Harvey Hans, 18, killed during fight in 2008 Abbotsford News

A man who went on trial for the second-degree murder of 18-year-old Harmin (Harvey) Hans of Abbotsford was found guilty Friday afternoon of the lesser charge of manslaughter. Sentencing for Amrit Gill, 23, has been delayed until Jan. 4 in B.C. Supreme Court in Chilliwack. Justice William Grist told the packed courtroom – mainly consisting of Hans’

family and friends – that the evidence did not conclusively prove that Gill was the man who fatally stabbed Hans in the neck on May 24, 2008. However, Grist found that Gill participated in the assault which led to Hans’ death. Gill’s co-accused, Shavinder (Shevy) Brar, previously pleaded guilty to manslaughter and was sentenced to five years in prison. At Brar’s sentencing hearing in June,

Grist said there was no conclusive proof that Brar was the one who wielded the knife. Brar and Gill have each denied being in possession of the weapon. The court heard that the pair went to Hans’ home on Ridgeview Drive in the early morning hours to confront the teen over a fight he had had with Brar’s brother. Hans was out at the time and they Continued on A5

Seven charged with kidnapping Abbotsford man among accused in Richmond case An Abbotsford man is among seven people facing kidnapping charges after what police are calling a “terrifying” gangrelated incident. Robert Ryan Carr, 28, faces charges on unlawful confinement and kidnapping along with suspects that include Thomas Crawford – believed to be the former second-incommand of the Kamloops chapter of the Independent Soldiers gang. Carr has previous convictions for operating a motor vehicle while disqualified, resisting a police officer, possession of a restricted firearm with ammunition, impaired driving and assault. He also has a robbery charge

Desmarais said investigators believe the alleged kidnappers were working with a larger, eastern organized-crime group. Those arrested in addition to Crawford, 30, and Carr were: David Tarrant, 28, and Veronica Moncur, 20, of Kamloops; Nazfar Mirhadi, 28, of North Vancouver; Demple Brar, 42, of Richmond; and Edmond Gammel, 24, of Surrey. All of the accused are slated to appear in court on Nov. 3. Desmarais said the investigation is ongoing.

called him on a cellphone from the driveway to tell him they were waiting for him. Witness testimony indicated that Brar was making punching noises and fighting motions during the wait, and Gill pulled from his pocket a shiny object that appeared to be a “shank” (makeshift knife) and said, “I’ll get him with this.” Other men appeared on the scene, and one of them gave a Taser to Gill, according to witness testimony. Hans arrived home in a vehicle with three others. Brar approached him first, followed by Gill, and a fight ensued. Three or four other men joined in, and one of Hans’ friends was Tasered by Gill during the attack. The court heard that Hans collapsed on the ground, and was bleeding from his neck. He was rushed to hospital, where he died a short while later. A short folding knife was found at the scene.

Grist said the witnesses were credible, and he did not believe Gill’s account that he was standing across the street at the time Hans was attacked. However, he ruled that Gill was guilty of manslaughter, and not murder, because there was not enough proof that Gill had wielded the knife or that he went to the scene with the intention of killing Hans. Grist also ruled that Gill’s bail should not be revoked, meaning he will remain in the community while awaiting sentencing. A spokesman for the family said in a written statement that they are content with the manslaughter conviction, but hope that Gill, who has shown no remorse, will receive a serious sentence. “It does not in any way seem fair, as we have lost a young, amazing and ambitious member of our family. Criminals like Amrit Gill and Shevy Brar should be punished more severely to help avoid similar tragedies in the future.”

The province has introduced legislation to raise gas taxes two cents a litre in Metro Vancouver to help fund TransLink’s expansion plan and build the Evergreen Line. The increase, requested this month by a majority vote of Metro mayors, would take effect next April and is expected to quickly pass with the support of the NDP. Transportation Minister Blair Lekstrom said the province will then formalize its agreement with TransLink, issue a request for proposals for the Evergreen Line to three pre-qualified bidders and get shovels in the ground “as quickly as possible. He was reluctant to promise a construction start by year-end but vowed it will be soon. The long-stalled $1.4-billion SkyTrain extension to Coquitlam was once sidelined by a decision to build the Canada Line first and had been derailed in recent years by a deadlock with the province on how to fund TransLink’s share. Lekstrom and mayors agreed earlier this summer to raise the gas tax and work together to find new funding sources over the next year. He repeated that pledge and said

