Dr. Ann Sherwood Zieser Nominated for WVMA President-Elect By Dr. Ann Sherwood Zieser Vision Statement What did the WVMA member say when asked to serve the association in a three year presidential term? The WVMA member said “yes” and that member happens to be me! I have been a member of the AVMA, WVMA and local Dane County VMA (DCVMA) since graduation eons ago. But honestly this is not a role that I coveted or ever expected to serve. I guess I’m trying to lead by example by starting with one simple word...yes! There is no doubt that the WVMA is currently strong because of our members, committee members, volunteers and support staff but we can be even stronger if we individually say yes to the challenge. Some of the current challenges we need to face together are: • Serving as a source of support and information for our members.

• Screening for potential issues related to our profession such as legislation that may cause undue burden to practitioners and business owners. • Staying relevant and being visible to the general public. • Continuing to be the trusted resource for all things pertaining to veterinary medicine. When we individually say yes to the challenge, then collectively we can be stronger and have a larger influence and a louder voice. So, my vision for the WVMA is to work together to continue the pursuit of a brilliant organization to improve the daily lives of our state veterinary members. Also, to assist our members in times of crisis, whether it be legal, business, employment related or even personal issues. I have been fortunate to already serve on the national level as an AVMA delegate which has allowed me to see and learn the inner workings of a large political body. I think and hope that this has helped prepare me to serve as your WVMA president!

Veterinarians Need Veterinarians Thirty years ago I’d get together with my classmates Don and Dirk to catch up. We were greenhorn cow doctors sharing our horror stories, triumphs, failures and unusual cases. On our first face-toface meeting, one year after graduating from veterinary school and dispersing across the nation, we talked into the wee hours of the night reconnecting, sharing and supporting each other. That is what socializing was prior to the internet and cell phones. The technological advances of the past thirty years have made “connecting” easier. We are in the age of the Jetsons now. We can have a “virtual” connection with friends and family nearly instantly and anywhere. Twelve years ago, the cell phone was a great tool for my daughter Heidi as she started as a new graduate in a mixed animal practice in Marathon County. She could call me for support and advice as she attended to farm calls. Add to that, texting, the internet and email, and social media platforms like Facebook and Instagram that have since been developed, people now have a wide variety of means to connect with each other. However, we are slowly realizing that “virtual connections” aren’t a substitute for old fashioned real time face-to-face events.

Conversely, the study found that real time socializing: spending time with family, religious groups and people that gathered for like minded hobbies, all were associated with improved mental wellbeing. Humans are social animals. We benefit from collective efforts and mutual support (think of teamwork). The human condition is nurtured and improved by interactions with others. Our tribe flourishes when we band together. We all feel better when we have a circle of support and a connection with others.
The technological advances of the past couple of decades have given us novel ways to connect with each other. The combination of the internet and cellular communication has given mankind new fast and easy ways to connect. We are able to make connections and communicate like never before. However, this study suggests something is missing with this mode of connecting. The activities that create “real” social connections had a positive effect on mental wellbeing, while excessive “virtual” connecting had just the opposite effect. The study also looked at non-work activities that might impact mental wellbeing. Interestingly, it found that those individuals that spent more than an hour daily on social
This social opportunity to share and support each other helped all participants to cope with the challenges of raising children. None of the mothers had extended family in the area, so this sort of became a family; a network of support. This interaction no doubt helped improve and maintain the psychological wellbeing of the participants. This group of ladies still meets weekly as MSG, even though they are all grandmothers now. This regular “real” reconnection is just the sort of thing identified in the study as having a positive effect on mental wellbeing.

