At the January Veterinary Examining Board (VEB) meeting, the VEB clarified two questions regarding patient records that have been the subject of confusion. The first question was whether a veterinarian/veterinary clinic is required to turn over their monthly rabies vaccinations records to a municipality if those records are requested. The answer can be found on page 3 of this newsletter. It is verbatim the letter issued by the VEB. Feel free to make copies of this document to share with your municipalities.
I encourage all members to evaluate how your clinic is currently handling both requests and adjust accordingly.

Our winter weather has run the gamut this year. The warm thaw and rain that followed the super cold has created ice everywhere. Great care is needed to navigate our precarious environment safely. Yesterday, our 20 year-old Quarter Horse gelding, Joe, wandered out and found himself stuck in the middle of slick ice. So there he stood, in what seemed to be deep equine contemplation, trying to sort out what to do. Only after a long pause did he creep away with baby steps to better footing. In veterinary medicine, segments of our profession, can sometimes find themselves in challenging situations. Luckily though, we don’t have to solve the problems alone like Joe did. We have organized ourselves to work collectively for the good of our profession and society. Unintended consequences that arise at the intersections of human endeavor must be resolved in a positive and constructive manner. Organized veterinary medicine, the AVMA and state VMA’s, are our voice in these efforts. The AVMA meets regularly to discuss important and timely issues. One of those meetings is the Veterinary Leadership Conference (VLC) held every year in early January in Chicago. The VLC includes AVMA governance meetings and CE training focused on leadership and development. The WVMA sends a delegation to this event every year. Our delegation includes our executive director, AVMA delegate and alternate, president-elect, president and two young emerging leaders. As such, this was my second year attending. Our President-Elect, Dr. Alan Holter and I attended an orientation on the governance of the AVMA with our Emerging Leaders, DeAnna Kosanovich a second-year student at UW School of Veterinary Medicine and Dr. Rheba Zimmerman a 2016 graduate of the University of Wisconsin School of Veterinary Medicine.
Both of these young ladies are/were non-traditional veterinary students. They both had significantly varied life experiences prior to admittance to veterinary school. Their perspectives, passions and willingness to be involved in organized veterinary medicine are impressive. Workshops for personal and leadership development and improving one’s communication skills were provided later during the conference. Current issues like telemedicine and student debt were also addressed. I found meeting with the state veterinary medical association’s delegations from our district (Illinois and Indiana) as well as the official business of the AVMA to be enlightening and gave me a better understanding and awareness of the many different issues facing our broad profession. And then there were the chance engagements with other attendees between sessions or during meals that were so engaging. My world of rural large animal practice is removed from so many of the issues facing small animal practice. I am grateful that our profession works collectively through the AVMA and the WVMA to be the voice of veterinary medicine in society. I greatly encourage anyone who has a passion for moving our profession forward to contact the WVMA about details of how to become involved. As for Joe, I can only hope that he has gained some wisdom from his experience that will prevent him from getting into such a predicament again. l

