Brief Overview - Written Prescription Requirements By Kai Hovden, JD, and Jordan Lamb, JD, DeWitt LLP There are specific requirements under Wisconsin law for what information must appear on written prescriptions issued by veterinarians. The best practice, based on our research, is for veterinarians to comply with the nine requirements specified in Wis. Stat. § 89.068(1)(b) AND to list the issuing veterinarian’s “registration” (i.e., license) number on the written prescription. Some of these requirements can likely be pre-printed on the prescription pad (i.e., name, address of the veterinarian, license number, signature line, date line, etc.) However, there does not appear to be any standard for the prescription pad itself under Wisconsin law. Rather, the veterinarian must comply with the statutory requirements for what must be on the written prescriptions. First, Wis. Stat. § 89.068(1)(b) lists the requirements for prescriptions for animal use. It states: Form of prescription. A prescription shall include all of the following: 1. The name and address of the veterinarian and, if the prescription is a written order, the signature of the veterinarian. 2. The name and address of the client. 3. The species and identity of the patient for which the prescription is issued. 4. The name, strength and quantity of the drug prescribed. 5. The date on which the prescription is issued. 6. The directions for administering the drug. 7. If the patient is a food-producing animal, the withdrawal time for the veterinary drug. 8. If the prescription authorizes extra-label use, the manner in which the client may use the drug. 9. Any cautionary statements required by law. These requirements are consistent with the requirements under Wisconsin’s pharmacy law, however, the pharmacy prescription law also requires that a written prescription display the practitioner’s “registration number.” As such, veterinarians should also include their license number on the written prescription. See Wis. Stat. § 450.11(1) and Wis. Admin. Code § Phar 8.05(1). Please note that “prescription” is defined as, “a written, oral or electronic order from a veterinarian to a pharmacist or to another veterinarian that authorizes the pharmacist or other veterinarian to dispense a drug, or from a veterinarian to a client that authorizes the client to make extra-label use of a drug.” See Wis. Stat. § 89.02(6m). In summary, a veterinarian should make sure that all nine requirements in Wis. Stat. § 89.068(1)(b) are satisfied on any written prescription AND that his/her license number is also included. l

Adapt for Continued Success One of the great things about being a part of the WVMA is having a chance to broaden my horizons and learn about different aspects of our association. I had the chance to read “The Future of Associations: Roadmap To Progress, Change & Influence” by Omer Soker. In the book, Soker writes about how associations need to change because their relevance is under threat. Let me be clear that I do not think the WVMA is under threat and I believe it is relevant. The book made me take a step back and think about where the future may lead us and how my small part in this organization may make a difference. In the book, the author lays out a roadmap for associations. I would like to give you my impression of how the WVMA has adapted in each of the six steps Soker believes are necessary. • Disruption: Soker states that associations must evolve if they are to survive and thrive in the future. I am proud of how the WVMA has evolved just in the past few years. We are leaders in how we are offering continuing education to our members. I expect other states to see what we are doing and also change. I believe we are better meeting our members’ needs with the new model. The demographics and expectations of our members have changed dramatically in the past 30 years, so the WVMA must continue to evolve. • Mission & Vision: The author questions how relevant the association is and how good the communication is. The WVMA Executive Board periodically reviews and updates its mission and vision statements and every 3-4 years develops a new strategic plan. As a member, you receive regular communications about industry news, alerts and legislative updates through email and the monthly newsletter. Wisconsin is one of only a few states that still mails a monthly newsletter to its members. It’s a great resource to engage members and a benefit for all! • Good Governance: Soker believes an association cannot be modern without a contemporary board that provides strategy and risk management. The WVMA Executive Board is made

up of a great cross section of people. In the years I have been part of the board, it has taken its responsibilities very seriously, whether it is fiscal monitoring, relating discussion to our mission statement or discussing legislative issues. • External Strategy: The author recommends a businesslike approach to succeed commercially and develop new revenue streams and grow memberships. Kim Brown Pokorny, our executive director, and the entire WVMA staff continually work on this strategy. Hopefully, you have seen our new membership categories, allowing the entire veterinary team to become WVMA members and get involved. The new CE model also allows more opportunities for our industry affiliates to sponsor and interact with WVMA members on a more frequent basis. The WVMA has done a great job keeping our dues one of the lowest in the Midwest, another indication that our association is alive and healthy. • Internal Alignment: Soker wants us to look inward for solutions to our greatest challenges. The WVMA office and staff functions like most of our veterinary clinics and businesses. The staff needs to be empowered and accountable, the processes and systems need to be efficient, and membership needs must be a priority. I believe the WVMA exceeds in all of these areas, and I am confident it will continue into the future. • Future Focus: Soker stresses that the future is dependent on the decisions we make today. The changes that have been made at the WVMA and the new services it provides help it remain relevant and competitive. As president of the WVMA, I try to keep this idea front and center when helping guide us through this adventure. I invite anyone interested in the future of our WVMA to read this book. There are too many examples of associations and businesses that do not change and adapt and end up failing. I will do my best to make sure the WVMA continues to thrive. Members Elected to WVMA Executive Board Dr. Joshua Stewart of Dousman, Wis., and Dr. Stacey Adams of Lake Geneva, Wis., were elected to the WVMA Executive Board. Dr. Stewart represents District 1, which includes Ozaukee, Milwaukee and Waukesha Counties, and Dr. Adams represents District 2, which covers Green, Jefferson, Kenosha, Racine, Rock and Walworth Counties.

