New District Representatives Elected to WVMA Executive Board District 3 – Jeffrey Bleck, DVM Dr. Jeffrey Bleck is a 1996 graduate of the University of Wisconsin School of Veterinary Medicine. He began his career as a large animal veterinarian with Kettle Moraine Veterinary Clinic, which was a mixed animal clinic at the time. The practice split in 2005 and he became one of three owners at Dairy Doctors Veterinary Service, a primarily dairy practice located in Plymouth, Wis. A member of the WVMA since 1996, Dr. Bleck served on the Professional Education Committee, Best Practices Committee and Dr. Jeffrey the WVMA HACCP for Proper Drug Use Committee. He has also Bleck attended several WVMA Annual Conventions during his career. On the national level, he served on the AVMA Gender Task Force and the Pfizer Dairy Advisory Board. “The WVMA Executive Board is a vital part of the WVMA, representing the total membership,” says Dr. Bleck. “I feel it is important to have a cross section of veterinarians represented to not only maintain, but to also provide leadership on important issues that arise regarding all domestic animals, both farm and companion as well as the veterinary medical profession.” As a large animal practitioner, he believes the most important issue facing food animal veterinary medicine is the FDA’s scrutiny and regulations of antibiotic use and hormone use in food producing animals. “With the Veterinary Feed Directives now in place monitoring feed additive antibiotics, will the FDA now switch gears to regulate and decrease hormone and injectable antibiotic use in food producing animals?” he questions. “The veterinary profession must take the lead in working with the food animal producers to continue to prescribe and monitor the use of these products in a judicious manner.” Outside of veterinary medicine, Dr. Bleck enjoys exhibiting dairy cattle with his family at various shows throughout the year, coaching his kids’ basketball teams and playing golf. He is married to Lea Ann, who is also a veterinarian, and has two children, Elise, 15, and Brady, 11.