VEB Clarifies Records Questions

DATE: January 3, 2018 TO: Veterinary Examining Board (VEB) FROM: Cheryl Furstace Daniels, Board Counsel SUBJECT: Requests by municipalities for veterinary rabies vaccination records The Wisconsin Veterinary Medical Association (WVMA) has requested guidance from the VEB on an increase in local municipalities requiring veterinarians in their jurisdiction to forward copies of rabies vaccination records on a monthly basis. After discussing this issue with Dr. Yvonne Bellay in the Wisconsin Department of Agriculture, Trade and Consumer Protection (“DATCP”) Division of Animal Health (“DAH”), municipalities appear to have the statutory and rule authority to impose this requirement, but shall do so in accordance with the statute and rule requirements. By the terms of Wis. Admin. Code§ VE 7.06(26), unprofessional conduct by a veterinarian includes the failure to provide copies of or information from veterinary records, with or without the client’s consent, to the board or to public health, animal health, animal welfare, wildlife or agriculture authorities, employed by federal, state, or local governmental agencies who have a legal or regulatory interest in the contents of said records for the protection of animal or public health. The question posed by the WVMA is whether the requirement to forward copies of rabies vaccination records on a monthly basis is within the legal or regulatory interest of a municipality of its rabies control program, such that a veterinarian is required by the VEB’s professional conduct rules to comply with the requirement. Pursuant to Wis. Stat. § 95.21(9) (a), a county, city, village or town may impose a rabies control program with more restrictive provisions than those specified in Wis. Stat.§ 95.21. However, paragraph (b) of that subsection requires DATCP, through the DAH, to approve the program and have promulgated rules establishing the criteria for program approval. Wis. Admin. Code ch. ATCP 13 governs local rabies control programs. Pursuant to Wis. Admin. Code§ ATCP 13.02(2), DATCP shall approve the municipality’s rabies control program plan, including the provisions for its enforcement program. This would include any requirement for a veterinarian to monthly forward copies of rabies vaccination records. Dr. Bellay indicated that DATCP would have no problem with such a requirement, in approving the plan, but expects all requirements to be in the plan so it is clear how enforcement will be conducted. In addition, pursuant to Wis. Admin. Code§ ATCP 13.02(1), all requirements for a rabies control program shall be adopted by the municipality in an ordinance, following approval by DATCP. Therefore, in order to have such a requirement, that a veterinarian shall meet in order to not be in violation of Wis. Admin. Code§ VE 7.06(26), a municipality needs the following: A) Approval by the Department for this requirement to be in either its initial rabies control plan, or as an amendment to the rabies control plan; and B) Passage by the municipal governing body of an initial or amended ordinance that includes this requirement. l

AVMA Takes Steps to Address Antimicrobial Resistance The definition and core principles were developed by the AVMA’s Committee on Antimicrobials, which comprises individuals representing a diverse array of veterinary organizational, species, and practice interests. The policy was subsequently reviewed and approved by the AVMA’s House of Delegates, which includes representation from all 50 states, the nation’s territories, and the AVMA’s allied veterinary associations. Antimicrobial Stewardship for Veterinarians Defined Antimicrobial stewardship refers to the actions veterinarians take individually and as a profession to preserve the effectiveness and availability of antimicrobial drugs through conscientious oversight and responsible medical decision-making while safeguarding animal, public and environmental health. Core Principles of Antimicrobial Stewardship in Veterinary Medicine Antimicrobial stewardship involves maintaining animal health and welfare by implementing a variety of preventive and management strategies to prevent common diseases; using an evidence-based approach in making decisions to use antimicrobial drugs; and then using antimicrobials judiciously, sparingly and with continual evaluation of the outcomes of therapy, respecting the client’s available resources. The following principles can be used to develop antimicrobial stewardship plans in any veterinary practice setting. 1. Commit to stewardship • Engage all practice members and relevant stakeholders in the stewardship effort. • Develop stewardship plans that incorporate dedication to and accountability for disease prevention and that also optimize the prescribing, administration and oversight of antimicrobial drugs. • Identify high-priority conditions that are commonly treated with antimicrobial drugs on which to focus stewardship efforts. • Demonstrate commitment to systematically assessing the outcomes of antimicrobial drug therapy. • Identify one or more individuals to lead the stewardship plan and provide accountability. 2. Advocate for a system of care to prevent common diseases • Identify barriers to improving disease prevention. • Work with clients to adopt preventive and management strategies to minimize the need for antimicrobial drugs. These strategies include animal husbandry and hygiene, biosecurity and infection control, nutrition and vaccination programs. • Consider alternatives to antimicrobial drugs.

