Animal assisted therapy (AAT) has become commonplace in recent years. Animals that visit health care facilities as therapy animals may encounter patients who are particularly susceptible to zoonotic infections due to immune compromising conditions. Additionally, there is a potential for the therapy animals themselves to be exposed to pathogens in such a setting. Because of these risks, certain measures can be considered by veterinarians and others who care for therapy animals. Some of the recommendations below provide guidance for the attending veterinarian, while others would need to be implemented by the health care facility in which AAT is being used. Suitable and Unsuitable Animals for AAT Use • Species considerations: Animals used in AAT programs should be domestic animals that are household pets, have been in a permanent home for at least 6 months, and are least 1 year of age (ideally > 2 years old). Certain species are inappropriate for use as therapy animals because of their higher risk of causing human infections or injury. Unsuitable species include reptiles, amphibians, nonhuman primates, livestock, avians, rodents, hedgehogs, and any other animal not litter trained. Some facilities do not permit the use of cats as therapy animals. • Temperament: A temperament evaluation should be conducted to evaluate the animal’s behavior under conditions that they might encounter when in health care facilities. Reactions to strangers, crowded rooms, hugs, and other novel stimuli should be evaluated. Health Screening of Therapy Animals • Therapy animals should be evaluated by a licensed veterinarian at least once (optimally twice) per year. • At a minimum, therapy animals should be current on rabies vaccinations. Dogs that have been vaccinated with the live-attenuated Bordetella bronchiseptica vaccine should not interact with patients for at least two weeks post-vaccination. • Animals should be free of dermatophytes and ectoparasites. • Animals should be free of enteric parasites, including Giardia and Cryptosporidium. • Routine screening of normal animals for methicillin-resistant Staphylococcus aureus (MRSA), group A streptococci, or Clostridium difficile is not necessary unless epidemiologic evidence suggests that the animal might be involved in transmission. Other Animal-related Considerations • Owners should not allow therapy animals to scavenge, hunt, or drink from the toilet. • Therapy animals should not be fed raw meat, raw eggs, or other non-cooked treats such as pig ears, hooves, or rawhide chews. • Therapy animals should not be allowed to lick patients. • Animals should not visit patients during mealtimes. • The animal should not come into contact with any breaches in the patient’s skin such as sites of invasive devices, open or bandaged wounds, or surgical incisions. • If the animal needs to be placed on a bed or patient’s lap, place animal on a clean towel, sheet, or ideally on an impermeable disposable barrier - not directly on the patient’s hospital gown or bed sheets. Planting Seeds-Growing Tomorrow’s Veterinarians Growing up on a farm in north central Wisconsin, I had a natural affinity to animals. My first passion was horses; my Dad used draft horses in the woods for making maple syrup. Later I became enamored with cows, enrolled in 4-H and showed them at the county fair for many years. This innate preference for animals was no doubt a significant factor that contributed to my career choice of a veterinarian. As a 12-year-old boy, I was amazed at the abilities and insights of our veterinarian as he attended to our animals. I was impressed at his ability to determine the pregnancy status of our cows by rectal examination. Given the challenges of artificial insemination, the rectal examination results were sort of a “report card” of our efforts. I always eagerly awaited the diagnosis, and when the cow was not pregnant appreciated advice and/or treatment to help achieve that goal. Additionally, I valued his ability to solve problems. From sorting out why a cow was sick and how to make her better, to delivering a “stuck” calf, the veterinarian left the farm in better shape than when he arrived. While this type of practice is considered “fire engine” practice, it was the norm back then. The preventive health programs that are common today were just being developed at that time. The notion of helping people with their animals appealed to me. My curiosity in veterinary medicine prompted me to seek job shadowing opportunities while I was in high school and college. Our veterinarian graciously allowed me to ride along several times. I learned quickly what a large animal veterinarian’s day was like and decided to pursue that career.

Aside from my affinity to animals, my job shadowing experience ranks as the next most important factor that focused my efforts to become a veterinarian. Recognizing the importance of job shadowing, I have returned the favor to many youths considering veterinary medicine as a career. The majority of those that rode along with me while I practiced were high school or undergraduate college students. I always discussed the wide spectrum of opportunities that exist in veterinary medicine and enjoyed their conversations with them. School organized Career Days are another venue to tell young people about the opportunities in veterinary medicine. My practice associates and I have participated in many of these programs at our local high schools over the years. At the other end of the spectrum, I’ve had great fun going into kindergarten classes to share some of the things I did as a cow doctor. I always got loud gasps when I showed them a cow aspirin and a hoof nipper, the bovine version of a fingernail clipper. Young children are fascinated with animals, and frequently rank veterinary doctor as what they want to be when they grow up. I encourage you to embrace the opportunities to nurture young people’s interest in veterinary medicine. We must plant the seeds that will grow into the next generation of veterinarians. l