Over the past few years, the WVMA has been expanding our presence and support of the University of Wisconsin School of Veterinary Medicine (SVM) students. As we begin a new year, I would like to take the opportunity to share some of the activities we work jointly with our student members on offering. Our impact includes: • Sponsorship and organization of the Blue Coat Ceremony (transition from third to fourth year) including a Blue Coat Task Force of second and third year students to customize the ceremony for each class. • Three scholarships. • Twice a semester the WVMA invites a speaker and sponsors a lunch at the SVM for members called Vets to Vet School. The goal is to highlight different career paths and areas of practice. • Hands-on wetlabs at the WVMA Annual Convention which are designed by students and taught by members. • Sponsorship of clubs on campus. • Participating at Student Orientation where we give students their first introduction to organized veterinary medicine and all that our association has to offer them. • Two student representatives on our Executive Board who are our main liaison to the students. • Student Advisory Committee that brainstorms and comes up with impactful programs. • Student Day, a Saturday in February where students pick the topics and the WVMA coordinates and sponsors. Salmonella Heidelberg Investigation Continues; Steps Veterinarians Can Take to Assist By Department of Agriculture, Trade and Consumer Protection Investigation Summary • The Wisconsin Department of Agriculture, Trade and Consumer Protection (DATCP) is working with the Department of Public Health, Centers for Disease Control, and the United States Department of Agriculture to investigate a recent outbreak of Salmonella Heidelberg in humans. Cases of human illness with multi-drug resistant Salmonella Heidelberg have recently been linked to dairy calves purchased from Wisconsin. • To date, there have been 29 S. Heidelberg isolates found in bovine specimens nationally with 18 of these from Wisconsin. • In the past year, there have been more than 20 human cases in the US associated with this outbreak with 14 of these occurring in Wisconsin. • Human illness has been largely associated with cattle contact.
What can you do? • Ensure the farms that you work with are aware of the outbreak in cattle and that it is a zoonotic disease. • If you suspect Salmonella in cattle on farms that you work with, we recommend submitting samples for testing. • Biosecurity is a very important measure that you and your producer can take to reduce the spread of human and animal pathogens. Remember to clean and disinfect boots, coveralls and equipment between farm visits. • Producers should be aware of the risks of bringing people, animals and equipment onto their facility and have biosecurity plans in place that reduce the risk of disease transmission. • For additional information, contact the Wisconsin DATCP Division of Animal Health by email at datcpanimals@wi.gov, or by telephone at 608-224-4872.
• Genetic sequencing of human and bovine isolates has demonstrated associations between cases. • Trace-back efforts from human and bovine cases and investigations are underway; herds that have been identified in traces or by positive tests are being contacted for further investigation. Now OK to Reimburse Employee Premiums for Individual Health Insurance By Brian L. Anderson, DeWitt Ross Stevens, s.c. In the “Legal Briefs” column for May 2015, I wrote that, to avoid a penalty tax under the Affordable Care Act (ACA), an employer could no longer, in lieu of providing group health insurance coverage, pay the health insurance premiums for an individual policy in the name of any employee. Beginning January 1, 2017, relief from that rule is available for small employers. For this purpose, a small employer is defined as an employer that is not subject to the ACA pay-or-play penalty rules, because it employed, in the prior calendar year, an average of fewer than 50 full-time (or full-time equivalent) employees. Therefore, most veterinary practices will qualify for the relief. The relief is important, because it enables small employers that cannot afford to provide group health plan coverage to nevertheless help employees purchase their own health insurance or pay for medical expenses. The relief was provided in a provision of the 21st Century Cures Act, signed by President Obama in early December 2016, which allows a small employer to establish a “qualified small employer health reimbursement arrangement” (QSEHRA) (a new acronym). In a QSEHRA, the employer reimburses employees pre-tax for (a) any premiums they pay for individual policies of insurance and/or (b) any other eligible medical expenses that are not paid by insurance. Employees will need to provide the employer with proof of the insurance coverage or other medical expenses. The maximum amount of reimbursements for any year cannot exceed an indexed dollar limit which, for 2017, is $4,950 (if reimbursements are limited to premiums and expenses incurred by the employee) or $10,000 (if reimbursements are available also for premiums and expenses incurred by the employee’s family members). The dollar limit is prorated in proportion to the number of months during the year for which the QSEHRA covered the employee: an employee covered for only 6 months in 2017 would be limited to reimbursements of $2,475 (employee-only) or $5,000 (employee plus family).
The source of all reimbursements must be the employer. A QSEHRA cannot be funded by employee salary reduction contributions, such as through a health flexible spending arrangement or other section 125 cafeteria plan. An employer adopting a QSEHRA must provide a notice to eligible employees no later than 90 days before the first day of the plan year (or the first day of eligibility, in the case of an employee who was not eligible at the start of the year). Because the law was enacted so late in 2016, however, an employer could provide the required notice for 2017 as late as March 7, 2017 (90 days after date of enactment). The notice must (a) state the maximum amount of reimbursements for the year, (b) require the employee to inform any health insurance exchange from which he or she applies for advance payment of the premium assistance tax credit, and (c) state that, if the employee is not covered under minimum essential coverage for any month, the employee may be subject to tax for that month and reimbursements under the QSEHRA may be taxed. The tax consequences are important: the QSEHRA is not intended to replace the ACA mandate that generally every individual have minimum essential coverage (such as a major medical insurance policy) or pay a tax penalty. QSEHRAs are expected to be adopted by many small employers that choose not to provide group health insurance coverage. Of course, all health insurance rules might change if the ACA is repealed. An employer cannot maintain a QSEHRA for only targeted employees and cannot offer the QSEHRA on different terms to different employees. If adopted, the QSEHRA must be available to generally all employees, except for those who have been employed for fewer than 90 days, or who are under age 25, or who are parttime (e.g., less than 25 hours per week) or seasonal employees (e.g., less than 7 months per year). To the extent the QSEHRA is used to reimburse for individual health insurance premiums, however, reimbursements can vary due to premium differences based on age and family size.

District 4 – Ronald Biese, DVM Dr. Ronald Biese is a 1991 graduate of the University of Wisconsin School of Veterinary Medicine. He began his career in veterinary medicine with Kaukauna Veterinary Clinic in Kaukauna, Wis. after graduation and has practiced small animal medicine there since.

“I am pulled in the direction of giving back to the profession I love,” Dr. Biese says when asked why he would like to serve on the WVMA Executive Board. There are several important issues Dr. Biese believes are facing veterinary medicine. “The main issue is the daunting debt with which students are coming out of school with to start their careers. Then to top that off their starting salaries are not competitive with other medical professions that take less time to obtain such a degree,” he says. “The other issue that continues to surface, and may one day pass, is the issue of forcing veterinarians to write a script every time they prescribe some medication in their practice. We need to make sure that bill gets squelched each time it comes up.” Outside of veterinary medicine, Dr. Biese enjoys spending time with his family, biking year-round, gardening, backpacking, along with playing volleyball and basketball.