3. Select and use antimicrobial drugs judiciously • Identify barriers to appropriate antimicrobial prescribing and usage. • Use an evidence-based approach for making a diagnosis and determining whether an antimicrobial drug is indicated. • Make an informed selection of an appropriate antimicrobial drug and regimen. • Refer to relevant veterinary medical guidelines for judicious therapeutic use. • Assess outcomes of antimicrobial use. 4. Evaluate antimicrobial drug use practices • Encourage development of a program for the evaluation of antimicrobial drug prescribing at the veterinary-practice or aggregated levels. • Ensure that feedback is provided to veterinarians. • Support analyzing and sharing of antimicrobial drug use data while preserving veterinarian-client confidentiality. • Engage clients to identify barriers to implementation of stewardship programs and to evaluate antimicrobial storage, administration and other use practices. 5. Educate and build expertise • Make resources available and encourage the development of expertise in antimicrobial stewardship. • Keep up-to-date on strategies for disease prevention, use of antimicrobial alternatives and selecting and using antimicrobial drugs. • Critically appraise and then implement appropriate existing clinical guidelines for antimicrobial use. • Provide client education on antimicrobial stewardship, including conditions when antimicrobial drugs are not needed. • Support research on antimicrobial drug use and resistance. Using These Principles, Veterinarians Are Urged to TAKE ACTION. Implement one or more principles of antimicrobial stewardship to improve disease prevention strategies and antimicrobial drug prescribing, assess the outcomes and modify plans as needed. l

Best Practices for Avoiding Liability For Veterinary Student Injuries By Megan A. Senatori and Wes Webendorfer, DeWitt, Ross & Stevens, s.c. Dear Legal Briefs: I am a veterinarian who enthusiastically supports having veterinary students work with me in my practice. Well, until now. I recently heard of a court case that resulted in a $4.2 million jury verdict for injuries to a vet student who was working with a veterinarian. I’ll be honest. I’m spooked. Does my love of educational opportunities for veterinary students need to take a back seat to protecting myself? Sincerely, Concerned Veterinarian Dear Concerned Veterinarian, You are not alone. You are not the first veterinarian who heard of this case and raised the issue to our attention. Allow us to explain what we understand transpired in that case, draw some lessons from it, and make some recommendations for best practices for working with veterinary students in your practice (which we, too, enthusiastically support).

The veterinarian in the Howell County case was neither directly supervising the veterinary student, nor personally present on the premises where the services were provided. It is not surprising on those facts that a jury found the veterinarian bore some responsibility for the student’s injuries. In sum, the Howell County case should not spook you from having students work with you if you are doing that which you are legally obligated to do already.
That said, there are steps veterinarians can take to protect themselves against the risk of a lawsuit resulting from an injury to a veterinary student. The practice of veterinary medicine is a dangerous job. Veterinarians (and students) assume certain risks when they decide to enter the profession – being kicked by a horse; being knocked down by a cow; being bitten by a patient. In the end, and while cases like the Howell County case can certainly occur, there are far more instances of veterinary students having fantastic experiences learning from veterinarians who take the time to educate them and follow Wisconsin regulations in the course of doing so. So, please do not be scared off! l
So, what are the lessons to be drawn from a case like this? The first is an obvious one. When a veterinarian agrees to allow a veterinary student to work with him or her, the veterinarian undertakes an obligation to be present. Simple right?

Case Study: Jessica Wodohodsky v. Jerry Hall, David Hall, and David Gourley By Leslie Ptak, Department of Labor/OSHA compliance assistance specialist This case study was brought to the attention of the OSHA alliance committee, and it is an excellent example of the challenges that large animal veterinarians face in keeping their workers and themselves safe. In this case, what is the best way to address the hazard of working with large, young, strong, animals undergoing a new experience that is administered by a stranger? Could this injury have been prevented? From an OSHA enforcement standpoint, what are large animal veterinarians required to do for their workers?