he’s very aware Metro mayors oppose any scenario that would increase property taxes, which is the backup mechanism if talks with Victoria fail to yield new sources. “I’m an optimist, Lekstrom said. “I believe we’re going to find a solution that’s going to work for everyone. That’s critical, he said, because TransLink needs a long-term funding solution so it can build more infrastructure beyond what’s contemplated in the new Moving Forward plan. “There has to be some certainty going into the future. Lekstrom also repeated a commitment to meet the mayors and look at how to fix any problems in how TransLink is governed. Mayors complain they have no control over TransLink’s priorities – decided by an unelected professional board – and that their only role is to vote on tax and fare increases. The gas tax increase will give TransLink an extra $40 million of the $70 million per year it needs to fund the new plan. The transportation authority will take in an estimated $364 million in fuel taxes in 2012 from its dedicated 17 cents a litre.

Lockup campaign helped SPCA get on funding track ‘We’re having a good year’ Neil CORBETT Abbotsford News

What a difference a year makes. Last year at this time, the Abbotsford SPCA branch was facing a funding crunch, as donations were down to half of normal, leaving a $58,000 shortfall. This year, donations are back up. “Maybe the economy is a little better this year – people are starting to give again,” said SPCA Abbotsford branch manager Jodi Dunlop. The budget for the annual Paws for a Cause fundraiser was $15,000, and this year it exceeded the goal, with $17,000 brought in. About 100 people walked their dogs for the event. A kennel lockup campaign, which saw Dunlop and local

veterinarian Dr. Kelly O’Blenis spend the night penned with the dogs, managed to raise $5,000 for the facility. “It wasn’t as bad as I thought it would be,” said Dunlop, adding that people were generous, and came to feed them, walk them, and “to see the spectacle.” They were also on a web cam, so friends, family and interested members of the public could see what they were up to. “It was worth it – I would do it again,” she said. “Now we are having a good year.” She said the plan next year is to ratchet the fundraiser up a notch by having a celebrity locked up. The budget to operate the facility for a year is approximately $500,000, said Dunlop, and most of it is raised through the provincial office of the SPCA.

End to wasteful program The looming end of the federal long gun registry is good news for taxpayers. It shows that the federal government is willing to get rid of programs that serve little to no purpose, and waste tax dollars in the process. While the Conservatives have long had this program in their sights, let’s hope there are more to follow. The gun registry was, from the very beginning, a highly political move. The Liberals, under Justice Minister Allan Rock, wanted to show city voters that they would be tough on gun owners. It was all about cementing urban voting blocs, and for the most part, it worked. The Liberals’ crumbling power base remains at its strongest in big city downtowns, particularly Montreal, Toronto and Vancouver. However, one reason that Liberal support has dramatically fallen off in other areas is the gun registry, which has been a waste of almost $2 billion, and has done almost nothing to stop crime.

Police access the database frequently, but all it does it alert them to the possibility that there may be guns in a specific home. It has been used to arrest legitimate gun owners whose only offence has been improper storage. Yet the registry does nothing to stop gun violence – most of which is committed with unregistered handguns smuggled into Canada from the U.S. Members of the public, even those who have never handled a gun, can recognize a waste of tax dollars when they see it – particularly when the auditor-general has laid it bare on more than one occasion. There is definitely a place for a registry for handguns, as has been in place in Canada since the 1930s. This is a key reason why gun violence here is minimal, as compared to the U.S. But there is no place for a registry of rifles and shotguns that are used for sport, and rarely used in crimes. – Black Press

letters City water: Fiscal restraint, or full speed ahead

It appears that the City of Abbotsford is prospecting for water –“blue gold” – and is willing to go to any length to strike it rich. The people of Abbotsford are being faced with an election where water is going to be on the slate among other civic issues. Rather, it is the major issue on taxpayers’ minds and the millions of dollars in debt to a community that it implies. What this comes down to is that either

pride or intelligence is up for grabs. A certain vain glorious civic pride gave the community Plan A, and a multi-million dollar debt for the ride. So far we are falling into a morass of debt that is growing and is about to grow by hundreds of millions of dollars again. This is being touted in the name of development for now and tomorrow. Well, that is certainly smart thinking? Don’t forget to add to this the existing

Plan A financing for the City of Abbotsford, and its present and future taxpayers. Whatever happened to the good old days of having money in the bank? In short, the questions are, can we afford what we are being led to believe we want and do we really need it? No, and yes, eventually. The wisdom to all this is to prepare now and build then – not to borrow now and build now! How about a P1 Project (no one, but us).