District 6 – Sally Harper, DVM Dr. Sally Harper is a 1988 graduate of the Colorado State University College of Veterinary Medicine. She began her career in February of 1988 at Lancaster Veterinary Clinic in Lancaster, Wis. where she continues to practice. Currently, she practices mixed animal medicine but mainly works with dairy cattle. A member of the WVMA since 1988, she has attended WVMA annual meetings, served on the Legislative Committee, participated in the Food Armor® program and has attended other WVMA seminars. Within her veterinary career, Dr. Harper has participated in missionary trips to Ecuador and Kenya. She became a clinic owner in 1992, and built a new building for the clinic two years ago. “The WVMA is a vital organization to promote and serve veterinarians in the state,” says Dr. Harper. “I would like to make sure that the WVMA continues to reflect food animal practitioner perspectives.” She believes the most important issue facing food animal veterinarians is antibiotic use and sales on prescriptions. “We need to work together with manufacturers and our clients to make sure we are able to continue using antibiotics and that we are using them effectively and judiciously,” she says. “We need to correct the consumer’s perception that animals need to be raised without any antibiotics at all.” Outside of veterinary medicine, Dr. Harper enjoys gardening, traveling, bicycling, playing bridge and other games, knitting and sewing, cooking, preserving food and the chickens at her home. l

Privacy & Network Security Liability: Are You Prepared? By Mara T. Roberts, CLU, RHU, REBC; president, WDAISC Are you aware that businesses must be able to notify all parties that were affected by a breach, communicate effectively the scope of the possible damage, and provide credit monitoring assistance and identity restoration case management to those affected by the breach. In addition, they may also face legal defense and settlement costs in the event an action is brought against them because of a breach.
Consider the cost for notification for example. How many notices would you need to send (potential victims), how many different versions of the notification letter and the cost for both printing and postage of the notification. How will you handle in bound calls once notification has gone out? Customer questions could tie up a considerable amount of staff time and a source of considerable disruption for your practice.
You may believe you don’t have this exposure. If you are like most small business owners, (an estimated 78 percent per a recent Harris Poll on behalf of Nationwide insurance) you don’t have a cyber attack response plan. The same Harris Poll survey found that 54 percent of small business owners were victim to at least one type of attack: virus, phishing or malware. Other exposures include hacking, unauthorized access to customer or company info, software, data breach and ransomeware. The U.S. Small Business Administration claims that small employers are becoming an increasingly attractive target because they not only have valuable customer data but provide access to larger networks and lack the personnel to provide cyber security. Even if you outsource or have dedicated IT staff, it cannot protect you from lost or stolen devices or internal threats. How you respond to and survive a breach depends upon whether you have given this exposure much thought and, if you have cyber coverage, how broad that coverage is.
If you are considering the use of Cloud Computing for all or part of your business operations, you should carefully review the contractual language prior to entering into any agreement. Many contracts have not been updated to reflect new technology and the impact of cloud computing on current data security/privacy laws.
Take time to develop a response plan-just like an emergency response plan, knowing what to expect and how to respond before an emergency ensures better outcomes for all involved. Develop policies for your practice which address mobile computing, personal devise use (BYOD), sensitive information handling and basic security of protected information. Do NOT wait for a data breach to happen. Inventory all of your stored Personal Identifiable Information (PII) and know what a “worst-case” breach scenario could look like. Should a hacker get into your system, all of your files (HR, clients, healthcare, communications, etc.) could be compromised at the same time and you won’t have the advantage of calmness and time to respond.
• Who owns your data once it resides in the Cloud? • Does your Cloud provider guarantee the security and privacy of your data? • Will you be alerted if there is a breach of your customer data inside the Cloud? • Will you have the right to investigate the breach? • Who will notify your customers of a breach incident? Everyone purchasing cloud services will need to address its unique requirements in the contracting process, and each contract should be the result of due diligence and a negotiated transaction.
If you have a breach: notify your broker or your insurance company claims representative as soon as possible. You should be sure to have your staff gather and document facts surrounding the incident - if you have an IT person, they would be instrumental in working with the insurance company. Network security event logs are often vital in helping verify the date, time and machine involved in an incident. If you have a cyber liability policy, this will trigger coverage and your carrier will step in to direct and assist. If you have any coverage under your business owners policy, the carrier will again step in to direct and assist per the policy language. Anesthetic Gases in Veterinary Clinics As an owner or employee of a veterinary clinic, we have all had questions regarding the safety of anesthetic gases. (1) Are these agents toxic? (2) Are there consequences to long term anesthetic gas exposure? (3) Is there anything that can be done to minimize these exposures? This fact sheet serves to answer these questions and more specifically in regards to isoflurane and sevoflurane. It also serves as a guide on minimizing, to the greatest extent possible, employee exposure to these chemicals so as to comply with OSHA standards. Understanding what an industrial hygienist, the occupational health professional who evaluates inhaled exposures to chemicals, would look for in a veterinary clinic is important. Any part of the anesthesia process that allows gases to enter workplace air needs to be evaluated. The first part of the anesthesia process is the anesthesia circuit. This is the equipment used during inhalation anesthesia to regulate concentrations of inhaled gases, includes a reservoir bag and usually directional valves, breathing tubes and a carbon dioxide absorber. There are other sources of exposure. The veterinary clinic’s challenge is to use the tools available so staff understands how anesthetic gases are emitted into the workplace atmosphere. Knowledge is power. Clinic staff that understand how anesthetic gases are being emitted have opportunities to reduce them. The resources listed at the end of this article are intended to be educational for all clinic staff and helpful in developing a program that addresses all aspects of employee exposures to anesthetic gases. Communicate about the chemicals. OSHA’s Hazard Communication standard requires that employers: (1) have written programs that address how they will implement a hazard communication program, (2) maintain and provide access to the safety data sheet (SDS) for the chemicals to which employees are exposed, (3) make sure labels on chemical containers are legible and in good condition, and (4) use the SDSs to provide training to employees about the health and physical hazards of the chemicals before they have exposure to the anesthetic gases. OSHA has an excellent publication called the Small Entity Compliance Guide for Employers That Use Hazardous Chemicals (OSHA 3695-2014) that explains the various aspects of the Hazard Communication standard. A PDF of the publication is also available on the OSHA website. Reproductive Health. Because halogenated anesthetic gases like isoflurane and sevoflurane can interfere with fertility and even harm an unborn child, it is extremely important that employee exposures to these chemicals be kept to a minimum. Each veterinary practice should have a clear and well-communicated policy about pregnancy in the workplace. The policy should clearly state that it is the employee’s responsibility to inform employers that they