What are OSHA’s expectations? If you look in a book of OSHA regulations you will not find any that specifically address veterinary medicine. The agency does have general standards that apply to this scenario. For instance, the hazard communication standard applies to the vaccines that were administered, and the agency’s personal protective equipment standard addresses any PPE the worker may need to wear. However, there is no standard for addressing the handling of animals. This is not unusual. OSHA regularly encounters workplace hazards the agency has not yet addressed with regulations.

The case study does not describe any safety programs that were in place by either the farmers or the veterinarian, and hindsight is 20/20, but recommendations to improve the safety efforts based on the facts presented in this article might have included the following: 1. Determine who is responsible for the workers. When the veterinarian ceded control of the vaccination process to the students, did he also cede control of their working conditions, including the safety and health aspects? It is hard to show visible leadership by management when it is not clear who the manager of the procedure happens to be. It can be dangerous to be in a risky environment and think that someone else will take care of you, when in reality you are considered to be responsible for yourself. Who did the farmers think were in charge of safety? If both the veterinarian and the farmers share responsibility, then they need to determine in advance of the work how the safety and health issues of the vaccination process are to be addressed. If the workers are genuinely in control, then they need to know they can stop or slow down the process when they feel uncertain. 2. Show visible and consistent concern for workplace safety. Employees need to know how to do their work, but they also need to know that the employer expects the work to be done safely. This message should be in writing, verbally communicated clearly and often. Workers should be encouraged to make suggestions to improve the safety aspects of the work. Workers should also have instructions for how to ask for help (e.g., phone calls, texts, etc.), and be supported when they do.
3. Have a set orientation and training for new workers that covers the technical aspects of the job, such as how to use vaccination equipment and squeeze chutes, as well as the employer’s SHMS policies. Make sure the workers understand both. 4. Determine the safest way to do the job. If squeeze chutes are the industry standard for vaccinating heifers, make sure the chutes are in good condition, used as the manufacturer intends, and the employee is proficient in using them before they are assigned to work on their own. It is valuable to have written procedures explaining how the squeeze chutes are to be used and for workers to have access to these procedures. Manufacturers’ recommendations carry great weight with OSHA. If the manufacturer states that the squeeze chute is designed for only one heifer at a time, then that is how the vaccinations should be done. If you are curious about how effective your practice’s safety and health efforts are, OSHA has a comprehensive website that addresses the development and implementation of SHMS. One excellent tool to determine if there are any gaps that need to be addressed is the Safety and Health Program Audit Tool. It is recommended that both management and employees complete the tool and then discuss their perceptions of how effectively safety and health issues are being addressed. Dr. Nate Haas Elected to WVMA Executive Board By Bailey Quam, WVMA communications and project specialist Dr. Nate Haas is a 2009 graduate of Iowa State University College of Veterinary Medicine. He has been a member of the WVMA since graduation. Immediately after graduation, Dr. Haas practiced food animal medicine at River Valley Veterinary Clinic in Plain and Reedsburg, Wis. After three years, he Dr. Nate returned to Iowa State University for Haas a residency in Clinical Microbiology. Upon completion he joined the faculty at Madison Area Technical College where he teaches courses in Pharmacology, Animal Disease and Large Animal Nursing to veterinary technician students. “My practice interests are in large animal, primarily dairy, although I do work with other food animal species and companion animals on a regular basis as an attending veterinarian at MATC,” he says. When asked what he believes is the most important issue facing veterinary medicine, he said “The exploding debt-to-salary imbalance for veterinarians is a primary threat to the future of veterinary medicine, especially in rural areas of the country.
Knowing the average new graduate carries a debt load of well over $100K, and in turn asking new veterinarians to dedicate a large percentage of their salaries for the first 10-20 years of their practice lives to pay off their college loan debt, is unsustainable to the future of our field and unsatisfactory to the quality of life for many capable veterinarians.“ In 2015, Dr. Haas was selected as the WVMA’s Emerging Leader and participated in the AVMA Veterinary Leadership Conference in Chicago. Currently, he serves on the WVMA Legislative Committee and WVMA/OHSA Alliance. For two years Dr. Haas served as a Veterinary Medical Officer (VMO) under the USDA National Animal Health Emergency Response Corps, which included a 3-week deployment to Minnesota in response to the Highly Pathogenic Avian Influenza outbreak in the summer of 2015. He has also contributed as an Ancillary Writer for several textbooks through the Elsevier publishing company. WVMA Member Spotlight – Dr. Eric Rooker By Bailey Quam, WVMA communications and project specialist
Dr. Eric Rooker is a 2013 graduate of the University of Wisconsin School of Veterinary Medicine. Since graduation, he has been practicing dairy medicine at Dairy Doctors Veterinary Services in Plymouth, Wis. From a young age, Dr. Rooker knew he wanted to be a dairy veterinarian. Dr. Eric Rooker
“These experiences continued to cultivate my interest in the dairy industry,” he says. While in veterinary school, Dr. Rooker was able to work under Dr. Garret Oetzel on a 4,000 cow research study involving ketosis and the oral calcium pill, Bovikalc. “This trial study really opened my eyes to all of the bovine medicine possibilities beyond reproductive technologies,” he says. “It is also responsible for my continued interest in general dairy practice today.” While he wasn’t active in the WVMA during veterinary school, Dr. Rooker credits fellow Dairy Doctors practitioner, Dr. Chris Booth for opening his eyes to the value of being a member. One of the most important lessons Dr. Rooker has learned as a WVMA member has been the importance of teaching and outreach to peers as well as students and sharing the lessons he has learned. “Far too often we lock-up a case or event in our head simply because of our personalities, fear or competitive nature,” says Dr. Rooker.