A Bold Step Forward

Anyone remember 1915? Obviously, the answer is no. It was a time when railways were on the rise, early motor vehicles were being unveiled and the horse and cart were still being used for transportation. About half of the population lived in rural areas and Alexander Graham Bell and Thomas A. Watson communicated between New York and San Francisco inaugurating the first transcontinental phone service. A loaf of bread was $.07, a pound of coffee $.30 and the median income for a man was $687 a year. If you were female, the income was only $343.50. Babe Ruth hit his first career home run, Einstein formulated the Theory of General Relativity and the House of Representatives rejected a proposal to give women the right to vote. Looking back at the past 103 years, you can’t help but realize how far we have come. We look back, and respect and pay tribute to 1915, but we also recognize and value the need for progression and evolution on issues such as transportation, communications, women’s rights and advancements in food production. Just like these advancements, non-profit associations must advance and grow. Building upon the strong road paved by our former leaders and members, we must be nimble and responsive to the changes and the needs of veterinarians, students, industry and all those involved in veterinary medicine. We can no longer do business like we did in 1915. Our founders built this association to respond to specific needs and to have a united voice on issues important to veterinary medicine and the clients and patients it serves. Today, being a united voice and responding to specific needs remains important, but the solutions must be delivered and executed in new ways. As a result, the WVMA Executive Board is taking A Bold Step Forward. After gathering and analyzing data, listening to our recent graduates (1-10 year post veterinary medical school) and performing research, we have decided to deliver continuing education differently starting in 2019. We will provide scientific, nonscientific and leadership CE for veterinarians and entire clinic teams. These one-day meetings will be focused on specific topics identified by our members. In addition, we are changing our membership options and will be incorporating a clinic membership category. This new category will allow all clinic members to be members of the WVMA. We operate as a team in our day-today settings and it is time we start doing so in organized veterinary medicine. So what does this mean? It means we are going to discontinue the WVMA Annual Convention after this fall’s meeting. The Annual Meeting and Awards Ceremony will be addressed in a different manner. This change will allow us to be in contact with more members, more clinic team members, and allows us to deliver CE in all areas of the state. It will allow us to build better relationships with our industry partners and to have a larger, more unified voice when working on policy issues. Brian Sooy, president of Aespire, states that “Innovation is a way of thinking. Innovation is not about doing an old thing in a new way, it is about creating a new way to do something new, or a new way to do something better. Innovation does not accept the status quo; it recognizes there may be a better way, and is open to making it a reality. That sounds a bit like what your purpose and mission are: to create greater impact for the cause your organization represents. The problem is we’re uncomfortable with new. We’re uncomfortable with new processes, new approaches. We’re uncomfortable with that with which we are not familiar: social media, with communications planning, with taking the time to communicate clearly. We’re uncomfortable with measuring the results we achieve, for fear they do not measure up to the board’s (and our supporter’s) expectations.” CONTINUED ON PAGE 10

Jodi Legge Joins the WVMA Jodi Legge has joined the Wisconsin Veterinary Medical Association (WVMA) as Director of Business Development. In this position, Legge will build relationships with industry partners and work with the Wisconsin Veterinary Medical Foundation (WVMF) Board of Directors. In addition to her position at the WVMA, Legge is the Executive Director of the Wisconsin Livestock Identification Consortium. Previously, she served as the Executive Director for March of Dimes in Wisconsin for five years. During her tenure, the Wisconsin Chapter realigned its infrastructure and staff responsibilities, doubled the size of the Chapter Board, and posted double digit increases in special events revenue. Prior to this position, Legge worked for 20 years in various non-profit and corporate entities, including serving for three years as the Deputy Director of Communications & Marketing for the Smithsonian’s National Zoo in Washington, D.C.

Legge has received several Wisconsin Newspaper Association awards for reporting on community and social issues, as well as a community award from the Wisconsin Bar Association. She has been a member of the International Association of Business Communicators, various Rotary Clubs and Chambers throughout Wisconsin and has served on her Church Council as both a member and Chair. Legge has a Bachelor of Arts Degree in Organizational Management Studies from Bethel University in St. Paul, Minnesota. Legge is married and has two adult sons and four grandsons. She enjoys spoiling her grandsons, politics, cooking, travel and rooting for the Green Bay Packers. She and her husband, Ed, live in Wisconsin Dells. l

