The Abbotsford man charged in connection with a car crash that resulted in the death of pregnant pedestrian Laurel Wilson and her father Ralph Jewell in March 2010 was sentenced yesterday to a lifetime driving prohibition and a $2,000 fine. In a sentencing hearing attended by about 20 members of the Wilson and Jewell families, Shaun James Cochrane, 25, pleaded guilty to driving with undue care and attention, an offence under the Motor Vehicle Act. He was driving a 1998 Ford F-150 pickup south on Ware Street on March 13, 2010, on his way to meet his dad to pick up a new barbecue and go for coffee. Cochrane ran a red light and collided with a Honda Prelude headed east on South Fraser Way. The crash spun the Prelude in a counterclockwise direction and into a pedestrian island where Laurel, seven months pregnant; her husband Kevin; and Ralph were waiting to cross. Continued on A5

Heat president resigns

The Abbotsford Heat are in the market for a new top executive, after team president Tom Mauthe resigned late last week. Mauthe, a Vancouver resident, said the move was prompted by a desire to spend more time with his family. He plans to explore job opportunities closer to home. “It was a difficult decision for me,� he said. “The demands of working in pro hockey in Abbotsford, combined with the commute time, was making it SWEETING very challenging from a family and lifestyle standpoint. I made a decision to change that.� Lane Sweeting, a member of the Heat’s local ownership group, said in a press release that he was disappointed to see Mauthe go. “We want to thank Tom for his efforts and tremendous commitment to our organization during our start-up and the first two seasons,� Sweeting said. Mauthe’s resignation continues a theme of off-season transition within the Abbotsford hockey club’s front office. Dave Sheldon, the Heat’s director of communication and broadcast, and Jennifer Metcalf, the director of community relations, recently departed the organization to pursue other opportunities.

Heat president Tom Mauthe will look for a job closer to Vancouver. Sweeting said it’s business as usual for the team, and there’s no timeline to find a replacement for Mauthe, who has agreed to assist the Heat for the next few months during the transition period. Mauthe, a former front office employee with the Vancouver Canucks, was hired as the Heat’s first president in June 2009, and he charted the course for the franchise over its two AHL seasons. Reflecting on his tenure, Mauthe said he relished the rare opportunity to work on the start-up of a pro sports franchise. He also said the Heat operate in a “unique environment� due to the public scrutiny which comes from the hockey team’s supply fee agreement with Global Spectrum, the company that operates the Abbotsford

Entertainment and Sports Centre. The Heat are two years into a 10-year deal that guarantees the team a break-even budget of up to $5.7 million annually. The City of Abbotsford covered a shortfall of $450,637 in 2009-10, and the estimated deficit for 2010-11 will be in the $1.2 million range. The Heat averaged 3,807 fans per game last season, 26th out of 30 AHL teams. “Those relationships were required to get the team here, but there are days where it makes it a challenging operating environment,� Mauthe said. “But if I were to look at building this sports franchise in isolation, looking at where we are today and where we plan to be tomorrow and the following years, I’m confident it is going to grow and it is going to be a success.�

Crash victim passes away The 20-year-old Mission driver involved in a collision with a Chilliwack RCMP cruiser last Tuesday in Agassiz passed away in hospital yesterday morning. Steve Genberg, a graduate of Mission Secondary and an employee of Mission Towing, had been in hospital in critical condition since the head-on collision between his Mustang and the marked cruiser. A 19-year-old passenger in Genberg’s car was seriously injured. An employee who answered the phone at Mission Towing said nobody was ready to speak about Genberg’s passing but said co-workers are “very distraught and need some time.� The Abbotsford Police Department’s major crime unit is investigating the crash, which

occurred on the Lougheed Highway near Bodnar Road. Genberg was reportedly leading a convoy of four or five vehicles en route to Harrison Hot Springs at about 11 p.m. He and his passenger were airlifted to hospital following the collision. The police officer was treated in hospital and released. “The Abbotsford Police Department extends its condolences to the friends and family of this young man from Mission,� said a press release from the APD, issued Monday morning. “The investigation into this tragic incident continues and our objective remains to conduct a thorough, comprehensive and complete examination of facts and evidence.�

