Animal bites and scratches ranked #1 in a polling of veterinarians and veterinary technicians attending the 2016 WVMA Convention as to which topics the WVMA-OSHA alliance team BLUE - Pantone 288 should pursue. These injuries are commonly encountered in veterinary clinics. The purpose GREEN - Pantone 356 of this fact sheet is to provide guidance to veterinary clinics in the optimum ways to minimize both the number of and the severity of animal bites and scratches in their workplaces. OSHA has no specific standards applicable to animal bites but instead focuses on personal protective equipment (PPE) to prevent injury. Employers must (1) assess the workplace to determine if PPE is needed to protect employees from hazards; (2) select appropriate PPE that protects employees from the hazard; 3) ensure employees understand the need for the PPE, its benefits and limitations, and its use when needed; 4) certify in writing that this hazard assessment has been performed for each workplace; and, 5) provide PPE to employees at no cost to them. Suggested Best Practices Keep the clinic as calm as possible. Because animals are most likely to bite and scratch when they are in distress, creating a calmer work environment can help alleviate patient stress and minimize injuries. Start by “turning down the volume.” Speak softly. Turn off the radio and centrifuge. Silence alarms. Consider using calming agents like dog appeasing pheromones (Adaptil). There are also opportunities for animal behavior education programs that focus on promoting low stress practice environments. One such program called Fear Free offers a certification process for veterinary health care teams in which staff are taught how to apply the knowledge and strategies learned into their own practices. Ensure only properly trained staff are providing patient restraint. It is recommended that veterinary practices actually have written office policies stating that only trained personnel are allowed to restrain patients. Consider the appropriate use of muzzles and cat bags if needed. Use appropriate personal protective equipment. Employees need protection against bites and scratches from the patients they work with every day. There are several factors to consider when selecting OSHA-mandated protective gear. First, there is a North American performance standard which classifies the level of protection offered by sets of gloves of varying materials. Specifically, the fabrics are tested for how well they protect against cuts, abrasions, and punctures on a “cut level” of 1-9 (1 being least protective, 9 being most protective). Once you have looked at a selection of rated gloves, there are other important considerations. (1) Can the gloves be cleaned or disinfected and will they require such maintenance? (2) Do the gloves come in sizes that will fit all staff? (3) Do the gloves still allow employees to maintain their dexterity to be able to perform the necessary procedure? (4) Are there protective sleeves available for the arms in the same materials? (5) Is the material used in the PPE appropriate for use with animals? CONTINUED ON PAGE 7

Previously, I’ve argued our profession’s practice level fragmentation; large capital investment duplicated in veterinary facilities in close proximity to one another; significantly limits veterinary practice profitability. Can the same argument be made for the profession’s organizations? Does fragmentation hinder our ability to maximize membership value? Nationally there is: American Veterinary Medical Association, American Association of Bovine Practitioners, American Association of Equine Practitioners, American Animal Hospital Association, American Feline Practitioners, you get my point, the list goes on and on and on. In Wisconsin, there is: Wisconsin Veterinary Medical Association, Wisconsin Veterinary Technician Association, Wisconsin Equine Practitioners Association and Wisconsin Veterinary Practice Managers Association and nine local, district veterinary associations. With this dilutive effect, how can the veterinary medical profession provide significant and demonstrable impact to improve the profession in the state of Wisconsin? We have an opportunity to be truly relevant! Let’s discuss tactics and strategies to increase collaboration and leverage synergies. Let’s consider opportunity to combine resources advocating for the veterinary medical profession’s best interest. Consider the combined expertise, consider the combined resources. Consider the combined impact the veterinary medical profession could have on high educational costs, overwhelming student loan debt, poor practice profitability, compassion fatigue and the profession’s wellness. The WVMA, WVTA, WEPA and WVPMA have far more in common than different. Fragmentation in Wisconsin’s veterinary medical profession’s organizations hinders our ability to effectively overcome countless challenges facing the profession. Let’s set aside our differences, identify common ground, leverage opportunity increasing of the profession’s relevancy, come together as one voice, as one united organization to advocate for the veterinary medical profession. As the New Year dawns, let’s have the courage to say yes to having the discussion, let’s have the courage to be relevant! l

