2015 WVMA Annual Convention – 100 Years of Membership, a Future of Possibilities Mark your calendar for the 2015 WVMA Annual Convention – 100 Years of Membership, a Future of Possibilites – being held October 8-11 at the Alliant Energy Center in Madison, Wis. The convention will be held in conjunction with the Wisconsin Veterinary Technician Association and Wisconsin Veterinary Practice Managers Association conventions, and features an immense lineup of nationally acclaimed speakers and trade show vendors. Large animal tracks will include dairy rations, drug residue, swine, poultry, automatic calf feeders, dairy calf health and equine immunology. Cardiology, end-of-life care, nutrition, parasites and neurology will be featured in small animal tracks along with sessions and a wetlab on behavior. The WMVA is excited to announce Dr. Barabara Natterson-Horowitz as the keynote speaker. Dr. NatersonHorowitz the co-author of the bestselling book Zoobiquity, which presents a revelatory understanding of what animals can teach us about the human body and mind while redefining the boundaries of medicine. A personal and provocative speaker, Dr. Natterson-Horowitz’s lectures are filled with captivating case studies. Dr. Natterson-Horowitz is a cardiology professor at the David Geffen School of Medicine at UCLA and lectures on cardiovascular physiology, cardiovascular pharmacology, echocardiography, and bioengineering. She speaks about her concept of “Zoobiquity” to medical groups, educators, and students around the globe. n

Do You Feel the “Call to Action”? Dr. Jane Clark
In March the WVMA sent out a legislative update and “Call to Action” email to all members. The action needed was for you to contact your legislative representatives and let them know how you feel about three issues identified by the WVMA as a concern in the 2015-17 biennial budget bill: 1) The WVMA supports moving the Veterinary Examining Board to DATCP, 2) the UW-SVM asks for your support in limiting budget cuts and 3) the WVDL would like to remain within the University of Wisconsin system. If you would like to support any of these issues, how would you go about it?
Set up an appointment with your representative or the staff member who is handling the particular legislation you are interested in. Representatives work closely with their staff so don’t be afraid to work with staff members. They can be good allies for you. Face-to-face appointments are good for establishing long-term relationships. If you make a good impression, you may become a good source for them to contact when something comes up that might affect you. Legislators can’t know about everything that passes across their desk. They rely on informed professionals to help them out.
First, figure out who your local representatives are. While you can talk to anyone about a particular bill, your opinion will carry more weight if you are located in the legislator’s district. They may not give much weight to your opinion if you cannot vote them in or out of office. Legislators want to be re-elected and this will let them know that you are paying attention to the legislative decisions they are making.
If you prefer to send an email, that works too. It is best if the email is personally written by you and is not a copied mass produced document. While all opinions will be counted, those of individuals who responded personally will carry more weight.
Next, do some homework. Know the basics of the bill or legislation you want to address. Refer to it by its specific name and number if you can. Create and practice a 1-2 minute speech explaining what you would like to happen and why. You may be allowed more time for this, but you may not, so it is not a bad idea to write it all down in a single page document you can leave with your representative. Try to be logical and support your argument with data, facts and substance. Tell them how this legislation may affect you or your business. Think about who may be against this bill because they might ask you, then include why your position is the one they should support.
Whether you meet in person, send an email, or make a phone call, establish a personal relationship by telling your legislator about you. Be yourself. Don’t try to be something you are not, it doesn’t impress. Be reasonable, be courteous and thank them for their time. You can also ask them how they are going to vote on the legislation you are interested in. You have a right to know so don’t be afraid to ask. Above all, contact them before they vote on the issue! If you want to influence their vote, it’s best to make your arguments sooner than later. We hope you answer the “Call to Action” and register your opinion on these very important issues. n