Dr. Adams grew up in Lake Geneva, Wis. She earned her undergraduate degree from the University of Wisconsin-Madison and her veterinary medical degree from the University of Wisconsin School of Veterinary Medicine.

After graduation in 2009, Dr. Adams joined Veterinary Associates, a multi-doctor, multi-location practice in Hazel Green, Wis., Dr. Stewart grew up in the New England and Galena, Ill. Outside of his veterinary medical practice he is involved in his local community church, the Southern Wisconsin Bluegrass Music Association, the Lapham Peak Trail Runners Club, the Delafield Chamber of Commerce and the Kettle Moraine High School Bluegrass Club. In his free time, he enjoys running marathons, downhill skiing and playing the five string banjo.

Her advice for current veterinary medical students is clear: “Work hard, take only as many student loans as you NEED, cherish your time in school because it will go fast, and your classmates will likely become some of your closest friends!” Aside from the WVMA, Dr. Adams is involved with the Rock Valley VMA, the Wisconsin Cattlemen’s Association, the Wisconsin Angus Association, her local FFA alumni and World Beef Expo. She and her husband, Jason, and one-year-old son, Mason, live on a small farm where they raise a mix of registered cattle. In her free time, Dr. Adams enjoys showing Angus, Simmental and Shorthorn cattle, sewing, doing needle crafts, and being a mom. l

Potential Pitfalls of “Self-Serve” Background Checks By Stephen A. DiTullio, JD, and Jordan Rohlfing, JD, DeWitt LLP More and more employers are performing “self-serve” background checks on job applicants. However, obtaining and using criminal history information can get employers, including veterinary clinics and hospitals, into hot water if not done correctly. There are certain laws and pitfalls all employers should be aware if/when performing a background check on an applicant. This article will first provide a brief overview of certain laws veterinary clinics and hospitals should be aware of and then present a short hypothetical to demonstrate how background checks can play out in the “real world.”

Please note that certain municipalities limit how far back you can look into an applicant’s criminal history, so make sure to check your jurisdiction’s laws. See, e.g., Madison General Ordinances § 39.03(8) (stating that an employer in Madison, Wisconsin, may only consider criminal convictions within three (3) years of the disposition, parole, or release from confinement, if the conviction is substantially related to the job).

Checking CCAP. The State of Wisconsin maintains the Circuit Court Access Program (CCAP), which provides public access to many court records. We find that many employers are using CCAP to check an applicant’s criminal history without awareness of potential pitfalls and limitations. First, a CCAP search may return inapplicable criminal history information because the applicant has a common name. For example, if you search for “John Smith” in the CCAP database, you will get almost 1,400 “hits.” It then becomes incumbent on the employer to try to match up middle names and dates of birth, which are often not listed and may be incorrect. This is a daunting task, but it is important to make sure you are basing your employment decision on correct information that actually pertains to the applicant. Second, a CCAP search is limited as it will not locate relevant out-of-state criminal history. An applicant may be “squeaky clean” in Wisconsin but have a string of animal cruelty convictions in another state. Wisconsin’s CCAP will not return criminal history information from other states. Lastly, a CCAP search may cause you to learn information on which you cannot legally base an employment decision (e.g., dismissed or expunged records).

