The Abbotsford man charged in connection with a car crash that resulted in the death of pregnant pedestrian Laurel Wilson and her father Ralph Jewell in March 2010 was sentenced yesterday to a lifetime driving prohibition and a $2,000 fine. In a sentencing hearing attended by about 20 members of the Wilson and Jewell families, Shaun James Cochrane, 25, pleaded guilty to driving with undue care and attention, an offence under the Motor Vehicle Act. He was driving a 1998 Ford F-150 pickup south on Ware Street on March 13, 2010, on his way to meet his dad to pick up a new barbecue and go for coffee. Cochrane ran a red light and collided with a Honda Prelude headed east on South Fraser Way. The crash spun the Prelude in a counter-clockwise direction and into a pedestrian island where Laurel, seven months pregnant, her husband Kevin and Ralph were waiting to cross. It was Laurel’s 27th birthday, and the trio were walking to the White Spot restaurant for a celebratory lunch. Laurel died later that day from massive blood loss from her injuries. In court, Crown counsel Ross McLeod and defence lawyer Eric Gottardi presented a joint submission suggesting the lifetime driving ban. This was based on a recommendation from a pediatrician at Sunny Hill Health Cen-
tre who assessed Cochrane in November 2010 and diagnosed him with Fetal Alcohol Spectrum Disorder. Gottardi said Cochrane, who was adopted at the age of three, did not know he had FASD until after the accident, despite his parents’ previous attempts to obtain a diagnosis for his behavioural, cognitive and social problems.

One of China’s most wanted men brought his illegal tactics to Canada, an Immigration and Refugee Board hearing was told yesterday. A Vancouver police officer told Lai Changxing’s detention hearing his reliable source told him Lai was in charge of an illegal gaming operation out of a Richmond, B.C., home. Det. James Fisher with the Vancouver Police special investigations unit said his source also told him Lai was in partnership with loan shark Betty Yan, who was found murdered in April 2009. Lai’s lawyer, Darryl Larson, was surprised to hear the allegations, and asked to delay yesterday’s hearing so he could talk to his client. Lai, who attended the hearing via video and phone link from the Fraser Regional Correction Centre, blurted out several times in Mandarin near the end of the officers’ testimony that the claims weren’t true. Chinese officials accuse Lai of being at the top of a huge smuggling operation that cheated the government there out of millions of dollars in taxes. Lai has been fighting removal from Canada for 12 years, arguing that he could face torture or even death at the hands of China’s Communist regime. The federal court will hear another application from Lai’s lawyers on Thursday asking for a stay of his deportation order.

GROWTH, HST HELP REDUCE B.C. DEFICIT TOM FLETCHER (Black Press)
The B.C. government finished the fiscal year this spring with a deficit of $309 million, nearly $1 billion less than what was forecast last fall. The savings came partly from extra tax revenues generated by four-percent economic growth during 2010-11, Finance Minister Kevin Falcon said yesterday in releasing the province’s audited public accounts. Some was realized from lower than expected spending in programs such as health care, and some came from extra revenues collected through the harmonized sales tax. But Falcon wasn’t able to say exactly how much extra revenue the HST brought in during its first year of operation. B.C. sales tax revenues are growing by about $600 million a year, partly due to the fact that provincial sales tax has been extended to a variety of services as well as goods. But B.C.’s gross domestic product is growing faster than the national average and consumer confidence is strong, so revenues from the former PST would also have grown, Falcon said. And he noted it has been clear since the HST was introduced that it collects more revenue because of the broader tax base. “It is also a tax that generates greater economic activity, generates more job creation, and that
in turn will drive more revenues to the government,” Falcon said. NDP finance critic Bruce Ralston said the government is using “funny math” to produce a rosy picture of the B.C. economy. One reason the past year’s deficit is so much lower is that B.C. collected $769 million from Ottawa, the second half of its $1.6 billion “bribe money” for adopting the HST, he said. “People have a sense they are being
played,” Ralston said. “They have an agenda, they want to ram the HST through and this is just one more instance of that.” Falcon warned that if the HST is rejected in the referendum that is currently underway, that will cost the province about $3 billion over the next three years. Half of that is to repay the federal government, and the rest is transition costs and extra HST revenue that won’t be collected.

Annie Linteau, with RCMP’s E Division, said yesterday a 19-year-old Surrey man was arrested Saturday and faces six charges in connection with Laursen’s death May 18. Laursen, 56, was hit just before 10 p.m., as she crossed Johnston Road at Thrift Avenue. Just prior to hitting Laursen and leaving the scene, the driver had avoided a police stop.

