Inspiration for 2014 Chris Booth, DVM

As we enter into a new year, many of us are setting new goals and making plans for what we hope to accomplish in our business and personal lives during 2014. We all go about this process differently and are inspired in a variety of ways, but the best way to accomplish great things is to have a plan on how to get there. Recently I began preparing for 2014 by reading a book called “The Right to Lead” by John Maxwell that was given to me by my wife when I started my year as WVMA President. The book’s focus is learning leadership through character and courage and contains a variety of real life stories and quotes that provide valuable examples to learn from. I decided to make this column a little different than normal and share with you some of the quotes in “The Right to Lead” that made an impression on me. Are you too busy:

Everything in Perspective

When talking with members, it seems like many are overwhelmed with the pressures of work, family, community and personal well-being. Working long hours, economic challenges and communicating difficult situations with clients about their animals gets overwhelming fast. Having a demanding client that is constantly unhappy, maybe yelling and sometimes being unreasonable is a reality of what you face when caring for their animals. Do you take it personally? Do you ask, “why me?” Is it really a result of something you have done (or not done), or is it about the client feeling frustrated, lacking control of a situation and facing their own emotions? It is important to keep these situations in perspective and not let it “eat away” at you. The negativity can be mentally draining, using up all your energy and keeping you from other, more positive activities. So, how do we keep it in perspective? I found the following excerpt in the book, “How Many People Does it Take to Make a Difference?,” it has made me stop and reevaluate some of the challenges I face on a regular basis and believe it may impact you the same way. “If you have food in your refrigerator, clothes on your back, a roof overhead and a place to sleep…you are richer than 75% of the world’s population. If you have a little money in the bank or spare change in a dish someplace…you are among the top 8% of the world’s wealthy. If you can drink from your kitchen faucet whenever you want…you are by far more fortunate than 1.5 billion people who have no access to clean water at all. If you can attend a church or a political rally without fear of harassment, arrest, torture or death…you have the kind of freedom denied to more than three billion people in the world. If you can read this message, you are more blessed than two billion people who cannot read at all. If your everyday problems are weighing you down, there are millions of people on Earth who would gladly trade places with you right now – problems and all – and feel they have been royally blessed. Remember: “From those to whom much is given, much is expected.” The next time you face an uncomfortable and difficult situation, step back and look at the bigger picture. n

Close Review of All Contracts Is Important Gregory E. Scallon, Esq., DeWitt Ross & Stevens, S.C.

A recent Wisconsin appellate court case highlights the need to be certain that each contract you enter into has been carefully tailored to the specific fact situation. This recent case happened to involve an employment agreement. The employee, a radiologist, was subject to an employment agreement that contained very specific grounds for termination. If the employee was terminated for any reason outside the listed grounds, the employer was required to give the employee 90 days advance notice, or pay the employee for the 90 days. The radiologist made an error in reading some film. In an attempt to cover-up the mistake, the radiologist sought to erase the film, including offering payment to a staff member to assist in the cover-up. When the employer discovered the conduct, the radiologist was immediately terminated with no notice or further pay. It seems that there was clearly grounds for termination for cause based on this egregious conduct, doesn’t it? Unfortunately for the employer, the court held that, because the reason for the termination did not fit within any of the specified reasons for immediate termination without pay, the employer was required to provide the additional 90 days of pay. This seemingly absurd result might well be considered the result of poor drafting on the part of the employer’s attorney (no, our firm was not involved). However, far too often when we are asked to get involved when a dispute arises, we find that the contract terms don’t quite fit the actual facts of the arrangement. A common error occurs when a contract is made in a name other than the legal name of the clinic. For example, the clinic may be owned by Dr. Gooddoc, incorporated as ABC Veterinary Hospital, Inc. and d/b/a Happy Pet. When the clinic purchases an expensive digital x-ray machine, along with a five year maintenance contract, Dr. Gooddoc signs the purchase order in his name, but signs the maintenance

contract in the name Happy Pet, in neither instance using the correct legal name. When the machine proves to be a lemon, a lawsuit is commenced in the name of ABC Veterinary Hospital, Inc. seeking to void the contract and recover lost profits, and the manufacturer moves to dismiss the case because there is no contract between the manufacturer and ABC Veterinary Hospital, Inc. It should be possible to clear-up the situation and proceed, but this will involve additional expense and time, all of which could have been avoided if the paperwork had been correct in the first instance. Another situation which occurs fairly often, and sometimes with very unfortunate consequences, arises when the clinic pulls an employment agreement, with a covenant not to compete, that was prepared several years ago out of the file and uses that agreement for a new hire. As we’ve discussed in an earlier Legal Briefs, it is very important that the terms of a covenant not to compete are tailored to the specifics of the employee’s services for the clinic. If the clinic uses an agreement that was last used for a large animal veterinarian for a newly hired small animal veterinarian, the terms of the restrictive covenant may be unenforceable. In addition, there are frequent court decisions interpreting covenants that result in up-dates to assure continued compliance with the evolving law. In many instances a quick call to your attorney’s office to discuss the specifics of the agreement that you are contemplating will answer any questions and allow you to proceed without delay. In some instances, it may be just a matter of you, or your practice manager, taking a little extra time to confirm that what may appear to be a “boiler plate” type document really works for the intended purpose. Occasionally, your attorney may suggest more extensive changes to the documents. In any case, a little extra time spent at the beginning may save considerable time and expense at the end. n

WVMA Member Speaks to UW School of Medicine and Public Health Students

On October 10, WVMA member Dr. Jeff Loomans participated in a question and answer session at the University of Wisconsin – School of Medicine and Public Health for students on antibiotics used as a food additive and their proposed connection to antibiotic resistance in humans.