Celebrating Wins – Regardless of the Size

We all have read a lot of articles, listened to speakers and discussed the very real mental health issues that face veterinary medicine. I am thankful the profession is starting to address and talk about mental health. Mental health wellness is something that is near and dear to my heart, based on my life experiences and the people I call friends and family. I think about the amount of pressure each of you are under. Debt, running a business, family, community engagement, the life cycle of your patients and so much more. I have also come to appreciate that in large, veterinary medicine is loaded with introverted individuals that put a lot of pressure on themselves to be perfect, to save every animal, to be the best parent, coworker or business owner you can be, all while keeping everything bottled inside. We are in a profession that operates at all or nothing. Do we need to be that way? Is it adding undue stress to our lives and challenging our mental health? Or, should we be celebrating the little steps forward and small wins, versus perfection right away or the selfdirected guilt of failure? I came across the story below. It hit home to me – as I too put a lot of pressure on myself to do better and be better. Then if I miss the mark, I can’t stop thinking about why I missed the mark, versus celebrating that fact I moved forward. Encouragement Gives a Lift I stopped by a Dairy Queen, purchased a sandwich, sat down in the crowded dining room next to a family celebrating their son’s basketball game over an ice-cream cake. Since the aisles were especially narrow, I soon felt like I was part of the party. “So, your team must have won this afternoon,” I commented. The little fellow smiled and wholeheartedly announced, “No, we lost 24 to 2!” “Well you must have made the only basket then,” I said. “No,” he responded, “I missed all of the eight shots I took, but three of them did hit the rim.” This child was elated, I was confused. They were celebrating because his team lost the game and because he had missed eight baskets!?!?!? Seldom am I at a loss for words, but the only response I could muster up at that moment was a blank stare (and a very large, insincere looking smile). I had absolutely no clue to as why this child was so happy. After another mouthful of cake, and still grinning from ear-to-ear, he added, “We’re having a party because last week I missed nine shots and none of them even came anywhere near to the backboard. Dad says that all of my practicing this week really paid off. I’m making progress.” – Rochelle Pennington Take time to reflect, and celebrate the little wins! l

Dr. David Jeans Recognized as Friend of World Dairy Expo World Dairy Expo’s (WDE) annual Friends of Expo Party was held on Monday, December 11, recognizing the efforts and contributions of WDE’s nearly 500 volunteers. The evening was highlighted with the presentation of the 2017 Friend of Expo Awards to longtime Expo supporters. Dr. David Jeans
Dr. David Jeans, has served as World Dairy Expo Ethics Coordinator for seven years. During expo week, Dr. Jeans oversees student workers and veterinary staff taking milk samples from champions, works with the ultrasound coordinator, walks the grounds monitoring cattle and exhibitors, and assists staff as ethics information and reports are generated. Through Dr. Jeans’ oversight, expo staff said they’re able to maintain high ethical standards for the world-class dairy-cattle show. l

Animal Conditions Requiring Temporary Exclusion Participation in AAT activities should be delayed for at least one week beyond resolution of the following conditions in the animal: • Vomiting or diarrhea • Urinary or fecal incontinence • Respiratory infections • Treatment with nontopical antibiotics or immunosuppressive medications • Open wounds • Ear infections • Acute moist dermatitis (”hot spots”) • Estrus Human Patient Considerations Policies should be in place at the health care facility to address the following issues. • Patients should wash their hands or use an alcohol-based hand sanitizer before and after touching the animal. Hand hygiene prior to contact reduces the risk of reverse zoonoses, especially transmission of MRSA from patients to animal. Humans can be colonized with MRSA and be asymptomatic. • Do not let patients kiss the therapy animal or feed it any treats. • Certain patients are not candidates for AAT. These include patients who: - Are asplenic (due to a high risk of severe Capnocytophagia infection) - Have tuberculosis, ringworm, giardiasis or amebiasis - Are colonized by or infected with Salmonella, Campylobacter, group A strep or MRSA Readers who are interested in more detail on this subject are advised to read the article “Guidelines for animal-assisted interventions in health care facilities” in the American Journal of Infection Control 2008, Volume 36(2), pages 78-85. l

Are Relief Veterinarians Employees or Independent Contractors? By Stephen A. DiTullio, DeWitt Ross & Stevens s.c. One of the more confusing and technical areas of employment law is in regard to classification of independent contractors. This issue has arisen in many veterinary practices, particularly in regard to whether relief veterinarians should be classified as employees or independent contractors. This article provides a starting point for the detailed analysis that is required regarding the proper classification of relief veterinarians and other workers in your veterinary practice.