Find something that brings you extreme joy and that will continue to advance or intrigue you for many years to come.” Dr. Rooker also recommends that students find a proper work-life balance in order to prevent burn-out. “Enjoy your work day but go home to your family,” he says. “Put as much time and effort into maintaining those relationships as you do at being a good clinician.” Dr. Rooker also encourages student and practicing members to read “How Successful People Think” by John Maxwell as it has changed how he approaches day to day practice and his own personal life. He feels this book provides excellent insight on how to better yourself, provide better service to your clients and help members of your clinic team excel in the workplace. For his fellow WVMA members, Dr. Rooker has a challenge. “Think back and remember that “one case” or “experience” that stands out and pass it that onto another member or student,” he says. “Disseminate that knowledge and we will become stronger as a state wide veterinary body.” l

Social Media Presence and Engagement is a Must By Kelsey Stockstad, Botham, INK. Social media has become one of the most effective and engaging forms of marketing in today’s digital world and contrary to popular belief, digital connectivity in the social sphere is no longer limited to Millennials and their successors. All ages and all generations are tapping into social media on some level. If your practice has yet to build a social media presence, start now. Facebook is a great place to begin. It’s intuitive and widely followed by people of all ages. The agriculture community is active on Twitter, so that’s a great place to be if your clinic specializes in large-animal health. Instagram is easy to use and conveys thoughts and messages quickly through photos (a picture really is worth 1000 words). A little market research can go a long way. Ask customers about their social media preferences and plan accordingly. Mostly, don’t feel like you need a presence on every platform. Start with one, build a following and proceed as you become comfortable with the digital world. The benefits of a social media presence are in many ways, limitless. They include establishing and maintaining relationships with customers, building trust and brand loyalty, creating a dialogue for open engagement, and as an educational resource. Today’s consumers are looking to ‘people like them’ for help with decisions, especially regarding service-industry businesses. In many ways today’s social media is yesterday’s word-of-mouth referral network. Show a little personality in your posts. Social media engagement not only helps maintain professional relationships, it can also build a deeper and more personal relationship with customers. People crave humor and authenticity in the digital world just as in the personal world.