are trying to become pregnant, are pregnant, or need reasonable accommodations. Pressure test your anesthesia machine. Every day that the machine is used, it should be pressure tested to make sure it is in good working order. This test will also indicate whether there is a leak. The process for doing this test should be in writing and required to be followed by all anesthesia staff. An example of such a checklist with instructions for setting up, pressurizing, and checking for leaks is available from a company called Sonopath. There also are videos that provide guidance on how to pressure test veterinary anesthesia equipment. One video produced by Oscar Chavez, DVM, was reviewed by the Alliance committee and demonstrates one method of conducting a pressure/leak test (see Resources). Check for leaks on a regular basis. Leak testing is good for initial system checks and for troubleshooting a high personal exposure result. Exposures to anesthetic gases can occur when (1) the equipment used to administer the gas has a leak, (2) anesthetic gases leak from the patient’s breathing mask into the air of operating or recovery rooms, (3) no masks or scavenging devices are used, and gases are leaked directly from the delivery system into room air, and (4) gases are exhaled by patients recovering from anesthesia. Additional sources of uncontrolled exposure occur when the anesthetic liquid reservoir is inadvertently overfilled or a supply bottle is left open after using it. A halogen detector, such as a TIF refrigerant leak detector, can be used to conduct a simple, qualitative survey of where leaks may be occurring in your clinic. TIF leak detectors are handy and readily available in a wide range of price points (some are ~$100). Simply hold the device’s sample inlet near locations where leaks would be expected, such as anesthetic tubing, connections, exhaust filters, etc. Leak checks should also be conducted during actual veterinary procedures and while the patient is in recovery. The device will show you where your anesthesia process needs to be adjusted or your protocols need to be changed. If a quantitative result is desired, a field portable IR would be the instrument of choice. These devices are bulky and very expensive (~$80K), but enable real-time measurement of leak concentrations. The definition of “regular” checks hinges on many factors. If, for instance, you do your initial leak tests and find that some part of the system is always leaking, you might want to increase your leak tests to a weekly schedule. If you test monthly and, after a year, have found minimal leaks, then perhaps a yearly check is