Substantial-Relatedness Test. Employers may only consider criminal convictions and pending charges that are “substantially related” to the job in question. “Substantially related” means that “Ban the Box” Laws. Third-Party Background Screening. Many employers opt to have a background screening company perform criminal record checks on their behalf. Doing so helps lessen the CCAP-related risks discussed above. Background screening companies are required to comply with the Fair Credit Reporting Act (FCRA), which requires that they only report accurate and up-to-date information. The FCRA also places certain legal obligations on employers. If your clinic or hospital uses a background screening company, we recommend working closely with that company and your legal counsel to make sure you are complying with the employer-side requirements of the FCRA. Now that you are armed with that information, the following hypothetical provides an example for identifying and addressing background checking legal issues: CONTINUED ON PAGE 7

Potential Pitfalls of “Self-Serve” Background Checks

Woof Veterinary Clinic wants to hire John Jones as a veterinary technician. During the hiring process, the clinic runs a CCAP search on Mr. Jones’ name and finds out that he has one conviction for domestic violence, one disorderly conduct guilty plea from 15 years ago, one drug possession conviction from two years ago, and one dismissed drug possession charge. The clinic really doesn’t want to hire Mr. Jones now that they know about his criminal history. Woof immediately calls Mr. Jones to tell him that he didn’t get the job. Problem 1: Common Name. John Jones is a common name. It may be difficult for Woof Veterinary Clinic to sift through all the CCAP records to make sure the records truly relate to the Mr. Jones who is applying for the job. Woof Veterinary Clinic will need to pay very close attention to middle names and birthdates associated with the CCAP records. If the clinic is not sure whether a conviction relates to Mr. Jones, the clinic should not rely on or use such information in the hiring process. Problem 2: Out-Of-State Information. Woof Veterinary Clinic’s CCAP search will not locate potentially-relevant criminal history information from other jurisdictions. One benefit of using a thirdparty background screening company is that the background screening company will search for criminal history information in all relevant jurisdictions if requested by the employer.

Problem 3: Failed to Apply Substantial-Relatedness Test. It seems that Woof Veterinary Clinic is making its decision based on Mr. Jones’ criminal history record as a whole as opposed to applying the substantial-relatedness test to his convictions. The drug possession conviction from two years ago is likely substantially related to a job as a veterinary technician assuming the job requires the veterinary technician to handle medications. However, the domestic violence conviction and the older disorderly conduct conviction are a tougher call. “Disorderly conduct” convictions are generally a catch-all category, making it difficult at first blush to determine whether they are substantially related to a particular job. Additionally, domestic violence convictions are more likely to be substantially related to a job only when the applicant/employee will be working with his/her spouse or other family members. Problem 4: Improper Use of Dismissed Charge. Woof Veterinary Clinic is not permitted to base an employment decision on Mr. Jones’ dismissed drug possession charge. Awareness of potential problems with “self-serve” background checks can help your clinic lessen the risks identified above. All veterinary clinics and hospitals should review their background screening process to make sure they are avoiding the pitfalls and issues identified in this article. l

Shelters, Sellers and Adopters Rely on Veterinarians for Healthy Dog Sales By Dr. Yvonne Bellay, Humane Program Manager, Wisconsin Department of Agriculture, Trade and Consumer Protection As a veterinarian, you play a crucial role in helping ensure dogs sold or adopted are healthy through proper care and that individuals who purchase dogs are receiving pets that meet health requirements. Your role also supports the goals of the Department of Agriculture, Trade and Consumer Protection’s (DATCP) Dog Breeders and Sellers Program.

By now, you may have used platforms such as Facebook, Instagram and Twitter as part of your marketing strategy. However, many businesses overlook another important platform, LinkedIn. With 562 million users, LinkedIn is about building a professional network, connecting you with brands, businesses and individuals. Unlike Facebook, Instagram and Twitter, LinkedIn was created solely for professional business networking purposes. LinkedIn allows you to promote your brand; network with professionals; search for business leads, prospects and partners; attract talent; and establish credibility. While many people have a personal profile, creating a company page will help grow your audience and aid in reaching your marketing goals. Before you can set up a company page, you need to create a personal profile. Once your personal profile has been created, visit the LinkedIn Marketing Solutions portal and click “Create Your Company.” Enter the official company name and website URL. Then click “Get Started” and complete the details on the template provided. Be sure to include a company cover photo and logo. These images can be similar to or the same as your company’s Facebook cover and profile photos. Next, enter a description of your company. Beneath the company description, you can include company specialties. These specialties are key words that will allow LinkedIn users to search for your business or the services you provide. The key words should represent your product and service offerings, as well as your company’s points of differentiation. Once these details are set, you are ready to publish the page. Like other social media platforms, simply having an active account will not suffice. You must leverage the platform to communicate and engage with a target audience. LinkedIn was built on the premise of connections, so begin by inviting your employees to connect.

Find these groups by using the search feature and key words that align with your business goals, interests and features. LinkedIn is also the premier platform for lead generation. To connect with potential leads, start by identifying individuals who view, like, comment or share your content. Identify those who have interacted positively with your content and determine if they match your target audience. Send a personalized connection request to the individuals who do match. These actions will expand your network and the reach of your business. Another simple way to identify leads is to use the network tool.