Furthermore, it is important to note that even if a relief veterinarian or other employee prefers the independent contractor status, government agencies and courts do not consider such preferences in their analysis. Indeed, oftentimes workers will testify that they want to be treated as independent contractors, but such testimony is generally given no consideration in this area of the law.

At the federal level, the IRS and Department of Labor are the two most likely agencies to audit employers that use independent contractors. At the State of Wisconsin, it is the Department of Workforce Development (DWD) that is most likely to conduct such an audit. Significantly, the current state of the law in Wisconsin is confusing because the DWD has three divisions – Workers Compensation, Unemployment Compensation, and Equal Rights Division – each of which has a unique independent contractor classification test. As such, in Wisconsin, it is possible that a worker could be classified as an employee for workers compensation purposes (the most stringent test under Wisconsin law), but as an independent contractor for unemployment compensation and equal rights purposes. However, that is not meant to imply that the tests under the DWD unemployment compensation and equal rights divisions are easy to meet. They certainly are not! Rather, it is more reflective of the fact that the nine-part workers compensation test in Wisconsin (set forth below) is extremely difficult to satisfy. Furthermore, veterinary practices should be aware that private law firms are interested in the issue of whether an employer may have misclassified independent contractors. Such issues often arise in individual claims and/or class action lawsuits brought by current and/ or former workers who were purportedly misclassified. These lawsuits can be difficult and expensive to defend. Obviously, there are benefits for a business to classify workers as independent contractors, including potentially lower labor costs,
withholdings. • Unpaid Wisconsin workers’ compensation insurance withholdings and potentially related damages connected to a workplace injury of an incorrectly classified independent contractor. • Unreimbursed employee expenses. • Failure to provide benefits to which employees would be entitled. • Coverage under the Affordable Care Act.
To provide a better perspective of this issue, the following is the test under Wisconsin Workers’ Compensation law. All nine of these factors must be fully satisfied in order for a worker to be properly classified as an independent contractor for Wisconsin workers compensation purposes: • Maintains a separate business with his or her own office, equipment, materials and other facilities. • Holds or has applied for a federal employer identification number with the IRS or has filed business or selfemployment income tax returns with the IRS based on the work or service in the previous year. • Operates under contracts to perform specific services or work for specific amounts of money and under which the independent contractor controls the means of performing the services or work. Ethylene Oxide in Veterinary Hospitals By Leslie Ptak, Department of Labor/OSHA compliance assistance specialist Veterinary hospitals might be surprised to learn that their medical equipment sterilization units probably use one of the most harmful chemicals that OSHA regulates. Ethylene oxide (EtO) is a toxic, flammable and highly reactive chemical. This article will focus on veterinary hospitals’ need to address potential employee exposures to EtO. EtO is the agent used in the processes that sterilize reusable medical equipment. Manufacturers of the sterilization equipment take great care to limit the amount of EtO used in their equipment and to engineer redundant controls that ensure employee exposures to EtO are as low as possible. When an EtO exposure does happen, it is usually because there was an equipment failure, employees or the contractors who service the equipment, did not understand how the equipment worked or they did not understand how to respond when an alarm went off. • Employees entered a room known to have an EtO leak; however, their direct reading device was not calibrated properly and their exposure was higher than they realized. • An employee mistook an EtO alarm indicating a leak for a buzzer indicating an equipment cycle change. The employee opened a door releasing EtO into the room. • An employee did not close a bleed off valve during an EtO tank change. The leak continued undetected for about 20 minutes until another employee noticed a visual alarm. • The manufacturer was contacted as room levels were found to be 20 ppm EtO. The technician investigating the situation determined that a missing seal in the line from an empty tank was the source of the leak. • A technician overloaded the sterilizer trays resulting in the equipment not working properly. A leak resulted.