sufficient. Instances when the anesthesia process should ALWAYS be leak tested include: (1) following installation of a system prior to first use, (2) when new tubing or connections have been made or changed, (3) during veterinary procedures, and (4) when there is active suspicion of a leak. Get staff members involved. Encourage Certified Veterinary Technicians that use the anesthetic machines to help develop the leak survey checklists and to be the leak testers. Survey checklists should be created for each anesthesia circuit used and each veterinary procedure done. Both developing the checklists and using them are educational processes, and provides a message to staff that everyone in the clinic is responsible for reducing anesthetic gas emissions. Check your employees’ breathing zone exposure. Representative personnel exposure monitoring is required by OSHA to measure employee exposures. Personal exposure monitoring can be done using passive dosimeter badges or the recommended OSHA sampling procedures. We suggest that clinics contact their insurance risk managers for assistance with the monitoring or the free and confidential Wisconsin On-site Consultation Program (contact them directly at 800-947-0553). They also can work with the Wisconsin Occupational Health Laboratory to do the surveys themselves. To obtain a “representative” exposure, choose the staff person(s) who have the most exposure to the anesthetic gases and conduct monitoring as they go about their full day, working with the inhalant gases. If they are not overexposed, then the people with less exposure are probably not either. Different staff may have different roles in the anesthesia process and monitoring should be done for each. For instance, the veterinarian conducting the procedure should be monitored, as should the veterinary technician who might not assist in surgery, but oversees the patient’s recovery. The personal exposure monitoring results are compared to established guidelines. While OSHA does not have workplace exposure limits for halogenated anesthetic agents, other creditable organizations do. These guidelines can serve as a reference point for determining whether further action to reduce exposure needs to be taken. Anesthetic Gas

The isoflurane OEL is referenced from the American Conference of Governmental Industrial Hygienists (ACGIH) and is an 8-hour time-weighted average. The sevoflurane OEL is referenced from the National Institute of Occupational Safety and Health (NIOSH) and is a time-weighted average for the duration of the procedure. Keep the records of the surveys in case an OSHA compliance officer asks. Although there are no OSHA permissible exposure limits for anesthetic gases, clinics can still be cited by OSHA for not evaluating the levels to which employees are exposed. Other countries do have standards for isoflurane and sevoflurane. Respiratory Protection. A negative-pressure, high-efficiency particulate air (HEPA) filter used for infection control is not appropriate to protect workers from anesthetic gases. Air-supplied respirators with a self-contained air source are ideal for eliminating exposure but are not a practical alternative. If respiratory protection is used, then the employer needs to develop a full respiratory protection program. OSHA’s publication titled Small Entity Compliance Guide for the Respiratory Protection Standard (OSHA 3384-09 2011) provides guidance to small employers in developing such a program (Attachment 4: Sample Program is available on page 101 of the Small Entity Guide). Maintain your survey records. SDSs, leak inspection records, and personnel exposure records are considered employee exposure records and must be preserved and maintained for 30 years. These can be maintained electronically and must be made available to employees who are exposed to anesthetic gases upon request.

Personal Exposure Monitoring Clinics can choose to have a third party conduct the air survey or they can do it on their own. If the clinic works through the Wisconsin On-site Consultation Program, their staff will do the survey at no cost. Clinics can also use the Wisconsin Occupational Health Laboratory (WOHL) to obtain the sampling media and equipment to do it themselves. A sampling guide with a list of analytical services and a fee schedule are available on WOHL’s web site, http://www.slh.wisc.edu/ occupational/wohl/. Passive sampling. This method uses a badge similar to the radiation badges worn by x-ray technicians. Following the direction of the laboratory from which it is ordered, the badge is placed in the breathing zone of the employee (on their collar) for the specified period of time and then returned to the lab. The cost of analysis is included in the price. The drawback is that the badges are validated for isoflurane but not sevoflurane, so if sevoflurane exposure needs to be monitored, the OSHA method must be used. OSHA Method. This method uses a calibrated, battery operated sampling pump, tubing and media. OSHA’s methodology for isoflurane and sevoflurane require the same sampling media (Anasorb 747) and analytical method. The pumps can be loaned pre-calibrated from the WOHL at no cost, but the vet clinic would pay for the analysis of the sampling media. Note: When using the WOHL, communication is the most important aspect of the survey. Tell them you are new to this type of monitoring and need assistance with the specifics.