The Treasurer provides oversight of all aspects of financial management within the Wisconsin Veterinary Medical Association (WVMA). This is a volunteer position. WVMA accounts include the WVMA operating account and investments, Political Action Committee account and Wisconsin Veterinary Medical Foundation account. Importation of Heartworm Positive Dogs into Wisconsin Yvonne Bellay, DVM, MS, Wisconsin Department of Agriculture, Trade and Consumer Protection Heartworm disease is a serious and potentially fatal disease in dogs which is much easier to prevent than to treat. Although heartworm disease can be found in all of the 50 states, it is particularly prevalent in states in the South and South East such as Texas, Florida, North Carolina and Georgia. The relocation of untreated dogs contributes to the spread of heartworm disease. In response to questions which have come up regarding bringing heartworm positive dogs into Wisconsin, please note that such movement is not permitted under Wisconsin law, Wis. Stat. s.95.19, which prohibits the import, sale or exhibition of an animal
that is infected with an infectious or contagious disease, unless specifically authorized to do so via a special permit issued by the State Veterinarian. Therefore, infected dogs may not be imported into Wisconsin until treatment for the disease is complete. This is a long-standing provision meant to protect animal health and welfare and ensure consumer protection, and is not a new requirement as has been suggested. Stop Reimbursing Employee Premiums for Individual Health Insurance Brian L. Anderson, DeWitt Ross & Stevens s.c.
Does your veterinary practice, in lieu of providing group health insurance coverage, pay (either directly or as reimbursements) the health insurance premiums for an individual policy in the name of any employee? If the answer is yes, then such payments must stop. Over the last two years, the IRS stated several times that, beginning January 1, 2014, such payments are considered a group health plan that violates the Affordable Care Act and that results in a penalty tax of $100 per day per benefited employee. If you were to make such payments for two employees for 365 days, therefore, you would incur a penalty in the amount of $73,000 (365 times 2 times $100). I wrote about this subject in the “Legal Briefs” column for February 2014. At that time, I wrote that such payments would be acceptable, if they were treated as taxable wages. The IRS has clarified that such payments cannot be made at all, even on an after-tax basis. You can pay your employees any amount you wish, including taxable amounts intended to cover the cost of health insurance, but such payments cannot be made contingent on their being used to purchase individual health insurance. In other words, employees must be able to pocket the amounts instead of using them to purchase health insurance. The most recent statement by the IRS on this subject was Notice 2015-17, issued in February 2015. In that notice, the IRS confirmed that an employer cannot reimburse employees, even in a taxable way, for the premiums paid for health insurance under individual policies covering the employees and/or their families. The only way for an employer to provide health insurance as a nontaxable employee benefit is through the purchase of a group health plan. Employers wishing to explore the cost of group health insurance should talk to their insurance agents, who are familiar with the group plans available in Wisconsin, including plans under the Small Business Health Options Program (SHOP) of the Affordable Care Act.

In the notice, the IRS stated it will not impose the penalty tax on small employers (under 50 employees) until after June 30, 2015. Therefore, small employers currently paying the health insurance premiums for individual coverage of their employees have a reprieve until that date. Keep in mind that the tax code has long allowed a self-employed individual to deduct (on line 29 of Form 1040) 100% of the premiums that he pays for his health insurance (as long as he is not eligible for coverage under an employer-subsidized health plan, such as through his spouse’s employer). For this purpose, individuals who own at least 2% of the shares of S corporations are treated as self-employed. Therefore, if your veterinary practice is (a) a sole proprietorship or partnership, (b) a limited liability company (LLC) treated as a sole proprietorship or partnership for tax purposes, or (c) an S corporation of which you own at least 2%, then you can deduct the premiums paid for your individual health insurance coverage. The IRS notice clarifies that the “no reimbursement” rule described above does not apply to S corporation shareholders. In other words, S corporations can continue to pay health insurance premiums for shareholders without incurring the penalty tax, but the premium amount continues to be reported as taxable wages on the shareholder’s Form W-2 and continues to be deductible on his Form 1040. In summary, to avoid the $100-per-day penalty, employers must stop reimbursing individual health insurance premiums, except in the limited case of premiums paid by S corporations for their shareholders. For further information, contact your tax advisor or health insurance agent. n

WVMA Classified Ad Guidelines Reviewed In recent months there has been some confusion on submitting classified ads with the WVMA and when ad will appear in the WVMA Voice and online. When placing an ad, please review the following guidelines: 1) Ads are due the first of the month but won’t appear in the WVMA Voice until the next months issue. The ad will be placed online for the same months it is published in the newsletter. Example: July ads are due June 1, but won’t be placed online until July 1. 2) To place an ad online prior to the designated month will cost an additional $25. Anna Hausmann, Class of 2017 1) What was your biggest take-away?
Learning about the diverse range of opportunities veterinarians have in government and policy was my biggest take-away from the Fly-in. I never knew all of the ways veterinarians could get involved in governmental work, such as being a staffer for a congressperson. 2) How did this trip impact your view on the veterinarian’s role in the legislative process?
This trip greatly impacted my view of veterinarians in the legislative process. The experience highlighted the importance of veterinarians taking the initiative to speak with their representatives on issues that affect the profession. Most lawmakers do not have a strong veterinary knowledge and it is the job of veterinarians to educate lawmakers so they can draft and pass legislation that advances the veterinary medical profession. 3) After attending, what would be your advice be to students and veterinarians questioning the impact an individual can make?