Call it The Fraser River Water Plan. We stick a big pipe in the Fraser River, clean up the water and use it. If the river runs dry the world will probably have come to an end. That’s what the voters are going to decide on in the coming election – fiscal restraint, or damn the torpedoes, full speed ahead! Myron Neville

Assumption governments should handle all that is ‘precious’ What, psychologically speaking, accounts for instinctive, automatic opposition to any private involvement at all in our water supply? Private companies have played a role for decades. They build dams (for profit), supply equipment (for profit – what else?) and conduct engineering studies (for which they are paid). Who else can do these things? Opponents of P3s offer nothing beyond sentimental slogans that water “is pre-

cious.” So it is. But so what? No significant conclusion follows simply from this flabby premise. The instinctive, automatic assumption is that whatever is precious is best handled by governments only. There is no reason to take this assumption as true. Governments can mishandle what is precious. Besides, there are many precious things beside water. Food is precious. Yet no one works herself into a snit against

“privatized” berry farms. We should be grateful to Safeway (an international corporation headquartered in California) for supplying us precious food. Clothing is just as precious as water. Yet no one clamors for it to be controlled by the Ministry of Jeans. It is privatization, not government control, that brings the wonderfully wide range of clothing we take for granted. Then there is the voodoo economics of Maude Barlow and her confused Council

of Canadians which, falsely, claims that private companies make water “more expensive” because they “must make a profit.” But non-profit organizations like governments make the functional equivalent of profit. Non-profits just call it “capital reserves” or “retained earnings,” although on their financial statements, it plays the exact same role as profits. Greg Lanning

letters Conservation is the answer This letter is in regards to the recent water conservation editorial. While I agree that conservation is not the only solution it is, by far, the easiest and most effective. Rainbarrels are neither expensive nor prohibitive; one or two in an average-sized yard could meet all personal outdoor water needs. We harvested a plethora of vegetables, enjoyed hanging baskets and many potted plants, with ease, all while rarely turning on a tap. Lowering or even eliminating residential outdoor tap water use would immediately resolve those high water-use peaks during the height of summer that the city is using to “prove” a shortage. Misuse of city water, and disuse of surplus rain sources, is not a shortage. Contrary to what is written in the editorial we did not have a watering ban in 2011. Bans were briefly in place prior to this year and were very effective. I can understand the confusion; while the city is shouting its running-out-ofwater anthem it is reneging on conservation methods that work. Don’t actions speak louder than words?

And with the debate and onus focusing on residents, we ignore the incredible potential for industrial water savings. “Even 20 per cent (conservation) doesn’t stave off the point where overall demand exceeds supply.” But the city needs a minimum of 20 per cent conservation for its Stave Lake P3 projections to be accurate; conservation is required, no matter the route taken. The $300-million P3 price tag is just a dream without conservation. And the city is counting on 40 per cent conservation before 2030, or we will exceed the capacity of the Stave Lake contract – and will “run out” of water. So, how is conservation not the answer? It is the solution to our immediate water wastage woes. It is the solution to not giving our water access over to a private operator, as conservation will give us plenty of time to build up our financial reserves so we can own and operate a system. It is the solution to high, and climbing, water rates. Ignoring reality is city hall’s forte, but it doesn’t have to be ours. Laurie Hoekstra

Don’t jail prostitutes, jail the johns Re: Letter, Legalize prostitution, Oct. 18. Yes, prostitution is a “service.” A service that degrades and demoralizes the women who, because of despair and addictions, participate in it. That, in no way, justifies it as a legitimate profession, and one that should be legalized.

We should instead be reaching out to those involved, offering them help, ways to get out, a better life. “Keeping them illegal simply makes criminals out of otherwise law-abiding citizens...” Are you kidding me? Men who are paying for sex, when they could be at

home, taking care of their families and being productive members of society? Sure, don’t put the poor women in jail, give them options. But please, do the world a favour and put every john away for a long time!