Commuters on the West Coast Express were stranded yesterday morning after a man was struck and killed by a westbound train at Coquitlam Centre station. RCMP Insp. A European tourist died after being swept over Elk Falls yesterday morning. A 42-year-old man lost his footing on the rocks and was carried down the river and over the 25-metre falls, Sgt. A provincial court judge has sent a local man with six previous drunk driving convictions to jail for impaired driving, provincial prosecutor Gordon Baines said. Judge Peter Doherty sentenced Norman Ted Walton, 45, to 18 months in prison for one count of impaired driving. Doherty further sentenced Walton to a five year driving ban and two years probation. Other charges related to the incident including driving while prohibited, driving while license is suspended and operated a motor vehicle while disqualified will be dealt with at a later date.

Foreign Affairs Minister John Baird says relations with China continue to improve and he hopes for increased investment and trade in the future. Baird is in Beijing on his first visit to China as foreign minister. He says he discussed trade, investment and human rights issues during his meeting with Yang Jiechi,

The Canada Revenue Agency has been given the green light by a judge to look at the financial records of dozens of Quebec municipalities. A Federal Court judge signed off on a request by government lawyers during a brief hearing in Montreal this morning. The revenue agency wants to scrutinize hundreds of contracts handed out by the municipalities between 2007 and 2010. It wants to see everything from snow-removal contracts to larger deals.

The government of the Indian state of West Bengal signed an agreement yesterday offering greater autonomy to ethnic Gorkhas in hopes of ending their often violent agitation for a homeland in the Himalayan foothills. The agreement was negotiated by the newly elected government in West Bengal with the main Gorkha organization, the Gorkha Peoples’ Freedom Front. In the 1980s, the Gorkhas led a violent insurgency leading to the deaths of some 1,200 people. Their means have been more peaceful since. Experts say the agreement could bring development to the Darjeeling region famed for its tea gardens.
Austrian police say thieves have made off with an unusual heist – 21 tons of mustard and ketchup. The loot was in a semitrailer parked in a lot over the weekend northwest of Vienna. Police say the truck driver showed up yesterday to deliver his cargo only to see the trailer missing. Police assume the thieves were more interested in the trailer than its contents. Authorities had no price tag for the stolen condiments but said the trailer was worth about 15,000 euros – more than $22,000 US.
Lawyers for Premier Silvio Berlusconi lost a bid yesterday to move his trial on charges of having paid for sex with an underage teen. Berlusconi’s lawyers petitioned the court to move the trial out of a Milan criminal court to the Tribunal of Ministers, which deals with offences committed by public officials in the execution of their duties. A panel of three judges denied the motion – along with a raft of others, including one to dismiss the charges. Unlike an ordinary court, the Tribunal of Ministers needs parliament’s authorization if it wants to try Berlusconi – which would likely be denied since the premier’s allies have a majority.
Cyprus’ foreign minister offered to resign yesterday over the explosion of dozens of gunpowder-filled containers at a naval base that killed 13 people and has ratcheted up pressure on the embattled government. New details on the condition of the containers – which were seized from an Iranian ship in 2009 – emerged yesterday. Official documents obtained by AP showed that senior military officials were aware that some of the gunpowder inside one container may have detonated a few days before the powerful explosion.

International support for a planned Palestinian declaration of independence at the UN in September is waning, in large part because of intense Israeli lobbying against the initiative, a senior Israeli diplomat claimed yesterday. The astronauts on NASA’s final shuttle voyage floated out of the International Space Station for the last time yesterday, leaving behind a historic U.S. flag and a commemorative shuttle model to mark the end of a 30-year era. Atlantis was set to undock from the orbiting lab early today – providing the last glimpses of a space shuttle in flight before the fleet is retired. As the hatches swung shut behind the four crew members of Atlantis, it closed “a chapter in the history of our nation,” space station astronaut Ronald Garan Jr. noted in yesterday’s emotional farewell ceremony. He attached the small flag – which rocketed into orbit on the very first shuttle flight in 1981 – to the door of the space station hatch before the shuttle astronauts departed. Atlantis has been parked at the space station for over a week, unloading a year’s worth of supplies and packing up trash and old equipment for the trip home. Atlantis is due to land at Florida’s Kennedy Space Center just before sunrise Thursday. Atlantis will pull away from the space station early today. As a final salute, the space station will rotate 90 degrees to provide a new angle for pictures.