The provincial government won’t soften its 10-monthold roadside administrative penalties for impaired driving, citing a 50-per-cent drop in drunk driving deaths since the rules took effect. Nor will it embark on a public information campaign previously pledged to help revelers decide how much they can drink before they might exceed the lower blood-alcohol limit of 0.05 if caught behind the wheel. “Half the number of people have died on the roads as a result of drunk driving based on the statistics we see,” Premier Christy Clark told reporters recently. Preliminary numbers show 30 deaths in alcohol-related

crashes in the first seven months of the new regulations, down from an average of 61 fatalities in the same October-toApril period of the previous five years. Police credit the new regulations – with the threat of stiff fines and car impoundments – for the improved driving safety record. Police can now impose an immediate penalty on any driver who blows in the “warn” range between 0.05 and 0.08. Instead of issuing a 24-hour suspension or a formal impaired charge, police can impose a 90-day driving ban, a $500 fine and impound the vehicle for 30 days, with the owner on the hook for the towing and storage charges. ised a review of the new rules late last year after the bar and restaurant industry complained of lost business because patrons were drinking less. He had indicated that might lead to an appeal period where drivers caught by police could lodge challenges before the penalties are applied. But no such legislation was tabled this spring. B.C. Restaurant and Food service Association president Ian Tostenson said his members now accept that the rules are here to stay. “When the theme of Families First came through from the premier, it was pretty obvious that no one in their right mind was going to say families are important – and by the way, we’re going to loosen up on

the impaired driving penalties,” he said. Business was down much more steeply in the immediate months after the change, he said. Now, he said, the worst-hit businesses are down perhaps 10 to 12 per cent from before the change, possibly as patrons understand the rules and make alternate arrangements for transportation. He said it’s also dif-

ficult to say how much of the losses stem not from the drunk driving penalties but from consumers’ reluctance to spend due to the sluggish economy or the imposition of the harmonized sales tax. “I think we just have to adapt and find ways to make it work,” Tostenson said. “We wish it hadn’t happened. But it’s here and let’s make the best of it.”

Attorney General Barry Penner is also counting on the policy change to help decongest B.C.’s crowded courts. The shift to policeimposed roadside penalties – dubbed by some defence lawyers as an effective decriminalization of impaired driving – means most of those incidents now no longer go into the court system. Penner previously

called it a side benefit of the change that should help cut the backlog in the criminal courts. While those punished under the administrative system and not the courts pay a high price up front, they avoid possible court sanctions, including a criminal record, a possible one-year Canada-wide driving ban as well as potential jail time.

Unacceptable delays It was easy to see first-hand the misery that is caused by B.C.’s backlogged court system, with two cases in Abbotsford last week. Black Press and the Abbotsford News chronicled the problems with the court system in a series titled “Justice Denied” earlier this year. They are illustrated this week in the case of Derek Hoare, whose nineyear-old autistic daughter Ayn was seized by the Ministry of Children and Family Development on June 16. On July 12 he finally got a court hearing on the matter, but only to state that he does not give consent for his daughter to be in ministry care. Later, he will get the opportunity to make his case to have her returned. The earliest opportunity will be September. So this grieving father, who has learned that his daughter cried for the first 18 days she missed him and is now in a foster home, is forced to wait at least three months before he

gets his day in court. Even then, the process is likely to drag on. It is outrageous for a government ministry to put a family through such heartache without being required to justify its reasons in a timely manner. The family of Laurel Wilson, who was seven months pregnant when she was struck by a car and killed; and of her father Ralph Jewell, who was killed in the same pedestrian accident; came to Abbotsford on Friday for the sentencing hearing for the man who caused the accident. Many of the family members took time off work for the hearing, and many travelled from the U.S., hoping to get the closure that a court verdict offers. Morning cases went longer than expected, and the hearing was put over until Monday. Such delays are routine, and even expected. Yet, despite demand for more courtrooms, judges and courthouse staff, Victoria has passed a budget that will require further cuts.

Other Hand The ‘X’ was made in the appropriate circle, the three envelopes stuffed and sealed, and today my vote on the HST hits the post office – governance by referendum. We like to call ourselves Hollywood North, but bringing in “initiatives” to determine the direction of government is a little too “California” for me, knowing where that state has gone on the economic front these days. Referenda, propositions and initiatives are all worthy pieces of a democracy, and on many fronts put more power into the hands of the people. They also result in emotional decisions that over the longterm can cripple the system and services we have come to expect and demand. The argument against referenda on most topics is that, every four years we hold the ultimate political referendum – an election. Don’t like what the bums did, toss ’em out; like their positions, return

them to office. While that seems to be the most acceptable, and fair, way to run things, the true reality is that it is the bureaucrats who make the decisions, and hold enduring power. Granted, most of those in high positions within government bureaucracy are highly skilled, understand the impact of their conclusions and recommendations, and operate fully within the mandate given them by our parliamentary system. And since there are so many, many things that happen on a daily basis it would be impossible for “our representatives”, our politicians, to have a hand in most of those rulings. In fact, often it is not even possible, save for an “emergency”, that politicians even get involved in decisions that can have lasting effect. Take, for example, the large mine that is proposed for the upper reaches of Sumas Mountain. Its lifespan is 100 years. Its development would eliminate, for a century, access to literally thousands of acres of soon-to-be-in-demand parkland in the heart of the Fraser Valley, which will be home for the majority of the million plus people expected to move to B.C. over the next 20 years. The only access/egress route for the new mine would be through the middle

of what is known on the mountain as Straiton Bowl. Abbotsford’s growth potential, its ability to house many of those million people due to arrive, is stopped by the Agricultural Land Reserve except on Sumas Mountain. It is the only area remaining that is, and will be, able to accommodate more homes, more people. And the mine would create an indus-