Serving Up SUV Versatility with Style & Refinement The 2011 Honda CR-V provides a versatile and accommodating crossover SUV package with space for up to five passengers and a versatile cargo area for utility. The CR-V also provides fuel economy and refined, comfortable handling similar to a mid-size sedan. A new model for 2011, the CR-V SE (Special Edition), adds to the standard features of the CR-V LX with alloy wheels (replaces styled-steel wheels), a 160-watt AM/FM/6disc changer with six speakers (up from a single-disc CD and four speakers), steering wheel-mounted audio controls and rear privacy glass. The previous, 2010 model-year CR-V received a wide range of enhancements including sharpened styling, additional features on certain trim levels, higher fuel economy ratings, and increased power. A dynamic forward cabin, a two-tiered grille and a distinctive side profile express the CR-V’s emphasis on

upscale style and design. Compact on the outside yet large on the inside, the interior provides a maximum passenger volume of 103.8 cu-ft. (CR-V LX), plus an accommodating cargo volume of 35.7 cu-ft. behind the rear seats. The 2.4-liter 4-cylinder engine generates 180 horsepower (hp) and 161 lb-ft of torque. City/highway/combined EPA-estimated fuel-economy ratings1 are 21/28/24 miles per gallon (mpg) on 2WD models and 21/27/23 mpg on models equipped with Real Time™ 4WD. The CR-V’s interior emphasizes functionality and style. The front row storage areas are designed to accommodate items such as a handbag between the seats. For comfort, there are driver’s and front passenger’s center-folding armrests. A center console replaces the retractable center tray table on the CR-V EX-L with navigation.

folding seatback offers cargo versatility by sliding forward to increase cargo space, folding forward to accommodate long objects, or folding and tumbling forward to create a large, flat cargo area. Maximum possible cargo volume measures 72.9 cu-ft. with approximate floor dimensions of 51 inches long by 39 inches wide (at wheel wells). Storage potential behind the rear seat is enhanced by a dual-deck cargo shelf (CR-V EX and EX-L) that can strategically accommodate items like a folded baby stroller on the lower level and grocery bags on the upper level. The second-row seat includes a LATCH (Lower Anchors and Tethers for CHildren) child seat mounting system for all rear seat positions, allowing either two child seats to be installed in the outboard positions or one in the center.

A sliding 60/40 split second-row seat with a 40/20/40

ABBOTSFORD NEWS I Tuesday, November 1, 2011

Dan KINVIG

Abbotsford News

The Abbotsford Heat found a cure to their early-season offensive woes, and his name is Krys Kolanos. The former Phoenix Coyotes first-round pick made his Heat debut on Friday, and notched a hat trick and added an assist in a 5-1 road victory over the Grand Rapids Griffins. Two days later the Heat knocked off the Hamilton Bulldogs 6-2 at Copps Coliseum, and Kolanos racked up three more points on a goal and two assists. In seven games without Kolanos, the Heat scored 12 goals. In two games with him, they have 11. Kolanos hadn’t seen game action since January 2010, having been sidelined by microfracture hip

surgery. He earned a professional tryout contract with the Heat out of training camp this fall, but his debut was delayed by lingering lower-body issues. “It’s definitely been a long time coming,” said Kolanos, who played on a line with Ben Walter and Jon Rheault. “I’m surrounded by a lot of great people in this organization, and they made it a real easy transition to coming back and playing at a high level again. All the credit goes to them.” Veteran centre Walter has already formed a tremendous chemistry with Kolanos, and he posted two three-point outings . Another eyebrow-raising performance came from goaltender Leland Irving. The normally mild-mannered gentleman had the first fight

Gareth Bartlett tries to break a tackle in Saturday afternoon’s match against Burnaby.

Clothes that work.

They’re calling it one of the biggest wins in the history of the Abbotsford Rugby Football Club. With Premiership qualification on the line, playing in front of some 600 fans on Saturday at Abbotsford Exhibition Park, Abby scored a last-minute try to go up on Burnaby 24-22. It was Graeme MacRury with the winner, as the winger took the ball off a broken play and sprinted 50 yards to score his third try of the game. That tied the game 22-22, and Patrick Shields kicked the convert to put Abby ahead. Then they held off Burnaby’s all-out attack for five minutes of injury time. “They came at us with everything they had,” said coach Jason Young. He and the rest of the sideline held their breath on every tackle – a penalty kick could have given Burnaby the three points they needed for the win. Battle tested veteran Chris Chalmers led the defensive stand, as Abby met the Burnaby ball carriers with clean hits as the clock slowly wound down. Chalmers was man of the match for the forwards. “Everyone was making big tackles,”

