Educating the Public Chris Booth, DVM

As veterinarians we are always seeking ways to grow and improve our businesses. We put forth great efforts to provide better services and care for our patients and clients in hopes of maintaining or growing our client base. Sometimes we also need to step outside of our practice doors into the community to help build our businesses. During the past couple days, the doctors of our veterinary practice have been involved in an annual event at a client’s dairy farm called “Classroom on the Farm”. The farm hosts over 1,000 urban students, their teachers and some parents who come to visit and learn about agriculture. There are eight educational stations including our stop that focuses on veterinary medical care. We have a unique opportunity to share our story of working as veterinarians where we make comparisons to the children’s visits with their doctor and other daily activities they encounter. We also answer a wide array of questions about animals and try to make it a fun experience for everyone. This event is just one example of a way to become involved in your community. I encourage you and your business to seek out opportunities to help enrich the lives of others. Ideas might include working with the wide array of youth groups such as 4-H, FFA, Boy and Girl Scouts or the YMCA. You can also try something new and participate in a local parade, join in the fun of a county fair, or share your knowledge at a health fair. If you find yourself short on time, try things such as creating a scholarship program for students seeking careers in veterinary

medicine, sponsoring youth athletic teams or writing an educational column in your local newspaper. All of these activities serve an important role in promoting the care and well-being of animals and their owners through our community involvement. These events require preparation, commitment, time away from our normal daily practice duties and financial resources, but they are an important part of what we can do to serve others. Involvement in your local community activities can help provide several great positive benefits. First of all, you can help provide valuable educational resources for both current and future animal owners. Community involvement also helps promote a positive image for your business and staff members. When people see you living by example and giving to others, it builds credibility with current and potential clients. New relationships can also be forged with other community leaders and businesses that may create other future opportunities. Veterinarians are one of the most respected professions by the general public. We can help maintain and grow that image in the future by providing great service inside and outside of our practice doors! “Service is the essence of greatness. I discovered that the hardest thing about my planned turnaround project was my own fortitude.” I am sure I am not alone when I use the example of going to a great conference, reading a great book or having an invigorating staff meeting. You get excited about the changes you are going to make in the office or at home. Then “fires” creep up and the day-to-day hustle and bustle get in the way of the changes you are excited about making. How do you implement structural or procedural changes? Every day is another day to push progress forward. Leaders lead from the front and by example. Amid the fires we all put out each day, there is an opportunity to plant the seeds of change. It is easy to make excuses on why those changes don’t get made. Not enough time, your staff isn’t supporting the changes or countless other examples. Putting all of those aside, ask yourself “Do I have the fortitude to make the changes happen?” Planting the seeds and turning the ship around starts with you. n

I recently started reading the book “Turn the Ship Around!” by L. David Marquet. It is a book of leadership and change. Just a few pages into the book, page 17, there were two sentences that stuck with me. These sentences forced me to think differently about the challenge of implementing and sustaining changes at work, at home and with the volunteer groups I work with.

Pre-Purchase Exams: Who Controls The Records? Gregory E. Scallon, Esq., DeWitt Ross & Stevens, S.C.

It seems that whenever two or more equine practitioners gather, at some point the conversation turns to the topic of whether pre-purchase exam records can be (or must be) shared with the owner and/or a third party (such as another prospective buyer). One of my partners, Megan Senatori, spoke at a county veterinary medicine association meeting recently, and this was a question that arose. Assuming that this issue may also confront practitioners in other areas of practice, we thought it a good topic to address to the general WVMA membership. Unfortunately, after fairly extensive review of the law and background information, there isn’t a clear answer with respect to pre-purchase exam records. However, we do have recommendations for a “best practice” that we believe works well. The issue regarding ownership and use of the records from the prepurchase exam typically arises when the prospective purchaser decides not to purchase the animal. Questions then arise because the veterinarian is contacted (i) by the owner of the animal who requests the records from the exam, or (ii) by a subsequent potential purchaser who wants to review the records from the earlier pre-purchase exam. The law governing access to animal patient health care records, which appears at section 453.075 of the Wisconsin Statutes, states that the owner of the animal, and anyone with written authorization from the owner, may receive copies of the animal’s health care records. We note that there may be preliminary questions of whether the record created from a pre-purchase exam qualifies as an “animal patient’s health care record”, and whether doing a pre-purchase exam, and nothing further, creates a “veterinarian-client-patient relationship”.

The definition of a “patient” at Wis. Stat. sec. 453.02(4s) and Wis. Admin Code sec. VE 1.02(7), includes an animal that is “examined” by a veterinarian, and, therefore, the subject of a pre-purchase exam seems to be a “patient”. However, the definition of a “client”, at section 453.02(3) of the Wisconsin statutes, and Admin. Code sec. VE 1.02(3), is the owner or other person who has primary responsibility for the care of a patient. This does not seem to include a prospective purchaser. Further, the veterinarian-client-patient relationship, described at section 453.02(8) of the Wisconsin statutes, is based on the concept that the veterinarian is engaged in diagnosis and treatment of the animal. Again, this is not the case with a pre-purchase exam. While these questions exist, and clarification would be good, until that occurs, we recommend that practitioners assume that in the absence of clear documentation to the contrary, pre-purchase exam records should be treated as animal patient health care records. We recommend that veterinarians eliminate the uncertainty and potential liability arising from the handling of pre-purchase exam records by the use a contractual agreement with each of the parties involved as to how the records will be handled. A written agreement with the owner should state (i) the owner’s consent that the veterinarian examine the animal, (ii) the owner’s consent that records from the examination be shared with the party requesting the examination (and, if appropriate, that the owner releases any right to >>> Continued on Page 6

have access to the records) and (iii) a statement that the examination does not create a veterinarian – client – patient relationship.