U.S. Supreme Court Has Approved Class Action Waivers, But Don’t Implement or Change Your Arbitration Agreement Just Yet By Stephen A. DiTullio, DeWitt Ross & Stevens, s.c. While many are proclaiming a huge victory for employers with the recent decision by the U.S. Supreme Court in Epic Systems Corp. v. Lewis approving employers’ use of class action waivers in arbitration agreements, veterinary practices and other employers would be wise to proceed cautiously before implementing arbitration agreements in the workplace. To be clear, arbitration means that a privately-hired “arbitrator” (typically a former judge or experienced lawyer) resolves a claim rather than a state or federal judge. Under the decision, a veterinary practice could potentially now require employees to go through “single plaintiff” arbitration in order to pursue a claim against a veterinary practicerather than seek class-wide damages through the court system. Particularly for large corporations, this could be very beneficial. It could mean that an employer no longer has to worry about the 1,000, 5,000, or 10,000-person class action or seven-figure settlement that frequently results. However, arbitration has its own costs, risks, and limitations that are important to understand, especially for smaller employers such as most veterinary practices. The Lead-Up to the Epic Decision The Supreme Court’s decision in Epic Systems Corp. resolves the longstanding disagreement among federal courts on the enforceability of class action waivers in employment arbitration agreements. This disagreement stemmed in large part from the National Labor Relations Board’s 2012 decision in D.R. Horton, 357 NLRB No. 184 (2012), which ruled that class action waivers in arbitration agreements violated the National Labor Relations Act (“NLRA”), a law that protects the right of workers to address the terms and conditions of employment as a group rather than as individuals. The majority of federal courts, including the Second, Fifth and Eighth Circuits, disagreed with the Board’s decision, finding it inconsistent with another more relevant federal law: the Federal Arbitration Act (“FAA”). The FAA protects the right of private parties to opt for arbitration rather than court to resolve disputes. However, the Sixth, Seventh and Ninth Circuits took the opposite view, agreeing with the Board’s decision and disallowing arbitration agreements with class action waivers. How Epic Resolved the Arbitration Question In Epic Systems Corp. v. Lewis, 138 S. Ct. 1612 (2018), the Supreme Court held in a 5-4 decision that class action waivers in arbitration agreements are enforceable and that employers can require
employees to agree to them as a condition of employment. The implications of Epic Systems Corp. are significant. The case could potentially allow employers to avoid the class actions that have often driven risk assessments and calculations in recent years. Pros Associated with Requiring Arbitration There may indeed be advantages to arbitration of employment disputes. From a pro-arbitration perspective, employers may prefer arbitration because it is often seen as less hostile, more flexible, more private, and more efficient in both time and resources. Likewise, arbitrators may be more business savvy than the average judge. In addition, as noted above, an arbitration clause with a class action waiver can potentially help businesses to eliminate their biggest employment law concern: an employment law class action. That concern is much less for businesses with small numbers of employees (less than 20) and increases for larger businesses. Cons Associated with Requiring Arbitration Although there are several good reasons to consider moving towards arbitration clauses with class action waivers (particularly in the current legal environment), employers will want to take into account the cons. Among other things: 1. Parties will need to be prepared to pay arbitrators $400, $500, $600 or more per hour to resolve claims. In other words, employers will need to be ready to cover not only their own lawyer, but the arbitrator as well. This could greatly increase the costs associated with resolving single-plaintiff disputes. 2. The rules in arbitration may be less clear, the decisions less predictable, and appeal rights non-existent. Although the absence of appeal rights can be great when a business prevails in arbitration, it can be frustrating and costly when a poor arbitration decision finds a business on the losing end with no appeal rights and no settlement leverage. 3. Plaintiff’s attorneys may resort to bringing a series of singleplaintiff arbitrations instead of one big class action. Although this may sound favorable, it is not always. Dealing with numerous individual arbitrations of claims rather than one class action could conceivably be more costly when one factors in cost for arbitrators and attorneys for each claim presented for arbitration. It could also give rise to inconsistent outcomes leaving businesses less sure of how to operate in the future. CONTINUED ON PAGE 7

Proactive Marketing By Kelsey Stokstad, Botham, INK. While creative marketing strategies are important, the content you generate needs to be both relevant to your audience and timely within your industry. What does that mean? Can you do just one or the other?

To stay relevant, focus your attention on your customers’ wants, needs and opinions. You can’t base marketing strategies on dated trends or yesterday’s technology and expect your audience to respond well. Think about what your customers want, where you can reach them and how your practice can benefit them. Sending an email reminder for a vaccination or preventative heartworm dose to all of your dog owners, for example, is information that is relevant to these customers. However, in order to be most effective the content must also be timely. Be sure to segment your list so that owners who have recently visited for just this purpose are eliminated and thus won’t be bothered with information that is not relevant right now.
Relevance and timeliness matter during on-farm or in-clinic visits as well. It’s important to consider sharing information that matters today as well as things that animal owners should be on the look out for or thinking about in the weeks and months ahead, as seasons change, litters are born or animals are weaned, for example.
Being timely means that you are sharing information that relates to current industry or practice news, as well as to the customer’s current situation. Consider sending an email and/or writing a blog post about an animal virus that might be spreading at local dog day care