That would not be in the long-term best interest of Abbotsford, or the economic future of the province, period. That factor however, may not be taken into account by those within the bureaucracy who have the mandate to make decisions, which are often specific only to

the ministry in which they work. Their job is to ensure land dispositions meet certain criteria, or mine proposals meet standards specific to mining. The long-term cause and effect, especially if it is not strongly pointed out, may not be considered at all. And that would be a travesty, for the impact of anything that will effect people or a community for 100 years or more must be carefully and deliberately considered, and in this case rejected. Our future is at stake. Yes there are mines on this mountain. However, all are on private lands, and all of which will probably be long depleted and closed before this mountain’s residential potential is exploited. This new proposal is on crown land, so in essence we would be giving up what is “ours”, to severely impact “our” growth over the next century. In the best interest of future residents and the inevitable huge increase in population of our city in the only place possible for it to go, this is a decision that requires political intervention of the highest order. Because I can assure you, that if a referendum was held on this issue, the outcome would be a resounding “No”. markrushton@abbynews.com

letters Teens show they care

Approximately two weeks ago there was a small accident in front of our house. A woman was attempting to avoid young people at the side of the road and swerved into the side of an oncoming vehicle. These young people were riding their bikes and skateboards at the side of the road. There were no injuries sustained thankfully but it took about an hour to sort out the details and wait for the tow-truck. In this day and age, we often encounter rudeness and disrespect when dealing with teenagers. They are often given a bad rap. However, in my experience, I have met many wonderful teens and saw this again the day of the accident. These kids could have left, but they did not. They stayed right until the end of the cleanup. One young lad was directing traffic in a very narrow lane, while another boy stayed in the car with the woman until we could extricate her from her car. I was extremely impressed with their friendliness and help.

The cutbacks in clerks in the court registries will slow down the processing of estate files and criminal files. The delays in the court system are already too long. An efficient, court system is worth paying more for. Timothy Hordal

Mosquito Control Update from the Fraser Valley Regional District Rain and continuous high-water levels on the Fraser River have led to an unusually large number of mosquitoes this summer, creating a major annoyance for many of this region’s residents. To address the extreme mosquito levels, the Fraser Valley Regional District (FVRD) will be spending an additional $100,000 this summer on ramped-up control efforts.

Coroners hindered by budget cuts: Audit Budget cuts are hampering the B.C. Coroners Service’s ability to more broadly investigate deaths and find ways to prevent them, B.C. Auditor-General John Doyle has concluded. His audit found the service is meeting its basic duties but could do much more within the scope of the Coroners Act. “A declining budget, coupled with escalating investigation expenses, are negatively impacting the quality of service,” Doyle found. “This has the potential for more significant long-term repercussions.” The service’s budget was cut from $15 million to $13 million this year. Doyle also called on the province to clarify the coroners service’s role and then “step back to preserve the organization’s independence.” Autopsy and body transport fees have risen, but the budget has gone down, so the service has been forced to cut back on areas like training. The audit provides eight recommendations for bolstering the coroners service and its role.

The FVRD’s mosquito control contractor (Morrow Bioscience Ltd.) has been working non-stop since early May to reduce mosquitoes and will continue doing so for as long as necessary.

Efforts to combat mosquitoes are ongoing and include: x On-the-ground larvicide* treatment of mosquito development sites. x Wide-scale aerial (helicopter) larvicide* treatment of sites that are inaccessible by foot or boat. To date

the FVRD has treated over 1200 hectares spanning from Abbotsford to Hope. x Continuously seeking out, monitoring, GPS-mapping and treating of known and new mosquito

development sites. x The FVRD is also making every effort to respond to the hundreds of emails and phone calls received

daily from the public during this unusually busy mosquito season. Larvicide* is a bacterial pesticide that is used to kill mosquitoes while they are still in the larval stage. It specifically targets mosquito larvae, and as used, is otherwise harmless to the environment. Adulticide is a chemical pesticide used to kill adult mosquitoes. Adulticiding, commonly referred to as “fogging”, is not a practice that is currently used in BC, as it is not considered to be an effective method of control. The FVRD does not conduct adulticiding.