If the purchase does not close and the veterinarian is approached by a subsequent potential purchaser, the same procedure should be repeated.

The written agreement with the prospective purchaser, your client, should state (i) the nature, scope and cost of the examination, and (ii) an acknowledgment that the potential purchaser will receive a written report but will not have any further rights to the work product produced during the examination, including x-rays, unless the person acquires the animal, nor the right to control future use of that work, and (iii) a statement that the examination does not create a veterinarian – client – patient relationship.

In the absence of any definitive guidance from the statutes or administrative code, it is our recommendation that a veterinarian minimize the likelihood of any disagreement with the prospective purchaser and with the animal owner, and thus minimize liability concerns, by utilizing agreements as described above with both the animal owner and with the client requesting the pre-purchase examination. n

Tom Filla Dr. Tom Filla attended the University of Wisconsin-River Falls and received his doctorate of veterinary medicine from the University of Minnesota College of Veterinary Medicine in 1985. “My ambition was to be a dairy farmer,” says Dr. Filla. “But the local veterinarian and agriculture teacher convinced me to enroll in the pre-veterinary medicine program at UW – River Falls.” Dr. Filla’s first position was as a mixed animal veterinarian at Bangor Veterinary Service, he became a partner in 1988 and purchased the practice in 1994. Since beginning his veterinary medical career, Dr. Filla has evolved to practicing only bovine medicine, working with 100 herds in a five county area in western Wisconsin. To help both his clients and himself, Dr. Filla earned a Certificate Degree in Dairy Herd Management in 2000 from the University of Wisconsin Dairy Herd Management Certificate Program and completed the Food ArmorTM WVMA HACCP for Proper Drug Use Program in 2012. “Animal welfare issues and proper drug use are hot topics right now, and are great opportunities for dairy veterinarians to further develop their relationships with clients,” he says. Dr. Filla also enjoys being active within the Coulee Region Veterinary Medical Association, where he has served as president and secretary.

For current veterinary medical students, Dr. Filla recommends volunteering at different types of practices and to learn more about the profession. “There are so many opportunities with a doctor of veterinary medicine degree, don’t be afraid to see what is out there,” he says. For veterinarians looking to become a clinic owner, Dr. Filla recommends finding a practice that shares your philosophy and is in the area you wish to live. “Realize you’re committed to your practice and your partners,” he says. “But don’t forget about your family, they will also be involved if you are a business owner.” Dr. Filla credits his business to allowing him to earn a reputation in areas outside of veterinary medicine. Within his local community, he has served on a bank board for 13 years, was involved in local government and is very active in local groups, especially Lions Club and his church. The rural practice setting has also allowed Dr. Filla and his wife to enjoy hobbies such as farming, hunting, hiking and traveling internationally. n

Meet Jereremy Panizza, WVMA Marketing and Development Manager My youth was spent mostly by running around the city of Wauwatosa playing as many sports as I could. Most summers were taken by golf and baseball as well as the Wisconsin State Fair, where I worked in exhibitor services and later interned in the Public Relations Department. I started college at Cardinal Stritch University, where I studied communication and played baseball. I then transferred and finished my college career at the University of Wisconsin-Green Bay. I achieved a Bachelor of Arts in Communication and Minors in Corporate and Graphic Communication. I most recently worked for Gannett Wisconsin Media. I am extremely excited to work for the Wisconsin Veterinary Medical Association and to get more involved in the community! When I’m not at the office, I enjoy outdoor activities with my wife, Erin, and our dog, Zoe. We are proud to say that Zoe completed a 5K walk. She may only be a 5 pound Morkie, but her will and stamina are incredible. I love to play any sports, but golf, baseball and basketball are my favorites to play. Now that spring is here and summer is on its way, I also spend time watching the Brewers and Cardinals. When the leaves start to fall my sports allegiance belongs to the Packers and the Badgers. I love to read, exercise and spend as much time with my wife and family as I can. I am excited to be a part of the WVMA journey and to share each step with you! n

WVMA Blue Coat Ceremony Held On April 13, students of the University of Wisconsin School of Veterinary Medicine class of 2015 participated in the WVMA Blue Coat Ceremony held at Union South Varsity Hall. During the ceremony, third-year students are presented with their “blue coats” signifying the end of classes and beginning of clinics. Family and friends of the students attended the event which included special presentations from Dr. Chris Booth, WVMA President; Dr. Mark Markel, Dean of the School of Veterinary Medicine; Dr. Sheila McGuirk and Dr. Eric Sandgren, School of Veterinary Medicine, and photograph presentation by Dr. Linda Sullivan, School of Veterinary Medicine. Students Jennifer Resch, Kolby McIntyre and Margaret Koosmann gave a speech in appreciation of Morrie Waud, an honorary class member. “The WVMA Blue Coat Ceremony is an event where veterinary medical students look forward to starting their fourth year,” says Matt Slentz, WVMA student member. “Receiving coats for clinical rotation makes