noted Young. “We really came together as a team.” In addition to MacRury’s three tries, Some Mosogau also had one. With the B.C. Rugby Union restructuring this year, Abbotsford had to re-qualify for the premier league. Both they and Burnaby entered Saturday’s contest with 2-1 records in qualifying action. “This win takes us to the next step, where we’re one of the top clubs in the country,” said Young. Competing at the top level is important to the organization, which prides itself on developing young players. It would be hard to attract elite talent playing in the lower ranks. ARFC is the only Fraser Valley team to qualify for the top tier. “Premier gives you a good, hard, quality, fast game each week,” Young said. “You don’t learn anything by beating someone by 60 points.” Abbotsford is home to the reigning provincial champs Castaway Wanderers on Saturday for their first Premier League match. In other action, the Abbotsford U-19 men won 39-7 over Surrey. Tyson Adams had two tries. The Division 1 men lost 44-0 to Burnaby.

Irving has first fight

From A24

of his hockey career late in the second period against the Griffins. John Armstrong ignited the festivities, driving to the net for a rebound and colliding with Grand Rapids goalie Joey MacDonald. A scrum ensued, with Armstrong at the bottom of the pile, and Irving spotted MacDonald feeding Armstrong a couple of shots with his blocker. Irving channeled his inner Ron Hextall, charging down to the far end of the ice and shedding blocker and trapper, and he earned the unofficial decision after landing a couple of punches. Both goalies received game misconducts for being involved in a secondary altercation, leaving Abby’s Joni Ortio and Grand Rapids’ Jordan Pearce to mop up in relief. “I guess you could say it’s something out of

character,” Irving said with a chuckle. “But when their goalie is beating on your teammate, it’s something that has to be done. You’ve got to even up the numbers. “The guys were pretty excited for me. It’s just one of those things – as a teammate, you’ve got to stick up for guys.” Kolanos said Irving’s fight really fired up the Heat bench. “I think everyone really enjoyed it, and I’d give him the nod, for sure,” Kolanos said with a chuckle. “It’s always nice to see your goalie get that into it.” The Heat (6-3-0-0) have a Tuesday rematch with the Bulldogs. They return home for a twogame set with the Oklahoma City Barons at the Abbotsford Entertainment and Sports Centre (Thursday and Saturday, 7 p.m. both nights).

They will now host the Abbotsford Collegiate Panthers in a game for the Double A Eastern Conference championship on Friday at 2 p.m. Mission running backs Jessie Forcier (11 carries for 119 yards and two touchdowns) and Brenden Atkinson (five carries, 72 yards, two majors) keyed the ground attack. Quarterback Kevin Wiens threw a 15-yard touchdown pass to tight end Rhys Parry, and Hadley Gwyn had a 65-yard punt return for a score. The T-Wolves were driving as the game wound down, with Roadrunner backups on the field, but Mission’s Parker Johnson scooped up a fumble and took it to the house for an 82-yard touchdown. Mission quarterback Kevin Wiens is brought down by a Bateman tackler. 7-2, and 3-0 in league. The Abby Panthers are also coming off a decisive win, having blown out Pit Meadows 40-0 on Thursday. Impressive running the ball were Mike Nguyen (four carries, 55 yards, two touchdowns) and Dillon McGwire (three carries, 54 yards and a touchdown). Quarterback Carter Williams also made an impact, twice connecting with Jesse Neufeld on touchdown passes,

and scoring a TD off the rush. A win Friday would give Mission, ranked second in the province, their first-ever conference title. “It’s a big game for both programs,” said coach Kevin Watrin. “They’ll be tough. They’re solid in their schemes, and they have good size and athleticism across the board.” MOUAT The W.J. Mouat Hawks beat Centennial

20-6 on Friday. Devin Logan scored on a 30-yard run, and quarterback Daniel Markin threw touchdown passes to Deion Bain and David Park. The Hawks are now 6-2 overall, and are ranked second on the triple A circuit. They will finish league play with a 4-1 record, getting credit for a victory after the Earl Marriott team was forced to fold last week due to a lack of players.