As part of the student’s advocacy integrative case, their task was to narrow down the information presented to a specific position they wanted to take. To goal of the session, titled “Should Feed Grade Antibiotic Use in Food Animals be Limited?” was not for the students to become experts on the topic, but for them to learn advocacy. The skills learned from the session will help the students when they are interviewing with a reporter, writing a letter to the editor, using social media, testifying at legislative hearings or any other event where their medical expertise may be needed in the future.

Other speakers included Dr. Barry Fox, an infectious disease doctor and faculty member at the Wisconsin School of Medicine and Public Health and Dr. Rachel Klos, foodborne disease epidemiologist at the Wisconsin Department of Health Services.

“The students were very well educated, receptive and open minded,” said Dr. Loomans. Dr. Loomans started his talk by stating, “Healthy animals make healthy food, and veterinarians are on the frontline when it comes to keeping our nation’s food supply safe.” Throughout the session, Dr. Loomans discussed the advances of animal healthcare, including how the use of vaccines and >>> Continued on page 6.


WVMA Member Spotlight Originally from Hollandale, Wis. in Iowa County, Dr. Erika Doescher graduated from the University of Wisconsin School of Veterinary Dr. Erika Doescher Medicine in 2003. While attending undergraduate at UW-Platteville, she was able to gain hands on experience at the Pioneer Farm and interned at Kentucky Equine Research assisting with nutritional physiology research. Both of these experiences helped deepen her interest in equine medicine and gave her a desire to work in practice on cattle and horses. She worked as an associate veterinarian at Corriente Veterinary Service in Plover from 2003 till 2010. There, she was able to work on a wide variety patients including equine, cattle, cervids, sheep, goats, alpacas and sometimes pot-bellied pigs. While working in private practice, Dr. Doescher gained interest in regulatory medicine by working with two district veterinarians with the cervid tuberculosis, Chronic Wasting Disease and Contagious Equine Metritis programs. While serving on the WVMA executive board, former Wisconsin State Veterinarian Dr. Robert Ehlenfeldt informed her when a position opened in southwestern Wisconsin. “The most memorable part of my ten years in practice is by far working with the wonderful clients and building friendship that lasts,” says Dr. Doescher. “It is an amazing part of practice to become a trusted and valued member of each client’s family or management team.” Though she enjoys the more consistent business hours of regulatory work, she has begun to miss the relationships made through private practice. “I do miss the client-animal interactions, so I am helping my former practice with emergency on weekends,” says Dr. Doescher. Through her regulatory work, Dr. Doescher has been able to meet and network with many practices and veterinarians.

“Like the WVMA, most of my regulatory work is done in the background trying to provide information to the private practitioners to keep them abreast of changes in rules, regulations or disease programs,” says Dr. Doescher. During her short time on the WVMA executive board, Dr. Doescher says her eyes were opened to how much goes on behind the scenes to help protect and enhance veterinary practice and licenses. Dr. Doescher says her favorite regulatory work is at World Dairy Expo where the Department of Animal Health (DAH) staff and UW School of Veterinary Medicine students check in over 2,500 head of cattle. “It is great exposure for the veterinary medical students and I enjoy talking with them about current classes, ideas and career goals,” says Dr. Doescher. For current students, she recommends they take advantage of all the learning opportunities available to them. “As veterinarians we are never done learning and that is what keep this profession exciting,” she says. “When I graduated from school I never thought I would work as a regulatory veterinarian so remember to keep your mind and options open. With veterinary medicine the job opportunities are numerous.” Dr. Doescher has talked with 4-H groups about veterinary medicine and is currently serving as a board member for a new equine assisted activities therapeutic facility. “The WVMA works tirelessly to promote, protect and enhance our profession. Even though I am not in private practice, I still feel my membership benefits me as a whole as a veterinarian,” says Dr. Doescher. n

He then explained how this has reduced the need for antimicrobials in food production systems, but also how antimicrobials are still needed and used judiciously for animal and public health. The three biggest concerns for the medical profession right now are campylobactor, salmonella and E. coli. Of these, salmonella is the only one antibiotics are used to treat, by using fluoroquinolones. Dr. Loomans indicated the relevance of drug resistant salmonella to sulfonamides is a not a huge human concern because they are not used to treat salmonella. “When you compare antibiotic use between animals and humans on a milligram to kilogram basis, humans might actually use more on an annual basis,” says Dr. Loomans.

He also stressed that the Federal Drug Administration (FDA) approval process is very vigorous. He then explained that even though the American Veterinary Medical Association opposes the Preservation of Antibiotics for Medical Treatment (PAMTA) of 2011, veterinarians acknowledge that there is a likely role for resistance to be transferred from food animals to humans. “As veterinarians we are trained to look at the areas of greatest risk and critical control points which includes both food supply and pathogens,” says Dr. Loomans. “The FDA is moving towards the reduction of antibiotic feed additives and is also progressing to Veterinary Directed Feeds (VDFs) classification/labeling/supervision for this class of antibiotic use.” The biggest message Dr. Loomans wanted to leave with the students is to know and be aware of their sources when researching any topic. n


Rare Veterinary Medical Books Arrive in Madison On November 4, the University of Wisconsin School of Veterinary Medicine received a collection of veterinary books, including a French veterinary text printed in 1551. This historical collection comes to Wisconsin as a result of the American Museum of Veterinary Medicine closing its doors in October 2012. The collection was driven to the School of Veterinary Medicine in an enclosed trailer and delivered to the University of Wisconsin Library System. The volumes will be divided between the rare book collection on campus, Steenbock Memorial Library and the School of Veterinary Medicine Library.

The WVMA has made changes to the classified ad fee structure beginning with new ads submitted for the May 2011 issue. All classified ads including veterinary relief ads will be published at the following rate: Members: First 30 words, $10. Every additional word after 30 is $1.50 per word.
