a living off those farms,” says Dr. Dean. “Today, there is only one dairy left on that road.” Dr. Dean’s experience and life with veterinary medicine is what inspired his son, Dr. Ray Pawlisch, to pursue his own career in veterinary medicine. Even though his father encouraged other career paths, Dr. Ray knew what he wanted to do with his life. “The easiest way to spend time with my father was to hop in his truck,” says Dr. Ray. “I witnessed first-hand all the amazing facets of veterinary medicine.” However, this is not the impact Dr. Dean meant to have on his son. “I took pride in being a veterinarian, but I encouraged my children to consider career paths other than veterinary medicine” says Dr. Dean. “Ray obviously didn’t listen to me since he came back to his home practice.” Dr. Ray graduated from Michigan State University College of Veterinary Medicine in 1982. Upon graduation, he returned to his hometown to practice with his father as a dairy practitioner at Brodhead Veterinary Medical Center. When he first began practicing, Dr. Ray would make 7-10 stops a day for anything from emergency calls, sick calls, surgeries or herd health visits. There were no set hours and veterinarians worked until all the calls were done. >>> Continued on page 8

“The owner or a family member would be available to help, give a history of the problems and discuss treatment options,” says Dr. Ray. While some farm visits are still similar to this, many farms now have employees or herd managers who work with the animals. The veterinarian’s role on the farm has also evolved to be more collaborative with the farmer or herd manager with many animal health and dietary decisions being made together. “The farmer is now managing, delegating and leading,” says Dr. Ray. “Today’s farmer is an agribusiness person who needs to sift through an incredible amount of information.” Through all the changes made in the agriculture industry, Dr. Ray believes veterinarians still maintain the role of being a trusted advisor. “The changes of veterinary medicine include species specialization or specialization in a particular area of veterinary medicine,” says Dr. Ray. “But my personal mission to promote health while providing education and encouragement to farm families remains the same.” With a combined career of 61 years, Dr. Dean and Dr. Ray have both seen tremendous growth and change within the veterinary medical profession. Neither expects the learning and evolution to stop any time soon. “The One Health approach will continue to challenge the medical profession and technology will provide a lot of the templates,” says Dr. Ray. “There are so many unanswered questions, so many problems and diseases to unravel.” As Dr. Dean enjoys retirement and Dr. Ray continues practicing at Brodhead Veterinary Medical Center, both see a bright and ever evolving future for veterinary medicine and the patients they vowed to care for. n

C. Who has rulemaking authority with regard to veterinarians and drug compounding?
D. When is compounding legal under federal law?
Federal extralabel drug use regulations only permit compounding from FDA-approved drugs when a veterinarian believes there is a need to alter the approved drug to adequately medicate a non-food animal with a diagnosed medical condition. This means that there an established Veterinarian-Client-Patient Relationship (VCPR); the individual patient has a medical condition for which a prescribed medication is needed; and the veterinarian determines that a compounded drug is needed for the animal. To be in line with FDA’s Extralabel Drug Use Rules, compounding should be performed using the FDA-approved drug.
(Note: Using a compounded drug in food animals is only reserved for when there is absolutely no other choice for treating that animal’s medical condition and when safe use of that animal for human food purposes can be predicted following discontinuation of the drug.)
The Veterinary Examining Board (VEB) has been granted rulemaking authority to enforce the power granted to veterinarians to “prepare, compound, dispense or prepare for delivery for a patient any prescription drug.” Wis. Stat. § 450.11(8)(c).
OVERVIEW OF FEDERAL LAW
A. What is “compounding” according to the FDA?
The FDA defined compounding as the manipulation of drugs to obtain products that differ from the stating materials in an approved dosage from drug.
B. When can drugs be “compounded” under federal law?
Federal rules require that compounded medications can only be modified versions of what you would otherwise buy at the store or pharmacy. In other words, they should be FDA-approved drugs that have been crushed, have had a flavor added, or otherwise tweaked for a particular patient. They may NOT be brand new medications (i.e., assembled from non-FDA approved ingredients); they are NOT generic drugs (i.e., a non-brand name version of an approved drug); they cannot be “mimic” drugs; and they cannot be produced in large quantities in anticipation of receiving orders. A “mimic drug” is an illegally compounded drug that is produced to copy an available FDA-approved human or animal drug, but avoids the drug approval process and is usually compounded for economic reasons and not medically necessary therapeutic reasons. It is clearly illegal under federal law to produce or prescribe mimic drugs.
C. When is compounding for non-food animals necessary according to the FDA?
According to the FDA, compounding for non-food animals may be necessary when approved drugs need to be modified to sufficiently treat the patient (e.g., flavoring, diluting, or changing the form of medications from tablet to suspension).
E. Is “cost” or “availability” a legitimate or legal reason to prescribe or produce a compounded drug under federal law?
No. Cost is not an appropriate reason for compounding from bulk ingredients and it is likely illegal under federal law. According to the FDA, compounding to avoid the cost of approved drugs could put a patient’s health at risk. If there is an FDA approved drug that can treat your patient’s condition, then it should be used. Under FDA rules, compounding is allowed when there is no approved animal or human drug that, when used as labeled or in conformity with the extralabel drug use regulation, will, in the available dosage, form and concentration, appropriately treat the condition diagnosed.