I honestly was skeptical about how receptive the congressional people would be to hearing from us, but I was received warmly by each office I spoke with. The opinions of constituents are important to the legislators because these are the voters who have the power to keep them in office. The veterinary profession is well respected in Washington, adding to the power of veterinarian’s voices when we speak as one. One of the senators we spoke with endorsed the Veterinary Medicine Loan Repayment Program Enhancement Act the day after we spoke with his staff person. A real impact can and is made when you make your voice heard. Speaking up and educating others is essential for the veterinary profession to continue forward into its future. 4) How important is the power of organized veterinary medicine, on the state and national level, when dealing with policy and legislation impacting veterinarians and small business?
Organized veterinary medicine is essential for dealing with policies impacting veterinarians and small businesses. Without people representing veterinarians on the hill there might be legislation passed that negatively impact the nation’s veterinarians. It is vital to educate lawmakers about veterinary issues and how legislation will affect veterinarians (either positively or negatively).

My biggest take-away was that even though we are not the largest profession, collectively we can still have an impact at the national level. We must be involved with policy or else people who we do not want making veterinary medical decisions may be negatively impacting our profession and deciding how we are permitted to serve our patients and our clients. 2) How did this trip impact your view on the veterinarian’s role in the legislative process?
This trip further cemented for me that even though many veterinarians would like to stay as far away from politics as possible, we simply cannot afford to do so. Fortunately, many of the issues for veterinarians are bipartisan and should allow us to group together as one voice. People from the entire political spectrum have animals and love their animals as pets, or care for their animals as their livelihood depends on healthy animals. Veterinarians have a unique background, are very knowledgeable and deserve a place at the table. We must vote, be active constituents, and relay the proper scientific and business facts to those making decisions.

3) After attending, what would be your advice be to students and veterinarians questioning the impact an individual can make?
As with everything, in the mass of things your ‘one vote’ may not change the election, but if everyone felt that way.... where would we be? Every individual is important and we can all make a difference; especially when we band together and work on common issues. Individually we can lead our businesses, our nonprofit groups, our lab groups, or mentor other students. On a policy level, the more individuals that get involved and contact policy makers- the bigger impact and the bigger deal that issue will become and we will be more likely to find a working solution for our profession and those we serve. 4) How important is the power of organized veterinary medicine, on the state and national level, when dealing with policy and legislation impacting veterinarians and small business?
Organized veterinary medicine is likely the most important tool in dealing with policy and legislation impacting veterinarians and small businesses. Veterinarians and veterinary medical students are some of the busiest people around, we simply do not have the time to fulfill all of our obligations and also keep up with all the happenings at state and federal government. We need an organization to keep an eye on things for us, and for a place for us to meet, discuss, and collectively take action on important issues as they come up. If we don’t, who will?

My biggest take-away from the experience was that veterinarians can play an invaluable role in many parts of the legislative process, and that we have acquired skills through our training that make us particularly adept at speaking with and working alongside policymakers. In particular, we are talented communicators, we are excellent synthesizers of information, and we have a wide breadth of knowledge both in and beyond our field. 2) How did this trip impact your view on the veterinarian’s role in the legislative process?
This trip expanded my view of how veterinarians can participate in the legislative process. Though I was already aware that we could serve as advocates of our profession, I learned that veterinarians work in numerous roles in Washington D.C., including as lobbyists, as congressional staff, and as members of Congress. We currently have three veterinarians serving as Congressmen! I also learned about the roles that veterinarians can serve under the Executive Branch -- not only by working for the USDA or FDA, but also for the State Department, Defense Department, and even CIA.

It is important to recognize that any individual can contact a Legislator’s office and set up a meeting, either with them or with a member of their staff. We as individuals absolutely have the power to make a difference, whether it is by meeting in person with our members of Congress, writing personalized letters explaining why we support or oppose a particular piece of legislation, or by signing petitions concerning legislation that would affect us and our profession. The more individuals choose to take action, the more likely a change will occur. There are many ways to truly make an impact as an individual, so choose the way that feels most comfortable and meaningful to you. 4) How important is the power of organized veterinary medicine, on the state and national level, when dealing with policy and legislation impacting veterinarians and small business?
With an industry as small as veterinary medicine, it is vital to have an organized voice when speaking to policymakers. Organized groups on the state and national level forge relationships with policymakers and serve as the primary liaisons between the veterinary profession and the political realm. They can prioritize issues, stay abreast of what happens in Congress at all times, and coordinate veterinarians to reach out to our Legislators at key times. Presenting a unified front, when possible, to our Legislators can lend a lot of credibility and power to our message. n