The executive director of the Ottawa Bluesfest says he’s looking at closer liaison with the weather office in the wake of a violent summer gale which toppled the main stage at the festival on Sunday. “Definitely, it’s something we’re going to be looking into,” Mark Monahan said yesterday. He said the festival routinely monitors weather conditions, but the weekend NO incident was a freak. SERIOUS “We were monitoring the weather INJURIES and what was a watch turned into a more severe situation and when that happened we called it immediately,” he said. The festival can’t stop every time the weather deteriorates, he said. “We deal with weather every day and we don’t automatically call a show because we have weather we see coming in, because if we did that we wouldn’t be able to run a festival.” Monahan said the storm came in fast and left fast. “It was a very unusual situation,” he said. “The fact that it brought that stage down and nothing else came down in the park was just a freak situation.” The big stage collapsed as howling winds blew into the middle of a Cheap Trick performance. Thousands
of people scurried for cover as scaffolding buckled and collapsed. At least four people were injured, but Monahan said they have all been released from hospital. He said the stage was a rental from a Montreal firm and was inspected regularly
during the festival. The Ministry of Labour is surveying the site and will produce a report on the incident.

RAPPER SENTENCED TO 28 MONTHS FOR NOT PAYING TAXES

Rapper Ja Rule was sentenced yesterday to more than two years in federal prison for failing to file income tax returns, and said a combination of youthful inexperience, bad advice and an inability to manage fame and fortune lead to his financial troubles. “I in no way attempted to deceive the government or do anything illegal,” he said, minutes before being sentenced in a New Jersey federal court. “I was a young man who made a lot of money – I’m getting a little choked up – I didn’t know how to deal with these finances, and I didn’t have people to guide me, so I made mistakes.” The multiplatinum-selling artist, whose real name is Jeffrey Atkins, admitted in March that he failed to pay taxes on more than $3 million US that he earned between 2004 and 2006. Ja Rule was sentenced in New York City last month to up to two years in prison after he pleaded guilty to attempted criminal weapon possession. The case stemmed from a gun found in his car in 2007. U.S. Magistrate Patty Shwartz in Newark ruled that the majority of his 28-month federal sentence could be served at the same time as the New York state prison sentence.

Here’s the real situation: It turns out MTV’s Jersey Shore isn’t killing New Jersey’s reputation after all. The bank’s latest Canadian Metropolitan Economic Activity Index found the economy in Canada’s largest city is firing on multiple cylinders, driving it to the top spot among the country’s biggest 25 cities. Its first place ranking is largely due to its vibrant labour and housing markets and a momentum gain across a diversity of sectors, CIBC deputy chief economist Benjamin Tal wrote in the report. “Simply put, the multi-channel nature of Toronto’s economic engine is the secret not only behind its current top ranking, but also behind its ability to maintain a relatively high ranking position over the past two years,’’ he said.

Korea’s state-owned natural gas company may be interested in snapping up Royal Dutch Shell PLC’s stake in the Mackenzie Valley Pipeline, an energy consultant said yesterday. “We know that Korea gas has been interested in looking around up there. Nate Schierholtz added two hits and an RBI, continuing his torrid pace set after manager Bruce Bochy moved him into the cleanup spot last week. Cody Ross’ two-run double in San Francisco’s four-run sixth helped the Giants break it open. Juan Uribe had two singles against his former club but the Dodgers hit into two double plays and were shut out for the 10th time this season while losing their fifth straight against their division rivals. Vogelsong (7-1), coming off his first all-star appearance, scattered seven hits over 6 2-3 innings, finishing with five strikeouts and a walk while lowering his ERA to 2.02. The journeyman right-hander already had the lowest ERA in the NL but hadn’t logged enough innings to qualify. Four days shy of his 34th birthday, he finally had the top spot, just ahead of Atlanta’s Jair Jurjjens. The Giants gave him plenty of support. Schierholtz had an RBI single in the big sixth inning and is batting .417 (10 for 24) in five games while batting cleanup. San Francisco is 5-0 in those games. Vogelsong retired the first eight batters he faced and didn’t allow a hit until Matt Kemp’s one-out single in the fourth. Bavarian prosecutors have opened a new investigation of John Demjanjuk after a German attorney filed a complaint accusing him of additional war crimes in an attempt to extend the precedent set by his landmark conviction. The 91-year-old retired Ohio autoworker was found guilty in May of 28,060 counts of accessory to murder after a Munich court found that the evidence showed he was a guard during the war the Nazis’ Sobibor death camp in occupied Poland. The case was the first time someone was convicted in Germany on evidence of being only a guard, without evidence of a specific killing. The court ruled that guarding a death camp meant, in legal terms, that Demjanjuk was an accessory to the murder of the people who were killed in the camp’s gas chambers even if it could not be proven that he was directly involved in the extermination process. Demjanjuk was sentenced to five years in prison but was immediately released pending appeal, which could take as long as two years, and is now living in a nursing home south of Munich.