OSHA expects the employer to make a presentation at the Informal Conference. Time is limited, so focus only on items where there is a significant controversy. Point out facts in dispute or interpretive questions. Be prepared to conclude by stating exactly what form of relief the clinic wants. The Area Director may propose an amendment to the citations and will ask for the employer to sign a preprinted settlement agreement. Most settlement agreements will include all items in the citation. Employers can negotiate with OSHA and make counterproposals. Informal conference settlement agreements must be posted in the workplace following settlement. If you dispute the violations and would prefer litigation rather than settlement, you will need to file a Notice of Contest. There are several important points about the Notice of Contest: • Time Limit. Notice of Contest must be filed within 15 working days (i.e., weekdays excluding federal holidays) from date of receipt. There are no exceptions to this requirement. • Form of Notice. There is no specified form and a simple letter is generally used. Refer to the date and OSHA identification number of the citation and list the specific items, penalties, and abatement dates being contested. • Considerations in Filing Notice. When in doubt, file a Notice of Contest. The Notice of Contest can be withdrawn at any time. It is particularly important to file when an employee or a third party has been injured. • Posting and Employee Participation. Employees have the right
to participate in a contested OSHA case. As such, the employer must post the Notice of Contest on a clinic bulletin board and must subsequently post a notice to employees advising them of their right to participate. Once the case is contested, it is assigned to an Administrative Law Judge from the Occupational Safety and Health Review Commission (OSHRC). An attorney from the Solicitor’s office of the U.S. Department of Labor will act as “prosecutor,” but also typically will attempt to settle the case. Your clinic likely will require legal representation to participate in this administrative law proceeding. A “Complaint” will be filed by the Solicitor and an “Answer” will be filed by your clinic. Eventually the case will be set for hearing before an Administrative Law Judge. Many OSHA cases are settled prior to a formal hearing, but any settlement agreement must be approved by the Administrative Law Judge. Judicial review of OSHRC decisions may be sought by an adversely affected employer, employee, employee representative or by the Secretary of Labor. Appeals are generally filed in the United States Court of Appeals for the Circuit in which the alleged violation occurred, or in which the employer has its principal place of business. While there are many additional issues that can arise during the OSHA inspection and litigation process, the two articles presented last month and this month provide at least an overview of what your clinic could face as a result of a safety issue of interest to OSHA. This process underscores the need to pay particular attention to workplace safety issues on a proactive basis. n

