NO SURVEY? Big Risk!
We often get the question, “Do I have to get a survey when buying real estate?” If you are buying the property through a lender, they will require one. But if you are purchasing with cash, you don’t have to get one—BUT YOU SHOULD!
there is a mistake with a pre-existing survey that you didn’t buy, the survey company owes you nothing because their obligation was to the person who purchased the survey, not you.
A survey is one of the single most important documents a homeowner can have — period. You want to know exactly what you are buying. Things like:
Buyers often think they don’t need to worry about it because any of these mistakes would be covered by the title insurance. But title insurance does not replace a survey. It may compensate you for a mistake, but it will not give you a driveway you thought you had or move fence lines. What if it turns out that the driveway you thought you owned is actually a public easement upon which you have no right to park? The value of the property could be severely decreased, and you would be stuck with a home with no driveway. The amount you pay for a survey pails in comparison to the financial toll the lack of one could cost you. Your safest bet is to always protect your investment by having the property surveyed before you buy.
• Where are the boundaries & easements? • Is your neighbor’s fence, outbuilding, garden, or driveway on your land? • Does the home you are buying have a driveway, fence, or building encroaching onto your neighbor’s property? • Is the property violating any deed restrictions? If you don’t have a survey done, you won’t know the answers to these questions! Lenders will usually allow a pre-existing survey to be used in lieu of requiring a new one if the seller signs an affidavit that says no changes have been made to the property. There is still a risk involved in this situation because it does not ask if the neighbors have added any fences or structures that may inadvertently affect the property. And if it turns out