Your customers want to know the ‘real’ you. Post photos of your staff with fun or unexpected facts about each of them. Sharing the faces of your team will help build the trust that is so important in these relationships. Videos are another popular and growing tool for attracting followers and enhancing engagement. Don’t worry about the videos being spit-polished and shiny; raw footage shot from a smartphone can work well and again, underscores authenticity. Try posting videos of patients doing something silly or a veterinarian sharing resources, expertise or how-to information. As a rule, videos that are 90 seconds in length or less will gain the most social media traction and engagement; 30 seconds is ideal. For a social media presence to be effective, consistency is key, both in posting and responding. This is another crucial component in building and maintaining trust with customers. Applications like Hootsuite and MavSocial can be used to organize social media platforms, schedule posts and track and follow engagement. TweetDeck is another option that works well but is specific to Twitter and does not track other social media platform use. Approximately 81 percent of the US population, meaning the majority of your customers, use social media. They use it not only as a tool for connecting with friends, but to gain insight on brands and businesses, including your practice.
One great way to promote engagement, is to pose a question. Questions begin conversations and will demonstrate to customers that you are interested in their thoughts and feedback. There I was able to observe the committee-based process of governing an organization. When approached to join the two committees on which I currently serve, I was eager to get a feel for WVMA leadership and through this experience I became interested in serving the organization at a higher level.”

Determining proper limits is not an exact science for professional liability so work with someone who understands your profession and its inherent exposures. It requires an understanding of your tolerance for financial risk, industry recommendations and what carriers are willing to offer based upon their assessment of the likelihood they will experience a loss if they offer coverage to you. Lastly, consider what premium are you willing/able to pay. Too often consumers underestimate their exposure, their tolerance for financial risk and ignore their advisor’s recommendations, focusing on the premium charged, only to find themselves lacking enough coverage when an event occurs. In the Missouri case, I don’t know what limits the veterinarian had however, if he carried the typical limits of $1,000,000 per claim/$3,000,000 aggregate and his legal defense was outside the limits, I am estimating that at 24 percent assigned liability, he had a gap of $8000. I do not know what his defense costs were, so I cannot speak to whether there was an additional gap there.

House members voted overwhelmingly that current VCPR language should be maintained as it presently exists.

My New Year’s resolution is to help as many people as possible secure and protect their critical personal and business information. We’ll focus on three simple steps anyone can take to protect themselves and their business.
For limited personal use, I recommend a simple, secure and free product that can integrate right into Gmail called Virtru. The best part is it’s simple to install (you don’t have to be an IT expert) and it’s even easier to use.
#1 Use a Secure Password Manager Software
When dealing with more frequent sensitive communications or communications that require larger attachments for business, I recommend SecureMail. It’s an easy to use, inexpensive solution that will integrate into all the top email clients, while providing you the capacity and security you need.
The first thing I recommend doing is using a dedicated password manager software (app) that encrypts and protects your personal or business passwords in a simple to use, quick to access application. Many people simply store their passwords in Word or Excel files on their computers. Some take additional steps to password protect these files. Unfortunately, these are not good methods to protect your passwords as individuals with just a basic level of IT expertise can hack these files as they provide very limited protection from intrusion. For your personal passwords, there are many free password encryption programs that can more effectively handle this. Simply search the IOS or Android App stores. Make sure to choose a program that encrypts your data and requires fingerprint identification or 2-factor authentication to securely access your information. #2 Use Encryption Software when Sending Sensitive Information via Email. Maybe you plan to take out a loan with your bank, or you plan to join a new club, or talk to your attorney and you just need to send the other party some personal information digitally. Whenever you plan to do this, remember the following: When using a regular email client like Gmail, hotmail, Yahoo, AOL, Outlook and more, your information is not secure while it is being transferred (in transit) from your email client to the recipients. Your information is secure and encrypted while it is in your inbox, but it is not as soon as it leaves it. The quick and simple way to fix this is to integrate encryption software into your email client.