Dr. Patrick Warpinski Calls Global Vet Exchange Career Highlight After returning from Beijing, Dr. Patrick Warpinski, veterinarian and owner of The Animal House Pet Clinic, enthusiastically refers to the entire global exchange experience as a “career highlight.” Dr. Warpinski is one of 10 veterinarians across the world selected to participate in the NOBIVAC Global Vet Exchange Program. The pilot program sponsored by Merck Animal Health’s NOBIVAC vaccine line, is designed to introduce veterinarians to a different culture, expose them to how veterinary medicine is performed and perceived globally, and share practice philosophies and business models. In mid-February, Dr. Pat flew to Beijing to complete the exchange with Dr. Yi (Eric) Dong at his three Puppytown Clinics. Says Dr. Pat, “The Beijing experience was so memorable on so many levels, from the language and culture, to the food and of course, veterinary medicine. For me to experience a few days in the life of a Chinese veterinarian was nothing less than phenomenal. This trip will resonate for years to come.” According to Dr. Pat, there are many differences in how veterinary medicine is practiced and perceived in Beijing versus the U.S. “Certainly Dr. Yi and his veterinary staff practice quality medicine, although they are limited by lack of access to many medications. What is unique, is the client-veterinarian relationship. At The Animal House, we work very diligently to develop a strong bond between our veterinarians and pet owners. We look to develop a sense of loyalty with our clients. Conversely, at The Puppytown Clinic, the emphasis is very focused on specialization so the pet owner rarely sees the same veterinarian on a repeated basis. Puppytown veterinarians have a specific modality emphasis. Thus, each doctor is designated to a particular field; Vaccinations, Internal Medicine, Surgery, Laboratory Medicine and of course, Dr. Yi’s specialty of Ophthalmology.” There also exists a different cultural attitude toward the management of pet care that is quite unique. First, pet owners prefer to not make appointments for wellness and sick cases and simply walk-in for appointments. This predictably creates a hectic environment in the clinic. When it comes to treatment approaches, Beijing pet owners strongly favor IV treatments to medications, and stay with their pets during the entire treatment process, hours if required. “They feel this is an important part of the healing process,” says Dr. Pat.

Another practice that is different is the payment process. It is normal for clients to take a number and pre-pay for each service as needed. For example, a client will pre-pay for a wellness exam. If lab work is indicated, the client will then pre-pay for that service and so on until that day’s visit is complete. Overall, Dr. Pat’s impression is that Beijing veterinary medicine is emerging, similar to how veterinary medicine was practiced and perceived years ago in the U.S. One of Dr. Yi’s veterinarians, Dr. Jing, relayed that she felt very proud to be at the very forefront of the veterinary profession in China. Dr. Pat expects a return visit in five years’ time would result in a very different but equally positive experience. WVMA Food Armor™ HACCP for Proper Drug Use Program VCPR + Drug List + Protocols + SOPs + Records + Oversight = Proper Drug Use PHASE l The WVMA Drug Residue Task Force developed Food Armor™, a six-section plan to proper drug use on farm. It’s the next level to develop and strengthen the drug oversight aspect of the VCPR. During the Phase I workshop you will be provided with skills and tool sets that will help you effectively implement a HACCP plan for proper drug use on the farm. PHASE ll, THE NEXT STEP The goals for the certification program: 1) Develop a non-regulatory risk management tool that facilitates implementation of HACCP plans for proper drug use on farms. 2) Support local veterinarians’ on-farm efforts in the area of proper drug use. 3) Maintain and grow consumer and regulatory confidence in the Veterinarian-Client-Patient Relationship (VCPR). In this program, farms may be certified when they can demonstrate full implementation and maintenance of a six-section HACCP plan for proper drug use. Only veterinarians accredited through the Food Armor™ program, those that have completed Phase l and ll training seminars provided by the WVMA Residue Task Force, may grant Food Armor™ Certification to farms. Food Armor™ Accreditation is limited to veterinarians because only veterinarians have the training and expertise to help farms effectively manage on-farm drug use. Attending Phase I and Phase II completes all necessary classroom work for veterinarians to earn accreditation status. The focus of Phase ll will be to train veterinarians how to effectively certify farms. Food Armor™ HACCP for Proper Drug Use is the “how-to” of achieving food safety and proper drug use on farms. Gaining Food Armor™ Accredited Veterinarian status will empower veterinarians to work with farms to improve the quality and safety of food produced and effectively manage risk.