The Legal View of Paying Commissions in a Veterinary Practice By Stephen A. DiTullio, DeWitt Ross & Stevens s.c. The November 2016 WVMA Newsletter included an interesting and informative article entitled “Your Best Bet for Paying Associates.” That article primarily discussed paying associate veterinarians on a guaranteed salary plus commission pay basis. Such a payment system is allowed under applicable law and may be a helpful system from a risk transfer standpoint as noted in the November article. This article is meant to supplement the previous article to address legal issues involved with the paying of commissions in a veterinary practice. Veterinary practices must be careful in regard to the amount paid in salary, rather than commissions, to veterinarians and other employees as it could impact whether they are properly classified as exempt from the legal right to receive overtime pay. Specifically, a veterinary practice (like all employers) must classify its employees as exempt or non-exempt from the general federal and Wisconsin rule of paying time and one-half for hours worked in excess of 40 per week. Exempt employees do not need to be paid overtime, whereas non-exempt employees must be paid overtime. Failure to properly classify employees can result in significant back wage damages, an automatic double wage penalty, and payment of attorneys’ fees. As such, a mistake in this area could subject a veterinary practice to significant damages and, if left uncorrected, jeopardize the exemption status on a going forward basis for veterinarians or other employees currently classified as exempt by a veterinary practice. The first threshold step in the exemption analysis is whether the employee was paid the minimal required salary every week regardless of how many hours they actually worked. If that first step is met, then the employer must evaluate whether one of the exemption “duties tests” applies under the professional, administrative, executive, computer, or outside sales classifications. In order to comply with the federal and state regulations for a veterinarian or other employee to be classified as exempt, it is important to understand that commissions do NOT count toward the salary requirement. As such, a 100 percent commissioned employee – veterinarian or otherwise – likely would not be considered exempt in large part because his/her weekly pay would wholly fluctuate depending on the amount of commissions paid each week. As such, the general rule is that paying 100 percent commissions likely means the employee is non-exempt. However, in regard to veterinarians, there is more to this analysis than just the salary issue. The applicable federal law, the Fair Labor Standards Act (“FLSA”) lists three categories of professionals who would be exempt regardless of whether they are paid a salary. Those categories are teachers, lawyers, and doctors who engage in the “practice of medicine.” Based on current case law, it is unlikely in Wisconsin that veterinarians would qualify under the “doctors” or

“practice of medicine” exemption, so that they could be exempt even if paid 100 percent commissions. Only one federal case throughout the country has held that veterinarians qualify under the “practice of medicine” exemption – and that case is from the Ninth Circuit Court of Appeals (which has jurisdiction in four western states). As Wisconsin is located within the Seventh Circuit, this decision has no binding authority and only limited precedential impact. Furthermore, there has not been further direction from the federal Department of Labor regarding this issue, even though it has been an open question for many years. Likewise, there is no precedent under Wisconsin law or Wisconsin regulations addressing this issue. Based upon the above analysis, the conservative approach would be to assume that the salary requirement continues to apply in Wisconsin for veterinarians, so that in order for veterinarians to be exempt, they must be paid the current $455 per week salary requirement (which was scheduled to increase to $913 per week on December 1, 2016 until a federal court in Texas blocked that regulatory change in late November 2016; no appeal was pending at the date this article was written). After that required amount of $455 per week has been met, then paying of commissions in addition to this salary would not risk loss of the exemption. If a veterinary practice wanted to roll the dice on this issue, it could pay a veterinarian solely on a 100 percent commissions basis, argue that the Ninth Circuit is correct that veterinarians fall under the “practice of medicine,” and take the position that no salary payment is required to maintain the exemption. While that is not the recommended approach, there is at least an argument that it could be done. It is also important to emphasize that the weekly salary requirement applies even for high earning veterinarians. For example, if a veterinarian earns at least $100,000 (this amount was scheduled to increase on December 1, 2016 to $134,004 annually, but the federal court in Texas blocked this change as well), he/she will be considered a highly-compensated employee. However, the FLSA regulations also indicate that for a highly-compensated employee to be exempt, he/she must also receive at least the standard salary amount of $455 per week. So, commission based only pay would not work even for a highly-compensated employee. Of course, after the base salary is met, the remainder of the pay could be commissions based. Business owners – including owners of veterinary practices – are defined under federal law as any employee who owns at least a bona fide 20 percent equity interest in the business in which the employee is employed and who is actively engaged in its management. Actively involve employees who will be wearing gloves and/or protective sleeves to participate in selecting the best products by speaking with suppliers of safety-rated equipment and trying them on before purchase.