Biography I was one of those kids who wanted to be a veterinarian since I was seven years old. The first conscious thought I had pertaining to this idea was when I visited my uncle’s farm and got knocked over by a big shepherd in his excitement. That same day I got eyed up by a huge Angus bull complete with a ring in his nose, huge pawing hooves, and steam coming out of his nostrils. This experience may have left most ordinary sane people running in the opposite direction, but for me the curiosity of these animals drew me in. Fast forward to the opening of the UW-Wisconsin School of Veterinary Medicine that I am honored to call my alma mater. (Go Badgers!!) The veterinary school began operation just as I was graduating high school. A few years later my first big dream came true when I was accepted into the fourth class. After veterinary school graduation my second big dream came true when I was hired as a companion animal practitioner at Middleton Veterinary Hospital (MVH). Fast forward an amazing 28 years and you will still find me working at MVH. Over that time period two more dreams have come true. First, I married my sweetheart (we actually met at the first annual Pharmaceutical Fair otherwise known as drug day). Secondly, I was ultimately blessed to become a mother to first a daughter and then a son. CONTINUED FROM PAGE 3

Excessive time spent on social media is associated with psychological distress. Our busy schedules today lead us to take short cuts. A text here or there, a post on Facebook or Instagram, and a quick reply from someone gives us a short dose of satisfaction. But something is missing. It is important to make a real effort to have face-to-face connections regularly with other

One more fun fact is that I am part owner in a veterinary clinic on the island of Providenciales in the Turks and Caicos Islands. I have visited and worked (and played) eight times since 2004. We have adopted two local street dogs called Potcakes as puppies and have brought back a number of puppies and kittens for rescue by other kind-hearted people. Of course, I love dogs and cats but I also love to read, bicycle and work on various yarn projects. l

Also, during that time, I was able to volunteer and gain a lot of experience in the world of organized veterinary medicine. I had an excellent role model as Dr. Bob Klostermann led by example since he was very active in the WVMA. I started as the secretary of our local DCVMA and then moved into several different volunteer positions within the WVMA. I have worked on the awards committee, convention committee and on the Executive Board as AVMA delegate. I spent four years as the AVMA alternate delegate with Dr. Randy Schuett as my mentor and then four years as Wisconsin AVMA delegate with Dr. Douglas Kratt (who is currently running for AVMA president-elect).

Dr. Clarke joined the Pathology service in June of 2018. Lorelei was born and raised in Hawaii and earned her DVM (2012) from Colorado State University. She recently completed a combined residency-PhD program in anatomic pathology at the University of Georgia. Her doctoral work focused on arboviral diseases of white-tailed deer, and she has broader interests in infectious diseases of wildlife and livestock. Outside of the lab, she enjoys hiking, camping, marathon running, water sports, and other outdoor activities.

My IT Guy Recommended Image Based Cloud Back-up. Is it Worth the Hype? By Steve Newton, WDA Insurance & Service Corp. The simple answer is… probably, but it depends. Backing up to the cloud can provide your office with numerous disaster and recovery benefits. There are two primary ways small business can back-up their information to the cloud. The first is called a file level back-up and the second is an image based back-up. While both methods are good solutions to help protect your critical information, you might be surprised to find that the best cloud based back-up solution might be one that combines the benefits of both file level and image based back-up solutions.

WVMA Member Spotlight – Dr. Carmi Simonson Veterinary Medical School: University of Wisconsin School of Veterinary Medicine Graduation Year: 2004 Background: I grew up in Chippewa Falls, Wis. and did my undergraduate work at UW-River Falls. I was a member of the University of Wisconsin-Madison Class of 2004. After graduation I worked for a year at a small animal practice in New Richmond then moved on to a clinic in Eau Claire, Wis. After 10 years at that practice I took the plunge and opened my own clinic in my hometown of Chippewa Falls in December of 2015. I am also an officer on the NWWVMA for 2018. Dr. Carmi Simonson
Value of WVMA membership: The WVMA has provided quality affordable continuing education for me and has also represented us as a profession very well at the capital. We are very lucky to have such a great organization working so hard for us.
Most memorable part of her veterinary career: Starting my own practice has been the most memorable part of my career. It was stressful and exciting all at the same time. Overall, a very rewarding change and I’m glad I did it. Advice for current veterinary students: I would advise to really explore all the different types of veterinary practices. You may love a huge specialty practice, or you may feel at home in a small general practice. Make that decision for yourself and no one else. Find a practice culture where you are comfortable and happy and can grow as veterinarian. You never stop learning in this profession and there are a lot of different opportunities out there so find one that makes you happy! Veterinary medicine outreach: We recently hosted and taught a Career Exploring program for middle school and high school students in conjunction with the Boy scouts of America. I have also gone to numerous elementary schools in the area and presented at the career fair at our local middle school. l