concentrations at or above the OSHA action level or in excess of the excursion limit under expected conditions that will cause the greatest possible release. Where do employers get this objective data? For veterinary hospitals, the most likely source will be the manufacturer of the EtO sterilizing equipment. Manufacturers often conduct their own assessments to ensure that their product meets the OSHA standard2. Contact your representative at the company and asked them if they have data showing that employees are not exposed to EtO during its regular intended use. If you decide to use the manufacturer’s assessment, OSHA requires that you obtain their records of the assessment. Objective data records must be kept as long as the employer relies on the data to demonstrate that monitoring is not required. The types of information that should be kept include: • The source of the objective data • The testing protocol, results and/or analysis of data • The exempted operation and corresponding information supporting the exemption • Any other data relevant to the operations, materials, processes, or employee exposures covered by the exemption
If you do not have objective data for the equipment used at your facility, you will need to have air monitoring done to evaluate employees’ 8-hour time-weighted average and 15 minute excursion exposures. Your results will determine whether you need to comply with OSHA’s ethylene oxide standard. • If neither the 8-hour TWA action level nor the excursion limit is exceeded, then the employer is finished with the assessment. Leak detection is an important part of protecting employees. If your employees’ exposures are over the permissible exposure limit you must have a schedule for routine leak detection surveys. If your employees’ exposures are below the action level, you might find it helpful to test equipment such as sterilizers, pipes, tanks, and fittings at least every two weeks to confirm that there are no leaks. Portable EtO gas-detection meters are available to check for leaks around equipment, such as sterilizers, tanks, fittings, and pipes that contain EtO. Leak testing is generally performed using hand-held EtO detection meters. The Wisconsin Onsite Consultation Program, which is at no cost to employers and confidential, is a great resource for getting the exposure assessment completed. Contact them directly at 800-947-0553. Ethylene oxide is a liquid at temperatures below 51.3ºF and it is corrosive. If there is a possibility for EtO to splash in the eyes of employees, then a plumbed eyewash station is required. If liquid can get on employees’ skin, then a personal protective equipment
assessment needs to be done to determine if protective eyeglasses, gloves or gowns are necessary for employees handling the EtO. Any records generated from air monitoring or medical surveillance conducted in accordance with 1910.1047 must be maintained by the employer. Exposure records need to be maintained for 30 years. Medical records need to be maintained for the duration of employment plus 30 years. The OSHA standard for record maintenance is 1910.1020. OSHA might not be the only agency that regulates you with regard to your EtO use, especially if you are discharging EtO to the outside air. Whether a veterinary clinic needs to comply with the Environmental Protection Agency regarding EtO depends on whether they are an outpatient clinic or their patients remain overnight. Contact the Wisconsin Department of Natural Resources Small Business Environmental Assistance Program. They can check to see of your business needs a permit and help you with resources if you do. Resources • The ethylene oxide standard provides a wealth of information on EtO and how it is used in workplaces. Although the actual standard (1910.1047) is dense with legalese, there are four appendices written in plain language. Appendices A and B are most useful in explaining the requirements. Are Relief Veterinarians Employees or Independent Contractors?
• Incurs the main expenses related to the service or work that he or she performs under contract. • Is responsible for the satisfactory completion of work or services that he or she contracts to perform and is liable for a failure to complete the work or service. • Receives compensation for work or service performed under a contract on a commission or per job or competitive bid basis and not on any other basis. • May realize a profit or suffer a loss under contracts to perform work or service. • Has continuing or recurring business liabilities or obligations. • The success or failure of the independent contractor’s business depends on the relationship of business receipts or expenditures. This is a very hard test to meet and there is a decent likelihood that many relief veterinarians do not meet all nine factors. Many
relief veterinarians play a role of simply filling a temporary need at a veterinary practice during a maternity/paternity leave or other temporary situation. In most other aspects, the relief veterinarian operates as a temporary replacement for a regular employee. Such a relationship in many circumstances will not satisfy the Workers Compensation test and may not satisfy many of the other tests. A thorough evaluation of your contract with any independent contractors, particularly with relief veterinarians, as well as the actual practical aspects of those relationships, is highly recommended for all veterinary practices using independent contractors. Furthermore, it is imperative that all veterinary practices are familiar with the other applicable tests under federal and state law as the Workers Compensation test set forth above is distinct from other federal and Wisconsin tests. Taking these steps will not only help to ensure that past problems or misconceptions are recognized and addressed, but to also maximize that classifications are correct in the future. l