Although there may be local laws that apply to these cases, the Communicable Disease Epidemiology Section of the Wisconsin Division of Public Health (DPH) offers consultation on situations involving potential human exposures to rabies. Local health department staff or health care providers can call 608-267-9003 during their regular office hours or the DPH emergency answering service at 608-258-0099 on nights and weekends, in order to consult with an epidemiologist.

There also is an OSHA standard for eye and face protection, and the Agency has an Eye and Face Protection eTool which provides guidance in selecting the appropriate PPE. Most important is the employee’s opportunity to try on the PPE before it is purchased. For such business owners, the salary level requirement does not apply. In such circumstances, a business owner could be paid solely on commissions. In regard to part-time employees, who probably will not work more than 40 hours per week, overtime is not likely to be an issue. That being said, the recommendation remains to classify a part-time employee who makes less than $455 per week or $23,660 per year as a non-exempt employee. If you have a part-time employee who earns at or in excess of these levels AND meets one of the duties tests, then classify him/her as exempt. It is always best to classify employees properly, just in case a part-timer works more than 40 hours per week. Also, keep in mind that an employer is legally permitted to pay any non-exempt employee on a salary basis. The employer would just need to pay any additional overtime pay based on the employee’s hourly rate (the weekly amount divided by 40). The key point – paying non-exempt employees a salary is permitted, so a part-timer does not need to be hourly. These types of wage and hour issues often are quite fact dependent and can involve technical issues regarding the law. As such, communication with legal counsel is often recommended. l

Hot Topics from the Public Health and Food Safety Committee 1. Salmonella Heidelberg infections in Wisconsin: Salmonella Heidelberg is an emerging multi-drug resistent strain of Salmonella that is being diagnosed in calves and people, especially small children. The infection seems to be circulating in sale barn calves and there is not a source yet. However, considering the isolates are almost genetically identical, public and animal health officials are optimistic that the severe infection can be controlled. 2. Rabies testing at the Wisconsin State Laboratory of Hygiene is now at the new laboratory on the east side of Madison. There may be an extra turn around time with submissions in large animals that requires brain removal or submissions that are sent to the Wisconsin Diagnostic Laboratory and need to be couriered to the WSLH. More information will follow during the transition of testing from the Henry Mall location to Madisonâ&#x20AC;&#x2122;s east side. 3. Lambing and kidding season is here. With significant increases in Wisconsinâ&#x20AC;&#x2122;s dairy goat population, keep Coxiella burnetti (causative agent of Q-Fever) in mind as a common cause of abortion and zoonosis. l

FDA Bans Powdered Gloves Effective Jan. 18 The Federal Register on Dec. 19, 2016, published its final rule establishing the Food and Drug Administration’s ban on powdered surgical and exam gloves. The FDA says powdered gloves are an adulterated product and are unsafe for use. This ban takes effect in 30 days. Unfortunately, the ban’s effective date also applies to end-users who have already purchased and are using powdered gloves. These gloves may not be used after Jan. 18, per the FDA and are subject to enforcement action. Powdered gloves represents a small percentage of the current exam glove marketplace and there are many high-quality powder-free gloves available as alternatives.