Whalers make waves Records fell at Centennial Pool on the weekend, as the Abbotsford Whalers swim club hosted its annual invitational meet. Nadia Berard led the way, setting a trio of meet records in the Division 7 girls category. Berard established new marks in the 100-metre breaststroke, 100m freestyle and 200m individual medley. The 200m IM record was a particularly impressive accomplishment for Berard, given that the previous mark had endured since 1985. Fallon Quast also took an eraser to the record books, setting a new standard in the Div. 2 girls 100m free. University of the Fraser Valley men’s basketball coach Barnaby Craddock wrapped up a productive recruiting period by signing a pair of veteran players from south of the border. Both players – 6’6” post Josh Monagle and 6’1” point guard James York – are former members of the Montana Tech basketball program (NAIA), both are heading into their fourth year of eligibility, and both fill major needs for the Cascades. Monagle adds depth in the post, which was an issue for UFV last season after starting big men Jasper Moedt and Kyle Grewal suffering season-ending knee injuries. With Monagle in the fold, and with

Moedt and Grewal set to return, the Cascades are in much better shape heading into the fall. Monagle led Montana Tech in scoring (16 points per game) and rebounding (7.4) in 200809, while shooting 59.6 per cent from the field. “Josh starts to give us that look we haven’t had here – that inside, back-to-the-basket presence,” Craddock said. With Zeon Gray, the Cascades’startingpoint the past two seasons, departing to pursue pro opportunities in Europe, York’s addition was also essential. He slipped away into the presence of the Lord on Wednesday, July 13, 2011 after a nine-month battle with pancreatic cancer. Henry was a graduate of Caronport High School and Briercrest Bible Institute, Caronport, Saskatchewan. He and his wife Lois served with Africa Inland Mission in Kenya and Uganda for 16 years. Much of his service involved mentoring pastors, maintenance and dorm parenting at Rift Valley Academy, and the building of two secondary schools in remote areas of Kenya.

Diane Truswell (Garry) Patricia Diane Truswell passed away peacefully on July 6, 2011, in Milwaukee, WI, after a long battle with Parkinson’s disease. Diane was born at Grace Hospital in Vancouver, B.C. on July 17, 1948. In Diane’s early years, the family moved around to several communities, including Kelowna, Langley and Lillooet and finally settled in Mission, B.C. She graduated from the Mission High School in June 1966. Diane went on to graduate from Vancouver Vocational Institute in Vancouver, B.C. and worked on the trading desk at Pemberton Securities and later ran the trading department for Pemberton Securities in Kelowna, B.C. In 1972, Diane met and married Byron “Bud” Truswell in Kelowna and they made their home in Wenatchee, WA, where they started a new mining business called Wenatchee Silica Products, Inc. Upon selling the business in 1984, Diane became an active partner in MT Investments and several other successful business ventures in Canada and the USA. Diane was very active in the community of Wenatchee; she was past President of Beta Sigma Phi and instrumental in starting a new chapter, past Secretary of the Inland Empire AAU for Swimming, past regional representative and coordinator for Weight Watchers in North Central Washington, past President of the 18 hole ladies’ club at the Wenatchee Golf and Country Club, past member of the Kelowna Golf and Country Club and the Lea Lea Golf Club in Kona, HI, and was also First Lady of the Wenatchee Applarians in 1993. Diane left Wenatchee in 1997, when she and Bud separated and she moved to Milwaukee, WI, where she is survived by her partner and best friend, Mary Kling. In Wisconsin, she was a founding member of the Badger Mutual Insurance/Brown Deer Women’s Amateur Golf Tournament, member of the New Berlin Hills Golf Club and Greenfield Golf Club. Diane had recently assumed the duty of President of the Metro Women’s Public Links Golf Association. Diane was a published novelist and poet, an accomplished painter and a creative cook. Diane was a world traveler, going to Western and Eastern Europe, Asia, South America, Russia, Australia and New Zealand. She was the devoted mother of Hallie (Greg Bradley) Truswell in Seattle, WA, Byron McRae Truswell in N. Vancouver, B.C. and Bradford (Summer) Truswell in Kirkland, WA; proud grandmother of Victoria, Madeline and Travis; loving daughter of Lucy and the late Russell Glen Garry; and dear sister of Laney, Bob and Donald Garry. She was loved by many and will be missed dearly. A Memorial Service will be held in Kelowna in August.

stages with various singers, demonstrations, audience participation, music workshops and collaborations between artists.