Dr. Melissa Haag, of Dane, is a 2012 graduate of the University of Wisconsin School of Veterinary Medicine. Since graduation she has worked in the livestock division of Lodi Veterinary Care. A member of the WVMA since her first year of veterinary medical school, Dr. Haag believes it’s important for veterinarians to stay involved and up to date on current issues facing the profession.

“Despite having busy lives, I believe it is important for veterinarians to participate in organized veterinary medicine and play an active role,” she says. “If we all sit back and solely focus on our individual jobs, we are likely to lose out on opportunities to help one another remain successful as a profession.“ When asked what she thinks the most important issues facing veterinary medicine are, mental health stability is the first one she listed. “Amongst our entire professional group, I worry about the mental health stability of veterinarians. Multiple different sources of stress seem to affect many veterinarians in various ways,” she says. In her opinion, sources of stress include high debt load and an inability to pay back the debt in an efficient manner, increasing pressure from entitled clients that seem to value information on their Google search more than information from their veterinarian, social media slandering, compassion fatigue, veterinary practice transition from the older generation to the younger and difficulty in creating a work/life balance.

Specific to livestock veterinary medicine, Dr. Haag is concerned about the training of lay people in large animal veterinary procedures. “Some veterinarians are being pressured to train individuals in pregnancy exams/diagnosis, displaced abomasum surgeries, and advanced reproductive techniques,” she says. “Additionally, feed companies/AI companies/etc. all seem to be training and soliciting their own experts in various consultation roles. It is challenging to remain competitive in a market that seems to want to replace almost every aspect of a large animal veterinarian’s job.” As a female large animal veterinarian, mother and dairy farmer, Dr. Haag believes she has a diverse perspective to bring to the WVMA Executive Board. “I wear many different hats and seek to support the agricultural community’s best interests, especially as it pertains to veterinary medicine,” she says. “Additionally, I think that my personality lends itself to working well in a group setting where important decisions need to be made. I practice veterinary medicine in a large clinic and am familiar with needing to work cohesively with many different personality types. I tend to internalize and analyze different viewpoints before drawing my own conclusions.” Outside of veterinary medicine, Dr. Haag is passionate about dairy farming and dairy genetics. She is active on her family’s farm, enjoys riding her horses, attending family gatherings and taking her daughters to their music or sporting events. Dr. Haag will represent District 5, which consists of Dane and Columbia counties. l
WVMA Member Spotlight – Allison Ludwig By Bailey Quam, WVMA communications and project specialist
WVMA Student Member, Allison Ludwig graduated from Iowa State University in 2015 where she majored in Animal Science with a strong interest in vision science research. The strength of the ophthalmology services and vision science drew her to the University of Wisconsin School of Veterinary Medicine where she began in the fall of 2015. Ludwig is currently completing the first Allison year of her PhD in the combined DVM/PhD Ludwig program in the Department of Comparative Biomedical Sciences. Students in the combined degree program spend their first two years in the DVM curriculum, then step out for four years to complete their PhD before returning to the DVM curriculum for their third and forth years. “My new graduation date is 2023,” says Ludwig. “It still feels really strange to say I’ll be in school that long.” The lab Ludwig is working with is using stem-cell based technologies to produce retinal cell types in vitro to study retinal disease and cellbased therapies for blindness in animal models of retinal disease. “We’re able to reprogram adult cells, like you might get from a blood sample or skin biopsy, into stem cells and use them to grow optic vesicle-like structures (OVs) that resemble the developing retina,” explains Ludwig. “From these OVs we can grow different types of retinal cells, and we focus primarily on producing photoreceptors, which are light-sensitive cells of the retina that are crucial to vision.” Ludwig is particularly interested in studying how these cells act in animal models of retinal disease and what effects they might have on vision, with the goal of working toward developing therapies for patients with blinding retinal diseases. After graduation, she would like to specialize in veterinary ophthalmology and continue to use basic science to expand treatment options for inherited eye diseases of both humans and animals as a clinician scientist at a university.

“The combined DVM/PhD program is uniquely suited to my career goals, since it has allowed me to gain experience with mentoring, working toward a common translational goal, and delving into the basic science that’s essential to understanding the field of vision science,” says Ludwig. “I get to train in the all the areas I am passionate about at the same time, which has been a really rewarding experience for me.” While pursuing her PhD, Ludwig has maintained her WVMA membership and is currently serving on Convention Committee. “Serving on this committee has been a very gratifying experience, as I’ve been able to be involved in planning and facilitating the annual convention each year,” Ludwig says. “Seeing the amount of time and effort that goes into planning educational events has given me a strong appreciation for the events WVMA offers to students.” Ludwig also credits her WVMA membership with helping her get involved in the veterinary community in Wisconsin and feeling like she is more than just a student passing through. While in veterinary school, Ludwig has had the opportunity to be involved in the OccuPaws/Journey Together service dog programs coordinated through the Oshkosh Correctional Institute. This program allows students to apply what they have learned in veterinary school by teaching program members while also learning about canine behavior and service dog training. “This has been a really eye-opening and rewarding experience that I hope to continue in the future,” she says. As Ludwig navigates her way through her PhD program, she is thankful for her Class of 2019 classmates and the two years she spent with them in veterinary school. “Now that I have left the class, I value the moments I had with my classmates even more,” she reflects. “The Class of 2019 has some incredible people in it, and having their support and continued friendship during my first year of graduate school has made all the difference in the world.” l
